4365 An Act relating to public health and safety; amending
4466 63 O.S. 2021, Section 1 -1923, as amended by Section
4567 1, Chapter 197, O.S.L. 2023 (63 O.S. Supp. 2024,

5577 BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
5678 SECTION 1. AMENDATORY 63 O.S. 2 021, Section 1-1923, as
5779 amended by Section 1, Chapter 197, O.S.L. 2023 (63 O.S. Supp. 2024,
5880 Section 1-1923), is amended to read as follows:
5981 Section 1-1923. A. There is hereby r e-created, to continue
6082 until July 1, 2025 July 1, 2026, in accordance with the provisions
6183 of the Oklahoma Sunset Law, a Long -Term Care Facility Advisory
6284 Council which shall be composed as follows:
6385 1. The Governor shall appoint a thirteen -member Long-Term Care
6486 Facility Advisory Council which shall advise the State Commissioner

92-of Health. The Advisory Council shall be comprised of the following
93-persons:
94140 a. one representative from the Oklahoma Health Care
95141 Authority, designated by the Administrator,
96142 b. one representative from the Department of Mental
97143 Health and Substance Abuse Services, designated by the
98144 Commissioner of Mental Health and Substance Abuse
99145 Services,
100146 c. one representative from the Department of Human
101147 Services, designated by the Director of Human
102148 Services,
103149 d. one member who shall be a licensed general
104150 practitioner of the med ical or osteopathic profession,
105151 e. one member who shall be a registered pharmacist,
106152 f. one member who shall be a licensed registered nurse
107153 Registered Nurse or licensed practical nurse Licensed
108154 Practical Nurse,
109155 g. one member who shall be an operator -administrator of a
110156 nursing home which has a current license issued
111157 pursuant to the Nursing Home Care Act and who shall
112158 have had five (5) years ’ experience in the nursing
113159 home profession as an operator-administrator,
160+h. one member who shall be an operator -administrator of a
161+residential care home licensed pursuant to the
162+provisions of the Residential Care Act,

141-h. one member who shall be an operator -administrator of a
142-residential care home licensed pursuant to the
143-provisions of the Residential Care Act,
144214 i. one member who shall be an owner -operator of an adult
145215 day care facility licen sed pursuant to the provisions
146216 of the Adult Day Care Act,
147217 j. one member who shall be an owner -operator of a
148218 continuum of care facility or assisted living center
149219 licensed pursuant to the provisions of the Continuum
150220 of Care and Assisted Living Act,
151221 k. two members who shall be over the age of sixty -five
152222 (65) who shall represent the gen eral public and have
153223 no long-term care professional work history, and
154224 l. one member who shall be over the age of sixty -five
155225 (65) who shall represent the general public and who
156226 advocates for individuals receiving long -term care
157227 services; and
158228 2. Appointments shall be for two -year terms. Members shall
159229 serve at the pleasure of their designators. Members may be
160230 reappointed not to exceed two terms. In case of a vacancy, the
161231 Governor shall appoint individuals to fill the remainder of the
162232 term.
163233 B. The State Department of Health shall provide administrative
164234 support to perform designated duties of the Advisory Council. The
235+Department shall also provide space for meetings of the Advisor y
236+Council.

192-Department shall also provide space for meetings of the Advisory
193-Council.
194288 C. The Advisory Council shall annually elect a chair, vice-
195289 chair vice chair and secretary-treasurer, shall meet at least
196290 quarterly, and may hold such special meetings as may be necessary.
197291 The members of the Advisory Council shall be reimbursed as provided
198292 for by the State Travel Reimbursement Act.
199293 D. The Advisory Counc il shall have the power and duty to:
200294 1. Serve as an advisory body to the Department for the
201295 development and improvement of services to and care and treatment of
202296 residents of facilities subject to the provisions of the Nursing
203297 Home Care Act, homes subject to the provisions of the Residential
204298 Care Act and facilities subject to the provisions of the Adult Day
205299 Care Act;
206300 2. Review and make recommendations regarding quality of
207301 services, care, and treatment provided to individuals receiving
208302 services from entitie s that are subject to the Nursing Home Care
209303 Act, the Residential Care Act and the Adult Day Care Act; and
210304 3. Evaluate and review the standards, practices, and procedures
211305 regarding the administration and enforcement of the provisions of
212306 the Nursing Home Care Act, the Residential Care Act and the Adult
213307 Day Care Act.
214308 SECTION 2. This act shall become effective July 1, 2025.
309+SECTION 3. It being immediately necessary for the preservation
310+of the public peace, health or safety, an emergency is hereby
