51	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	78		SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -101, as
53	79		last amended by Section 34, Chapter 452, O.S.L. 2024 (47 O.S. Supp.
54	80		2024, Section 6-101), is amended to read as follows:
55	81		Section 6-101. A. No person, except those hereinafter
56	82		expressly exempted in Sections 6 -102 and 6-102.1 of this title,
57	83		shall operate any motor vehicle upon a highway in this state unless
58	84		the person has a valid Oklahoma driver license for the class of
59	85		vehicle being operated under the provisions of this title. No
60	86		person shall be permitted to posse ss more than one valid license at
61	87		any time, except as provided in paragraph 4 of subsection F of this
62	88		section.

90	140		B. 1. No person shall operate a Class A commercial motor
91	141		vehicle unless the person is eighteen (18) years of age or older and
92	142		holds a valid Class A commercial license, except as provided in
93	143		paragraph 5 of this subsection and subsection F of this section.
94	144		Any person holding a valid Class A commercial license shall be
95	145		permitted to operate motor vehicles in Classes A, B, C , and D,
96	146		except as provided for in paragraph 4 of this subsection.
97	147		2. No person shall operate a Class B commercial motor vehicle
98	148		unless the person is eighteen (18) years of age or older and holds a
99	149		valid Class B commercial license, except as provided in paragraph 5
100	150		of subsection F of this section. Any person holding a valid Class B
101	151		commercial license shall be permitted to operate motor vehicles in
102	152		Classes B, C, and D, except as provided for in paragraph 4 of this
103	153		subsection.
104	154		3. No person shall operate a Class C commercial motor v ehicle
105	155		unless the person is eighteen (18) years of age or older and holds a
106	156		valid Class C commercial license, except as provided in subsection F
107	157		of this section. Any person hold ing a valid Class C commercial
108	158		license shall be permitted to operate motor vehicles in Classes C
109	159		and D, except as provided for in paragraph 4 of this subsection.
110	160		4. No person under twenty -one (21) years of age shall be
111	161		licensed to operate any motor vehicl e which is required to be
112	162		placarded for hazardous materials pursuant to 49 C.F .R., Part 172,
113	163		subpart F, except as provided in subsection F of this section;

142	216		licensed to operate a farm vehicle whi ch is required to be placarded
143	217		for hazardous materials pursuant to 49 C.F.R., Part 172, subpart F,
144	218		except as provided in subsection F of this section.
145	219		5. A person at least seventeen (17) years of age who
146	220		successfully completes all examinations required by law may be
147	221		issued by Service Oklahoma:
148	222		a. a restricted Class A commercial lic ense which shall
149	223		grant to the licensee the privilege to operate a Class
150	224		A or Class B commercial motor vehicle for harvest
151	225		purposes or a Class D motor vehicle, or
152	226		b. a restricted Class B commercial license which shall
153	227		grant to the licensee the privilege to operate a Class
154	228		B commercial motor vehicle for harvest purposes or a
155	229		Class D motor vehicle.
156	230		6. No person shall operate a Class D motor vehicle unless the
157	231		person is sixteen (16) years of age or older and holds a valid Class
158	232		D license, except as provided fo r in Section 6-102 or 6-105 of this
159	233		title. Any person holding a valid Class D license shall be
160	234		permitted to operate motor vehicles in Class D only.
161	235		C. Any person issued a drive r license pursuant to this section
162	236		may exercise the privilege thereby granted upon all streets and
163	237		highways in this state.

