59 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

60 | 53 | | SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, as last |
---|
61 | 54 | | amended by Section 3, Chapter 180, O.S.L. 2024 (25 O.S. Supp. 2024, |

62 | 55 | | Section 307), is amended to read as follows: |

63 | 56 | | Section 307. A. No public body shall hold executive sessions |
---|
64 | 57 | | unless otherwise specifically provided in this section. |
---|
65 | 58 | | B. Executive sessions of public bodies will be permitted only |
---|
66 | 59 | | for the purpose of: |
---|
97 | 89 | | 2. Discussing negotiations concerning employees and |
---|
98 | 90 | | representatives of employee groups; |
---|
99 | 91 | | 3. Discussing the sale, purchase, lease, acquisition, or |
---|
100 | 92 | | appraisal of real property by the public body; |

101 | 93 | | 4. Confidential communications between a public body and its |

102 | 94 | | attorney concerning a pending investigation, claim, or action if the |
---|
103 | 95 | | public body, with the advice of its attorney, determines th at |

105 | 97 | | process the claim or conduct a pending investigation, litigation, or |
---|
106 | 98 | | proceeding in the public interest; |

108 | 100 | | discuss the expulsion or suspension of a student when requested by |
---|
109 | 101 | | the student involved or the student ’s parent, attorney or legal |
---|
110 | 102 | | guardian; |

111 | 103 | | 6. Discussing matters involving a specific disabled child; |
---|
112 | 104 | | 7. Discussing any matter where disclosure of information would |
---|
113 | 105 | | violate confidentiality requiremen ts of state or federal law; |
---|
114 | 106 | | 8. Engaging in deliberations or rendering a final or |
---|
115 | 107 | | intermediate decision in an individual proceeding pursuant to |
---|
116 | 108 | | Article II of the Administrative Procedures Act; |
---|
147 | 138 | | 10. Discussing contract negotiations involving contracts |

148 | 139 | | requiring approval of the State Board of Corrections, which shall be |
---|
149 | 140 | | limited to members of the pub lic body, the attorney for the public |
---|

160 | 151 | | c. plans for deterrence or prevention of or protectio n |

161 | 152 | | from an act of terrorism , |
---|
162 | 153 | | d. plans for response or remediation after an act of |
---|
163 | 154 | | terrorism, |
---|
164 | 155 | | e. information technology of the public body but only if |
---|
165 | 156 | | the discussion specifically identifies: |

207 | 197 | | f. the investigation of an act of terrorism that has |

209 | 199 | | g. for the purposes of this paragraph, the term |
---|
210 | 200 | | “terrorism” means any act encompassed by the |
---|
211 | 201 | | definitions set forth in Section 1268.1 of Title 21 of |
---|
212 | 202 | | the Oklahoma Statutes; or |
---|
213 | 203 | | 12. Reviewing and discussing mental health documents related to |
---|
214 | 204 | | a licensee under investigation or review by a professional licensing |
---|
215 | 205 | | board if: |
---|
248 | 237 | | b. the documents reviewed or discussed are kept |
---|
249 | 238 | | confidential, privileged and not discoverable in civil |
---|
250 | 239 | | actions, and not made available to the public, and |
---|
251 | 240 | | c. the licensee is given the opportuni ty to be present |
---|
252 | 241 | | during any witness testimony or discussion of the |
---|
253 | 242 | | mental health documents. |
---|
254 | 243 | | C. Notwithstanding the provisions of subsection B of this |
---|
255 | 244 | | section, the following public bodies may hold executive sessions: |

256 | 245 | | 1. The Banking Board, as provided for under Section 306.1 of |
---|
257 | 246 | | Title 6 of the Oklahoma Statutes; |
---|
258 | 247 | | 2. The Oklahoma Industrial Finance Authority, as provided for |
---|
259 | 248 | | in Section 854 of Title 74 of the Oklahoma Statutes; |
---|
260 | 249 | | 3. The Oklahoma Development Finance Authority, as provided for |
---|
261 | 250 | | in Section 5062.6 of Title 74 of the Oklahoma Statutes; |
---|
262 | 251 | | 4. The Oklahoma Center for the Advancement of Science and |
---|
263 | 252 | | Technology, as provided for in Section 5060.7 of Title 74 of the |
---|
264 | 253 | | Oklahoma Statutes; |
---|
265 | 254 | | 5. The Oklahoma Health Research Committee for purposes of |
---|
266 | 255 | | conferring on matters pertaining to research and development of |
---|

