3839 An Act relating to firearms; amending 21 O.S. 2021,
3940 Sections 1289.9, 1290.10, and 1290.11, which relate
4041 to carrying weapons under the influence of alcohol

5051 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5152 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1289.9, is
5253 amended to read as follows:
5354 Section 1289.9.
5455 CARRYING WEAPONS UNDER INFLUENCE OF ALCOHOL
5556 It shall be unlawful for any person to carry or use shotguns,
5657 rifles, or pistols in any circumstances while under the influence of
5758 beer, intoxicating liquors or, any hallucinogenic, or any unlawful
5859 or unprescribed drug, and it shall be unlawful for any person to
5960 carry or use shotguns , rifles, or pistols when under the influence
6061 of any drug prescribed by a licensed ph ysician or medical marijuana
6162 obtained pursuant to a valid medical marijuana patient license if
6263 the current effects or aftereffects of such consumption affect

8991 mental, emotional, or physical processes to a degree that would
9092 result in abnormal behavior. Any person convicted of a violation of
9193 the provisions of this section shall be punished as provided in
9294 Section 1289.15 of this title.
9395 Any person convicted of a violation of th e provisions of this
9496 section after having been issued a handgun license pursuant to t he
9597 provisions of the Oklahoma Self -Defense Act shall have the license
9698 suspended for a term of six (6) months and shall be subject to an
9799 administrative fine of Fifty Dollars ($50.00) , upon a hearing and
98100 determination by the Oklahoma State Bureau of Investig ation that the
99101 person is in violation of the provisions of this section.
100102 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1290.10, is
101103 amended to read as follows:
102104 Section 1290.10.
103105 MANDATORY PRECLUSIONS
104106 In addition to the requirements st ated in Section 1290.9 of this
105107 title, the conditions stated in this section shall preclude a person
106108 from eligibility for a handgun license pursuant to the provisions of
107109 the Oklahoma Self-Defense Act. The occurrence of any one of the
108110 following conditions s hall deny the person the right to have a
109111 handgun license pursuant to the provisions of the Oklahoma Self -
110112 Defense Act. Prohibited conditions are:
111113 1. Ineligible Ineligibility to possess a pistol due to any
112114 felony conviction or adjudication as a delinquent as provided by

139142 Section 1283 of this title, except as provided in subsection B of
140143 Section 1283 of this title;
141144 2. Any felony conviction pursuant to any law of another state,
142145 a felony conviction pursuant to any provision of the United States
143146 Code, or any conviction pursuant to the laws of any foreign country,
144147 provided such foreign conviction would constitute a felony offense
145148 in this state if the offense had been committed in this state,
146149 except as provided in subsection B of Section 1283 of this title;
147150 3. Adjudication as a mentally incompetent person pursuant to
148151 the provisions of the Oklahoma Mental Health Law, or an adjudication
149152 of incompetency entered in another state pursuant to any provision
150153 of law of that state, unless the person has been granted relief f rom
151154 the disqualifying disability pursuant to Section 1290.27 of this
152155 title;
153156 4. Any false or misleading statement on the application for a
154157 handgun license as provided by p aragraph 5 of subsection A of
155158 Section 1290.12 of this title;
156159 5. Conviction of any on e of the following misdemeanor offenses
157160 in this state or in any other state:
158161 a. any assault and battery which caused serious physical
159162 injury to the victim, or any second or subsequent
160163 assault and battery conviction,
161164 b. any aggravated assault and battery,

188192 c. any stalking pursuant to Section 1173 of this title,
189193 or a similar law of another state,
190194 d. a violation relating to the Protection from Domestic
191195 Abuse Act or any violatio n of a victim protection
192196 protective order of another state,
193197 e. any conviction relatin g to illegal drug use or
194198 possession, or
195199 f. an act of domestic abuse as defined by provided for in
196200 Section 644 of this title or an act of domestic
197201 assault and battery or any comparable acts under the
198202 laws of another state.
199203 The preclusive period for a misdem eanor conviction related to
200204 illegal drug use or possession shall be ten (10) years from the date
201205 of completion of a sentence. For purposes of this subsection, “date
202206 of completion of a sentence ” shall mean the day an offender
203207 completes all incarceration, p robation, and parole pertaining to
204208 such sentence;
205209 6. An attempted suicide or other condition relating to or
206210 indicating mental instability or an unsound mind which occurred
207211 within the preceding ten -year period from the date of the
208212 application for a license to carry a concealed firearm or that
209213 occurs during the period of licensure;
210214 7. Currently undergoing treatment for a mental illness,
211215 condition, or disorder. For purposes of this paragraph, “currently

238243 undergoing treatment for a mental illness, condition, or disorder”
239244 means the person has been diagnosed by a licensed physician as being
240245 afflicted with a substantial disorder of thought, mood, perception,
241246 psychological orientation, or memory that significantly impairs
242247 judgment, behavior, capacity to recognize reality, or ability to
243248 meet the ordinary demands of life;
244249 8. Significant character defects of the applicant as evidenced
245250 by a criminal record indicating habitual criminal activity;
246251 9. Ineligible Ineligibility to possess a pistol due to any
247252 provision of law of this state or the United States Code, except as
248253 provided in subsection B of Section 1283 of this title ;
249254 10. Failure to pay an assessed fine or surrender the handgun
250255 license as required by a decision by the administrative hearing
251256 examiner pursuant to authority of the Oklahoma Self -Defense Act;
252257 11. Being subject to an outstanding felony warrant issued in
253258 this state or another state or the United States; or
254259 12. Adjudication as a delinquent as provided by Section 1283 of
255260 this title, except as provided in subsection B of Section 1283 of
256261 this title.
257262 An applicant shall not be considered ineligible solely on the
258263 basis of being a lawful holder of a medical marijuana patient
259264 license.
260265 SECTION 3. AMENDATORY 21 O.S. 2021, Section 1290.1 1, is

