57 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

58 | 51 | | SECTION 1. AMENDATORY 59 O.S. 2021, Section 1873, as |
---|
59 | 52 | | amended by Section 1, Chapter 88, O.S.L. 2023 (59 O.S. Supp. 2024, |

60 | 53 | | Section 1873), is amended to read as follows: |

61 | 54 | | Section 1873. A. There is hereby re -created, to continue until |
---|
62 | 55 | | July 1, 2025 July 1, 2028, in accordance with the provisions of the |
---|
63 | 56 | | Oklahoma Sunset Law, the Oklahoma Board of Licensed Alcohol and Drug |
---|
64 | 57 | | Counselors, consisting of seven (7) members, to be appointe d by the |
---|
65 | 58 | | Governor, with the advice and consent of the Senate, a s follows: |

97 | 89 | | subsequently secure licensure and one such member |
---|
98 | 90 | | shall subsequently secure certification, pursuant to |
---|
99 | 91 | | the provisions of the Licensed Alcohol and Drug |
---|
100 | 92 | | Counselors Act, no later than January 1, 2005. |
---|
101 | 93 | | b. Thereafter, five membe rs shall be licensed alcohol and |
---|
102 | 94 | | drug counselors at the time of appointment, and one |
---|
103 | 95 | | member shall be certified as an alcohol and drug |
---|
104 | 96 | | counselor at the time of appointment. |
---|
105 | 97 | | c. Pursuant to the provisions of this paragraph, the |
---|
106 | 98 | | Governor shall appoint: |
---|
107 | 99 | | (1) four members from a list of names submitted by |
---|
108 | 100 | | the Oklahoma Drug and Alcohol Professional |
---|
109 | 101 | | Counselors Counselor Association, |
---|
110 | 102 | | (2) one member from a list of names submitted by the |
---|
111 | 103 | | Oklahoma Substance Abuse Services Alliance, and |
---|
112 | 104 | | (3) one member from a list of name s submitted by the |
---|
113 | 105 | | Oklahoma Citizen Advocates for Recovery and |
---|
114 | 106 | | Treatment Transformation Association. |
---|
115 | 107 | | d. One member shall be appointed from and shall represent |
---|
116 | 108 | | the general public. Such member shall be a resident |
---|
148 | 139 | | a person who has ever had any material financial |
---|
149 | 140 | | interest in the provision of alc ohol and drug |
---|
150 | 141 | | counseling services or has engaged in any activit y |
---|
151 | 142 | | directly related to the practice of alcohol and drug |
---|
152 | 143 | | counseling. |
---|
153 | 144 | | 2. The composition of the Board shall include five members who |
---|
154 | 145 | | hold a master’s or higher degree and one member whose highest degree |
---|
155 | 146 | | held is a bachelor’s degree. |
---|
156 | 147 | | 3. The Governor shall appo int the members to the Board no later |
---|
157 | 148 | | than July 1, 2004. |
---|
158 | 149 | | B. Each member of the Board appointed as a licensed alcohol and |
---|
159 | 150 | | drug counselor shall: |
---|
160 | 151 | | 1. Be certified or licensed to engage in the pra ctice of |
---|
161 | 152 | | alcohol and drug counseling in this state and shall be in good |
---|
162 | 153 | | standing; and |
---|
163 | 154 | | 2. Have at least three (3) years of experience in the practice |
---|
164 | 155 | | of alcohol and drug counseling in this state. |
---|
165 | 156 | | C. Two of the members initially appointed shall serve three - |
---|
166 | 157 | | year terms; two shall serve four -year terms; and three shall serve |
---|
199 | 189 | | consecutive terms. Each member shall serve until a successor is |
---|
200 | 190 | | appointed and qualified. |
---|
201 | 191 | | E. Members of the Board may be removed from office for one or |
---|
202 | 192 | | more of the following reasons: |
---|
203 | 193 | | 1. The refusal or inability for any reason to perform the |
---|
204 | 194 | | duties of a Board member in an efficient, responsible and |
---|
205 | 195 | | professional manner; |
---|
206 | 196 | | 2. The misuse of office for pecuniary or material gain or for |
---|
207 | 197 | | personal advantage for self or another; |
---|
208 | 198 | | 3. A violation of the laws or ru les governing the practice of |
---|
209 | 199 | | alcohol and drug counseling; or |
---|
210 | 200 | | 4. Conviction of a felony as verified by a certified copy of |
---|
211 | 201 | | the record of the court of conviction. |
---|
212 | 202 | | F. Members of the Board shall serve without compensation, but |
---|
213 | 203 | | shall be reimbursed for actual and necessary travel expenses as |
---|
214 | 204 | | provided in the State Travel Reimbursement Act. |
---|
215 | 205 | | SECTION 2. This act shall become effective July 1, 2025. |
---|
216 | 206 | | SECTION 3. It being immediately necessary for the preservation |
---|
217 | 207 | | of the public peace, health or safety, an emergency is hereby |