191	289		D. No person shall operate a motorcycle or motor -driven cycle
192	290		without having a valid Class A, B, C , or D license with a motorcycle
193	291		endorsement. Except as otherwise provided by law, any new applicant
194	292		for an original driver license shall be required to successfully
195	293		complete a written examination, vision examination , and driving
196	294		examination for a motorcycle as prescribed by the Departmen t of
197	295		Public Safety, in conjunction with Service Oklahoma, and a certified
198	296		state-approved motorcycle basic rider course approved by the
199	297		Department, in conjunction with Service Oklahoma, if the applicant
200	298		is seventeen (17) years of age or younger to be eligib le for a
201	299		motorcycle endorsement thereon. The written examination and driving
202	300		examination for a motorcycle shall be waived by Service Oklahoma
203	301		upon verification that the person has successfully completed a
204	302		certified Motorcycle Safety Foundation rider cours e approved by the
205	303		Department, in conjunction with Service Oklahoma.
206	304		E. Except as otherwise provided by law, any person who lawfully
207	305		possesses a valid Oklahoma driver license which is eligible for
208	306		renewal shall be required to successfully complete a writte n
209	307		examination, vision examination , and driving examination for a
210	308		motorcycle as prescribed by the Department, in conjunction with
211	309		Service Oklahoma, and a certified state -approved motorcycle basic
212	310		rider course approved by the Department, in conjunction with Service
213	311		Oklahoma, if the person is seventeen (17) years of age or younger to
214	312		be eligible for a motorcycle endorsement. The written examination

246	368		F. 1. Any person eighteen (18) years of age or older may apply
247	369		for a restricted Class A, B , or C commercial learner permit.
248	370		Service Oklahoma, after the applicant has passed all parts of the
249	371		examination for a Class D license and has successfully passed all
250	372		parts of the examination for a Class A, B , or C commercial license
251	373		other than the driving examination, may issue to the applicant a
252	374		commercial learner permit which shall entitle the per son having
253	375		immediate lawful possession of the commercial learner permit and a
254	376		valid Oklahoma driver license or provisional driver license pursuant
255	377		to Section 6-212 of this title to operate a Class A, B , or C
256	378		commercial motor vehicle upon the public highways solely for the
257	379		purpose of behind-the-wheel training in accordance with rules
258	380		promulgated by the Department.
259	381		2. This commercial learner permit shall be issued for a period
260	382		as provided in Section 6 -115 of this title of one year; provided,
261	383		such commercial learner permit may be suspended, revoked, canceled,
262	384		denied, or disqualified at the discretion of the Department, with
263	385		notice to Service Oklahoma, for violation of the restriction s, for
264	386		failing to give the required or correct information on the
265	387		application, or for violation of any traffic laws of this state

293	439		pertaining to the operation of a motor vehicle. Except as otherwise
294	440		provided, the lawful possessor of a commercial learner pe rmit who
295	441		has been issued a commercial learner permit for a minimum of
296	442		fourteen (14) days may have the restriction requiring an
297	443		accompanying driver removed by satisfactorily completing a driver ’s
298	444		examination; provided, the removal of a restriction shall not
299	445		authorize the operation of a Class A, B , or C commercial motor
300	446		vehicle if such operation is otherwise prohibited by law.
301	447		3. No person shall apply for and Service Oklahoma shall not
302	448		issue an original Class A, B , or C driver license until the person
303	449		has been issued a commercial learner permit and held the permit for
304	450		at least fourteen (14) days. Any person who currently holds a Class
305	451		B or C license and who wishes to apply for another class of
306	452		commercial driver license shall be required to apply for a
307	453		commercial learner permit and to hold the permit for at least
308	454		fourteen (14) days before applying for the Class A or B license, as
309	455		applicable. Any person who currently holds a Class A, B , or C
310	456		license and who wishes to add an endorsement or remove a restriction
311	457		for which a skills examination is required shall be required to
312	458		apply for a commercial learner permit and to hold the permit for at
313	459		least fourteen (14) days before applying for the endorsement.
314	460		4. A commercial learner permit shall be issued by Service
315	461		Oklahoma as a separate and unique document which shall be valid only
316	462		in conjunction with a valid Oklahoma driver license or provisional

