81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 19 O.S. 2021, Section 326, is
83	83	amended to read as follows:
84	84	Section 326. A. In addition to the special sessions for
85	85	equalizing assessments, and all other special sessions now provide d
86	86	by law, the county commissioners shall meet and hold sessions for
87	87	the transaction of business in the county courthouse, at the county
88	88	seat, on or before the first Monday of each month, and may remain in
89	89	session as long as the public business may require, and the passing
90	90	upon, allowing or rejecting of bills against the county shall be

142	142	taken up and passed upon by the board in the order in which the
143	143	claims have been filed, and in which order such claims must be
144	144	entered upon the calendar, except salary, wage and compensation
145	145	claims of officers and deputies and employees, which salary, wage
146	146	and compensation claims may be considered and paid, on or after the
147	147	termination of the service pay period; provided, that such claims by
148	148	subordinate deputies and employees b e first approved by the officer
149	149	having charge of the office or department. The board of county
150	150	commissioners may recess or adjourn its meetings within the session,
151	151	either from time to time or from day to day, or on call of the
152	152	chairman chair; but, if such board does not sooner adjourn its
153	153	session for any month, such session shall t erminate and be adjourned
154	154	by operation of law on the last business day of such month. If the
155	155	board shall have adjourned its session before the last business day
156	156	of any month, the county clerk shall have power to call special
157	157	sessions when the best interests of the county demand it, upon
158	158	giving five (5) days ’ notice of the time and object of calling the
159	159	commissioners together, by posting up notices in three public places
160	160	in the county, or by publication in some newspaper of general
161	161	circulation in the county ; provided, that in the case of a vacancy
162	162	in the office of county clerk, the chairman chair of the board shall
163	163	have power to call a special session for the purpose of filling suc h
164	164	vacancy.

216	216	B. The board of county commissioners may meet at times and in
217	217	places within the county other than the county courthouse if it is
218	218	determined that such meetings are beneficial to the general public.
219	219	Such meetings shall be in compliance with the Oklahoma Open Meeting
220	220	Act.
221	221	C. County commissioners may discuss administrative ,
222	222	operational, and procedural matters of the board , even when a quorum
223	223	of the board is present, provided that the discussion d oes not
224	224	address the appropriation of county funds , except as provided for in
225	225	subsection F of this section, and the board takes no official
226	226	action. Such discussion shall not be subject to the provisions of
227	227	the Oklahoma Open Meeting Act. Such discussion shall be limited to:
228	228	1. The scheduling of agenda item s to be set before the board of
229	229	county commissioners for an emergency, regular , or special meeting;
230	230	2. Public and media statements;
231	231	3. Organizational structure;
232	232	4. Internal processes;
233	233	5. Staffing needs; and
234	234	6. The receipt of reports from county employ ees.
235	235	D. County commissioners may conduct regular meetings with
236	236	county employees which discuss the management of the county. Such
237	237	meetings shall not be subject to the provisions of the Oklahoma Open
238	238	Meeting Act.

291	291	participate in conferences ; training; and educational, press, and
292	292	social events, even if a quorum is present at such event. The
293	293	county commissioners may discuss the business of the county at such
294	294	event, provided that the board takes no official action.
295	295	F. In counties that have a county budget board as provided in
296	296	Section 1407 of this title, county commissioners and other elected
297	297	officials of the county may discuss budgetary matters, provided that
298	298	a quorum of the county budget board is not prese nt and the board
299	299	takes no official action.
300	300	SECTION 2. AMENDATORY 25 O.S. 2021, Section 304, as last
301	301	amended by Section 3, Chapter 237, O.S.L. 2024 (25 O.S. Supp. 2024,
302	302	Section 304), is amended to read as follows:
303	303	Section 304. As used in the Oklahoma Open Meeting Act:
304	304	1. “Public body” means the governing bodies of all
305	305	municipalities located within this state, boards of county
306	306	commissioners of the counties in this state, boards of public and
307	307	higher education in this state and all b oards, bureaus, commissions,
308	308	agencies, trusteeships, authorities, councils, co mmittees, public
309	309	trusts or any entity created by a public trust including any
310	310	committee or subcommittee composed of any of the members of a public
311	311	trust or other legal entity rec eiving funds from the Rural Economic
312	312	Action Plan Fund as authorized by Section 2007 of Title 62 of the
313	313	Oklahoma Statutes, task forces or study groups in this state

