7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -106, as
7979 last amended by Section 5, Cha pter 11, O.S.L. 2024 (47 O.S. Supp.
8080 2024, Section 6-106), is amended to read as follows:
8181 Section 6-106. A. 1. Every application for a driver license
8282 or identification card shall be made by the applicant upon a form
8383 furnished by Service Oklahoma.
8484 2. Every original, renewal, or replacement application for a
8585 driver license or ident ification card made by a male applicant who
8686 is at least sixteen (16) but less than twenty -six (26) years of age
8787 shall include a statement that by submitting the application, the
8888 applicant is consenting to registration with the Selective Service

140140 System. The pertinent information from the application shall be
141141 forwarded by Service Oklahoma to the Data Management Center of the
142142 Selective Service System in order to register the applica nt as
143143 required by law with the Selective Service System. Any applicant
144144 refusing to sign the consent statement shall be denied a driver
145145 license or identification card.
146146 3. Except as provided for in subsections G and H of this
147147 section, every applicant for a driver license or identification card
148148 shall provide to Service Oklahoma at the time of application a
149149 document showing proof of identity. Service Oklahoma shall
150150 promulgate rules prescribing forms of identification acceptable for
151151 an original Oklahoma drive r license.
152152 B. Every applicant for a driver license shall provide the
153153 following information:
154154 1. Full name;
155155 2. Date of birth;
156156 3. Sex;
157157 4. Address of principal residence and county of such residence
158158 which shall be referenced on the REAL ID Compliant Drive r License or
159159 Identification Card; proof of principal residency, as prescribed by
160160 rules promulgated by Service Oklahoma, documenting provided address;
161161 5. Current and complete mailing address to be maintained by
162162 Service Oklahoma for the purpose of giving no tice, if necessary, as
163163 required by Section 2 -116 of this title;

215215 6. Medical information, as determined by the Department Service
216216 Oklahoma, which shall assure Service Oklahoma that the person is not
217217 prohibited from being licensed as provided by paragraph 7 of
218218 subsection A of Section 6 -103 of this title;
219219 7. Whether the applicant is deaf or hard -of-hearing;
220220 8. A brief description of the applicant, as determined by the
221221 Department Service Oklahoma;
222222 9. Whether the applicant has previously been licensed, and, i f
223223 so, when and by what state or country, and whether any license has
224224 ever been suspended or revoked, or whether an application has ever
225225 been refused, and, if so, the date of and reason for the suspension,
226226 revocation or refusal;
227227 10. Whether the applicant i s an alien eligible to be considered
228228 for licensure and is not prohibited from licensure pursuant to
229229 paragraph 9 of subsection A of Section 6 -103 of this title;
230230 11. Whether the applicant has:
231231 a. previously been licensed and, if so, when and by what
232232 state or country, and
233233 b. held more than one license at the same time during the
234234 immediately preceding ten (10) years; and
235235 12. Social Security number.
236236 No person shall request Service Oklahoma to use the Social Security
237237 number of that person as the driver license number. Upon renewal or
238238 replacement of any driver license issued after the effective date of

290290 this act July 1, 2001, the licensee shall advise Service Oklahoma or
291291 the licensed operator if the present driver license number of the
292292 licensee is the Social Secu rity number of the licensee. If the
293293 driver license number is the Social Secur ity number, Service
294294 Oklahoma or the licensed operator shall change the driver license
295295 number to a computer -generated alphanumeric identification.
296296 C. 1. In addition to the requi rements of subsections A and B
297297 of this section, every applicant for a commercial driver license who
298298 is subject to the requirements of 49 C.F.R., Part 391, and is
299299 applying for an original, renewal, or replacement license, and every
300300 person who, upon or after May 8, 2012, is currently the holder of a
301301 commercial driver license and is su bject to the requirements of 49
302302 C.F.R., Part 391, and who does not apply for a renewal or
303303 replacement license prior to January 30, 2014, shall submit to
304304 Service Oklahoma and main tain with Service Oklahoma a current
305305 approved medical examination certificate signed by a licensed
306306 physician authorized to perform and approve medical examination
307307 certifications. Service Oklahoma shall adopt rules for maintaining
308308 medical examination certi ficates pursuant to the requirements in 49
309309 C.F.R., Parts 383 and 384. Any com mercial driver licensee subject
310310 to the requirements of this paragraph who fails to maintain on file
311311 with Service Oklahoma a current, approved medical examination
312312 certificate shall have the driving privileges of the person
313313 downgraded to a Class D driver license by Service Oklahoma.