345	515		which shall be in the possession of the person to whom they have
346	516		been issued whenever that person is operating a commercial motor
347	517		vehicle as provided in this subsection.
348	518		5. After one renewal of a commercial learner permit, as
349	519		provided in paragraph 2 of this subsection, a commercial permit
350	520		shall not be renewed aga in. Any person who has held a commercial
351	521		learner permit for the initial issuance period and one renewal
352	522		period shall not be eligible for and Service Oklahoma shall not
353	523		issue another renewal of the permit; provided, the person may
354	524		reapply for a new commerc ial learner permit, as provided for in this
355	525		subsection.
356	526		G. 1. For purposes o f this title:
357	527		a. “REAL ID Compliant Driver License” License or
358	528		“Identification Identification Card” means a driver
359	529		license or identification card issued by this state
360	530		that has been certified by the United States
361	531		Department of Homeland Security (USDHS) as compliant
362	532		with the requirements of the REAL ID Act of 2005,
363	533		Public Law No. 109-13. A REAL ID Compliant Driver
364	534		License or Identification Card and the process through
365	535		which it is issued incorporate a variety of security
366	536		measures designed to protect the integ rity and
367	537		trustworthiness of the license or card. A REAL ID

396	590		be clearly marked on the face indicating that it is a
397	591		compliant document, and
398	592		b. “REAL ID Noncompliant Driver License” License or
399	593		“Identification Identification Card” means a driver
400	594		license or identification card issued by this state
401	595		that has not been certified by the United States
402	596		Department of Homeland Security (USDHS ) as being
403	597		compliant with the requirements of the REAL ID Act of
404	598		2005. A REAL ID Noncompliant Driver License or
405	599		Identification Card will be clearly marked on the face
406	600		indicating that it is not compliant with the federal
407	601		REAL ID Act of 2005 and is not acce ptable for official
408	602		federal purposes. The driver license or
409	603		identification card will have a unique design or color
410	604		indicator that clearly distinguishes it from a
411	605		compliant license or card.
412	606		2. Original Driver License and Identification Card Issuance:
413	607		a. Application for an original REAL ID Compliant or REAL
414	608		ID Noncompliant Driver Li cense or Identification Card
415	609		shall be made to Service Oklahoma or a licensed
416	610		operator provided such licensed operator is authorized
417	611		to process application for REAL ID Compliant D river
418	612		Licenses and Identification Cards. Application for a

448	666		b. Service Oklahoma employees or authorized licensed
449	667		operators shall perform all document recognition and
450	668		other requirements needed for approval of an original
451	669		REAL ID Compliant Dr iver License or Identification
452	670		Card application. Service Oklahoma employees shall
453	671		perform all document recognition and other
454	672		requirements needed for approval of a REAL ID
455	673		Noncompliant Driver License or Identification Card
456	674		application.
457	675		c. Upon approval of an original REAL ID Compliant or REAL
458	676		ID Noncompliant Driver License or Identification Card
459	677		application, the applicant may take the approved
460	678		application document to a licensed op erator to receive
461	679		a temporary driver license or identification card.
462	680		d. The licensed operator shall process the approved REAL
463	681		ID Compliant or REAL ID Noncompliant Driver License or
464	682		Identification Card application and upon payment shall
465	683		provide the applican t a temporary driver license or
466	684		identification card. A temporary driver license or
467	685		identification card shall afford the holder the
468	686		privileges otherwise granted by the specific class of
469	687		driver license or identification card for the period

502	744		3. REAL ID Compliant Driver Li cense and Identification Card
503	745		Renewal and Replacement:
504	746		a. Application for renewal or replacement of a REAL ID
505	747		Compliant Driver License or Identification Card may be
506	748		made to Service Oklahoma or to a licensed operator;
507	749		provided, such licensed operator is aut horized to
508	750		process application for REAL ID Compliant Driver
509	751		Licenses and Identification Cards. A licensed
510	752		operator may process the voluntary downgrade of a REAL
511	753		ID Compliant Commercial Driver License to any lower
512	754		class license upon request of the licensee ;, provided,
513	755		no additional endorsements or restrictions are placed
514	756		on the license.
515	757		b. Service Oklahoma employees or authorized licensed
516	758		operators shall perform all document recognition and
517	759		other requirements needed for approval of a renewal or
518	760		replacement REAL ID Compliant Driver License or
519	761		Identification Card application.

552	818		d. A temporary driver license or identification card
553	819		acquired under the provisions of this paragraph shall
554	820		afford the holder the privileges otherwise granted by
555	821		the specific class of driver licen se or identification
556	822		card being renewed or replaced for the period of time
557	823		listed on the temporary driver license or
558	824		identification card or the period of time prior to the
559	825		applicant receiving a REAL ID Compliant Driver License
560	826		or Identification Card, which ever time period is
561	827		shorter.

