77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY Section 1, Chapter 286, O.S.L.
79	79	2022 (26 O.S. Supp. 2024, Section 14 -115.12), is amended to read as
80	80	follows:
81	81	Section 14-115.12. A. 1. A registered voter who swears or
82	82	affirms that the voter is physically unable to vo te in person at the
83	83	voter’s precinct on the day of the election because the voter is a
84	84	blind person and who provides documentation from a licensed
85	85	physician confirming that the voter is a blind person , as defined by
86	86	Section 72 of Title 7 of the Oklahoma St atutes, may request that an
87	87	accessible absentee ballot be delivered to the vot er electronically
88	88	in a manner prescribed by the Secretary of the State Election Board.

140	140	A system for electronic delivery of absentee ballots to voters who
141	141	are blind persons may i nclude the same or similar requirements as
142	142	the electronic delivery system authorized for uniformed services
143	143	voters as set forth in Section 14 -118 of Title 26 of the Oklahoma
144	144	Statutes this title.
145	145	2. An accessible absentee voting packet for voters who are
146	146	blind persons, which shall include all necessary materials except
147	147	the absentee ballot, shall be prescribed by the Secretary of the
148	148	State Election Board. The accessible absentee voting packet may be
149	149	delivered to the voter by United States mail or electronic ally.
150	150	B. 1. The electronic delivery system may provide the voter the
151	151	opportunity to use the voter ’s personal computer to mark an
152	152	accessible absentee ballot privately and independently and then
153	153	print the marked ballot.
154	154	2. The absentee ballot shall be acc ompanied by an absentee
155	155	ballot affidavit, which shall be executed in the same manner as
156	156	provided for affidavits in Section 14 -113.2 of Title 26 of the
157	157	Oklahoma Statutes this title.
158	158	3. The voter shall return the absentee ballot and executed
159	159	affidavit to the secretary of the county election board in the same
160	160	manner provided in Section 14 -113.2 of Title 26 of the Oklahoma
161	161	Statutes this title. Nothing in this section shall allow for an
162	162	absentee ballot to be returned to the county election board

214	214	electronically, and no absentee ballot returned electronically shall
215	215	be eligible to be count ed by a county election board.
216	216	C. A registered voter who is a blind person, as defined by
217	217	Section 72 of Title 7 of the Oklahoma Statutes, may choose to
218	218	request the assistance of another person to complete any
219	219	requirements of this section, as provided in Section 7 -123.3 of
220	220	Title 26 of the Oklahoma Statutes this title.
221	221	D. Upon return of an absentee ballot described in this section,
222	222	the secretary of the county election board shall cause it to be
223	223	processed in the same manner as prescribed by law for other abs entee
224	224	ballots.
225	225	E. Any person who is not qualified for the electronic delivery
226	226	of an absentee ballot as provided in this section, but who applies
227	227	for an absentee ballot described in this section, shall be deemed
228	228	guilty of a felony as provided in Section 16 -102.2 of Title 26 of
229	229	the Oklahoma Statutes this title.
230	230	F. The Secretary of the State Election Board may promulgate
231	231	rules or procedures to implement the requirements of this sec tion.
232	232	SECTION 2. This act shall become effective January 1, 2 026.
