9393 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9494 SECTION 1. NEW LAW A new section of law to be codified
9595 in the Oklahoma Statutes as Section 11 -105.2 of Title 70, unless

148148 A. This act shall be known and may be cited as the “Oklahoma
149149 Sexual Education Reform and Parental Rights Protection Act”.
150150 B. As used in this act:
151151 1. “Comprehensive sexual education ” or “sexual risk reduction ”
152152 means any educational program that includes, endorses, or promotes
153153 any of the following:
154154 a. the advocacy of sexual activity outside of marriage,
155155 b. the advocacy or promotion of any form of sexual
156156 activity that deviates from the understanding of
157157 sexual norms within a traditional family structure,
158158 c. the provision of information about contraceptive
159159 methods without emphasizing their potential risks and
160160 failure rates,
161161 d. the endorsement or promotion of non -heterosexual
162162 orientations as equally valid or preferable to
163163 heterosexual orientations,
164164 e. the teaching of explicit sexual techniques without a
165165 focus on abstinence as the preferred choice,
166166 f. the inclusion of materials that may be considered
167167 obscene or harmful to minors,
168168 g. the teaching of gender identity and gender expression
169169 outside the binary concept of male and female, without
170170 emphasizing the biological basis of sex,
171171 h. rights-based, pleasure-based sexual response system,

223223 i. teaching of consent and negotiation skills for sexual
224224 activity,
225225 j. sexually transmitted infections (STIs) presented as
226226 normal or common,
227227 k. instruction segmented for students of different sexual
228228 orientation and gender identity,
229229 l. abortion presented as a safe, reproductive health care
230230 choice and a right, and
231231 m. the undermining of the parent relationship, knowledge,
232232 and relevancy with students encouraged to seek other
233233 help; and
234234 2. “Optimal sexual health education ” or “sexual risk avoidance”
235235 means an educational program that emphasizes the following:
236236 a. the importance of monogamous, heterosexual
237237 relationships within the context of marriage,
238238 b. the benefits of abstaining from sexual activity,
239239 c. the physical, psychological, and emotional risks and
240240 consequences of engaging in premarital sexual
241241 activity,
242242 d. the importance of personal responsibility and self -
243243 discipline,
244244 e. the positive aspects of healthy relationships
245245 including communication skills, mutual respect, and
246246 emotional intimacy,

300300 g. the understanding of the potential social, emotional,
301301 and physical consequences of early sexual activity,
302302 h. science-based, health-based information about the
303303 reproductive system,
304304 i. refusal and resistance skills for sexual avoidance,
305305 j. that sexually transmitted infections (STIs) can cause
306306 serious health concerns and can and should be avoided,
307307 k. information provided and risk avoidance promoted for
308308 all students, regardless of se xual orientation or
309309 gender identity,
310310 l. that abortion, if discussed, is presented in the
311311 context of state law and physical and emotional risks,
312312 and
313313 m. parental involvement, communication, and authority are
314314 upheld and family values are supported.
315315 SECTION 2. AMENDATORY 25 O.S. 2021, Section 2003, is
316316 amended to read as follows:
317317 Section 2003. A. The board of education of a school district,
318318 in consultation with parents, teachers , and administrators, shall
319319 develop and adopt a policy to promote the involvement of parents and
320320 guardians of children enrolled in the schools within the school
321321 district, including:

373373 1. A plan for parent participation in the schools which is
374374 designed to improve parent and teacher cooperation in such areas as
375375 homework, attendance, and discipline;
376376 2. Procedures by which parents may learn a bout the course of
377377 study for their children and review learning materials , including
378378 the source of any supplemental educational materials;
379379 3. Procedures by which parents who obj ect to any learning
380380 material or activity on the basis that it is harmful may withdraw
381381 their children from the activity or from the class or program in
382382 which the material is used. Objection to a learning material or
383383 activity on the basis that it is harmful includes objection to a
384384 material or activity because it questions beliefs or practices in
385385 sex, morality, or religion;
386386 4. If a school district offers any sex education curricula
387387 pursuant to Section 11 -105.1 of Title 70 of the Oklahoma Statutes or
388388 pursuant to any rules adopted by the State Board of Education,
389389 procedures to opt out of a school district from providing sex
390390 education require written consent from a parent for a child to
391391 participate in comprehensive sexual education or sexual risk
392392 reduction instruction to a child if the child ’s parent provides
393393 written objection to the chil d’s participation in the sex education
394394 curricula or optimal sexual health education or sexual risk
395395 avoidance instruction, as defined in Section 1 of this act ;