600	890		A licensed operator may process the voluntary
601	891		downgrade of a REAL ID Noncompliant Commercial Driver
602	892		License to any lower class license upon request of the
603	893		licensee;, provided, no additional endorsemen ts or
604	894		restrictions are added to the license.
605	895		b. Service Oklahoma employees or licensed operators shall
606	896		perform all document recognition and other
607	897		requirements needed for approval of a renewal or
608	898		replacement REAL ID Noncompliant Driver License or
609	899		Identification Card application.
610	900		c. Upon approval of a renewal or replacement REAL ID
611	901		Noncompliant Driver License or Identification Card
612	902		application, the applicant may receive a temporary
613	903		driver license or identification card from Service
614	904		Oklahoma or a licensed oper ator.
615	905		d. A temporary driver license or identification card
616	906		acquired under the provisions of this paragraph shall
617	907		afford the holder the privileges otherwise granted by
618	908		the specific class of driver license or identification
619	909		card being renewed or replaced for the period of time
620	910		listed on the temporary driver license or

807	1193		created in Section 1 -2530.9 of Title 63 of the Oklahoma Statutes;
808	1194		2. Six Dollars and seventy-five cents ($6.75) of a 4-year four-
809	1195		year license or Thirteen Dollars and fifty cents ($13.50) of an 8-
810	1196		year eight-year license shall be deposited to the Department of
811	1197		Public Safety Computer Imaging System Revolving Fund to be used
812	1198		solely for the purpose of administration and maintenance of the
813	1199		computerized imaging sys tem of the Department through October 31,
814	1200		2022. Beginning November 1, 2022, Six Dollars and seventy -five
815	1201		cents ($6.75) of a 4-year four-year license or Thirteen Dollars and
816	1202		fifty cents ($13.50) of an 8-year eight-year license shall be
817	1203		deposited to the Service Oklahoma Computer Imaging System Revolving
818	1204		Fund to be used solely for the purpose of administration and
819	1205		maintenance of the computerized imaging system of Service Oklahoma;
820	1206		3. Ten Dollars ($10.00) of a 4-year four-year license or Twenty
821	1207		Dollars ($20.00) of an 8-year eight-year license shall be deposited
822	1208		to the Department of Public Safety Revolving Fund for all original
823	1209		or renewal issuances of licenses through October 31, 2022 .

861	1271		O. 1. Through May 31, 2025, any person sixty -two (62) to
862	1272		sixty-four (64) years of age during the calendar year of issuance or
863	1273		renewal of a Class D license or motorcycle endorsement shall be
864	1274		charged the following prorated fee:
865	1275		4-year 8-year

869	1279		2. Any person sixty -five (65) years of age or older during the

872	1282		P. No person who has been honorably discharged from active
873	1283		service in any branch of the Armed Forces of the United States or
874	1284		Oklahoma National Guard and who has been certified by the United
875	1285		States Department of Veterans Affairs, its success or, or the Armed

908	1342		Veterans Affairs shall be charged a fee for the issuance,
909	1343		replacement, or renewal of an Oklahoma driver license; provided,
910	1344		that if a veteran has been previously exempt from a fee pursuant to
911	1345		this subsection, no registration with the veterans reg istry shall be
912	1346		required.
913	1347		Q. In accordance with the provisions of subsection G of this
914	1348		section, Service Oklahoma is authorized to promulgate rules for the
915	1349		issuance and renewal of driver licenses authorized pursuant to the
916	1350		provisions of Sections 6 -101 through 6-309 of this title; provided,
917	1351		that no such rules applicable to the issuance or renewal of REAL ID
918	1352		Noncompliant Driver Licenses shall create more stringent standards
919	1353		than such rules applicable as of January 1, 2017, unless directly
920	1354		related to a specific change in statutory law concerning standards
921	1355		for REAL ID Noncompliant Driver Licenses. Applications, upon forms
922	1356		approved by Service Oklahoma, for such licenses shall be handled , in
923	1357		accordance with the provisions of subsection G of this section, by
924	1358		the licensed operator; provided, Service Oklahoma is authorized to
925	1359		assume these duties in any county of this state. Each licensed
926	1360		operator accepting applications for driver licenses s hall receive

