6565 An Act relating to conduct of elections; prohibiting
6666 state or political subdivision from enacting certain
6767 voting method; declaring certain ordinances void;
6868 providing exceptions; providing for enforcement;
6969 authorizing civil action for certain violations;

7171 providing for codification; and declaring an

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new sec tion of law to be codified
7979 in the Oklahoma Statutes as Section 7 -140 of Title 26, unless there
8080 is created a duplication in numbering, reads as follows:
8181 A. The state or a politic al subdivision shall not enact or
8282 adopt any voting method that:
8383 1. Allows qualified electors to rank candidates for any
8484 federal, state, or local office in order of preference; and
8585 2. Tabulates ballots cast in multiple rounds following the
8686 elimination of a candidate until a single candidate attains a
8787 majority.

139139 B. Any ordinance ena cted or adopted by a county, municipality,
140140 school board, or other political subdivision that conflicts with the
141141 requirements of subsection A of this section shall be void.
142142 C. The prohibitions of this section shall not apply to the
143143 internal processes of a political party including, but not limited
144144 to, conventions, election of party officers, or other non -public
145145 procedures by the party.
146146 D. The Attorney General shall have the autho rity to enforce the
147147 provisions of this section.
148148 E. Any person aggrieved by a violation of this section may
149149 bring a civil action for declaratory or injunctive relief. An
150150 aggrieved person includes, but is not limited to, a candidate
151151 running for office, a v oter, or an election official operating under
152152 a ranked choice election. The court may award court costs and
153153 reasonable attorney fees to the prevailing party.
154154 SECTION 2. It being immediately necessary for the preservation
155155 of the public peace, health or safety, an emergency is hereby
156156 declared to exist, by reason wher eof this act shall take effect and
157157 be in full force from and after its passage and approval.