289295 OTHER PRECLUSIONS
290296 A. The following conditions shall preclude a person from being
291297 eligible for a handgun license pursuan t to the provisions of the
292298 Oklahoma Self-Defense Act for a period of time as prescrib ed in each
293299 of the following paragraphs:
294300 1. An arrest for an alleged commission of a felony offense or a
295301 felony charge pending in this state, another state , or pursuant to
296302 the United States Code. The preclusive period shall be until the
297303 final determination of the matter;
298304 2. The person is subject to the provisions of a deferred
299305 sentence or deferred prosecution in this state or another state or
300306 pursuant to federal authority for the commission of a felony
301307 offense. The preclusive period shall be three (3) ye ars and shall
302308 begin upon the final determination of the matter;
303309 3. Any involuntary commitment for a mental illness, condition,
304310 or disorder pursuant to the provisions of Section 5 -410 of Title 43A
305311 of the Oklahoma Statutes or any involuntary commitment in a nother
306312 state pursuant to any provisions of law of that state. The
307313 preclusive period shall be permanent as provided by Title 18 of the
308314 United States Code Section 922(g)(4) unless the person has been
309315 granted relief from the disqualifying disability pursuant to Section
310316 1290.27 of this title;

337344 4. The person has previously undergone treatment for a mental
338345 illness, condition, or disorder which required medication or
339346 supervision as defined by provided for in paragraph 7 of Section
340347 1290.10 of this title. The prec lusive period shall be three (3)
341348 years from the last date of treatment or upon presentation of a
342349 certified statement from a licensed physician stating that the
343350 person is either no longer disabled by any mental or psychiatric
344351 illness, condition, or disorder or that the person has been
345352 stabilized on medication for ten (10) years or more;
346353 5. Inpatient treatment for substance abuse. The preclusive
347354 period shall be three (3) years from the last date of treatment or
348355 upon presentation of a certified statement fro m a licensed physician
349356 stating that the person has been free from substance use for twelve
350357 (12) months or more preceding the filing of an application for a
351358 handgun license;
352359 6. Two or more convictions of public intoxication pursuant to
353360 subsection D of Sect ion 6-101 of Title 37A of the Oklahoma Statutes,
354361 or a similar law of another state. The preclusive period shall be
355362 three (3) years from the date of the completion of the last sentence
356363 or shall require a certified statement from a licensed physician
357364 stating that the person is not in need of substance abuse treatment;
358365 7. Two or more misdemeanor convictions relating to intoxication
359366 or driving under the influence of an intoxi cating substance or
360367 alcohol. The preclusive period shall be three (3) years from the

387395 date of the completion of the last sentence or shall require a
388396 certified statement from a licensed physician stating that the
389397 person is not in need of substance abuse treatment;
390398 8. A court order for a final Victim Protection Order protective
391399 order against the applicant, as authorized by the Protection from
392400 Domestic Abuse Act, or any court order granting a final victim
393401 protection protective order against the applicant from another
394402 state. The preclusive period shall be sixty (60) days from the date
395403 an order was vacated, canceled, withdrawn , or is otherwise no longer
396404 in effect;
397405 9. An adjudicated delinquent or convicted felon residing in the
398406 residence of the applicant which may be a violation of Section 1283
399407 of this title. The preclusive period shall be thi rty (30) days from
400408 the date the person no longer resides in the same residence as the
401409 applicant;
402410 10. An arrest for an alleged commission of, a charge pending
403411 for, or the person is subject to the provisions of a deferred
404412 prosecution for any one or more of the following misdemeanor
405413 offenses in this state or another state:
406414 a. any assault and battery which caused serious physical
407415 injury to the victim or any second or subsequent
408416 assault and battery,

437446 or a similar law of another state,
438447 d. any violation of the Protection from Domestic Abuse
439448 Act or any violation of a victim protection protective
440449 order of another state,
441450 e. any violation relating to illegal drug use or
442451 possession except for an applicant or licensee in
443452 legal possession of a medical marijuana patient
444453 license, or
445454 f. an act of domestic abuse as defined by provided for in
446455 Section 644 of this title or an act of domestic
447456 assault and battery or any comparable acts un der the
448457 law of another state.
449458 The preclusive period shall be until the final determination of the
450459 matter. The preclusive period for a person subject to the
451460 provisions of a deferred sentence for the offenses mentioned in this
452461 paragraph shall be three (3) y ears and shall begin upon the final
453462 determination of the matter; or
454463 11. A previously issued handgun license has been revoked. The
455464 preclusive period shall be five (5) years from the date of
456465 revocation and shall require the person to submit a new applicati on
457466 for a handgun license pursuant to the provisions of Section 1290.12
458467 of this title.

485495 B. Nothing in this section shall be construed to require a full
486496 investigation of the applicant by the Oklahoma State Bureau of
487497 Investigation.
488498 C. Nothing in this section shall be construed to allow the
489499 Oklahoma State Bureau of Investigation to deny an otherwise
490500 qualified applicant from obtaining a handgun license pursuant to the
491501 Oklahoma Self-Defense Act solely on the basis of the applicant being
492502 a lawful holder of a medi cal marijuana patient license.
493503 SECTION 4. This act shall become effective November 1, 2025.
