7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 74 O.S. 2021, Section 20j, is
8181 amended to read as follows:
8282 Section 20j. A. The Attorney General is authorized and
8383 directed to negotiate the terms of a Memorandum of Understanding
8484 between the State of Oklahoma and the United States Department of
8585 Justice or the United States Department of Homeland Security, as
8686 provided by Section 1357(g) of Title 8 of the United States Code,
8787 concerning the enforcement of federal immigration and customs laws,
8888 detention and removals, and investigations in the State of Oklahoma

141141 B. The Memorandum of Understanding negotiated pursuant to
142142 subsection A of this section shall be signed on behalf of this state
143143 by the Attorney General and the Governor or as otherwise required by
144144 the appropriate federal agency.
145145 C. No political subdivision or agency of the state or any local
146146 government, whether acting through its governing body or by an
147147 initiative, referendum, or any other process, shall enact or adopt
148148 any ordinance, sanctuary policy, or other policy that limits or
149149 prohibits a law enforcement officer, local government official, or
150150 local government employee from communicating or cooperating with
151151 federal officials with regard to the immigration status of any
152152 person within this state. For the purposes of this section,
153153 “sanctuary policy” includes, but is not limited to, any ordinance or
154154 policy that:
155155 1. Restricts or imposes conditions on compliance with a
156156 detainer or other request from United States Immigration and Customs
157157 Enforcement to maintain custody of an undocumented alien or to
158158 transfer custody of an undocumented alien to the United States
159159 Immigration and Customs Enforcement;
160160 2. Requires United States Immigration and Customs Enforcement
161161 to obtain a warrant or court order before compliance with a detainer
162162 or other request;
163163 3. Prevents a law enforcement officer from inquiries to a
164164 person about his or her immigration status when specific and

216216 articulable facts su pport probable cause that the person is an
217217 undocumented alien; or
218218 4. Knowingly provides special benefits, privileges, or support
219219 to an undocumented alien.
220220 D. Notwithstanding an y other provision of law, no government
221221 entity or official within the State of Oklahoma this state may
222222 prohibit, or in any way restrict, any government entity or official
223223 from sending to, or receiving from, the United States Department of
224224 Homeland Security, information regarding the citizenship or
225225 immigration status, lawful or unlaw ful, of any individual.
226226 E. Notwithstanding any other provision of law, no person or
227227 agency may prohibit, or in any way restrict, a public employee from
228228 doing any of the followin g with respect to information regarding the
229229 immigration status, lawful or unlawful, of any individual:
230230 1. Sending such information to, or requesting or receiving such
231231 information from, the United States Department of Homeland Security;
232232 2. Maintaining such information; or
233233 3. Exchanging such information with any other federal, stat e,
234234 or local government entity.
235235 F. Upon request for an opinion pursuant to paragraph 5 of
236236 subsection A of Section 18b of this title, the Attorney General
237237 shall determine whether an ordinance or policy is in violation of
238238 this section. A political subdivision or agency of the state or any
239239 local government that enacts or adopts any ordinance, sanctuary

291291 policy, or other policy in violation of this section shall be
292292 ineligible to receive any state appropriation or funding through a
293293 grant administered by any stat e agency or department until such
294294 ordinance or policy is repealed or no longer in effect.
295295 G. The provisions of this section shall allow for a private
296296 right of action by any natu ral or legal person lawfully domiciled in
297297 this state to file for a writ of mandamus to compel any
298298 noncooperating local or state governmental agency or political
299299 subdivision to comply with such reporting laws.
300300 H. An elected or appointed official who willfu lly violates the
301301 provisions of this section shall be subject to removal for of ficial
302302 misconduct pursuant to Section 93 of Title 51 of the Oklahoma
303303 Statutes.
304304 SECTION 2. This act shall become effective November 1, 2025.
