5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6053 SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, as last
6154 amended by Section 3, Chapter 180, O.S.L. 2024 (25 O.S. Supp. 2024,
6255 Section 307), is amended to read as follows:
6356 Section 307. A. No public body shall hold executive sessions
6457 unless otherwise specifically provided in this section.
6558 B. Executive sessions of public bodies will be permitted only
6659 for the purpose of:
60+1. Discussing the employmen t, hiring, appointment, pr omotion,
61+demotion, disciplining or resignation of any individual salaried
62+public officer or employee;

10193 4. Confidential communications between a public body and its
10294 attorney concerning a pending investigation, claim, or action if the
10395 public body, with the advice of its attorney, determines th at
10496 disclosure will serious ly impair the ability of the public body to

113105 violate confidentiality requiremen ts of state or federal law;

144-9. Discussing matters involving safety and security at state
145-penal institutions or correctional facilities used to house state
146-inmates;
147138 10. Discussing contract negotiations involving contracts
148139 requiring approval of the State Board of Corrections, which shall be
149140 limited to members of the pub lic body, the attorney for the public
150141 body, and the immediate staff of the public body. No person who may
151142 profit directly or indirectly by a proposed transaction which is
152143 under consideration may be present or participate in the executive
153144 session;
154145 11. Discussing the following:
155146 a. the investigation of a plan or scheme to commit an act
156147 of terrorism,
157148 b. assessments of the vulnerability of government
158149 facilities or public improvements to an act of
159150 terrorism,

195-or systems,
196-(2) system configuration information,
197187 (3) security monitoring and response equipment

199189 (4) specific location or placement of systems,
200190 components or devices,
201191 (5) system identification numbers, names, or
202192 connecting circuits,
203193 (6) business continuity and disaster planning, or
204194 response plans, or
205195 (7) investigation information directly related to
206196 security penetrations or denial of services,
207197 f. the investigation of an act of terrorism that has
208198 already been committed, or
209199 g. for the purposes of this paragraph, the term
210200 “terrorism” means any act encompassed by the
211201 definitions set forth in Section 1268.1 of Title 21 of
212202 the Oklahoma Statutes; or
213203 12. Reviewing and discussing mental health documents related to
214204 a licensee under investigation or review by a professional licensing
215205 board if:
206+a. the executive session is held only to review or
207+discuss mental health documents directly related to
208+the licensee or to receive testimony from relevant
209+witnesses as necessary for the board to make a
210+determination in the matter,

243-a. the executive session is held only to review or
244-discuss mental health documents directly related to
245-the licensee or to receive testimony from relevant
246-witnesses as necessary for the board to make a
247-determination in the matter,
248237 b. the documents reviewed or discussed are kept
249238 confidential, privileged and not discoverable in civil
250239 actions, and not made available to the public, and
251240 c. the licensee is given the opportuni ty to be present
252241 during any witness testimony or discussion of the
253242 mental health documents.
254243 C. Notwithstanding the provisions of subsection B of this
255244 section, the following public bodies may hold executive sessions:
256245 1. The Banking Board, as provided for under Section 306.1 of
257246 Title 6 of the Oklahoma Statutes;
258247 2. The Oklahoma Industrial Finance Authority, as provided for
259248 in Section 854 of Title 74 of the Oklahoma Statutes;
260249 3. The Oklahoma Development Finance Authority, as provided for
261250 in Section 5062.6 of Title 74 of the Oklahoma Statutes;
262251 4. The Oklahoma Center for the Advancement of Science and
263252 Technology, as provided for in Section 5060.7 of Title 74 of the
264253 Oklahoma Statutes;
265254 5. The Oklahoma Health Research Committee for purposes of
266255 conferring on matters pertaining to research and development of
256+products, if public disclosure of the matter discussed would
257+interfere with the development of patents, copyrights, products, or
258+services;

