6565 An Act relating to absentee voting; amending Section

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY Section 1, Chapter 286, O.S.L.
7979 2022 (26 O.S. Supp. 2024, Section 14 -115.12), is amended to read as
8080 follows:
8181 Section 14-115.12. A. 1. A registered voter who swears or
8282 affirms that the voter is physically unable to vo te in person at the
8383 voter’s precinct on the day of the election because the voter is a
8484 blind person and who provides documentation from a licensed
8585 physician confirming that the voter is a blind person , as defined by
8686 Section 72 of Title 7 of the Oklahoma St atutes, may request that an
8787 accessible absentee ballot be delivered to the vot er electronically
8888 in a manner prescribed by the Secretary of the State Election Board.

140140 A system for electronic delivery of absentee ballots to voters who
141141 are blind persons may i nclude the same or similar requirements as
142142 the electronic delivery system authorized for uniformed services
143143 voters as set forth in Section 14 -118 of Title 26 of the Oklahoma
144144 Statutes this title.
145145 2. An accessible absentee voting packet for voters who are
146146 blind persons, which shall include all necessary materials except
147147 the absentee ballot, shall be prescribed by the Secretary of the
148148 State Election Board. The accessible absentee voting packet may be
149149 delivered to the voter by United States mail or electronic ally.
150150 B. 1. The electronic delivery system may provide the voter the
151151 opportunity to use the voter ’s personal computer to mark an
152152 accessible absentee ballot privately and independently and then
153153 print the marked ballot.
154154 2. The absentee ballot shall be acc ompanied by an absentee
155155 ballot affidavit, which shall be executed in the same manner as
156156 provided for affidavits in Section 14 -113.2 of Title 26 of the
157157 Oklahoma Statutes this title.
158158 3. The voter shall return the absentee ballot and executed
159159 affidavit to the secretary of the county election board in the same
160160 manner provided in Section 14 -113.2 of Title 26 of the Oklahoma
161161 Statutes this title. Nothing in this section shall allow for an
162162 absentee ballot to be returned to the county election board

214214 electronically, and no absentee ballot returned electronically shall
215215 be eligible to be count ed by a county election board.
216216 C. A registered voter who is a blind person, as defined by
217217 Section 72 of Title 7 of the Oklahoma Statutes, may choose to
218218 request the assistance of another person to complete any
219219 requirements of this section, as provided in Section 7 -123.3 of
220220 Title 26 of the Oklahoma Statutes this title.
221221 D. Upon return of an absentee ballot described in this section,
222222 the secretary of the county election board shall cause it to be
223223 processed in the same manner as prescribed by law for other abs entee
224224 ballots.
225225 E. Any person who is not qualified for the electronic delivery
226226 of an absentee ballot as provided in this section, but who applies
227227 for an absentee ballot described in this section, shall be deemed
228228 guilty of a felony as provided in Section 16 -102.2 of Title 26 of
229229 the Oklahoma Statutes this title.
230230 F. The Secretary of the State Election Board may promulgate
231231 rules or procedures to implement the requirements of this sec tion.
232232 SECTION 2. This act shall become effective January 1, 2 026.