447447 5. Procedures by which parents will be notified in advance of
448448 and given the opportunity to withdraw their children from provide
449449 written consent for a child to participate in any instruction or
450450 presentations regarding sexuality in courses other than formal sex
451451 comprehensive sexual education or sexual risk reduction curricula or
452452 optimal sexual health e ducation or sexual risk avoidance curricula
453453 pursuant to Section 11 -105.1 of Title 70 of the Oklahoma Statutes;
454454 6. Procedures by which parents may learn about the nature and
455455 purpose of clubs and activities that are part of the school
456456 curriculum, as well as extracurricular clubs and activities that
457457 have been approved by the school; and
458458 7. Procedures by which parents may learn about parental rights
459459 and responsibilities under the la ws of this state, including the
460460 following:
461461 a. the right to opt out of in to a sex comprehensive
462462 sexual education or sexual risk reduction curriculum
463463 or an optimal sexual health education or sexual risk
464464 avoidance curriculum if one such a course or courses
465465 is provided by the school district,
466466 b. open enrollment rights,
467467 c. the right to opt out of assignments pursuant to this
468468 section,

521521 the state pursuant to Section 1210.192 of Title 70 of
522522 the Oklahoma Statutes,
523523 e. the promotion requirements prescribed in Section
524524 1210.508E of Title 70 of the Oklahoma Statutes
525525 provisions of the Strong Readers Act ,
526526 f. the minimum course of study and competency
527527 requirements for graduation from high school
528528 prescribed in Section 11 -103.6 of Title 70 of the
529529 Oklahoma Statutes,
530530 g. the right to opt out of instruction on the acquired
531531 immune deficiency syndrome pursuant to Section 11 -
532532 103.3 of Title 70 of the Oklahoma Statutes,
533533 h. the right to review test results,
534534 i. the right to participa te in gifted programs pursuant
535535 to Sections 1210.301 through 1210.308 of Title 70 of
536536 the Oklahoma Statutes,
537537 j. the right to inspect instructional materials used in
538538 connection with any research or experimentation
539539 program or project pursuant to Section 11 -106 of Title
540540 70 of the Oklahoma Statutes,
541541 k. the right to receive a school report card,
542542 l. the attendance requirements prescribed in Section 10 -
543543 106 of Title 70 of the Oklahoma Statutes,

595595 m. the right to public review of courses of study and
596596 textbooks,
597597 n. the right to be excused from school attendance for
598598 religious purposes,
599599 o. policies related to parental involvement pursuant to
600600 this section,
601601 p. the right to participate in parent -teacher
602602 associations and organizations that are sanctioned by
603603 the board of educati on of a school district, and
604604 q. the right to opt out of any data collection instrument
605605 at the district level that would capture data for
606606 inclusion in the state longitudinal student data
607607 system except what is necessary and essential for
608608 establishing a stude nt’s public school record.
609609 B. The board of education of a school district may adopt a
610610 policy to provide to parents the information required by this
611611 section in an electronic form.
612612 C. A parent shall submit a written request for information
613613 pursuant to this section during regular business hours to either the
614614 school principal at the school site or the superintendent of the
615615 school district at the office of the school district. Within ten
616616 (10) days of receiving the request for information, the school
617617 principal or the superintendent of the school district shall either
618618 deliver the requested information to the parent or submit to the

670670 parent a written explanation of the reasons for the denial of the
671671 requested information. If the request for information is denied o r
672672 the parent does not receive the requested information within fifteen
673673 (15) days after submitting the request for information, the parent
674674 may submit a written request for the information to the board of
675675 education of a school district, which shall formally consider the
676676 request at the next scheduled public meeting of the board if the
677677 request can be properly noticed on the agenda. If the request
678678 cannot be properly noticed on the agenda, the board of education of
679679 a school district shall formally consider the r equest at the next
680680 subsequent public meeting of the board.
681681 SECTION 3. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
682682 amended to read as follows:
683683 Section 11-105.1. A. All curriculum and materials including
684684 supplementary materials which will be used to teach or will be used
685685 for or in connection with a sex comprehensive sexual education or
686686 sexual risk reduction class or program which is designed for the
687687 exclusive purpose of discussing sexual behavior or attitudes or an
688688 optimal sexual health education or sexual risk avoidance class or
689689 program, as defined in Section 1 of this act , or any test, survey or
690690 questionnaire whose primary purpose is to elicit responses on sexual
691691 behavior or attitudes shall be available on the school district ’s
692692 website and through the superintendent or a designee of the school
693693 district for inspection by parents and legal guardians of the

