3965 An Act relating to driver education; amending 47 O.S.
4066 2021, Section 804, as amended by Section 28, Chapter
4167 310, O.S.L. 2023 (47 O.S. Sup p. 2024, Section 804),
4268 which relates to instructor ’s license qualifications;
4369 requiring Service Oklahoma to promulgate certain
4470 rules; and declaring an emergency .

4975 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5076 SECTION 1. AMENDATORY 47 O.S. 2021, Section 804, as
5177 amended by Section 28, Chapte r 310, O.S.L. 2023 (47 O.S. Supp. 2024,
5278 Section 804), is amended to read as follows:
5379 Section 804. A. No person shall act as an instructor unless
5480 such person applies for and obt ains from Service Oklahoma a license
5581 in the manner and form prescribed by Service Oklahoma.
5682 B. Rules promulgated by Service Oklahoma, in conjunction with
5783 the Department of Public Safety, shall state the requirements for an
5884 instructor’s license, including requirements concerning moral
5985 character, physical condition, knowledge of the courses of
6086 instruction, motor vehicle laws and safety principles and practices,
6187 previous personnel and employment records, and such other matters as

89139 Service Oklahoma, in conjunct ion with the Department of Public
90140 Safety, may prescribe for the protection of the public.
91141 C. Service Oklahoma, in conjunction with the State Department
92142 of Rehabilitation Services, shall promulgate rules to allow a person
93143 to act as an instructor for an ind ividual who, due to injury,
94144 disability, or other circumstance, is unable to op erate an
95145 unmodified motor vehicle and must operate a modified motor vehicle
96146 that accommodates such injury, disability, or other circumstance.
97147 SECTION 2. It being immediately necessary for the preservation
98148 of the public peace, health or safety, an emergency is hereby
99149 declared to exist, by reason whereof this act shall take effect and
100150 be in full force from and after its passage and approval.