365365 2. If the applicant is applying for an original commercial
366366 driver license in Oklahoma or is transferring a commercial driver
367367 license from another state to Oklahoma, Service Oklahoma shall
368368 review the driving record of the applican t in other states for the
369369 immediately preceding ten (10) years, unless the record review has
370370 already been performed by Service Oklahoma. As a result of the
371371 review, if it is dete rmined by Service Oklahoma that the applicant
372372 is subject to a period of disqualification as prescribed by Section
373373 6-205.2 of this title which has not yet been imposed, Service
374374 Oklahoma shall impose the period of disqualification and the
375375 applicant shall serve the period of disqualification before a
376376 commercial driver license is issued to the applicant; provided,
377377 nothing in this paragraph shall be construed to prevent the issuance
378378 of a Class D driver license to the applicant.
379379 3. If the applicant has or is app lying for a hazardous material
380380 endorsement, the applicant shall submit to a security threat
381381 assessment performed by the Transportation Security Administration
382382 of the United States Department of Homeland Security as required by
383383 and pursuant to 49 C.F.R., Pa rt 1572, which shall be used to
384384 determine whether the applicant is eligible fo r the endorsement
385385 pursuant to federal law and regulation.
386386 4. Service Oklahoma shall notify each commercial driving school
387387 of the passage of this section, and each commercial dri ving school

439439 shall notify prospective students of its school of the hazardous
440440 material endorsement requirement.
441441 D. In addition to the requirements of subsections A and B of
442442 this section, every applicant shall be given an option on the
443443 application for issua nce of a driver license or identification card
444444 or renewal pursuant to Section 6-115 of this title to provide an
445445 emergency contact person. The emergency contact information
446446 requested may include full name, address, and phone number. The
447447 emergency contact information shall be maintained by Service
448448 Oklahoma and shall be used by Service Oklahoma and law enforcement
449449 for emergency purposes only. A person listed as an emergency
450450 contact may request to be removed at any time. Any update to a
451451 change of name, addr ess, or phone number may be made by the
452452 applicant listing the emergency contac t person or by the person
453453 listed as the emergency contact.
454454 E. Whenever application is received from a person previously
455455 licensed in another jurisdiction, Service Oklahoma shall request a
456456 copy of the driving record from the other jurisdiction and,
457457 effective September 1, 2005, from all other jurisdictions in which
458458 the person was licensed within the immediately previous ten (10)
459459 years. When received, the driving record shall become a part of the
460460 driving record of the person in this state with the same force and
461461 effect as though entered on the driver ’s record in this state in the
462462 original instance.

514514 F. Whenever Service Oklahoma receives a request for a driving
515515 record from another lic ensing jurisdiction, the record shall be
516516 forwarded without charge.
517517 G. A person shall not apply for or possess more than one state -
518518 issued or territory-issued REAL ID Compliant Driver License or
519519 Identification Card pursuant to the provisions of Section 6 -101 of
520520 this title. A valid and unexpired Oklahoma driver license shall
521521 serve as both primary and secondary proofs of identity whenever
522522 application for a REAL ID Noncompliant Identification Card is
523523 submitted to Service Oklahoma. The provisions of subsection B of
524524 Section 1550.42 of Title 21 of the Oklahoma Statutes shall not apply
525525 when issuing an identification card pursuant to the provisions of
526526 this subsection. Service Oklahoma shall promulgate rules necessary
527527 to implement and administer the provisions of t his subsection.
528528 H. A valid and unexpired U.S. passport shall serve as both
529529 primary and secondary proofs of identity whenever application for a
530530 driver license or identification card is submitted to the Department
531531 Service Oklahoma. Service Oklahoma shall p romulgate rules necessary
532532 to implement and administer the provisions of this subsection.
533533 I. An original or certified copy of the applicant ’s birth
534534 certificate filed with the Division of Vital Records within the
535535 State Department of Health or equivalent agency in the applicant’s
536536 state of birth shall serve as a primary proof of identi ty whenever
537537 application for a driver license or identification card is submitted

589589 to Service Oklahoma. No birth certificate issued by a county of
590590 this state or any other state sh all be accepted as a primary proof
591591 of identity. Any employee of Service Oklahoma who accepts a birth
592592 certificate issued by a county as a primary proof of identity shall
593593 be suspended for thirty (30) days without pay on the first instance
594594 and lose his or her employment on the second instance. Any employee
595595 of Service Oklahoma who ver bally or in writing instructs another
596596 employee to accept a birth certificate issued by a county as a
597597 primary proof of identity shall lose his or her employment.
598598 SECTION 2. This act shall become effective November 1, 2025.