303 | 291 | | conferring on matters pertaining to m aterials declared confidential |
---|

305 | 293 | | 9. The Domestic Violence Fatality Review Board as provided in |

306 | 294 | | Section 1601 of Title 22 of the Oklahoma Statutes; |
---|
307 | 295 | | 10. The Opioid Overdose Fatality Review Board, as provided in |
---|
308 | 296 | | Section 2-1001 of Title 63 of the Oklaho ma Statutes; |
---|
309 | 297 | | 11. All nonprofit foundations, boards, bureaus, commissions, |
---|
310 | 298 | | agencies, trusteeships, authorities, councils, committees, public |
---|
311 | 299 | | trusts, task forces or study groups supported in whole or part by |
---|
312 | 300 | | public funds or entrusted with the expenditure of public funds for |
---|
313 | 301 | | purposes of conferring on matters pertaining to economic development |
---|
314 | 302 | | including the transfer of property, financing, or the creation of a |
---|
315 | 303 | | proposal to entice a business to remain or to locate within their |
---|
316 | 304 | | jurisdiction if public disclosure o f the matter discussed wou ld |
---|
348 | 335 | | counteroffers to offers to contract to provide legal representation |
---|
349 | 336 | | to indigent criminal defendants and indigent juveniles in cases for |
---|
350 | 337 | | which the System must provide representation pursuant to the |
---|
351 | 338 | | provisions of the Indig ent Defense Act; |
---|
352 | 339 | | 13. The Quality Investment Committee for purposes of discussing |
---|
353 | 340 | | applications and confidential materials pursuant to the terms of the |
---|
354 | 341 | | Oklahoma Quality Investment Act; |
---|
355 | 342 | | 14. The Oklahoma Municipal Power Authority established pursuant |
---|
356 | 343 | | to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and |
---|
357 | 344 | | in its role as an electric utility regulated by the federal |
---|
358 | 345 | | government, for purposes of discussing security plans and procedures |
---|
359 | 346 | | including, but not limited to, cybersecurity matters; |
---|
360 | 347 | | 15. The Oklahoma Tax Commission for pu rposes of discussing |
---|
361 | 348 | | confidential taxpayer matters as provided in Section 205 of Title 68 |
---|
362 | 349 | | of the Oklahoma Statutes, and in compliance with subsection E of |
---|
363 | 350 | | this section; and |
---|
364 | 351 | | 16. The Sexual Assault Forensic Evidence (SAFE) Board as |
---|
365 | 352 | | provided in Section 1 143 of this act Title 21 of the Oklahoma |
---|
366 | 353 | | Statutes. |
---|

402 | 388 | | in the executive session, unless they are operating under an |
---|
403 | 389 | | existing agreement to represent the public body. |
---|
404 | 390 | | E. No public body may go into an executive session unless the |
---|
405 | 391 | | following procedures are strictly complied with: |
---|
406 | 392 | | 1. The proposed executive session is noted on the agenda as |
---|
407 | 393 | | provided in Section 311 of this title; |
---|
408 | 394 | | 2. The executive session is authorized by a majority vote of a |
---|
409 | 395 | | quorum of the members present and the vote is a recorded vote; and |
---|
410 | 396 | | 3. Except for matters considered in executive sessions of the |
---|
411 | 397 | | Banking Board and the Oklahoma Tax Commission, and which are |
---|
412 | 398 | | required by state or federal law to be confidential, any vote or |
---|
413 | 399 | | action on any item of business conside red in an executive sessio n |
---|
414 | 400 | | shall be taken in public meeting with the vote of each member |
---|
415 | 401 | | publicly cast and recorded. |
---|
416 | 402 | | F. A willful violation of the provisions of this section shall: |