297285 6. The Oklahoma Workers ’ Compensation Commission for the
298286 purposes provided for in Section 22 of Title 85A of the Oklahoma
299287 Statutes;
300288 7. A review committee, as provided for in Section 855 of Title
301289 62 of the Oklahoma Statutes;
302290 8. The Child Death Review Board for purposes of receiving and
303291 conferring on matters pertaining to m aterials declared confidential
304292 by law;
305293 9. The Domestic Violence Fatality Review Board as provided in
306294 Section 1601 of Title 22 of the Oklahoma Statutes;
307295 10. The Opioid Overdose Fatality Review Board, as provided in
308296 Section 2-1001 of Title 63 of the Oklaho ma Statutes;
309297 11. All nonprofit foundations, boards, bureaus, commissions,
310298 agencies, trusteeships, authorities, councils, committees, public
311299 trusts, task forces or study groups supported in whole or part by
312300 public funds or entrusted with the expenditure of public funds for
313301 purposes of conferring on matters pertaining to economic development
314302 including the transfer of property, financing, or the creation of a
315303 proposal to entice a business to remain or to locate within their
316304 jurisdiction if public disclosure o f the matter discussed wou ld
305+interfere with the development of products or services or if public
306+disclosure would violate the confidentiality of the business;
307+12. The Oklahoma Indigent Defense System Board for purposes of
308+discussing negotiating strategies in connection with making possible

344-interfere with the development of products or services or if public
345-disclosure would violate the confidentiality of the bu siness;
346-12. The Oklahoma Indigent Defense System Board for purposes of
347-discussing negotiating strategies in connection with making possible
348335 counteroffers to offers to contract to provide legal representation
349336 to indigent criminal defendants and indigent juveniles in cases for
350337 which the System must provide representation pursuant to the
351338 provisions of the Indig ent Defense Act;
352339 13. The Quality Investment Committee for purposes of discussing
353340 applications and confidential materials pursuant to the terms of the
354341 Oklahoma Quality Investment Act;
355342 14. The Oklahoma Municipal Power Authority established pursuant
356343 to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and
357344 in its role as an electric utility regulated by the federal
358345 government, for purposes of discussing security plans and procedures
359346 including, but not limited to, cybersecurity matters;
360347 15. The Oklahoma Tax Commission for pu rposes of discussing
361348 confidential taxpayer matters as provided in Section 205 of Title 68
362349 of the Oklahoma Statutes, and in compliance with subsection E of
363350 this section; and
364351 16. The Sexual Assault Forensic Evidence (SAFE) Board as
365352 provided in Section 1 143 of this act Title 21 of the Oklahoma
366353 Statutes.
354+D. Except as otherwise specified in this subsection, an
355+executive session for the purpose of discussing the sale, purchase,
356+lease, acquisition, or appraisal of real property shall b e limited
357+to members of the public body, the attorney for the public body and

394-D. Except as otherwise specified in this subsection, an
395-executive session fo r the purpose of discussing the sale, purchase,
396-lease, acquisition, or appraisal of real property shall b e limited
397-to members of the public body, the attorney for the public body and
398-the immediate staff of the public body. No landowner, real estate
399385 salesperson, broker, developer or any other person who may profit
400386 directly or indirectly by a proposed transact ion concerning real
401387 property which is under consideration may be present or participate
402388 in the executive session, unless they are operating under an
403389 existing agreement to represent the public body.
404390 E. No public body may go into an executive session unless the
405391 following procedures are strictly complied with:
406392 1. The proposed executive session is noted on the agenda as
407393 provided in Section 311 of this title;
408394 2. The executive session is authorized by a majority vote of a
409395 quorum of the members present and the vote is a recorded vote; and
410396 3. Except for matters considered in executive sessions of the
411397 Banking Board and the Oklahoma Tax Commission, and which are
412398 required by state or federal law to be confidential, any vote or
413399 action on any item of business conside red in an executive sessio n
414400 shall be taken in public meeting with the vote of each member
415401 publicly cast and recorded.
416402 F. A willful violation of the provisions of this section shall:
403+1. Subject each member of the public body to criminal sanctions
404+as provided in Section 314 of this title; and
405+2. Cause the minutes and all other records of the executive
406+session including tape recordings, to be immediately made public.
407+SECTION 2. This act shall become effective November 1, 2025.