962	1420		operator accepting applications for driver licenses for individuals
963	1421		over the age of sixty -five (65) years or for applications for
964	1422		drivers pursuant to subsection P of this section shall receive Six
965	1423		Dollars ($6.00) for a 4-year four-year driver license or Twelve
966	1424		Dollars ($12.00) for an 8-year eight-year driver license to be
967	1425		deducted daily by the motor license agent or licensed operator
968	1426		receipts. Beginning July 1, 2023, these fees shall be retained by
969	1427		the licensed operator pursuant to subsection E of Section 1141.1 of
970	1428		this title. The fees received b y the licensed operator, authorized
971	1429		by this subsection, shall be used for operating expenses. The
972	1430		amount retained pursuant to this subsection shall not be retained by
973	1431		any state agency. The fees received by the licensed operator,
974	1432		authorized by this subsection, shall be used for operating expenses.
975	1433		For purposes of this subsection, “licensed operator” shall mean an
976	1434		individual who obtains a license from the Service Oklahoma Operato r
977	1435		Board to operate a designated Service Oklahoma location and offers

1010	1492		Dollars ($60,000.00) of all monies collected pursuant to this
1011	1493		section shall be paid by the Oklahoma Tax Commission to the State
1012	1494		Treasurer to be deposited in the General Reven ue Fund of the State
1013	1495		Treasury.
1014	1496		The next Five Hundred Thousand Dollars ($500,00 0.00) of monies
1015	1497		collected pursuant to this section shall be paid by the Tax
1016	1498		Commission to the State Treasurer to be deposited each fiscal year
1017	1499		under the provisions of this sectio n to the credit of the Department
1018	1500		of Public Safety Restricted Revolving Fund for the purpose of the
1019	1501		Oklahoma Law Enforcement Telecommunications System. All other
1020	1502		monies collected in excess of Five Hundred Sixty Thousand Dollars
1021	1503		($560,000.00) each fiscal y ear shall be apportioned as provided in
1022	1504		Section 1104 of this title, except as otherwise provided in this
1023	1505		section.
1024	1506		S. Service Oklahoma shall retain the images displayed on
1025	1507		licenses and identification cards issued pursuant to the provisions
1026	1508		of Sections 6-101 through 6-309 of this title which may be used
1027	1509		only:

1062	1568		All agencies approved by the Oklahoma Law Enforcement
1063	1569		Telecommunications System (OLETS) or the National Law Enforcement
1064	1570		Telecommunications System (NLETS) to receive photographs or
1065	1571		computerized images may obtain them through OLETS or through NLETS.
1066	1572		Photographs or computerized images may be obtained by law
1067	1573		enforcement one inquiry at a time.
1068	1574		The computer system and related equipment a cquired for this
1069	1575		purpose must conform to industry standards for interoperabili ty and
1070	1576		open architecture. The Department of Public Safety may promulgate
1071	1577		rules to implement the provisions of this subsection.
1072	1578		T. No person may hold more than one state -issued or territory-
1073	1579		issued REAL ID Compliant Driver License or REAL ID Compliant

1107	1637		related to the issuance of replacement REAL ID Compliant Driver
1108	1638		Licenses in the event of loss or theft.
1109	1639		U. Beginning May 24, 2021, and ending on June 30, 2023, in
1110	1640		addition to the amounts provided in subsection Q of this section, a
1111	1641		licensed operator shall receive Five Dollars ($5.00) for each
1112	1642		processed application for a four-year REAL ID Compliant 4-year
1113	1643		Driver License and T en Dollars ($10.00) for each processed
1114	1644		application for a an eight-year REAL ID Compliant 8-year Driver
1115	1645		License. Any additional amounts provided pursuant to this
1116	1646		subsection shall not be retained by Service Oklahoma.
1117	1647		SECTION 2. This act shall become effective November 1, 2025.
