4851 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4952 SECTION 1. AMENDATORY 74 O.S. 2021, Section 18c, is
5053 amended to read as follows:
5154 Section 18c. A. 1. Except as otherwise provided by this
5255 subsection, no state officer, board or commission shall have
5356 authority to employ or appoint attorneys to advise or represent said
5457 the officer, board or commission in any mat ter.
5558 2. The provisions of this subsection shall not apply to the
5659 Corporation Commission, the Council on Law Enforc ement Education and
5760 Training, the Commission on Consumer Credit Commission, the Board of
5861 Managers of the State Insurance Fund, the Oklahoma T ax Commission,
5962 the State Treasurer, the Commissioners of the Land Office, the
6063 Oklahoma Public Welfare Commission also known as the Commission for

96100 Conservation Commission, the Northeast Oklahoma Public Facilities
97101 Authority, the Oklahoma Firefighters Pension and Retirement System,
98102 the Oklahoma Public Em ployees Retirement System, the Uniform
99103 Retirement System for Justices and Judges, the Oklahoma Conservation
100104 Commission, the Office of Juvenil e Affairs, the State Board of
101105 Pharmacy and the Oklahoma Department of Veterans Affairs.
102106 3. The provisions of paragraph 2 of this subsection shall not
103107 be construed to authorize the Office of Juvenile Affairs to employ
104108 any attorneys that are not specificall y authorized by law.
105109 4. All the legal duties of such officer, board or commission
106110 shall devolve upon and are hereb y vested in the Attorney General;
107111 provided that:
108112 a. the Governor shall have authority to employ special
109113 counsel to protect the rights or inte rest of the state
110114 as provided in Section 6 of this title, and

137142 b. liquidation agents of banks shall have the authority
138143 to employ local counsel, with the consent of the Bank
139144 Commissioner and the Attorney General and the approval
140145 of the district court.
141146 B. At the request of any state officer, board or commission,
142147 except the Corporation Commission, the Board of Managers of the
143148 CompSource Oklahoma, Oklahoma Tax Commission and the Commissioners
144149 of the Land Office, the Grand River Dam Authority, the Oklahoma
145150 State Bureau of Narcotics and Dangerous Drugs Control, the Alcoholic
146151 Beverage Laws Enforcement Commission, the Oklahoma Firefighters
147152 Pension and Retirement System, the Oklahoma Public Employees
148153 Retirement System, the Uniform Retirement System for Justices and
149154 Judges and the Interstate Oil and Gas Compact Commission, the
150155 Attorney General shall defend any action in which they may be sued
151156 in their official capacity. At the request of any such state
152157 officer, board or commission, the Attorney General shall have
153158 authority to institute suits in the name of the State of Oklahoma on
154159 their relation, if after investigation the Attorney General is
155160 convinced there is sufficient legal merit to justify the action.
156161 C. Any officer, board or commission which has the authority to
157162 employ or appoint attorneys may request that the Attorney General
158163 defend any action arising pursuant to the provis ions of The
159164 Governmental Tort Claims Act.

186192 D. Nothing in this section shall be construed to repeal or
187193 affect the provisions of the statutes o f this state pertaining to
188194 attorneys and legal advisors of the several commissions and
189195 departments of state specified in subsection B of this section, and
190196 all acts and parts of acts pertaining thereto shall be and remain in
191197 full force and effect.
192198 SECTION 2. This act shall become effective November 1, 2025.