367	367	shall include all committees or subco mmittees of any public body.
368	368	Public body shall not include :
369	369	a. the state judiciary,
370	370	b. the Council on Judicial Complaints when conducting,
371	371	discussing, or deliberating any matter relating to a
372	372	complaint received or filed with the Council,
373	373	c. the Legislature, or
374	374	d. administrative staffs of public bodies including, but
375	375	not limited to, faculty meetings and athletic staff
376	376	meetings of institutions of higher education when
377	377	those staffs are not meeting with the public body, or
378	378	entry-year assistance committees . Furthermore, public
379	379	body shall not include the ,
380	380	e. multidisciplinary teams provided for in Section 1 -9-
381	381	102 of Title 10A of the Oklahoma Statutes, in Section
382	382	10-115 of Title 43A of the Oklahoma Statutes, and in
383	383	subsection C of Section 1 -502.2 of Title 63 of the
384	384	Oklahoma Statutes or any school board meeting for the
385	385	sole purpose of considering recommendations of a
386	386	multidisciplinary team and deciding the placement of
387	387	any child who is the subject of the recommendations .
388	388	Furthermore, public body shall not include ,

441	441	Oklahoma Horse Racing Commission pursuant to Section
442	442	203.4 of Title 3A of the Oklahoma Statutes when the
443	443	stewards are officia ting at races or otherwise
444	444	enforcing rules of the Commission . Furthermore,
445	445	public body shall not include ,
446	446	g. the board of directors of a Federally Qualified Health
447	447	Center or the postadjudication review boards provided
448	448	for in Sections 1116.2 and 1116.3 of Title 10 of the
449	449	Oklahoma Statutes, or
450	450	h. boards of county commissioners for the purposes set
451	451	forth in Section 326 of Title 19 of the Oklahoma
452	452	Statutes;
453	453	2. “Meeting” means the conduct of business of a public body by
454	454	a majority of its members being personal ly together or, as
455	455	authorized by Section 307.1 of this title, together pursuant to a
456	456	videoconference. Meeting shall not include informal gatherings of a
457	457	majority of the members of the public body when no business of the
458	458	public body is discussed;
459	459	3. “Regularly scheduled meeting ” means a meeting at which the
460	460	regular business of the public body is conducted;
461	461	4. “Special meeting” means any meeting of a public body other
462	462	than a regularly scheduled meeting or emergency meeting;

514	514	5. “Emergency meeting” means any meeting called for the purpose
515	515	of dealing with an emergency. For purposes of the Oklahoma Open
516	516	Meeting Act, an emergency is defined as a situation involving injury
517	517	to persons or injury and damage to public or personal property or
518	518	immediate financial los s when the time requirements for public
519	519	notice of a special meeting would make such procedure impractical
520	520	and increase the likelihood of injury or damage or immediate
521	521	financial loss;
522	522	6. “Continued or reconvened meeting ” means a meeting which is
523	523	assembled for the purpose of finishing business appearing on an
524	524	agenda of a previous meeting. For the purposes of the Oklahoma Open
525	525	Meeting Act, only matters on the agenda of the previous meeting at
526	526	which the announcement of the continuance is made may be discussed
527	527	at a continued or reconvened meeting;
528	528	7. “Videoconference” means a conference among members of a
529	529	public body remote from one another who are linked by interactive
530	530	telecommunication devices or technology , and/or or technology
531	531	permitting both visual and au ditory communication between and among
532	532	members of the public body and/or or between and among members of
533	533	the public body and members of the public. During any
534	534	videoconference, both the visual and auditory communications
535	535	functions shall attempt to be utili zed; and
536	536	8. “Teleconference” means a conference among members of a
537	537	public body remote from one another who are linked by
