145 | 145 | | B. If the child is not otherwise represented by counsel and |

146 | 146 | | either the child, his or her parent, guardian, or next friend |

147 | 147 | | requests an attorney prior to or during interrogation, or upon being |
---|
148 | 148 | | charged by information, as provided in subsection A of this section, |
---|
149 | 149 | | the court shall appoint an attorney, who shall not be a district |
---|
150 | 150 | | attorney, for the child regardless of any attempted waiver by the |
---|
151 | 151 | | parent, guardian, or next friend of the right to be represented by |
---|
152 | 152 | | counsel. If the court appoints an atto rney for a child for the |
---|
153 | 153 | | interrogation or at the initial appearance, the court shall review |
---|
154 | 154 | | the appointment at a subsequent hearing to determine if the child, |
---|
155 | 155 | | parent, guardian, or next friend qualifies for a court -appointed |
---|
156 | 156 | | attorney. |
---|
157 | 157 | | C. When a person proc eeds to trial as either a youthful |
---|
158 | 158 | | offender or as an adult as provided by the Youthful Offender Act, |
---|
159 | 159 | | the accused person shall have all the statutory and constitutional |
---|
160 | 160 | | rights and protections of an adult accused of a crime. All |
---|
161 | 161 | | proceedings shall be as for a criminal action and the provisions of |
---|
162 | 162 | | Title 22 of the Oklahoma Statutes shal l apply, except as provided |
---|

229 | 229 | | public; provided, all persons having a dire ct interest in the case |
---|
230 | 230 | | as provided in paragraph 1 of subsection A of Section 2 -2-402 of |
---|
231 | 231 | | this title shall be allowed to be present during the testimony but |
---|
232 | 232 | | shall be admonished no t to discuss the testimony following the |
---|
233 | 233 | | hearing. All reports, evaluations, motions, records, exhibits , or |

---|

293 | 293 | | F. Upon arrest and detention of a person subject to the |

294 | 294 | | provisions of the Youthful Offender Act, the person has the same |
---|
295 | 295 | | right to be released on bail as would an adul t in the same |

296 | 296 | | circumstances. |
---|
297 | 297 | | G. Upon a verdict of guilty or entry of a plea o f guilty or |
---|
298 | 298 | | nolo contendere by a youthful offender who has been certified for |
---|
299 | 299 | | the imposition of an adult sentence as provided by Section 2-5-207 |
---|
300 | 300 | | 2-5-207A of this title, the perso n may be detained in an adult jail, |
---|
301 | 301 | | adult lockup, adult detention facility , or other adult facility if |
---|
302 | 302 | | that facility is licensed by the State Department of Health to |
---|
303 | 303 | | detain children under eighteen (18) years of age while the person is |
---|
304 | 304 | | awaiting housing by t he Department of Corrections. In no event |
---|
305 | 305 | | shall a person who was under eighte en (18) years of age at the time |
---|
306 | 306 | | the offense was committed be sentenced to life imprisonment without |
---|
307 | 307 | | the possibility of parole or be given a mandatory minimum sentence |
---|
308 | 308 | | that carries a term of imprisonment that exceeds twenty (20) years. |
---|
309 | 309 | | H. A child or youthful offender shall be tried as an adult in |
---|
310 | 310 | | all subsequent criminal prosecutions, and shall not be subject to |
---|
311 | 311 | | the jurisdiction of the juvenile court as a juvenile delinquent or |
---|
312 | 312 | | youthful offender processes in any further proceedings if: |
---|
313 | 313 | | 1. The child or yout hful offender has been certified to stand |
---|

---|

374 | 374 | | I. Except as otherwise provided in the Youthful Offender Act, a |

375 | 375 | | person who has been certified as a youthful offender shall be |

376 | 376 | | prosecuted as a youthful offender in all subseq uent criminal |

377 | 377 | | proceedings until the youthful offender has attained eighteen (18) |

446 | 446 | | 3. The mandatory minimum sente nce of imprisonment is not |
---|
447 | 447 | | necessary for the protection of the public and the defendant, based |
---|
448 | 448 | | on a risk and needs assessment, is eligible for an alternative |
---|
449 | 449 | | court, a diversion program , or community sentencing, without regard |
---|
450 | 450 | | to exclusions because of previ ous convictions, and has been accepted |
---|
451 | 451 | | to the same, pending sentencing. |
---|
452 | 452 | | B. The Except as provided in subsection D of this section, the |
---|
453 | 453 | | court shall not have the discretion to depart from the applicable |
---|
454 | 454 | | mandatory minimum sentence of imprisonment on convicti ons for |
---|
455 | 455 | | criminal offenses under the following circumstances: |
---|
456 | 456 | | 1. The offense for which the defendant was convicted is among |
---|
457 | 457 | | those crimes listed in Section 571 of Title 57 of the Oklahoma |
---|
458 | 458 | | Statutes as excepted from the definition of “nonviolent offense”; |
---|
459 | 459 | | 2. The offense for which the defendant was convicted was a sex |
---|
460 | 460 | | offense and will require the defendant to register as a sex offender |
---|
461 | 461 | | pursuant to the provisions of the Sex Offenders Registration Act; |
---|
462 | 462 | | 3. The offense for which the defendant was convicted involv ed |
---|
463 | 463 | | the use of a firearm; |