745745 student who will be involved with the class, program or, test,
746746 survey, or questionnaire. Such curriculum, materials, classes,
747747 programs, tests, surveys , or questionnaires shall include
748748 information about consent and shall have as one of its primary
749749 purposes the teaching of or informing students about the practice of
750750 abstinence. For the purposes of this section, “consent” shall have
751751 the same meaning as that provided by Section 113 of Title 21 of the
752752 Oklahoma Statutes. The superintendent or a designee of the school
753753 district shall provide prior written notification to the parents or
754754 legal guardians of the students involved of their r ight to inspect
755755 the curriculum and material , the right to inspect a detailed outline
756756 of the curriculum, and of their obligation to notify the right of
757757 parents or legal guardians to provide the school in writing written
758758 consent if they do not want their child to participate in the class,
759759 program, test, survey , or questionnaire. Each local board of
760760 education shall determine the means of providing written
761761 notification to the parents and legal guardian which will ensure
762762 effective notice in an efficient and app ropriate manner including a
763763 reasonable time period for the parent or legal guardian to review
764764 the curriculum. No student shall be required to participate in a
765765 sex comprehensive sexual education or sexual risk reduction class or
766766 program or an optimal sexual health education or sexual risk
767767 avoidance class or program which discusses sexual behavior or
768768 attitudes if a parent or legal guardian of the student objects in

821821 If the type of program re ferred to in this section is a part of or
822822 is taught during a credit course, a student may be required to
823823 enroll in the course but shall not be required to receive
824824 instruction in or participate in the program if a parent or legal
825825 guardian objects in writing does not provide written consent .
826826 B. The superintendent or a designee of a s chool district in
827827 which sex a comprehensive sexual education or sexual risk reduction
828828 class or program or an optimal sexual health education or sexual
829829 risk avoidance class or pro gram is taught or a program is offered
830830 which is designed for the exclusive purpose of discussing sexual
831831 behavior or attitudes shall approve all curriculum and materials
832832 which will be used for such education and any test, survey , or
833833 questionnaire whose prim ary purpose is to elicit responses on sexual
834834 behavior or attitudes used in the school prior to their use in the
835835 classroom or school. The teacher involved in the class, program,
836836 testing, or survey shall submit the curriculum, materials, tests , or
837837 surveys to the superintendent or a designee for approval prior to
838838 their use in the classroom or school. This section shall not apply
839839 to those students enrolled in classes, programs, testings , or
840840 surveys offered through an alternative education program.
841841 C. A comprehensive sexual education or sexual risk reduction
842842 class or program or an opti mal sexual health education or sexual
843843 risk avoidance class or program offered by a school district

895895 pursuant to this section shall only be taught by a certified teacher
896896 who is employed by the school district. Outside organizations
897897 including, but not limited to, county health departments and city -
898898 county health departments shall be prohibited from leading such a
899899 class or program.
900900 D. Only textbooks and other instructional materials included in
901901 the list of textbooks selected by the State Textbook Committee
902902 pursuant to Section 16-110 of this title shall be used in a
903903 comprehensive sexual education or sexual risk reduction class or
904904 program or an optimal sexual health education or sexual risk
905905 avoidance class or program offered pursuant to this section. A
906906 school district shall be prohibited from using state funds to
907907 purchase textbooks or other instructional materials not included in
908908 the list of textbooks selected by the State Textbook Comm ittee.
909909 SECTION 4. This act shall become effective July 1, 202 5.
910910 SECTION 5. It being immediately necessary for the preservation
911911 of the public peace, health, or safety, an emergency is hereby
912912 declared to exist, by reason whe reof this act shall take effect and
913913 be in full force from and after its passage and approval.
