8787 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8888 SECTION 1. AMENDATORY 69 O.S. 2021, Section 1705, is
8989 amended to read as follows:
9090 Section 1705. The Oklahoma Turnpike Authority is hereby
9191 authorized and empowered:
9292 (a) To adopt bylaws for the regulation of its affairs and
9393 conduct of its business.

145145 (b) To adopt an official seal and alter the same at pleasure.
146146 (c) To maintain an office at such place or places within the
147147 state as it may designate.
148148 (d) To sue and be sued in contract, reverse condemnation,
149149 equity, mandamus, and similar actions in its own name, plead and be
150150 impleaded; provided, that any and all actions at law or in equity
151151 against the Authority shall be brought in the county in which the
152152 principal office of the Authority shall be located, or in the county
153153 of the residence of the plaintiff, or the county where the cause of
154154 action arose. All privileges granted to the Authority and duties
155155 enjoined upon the Authority by the provisions of Sections 1701
156156 through 1734 1736 of this title may be enforced in a court of
157157 competent jurisdiction in an action in mandamus.
158158 (e) To construct, maintain, repair , and operate turnpike
159159 projects and highways, wit h their access and connecting roads, at
160160 such locations and on such routes as it shall determine to be
161161 feasible and economically sound; provided, that until specifically
162162 authorized by the Legislature, the Authority shall be authorized to
163163 construct and operate toll turnpikes only at the following
164164 locations:
165165 (1) The Turner Turnpike between Oklahoma City and Tulsa.
166166 (2) The Southwestern (H.E. Bailey) Turnpike between Oklahoma
167167 City and Wichita Falls, Texas.

233233 Hot Springs, Texarkana, Shreveport , and New Orleans.
234234 (8) A tollgate on the Turner Turnpike in the vicinity of
235235 Luther, Oklahoma, and in the vicinity of the intersection of State
236236 Highway 33 and Turner Turnpi ke in Creek County, Oklahoma, or in the
237237 vicinity of the intersection of State Highway 33 and Turner Turnpike
238238 or U.S. Highway 66 in Creek County, Oklahoma, from any monies
239239 available to the Authority.
240240 (9) Add on the Will Rogers Turnpike a northbound automat ic
241241 tollgate onto State Highway 28 and a southbound on -ramp from State
242242 Highway 28.

311311 and Will Rogers World Airport Complex in the south and southwest
312312 parts of Oklahoma City.
313313 (13) A turnpike (The I ndustrial Parkway) or any part or parts
314314 thereof beginning at a point on the Ok lahoma-Kansas state boundary
315315 line between the point where U.S. Highway 66 intersects the boundary
316316 line and the northeast corner of Oklahoma and ending by means of a
317317 connection or connections with Shreveport, Louisiana, and Houston,

388388 (19) A tollgate on the Muskogee Turnpike in the vicinity of
389389 Brushy Mountain, Oklahoma, and in the vicinity of Elm Grove,

462462 the connection between State Highway 33 and U.S. Highway 69 easterly

464464 (24) A four-lane extension of the Muskogee Turnpike from
465465 Interstate Highway 40 west of Webbers Falls to the Poteau vicinity.
466466 (25) A new turnpike or any part or parts thereof beginning at a

530530 farthest western reach within the bounds of Oklahoma of U.S. Highway
531531 70 creating a southern route throug h Oklahoma.
532532 (28) A new turnpike and bridge or any parts thereof from a
533533 point in the vicinity of the city intersection of Mustang Interstate
534534 40 and the Kickapoo Turnpike southerly across the South Canadian
535535 River and east of Lake Thunderbird State Park to the H.E. Bailey
536536 Turnpike in the vicinity of the city town of Tuttle Etowah; and then
537537 easterly across the South Canadian River westerly to a point in the
538538 vicinity of the city City of Norman Slaughterville. Such turnpike
539539 and bridge or any parts thereof shall not be placed west of Lake
540540 Thunderbird State Park .
541541 (29) A new turnpike or any parts thereof beginning at a point
542542 in the vicinity of the city City of Altus and extending in a

596596 (30) A new turnpike or any parts thereof beginning at a point
597597 in the vicinity of the city City of Enid and extending in a westerly
598598 direction to a point in the vicinity of the city City of Woodward.
599599 (31) An on- and off-ramp or any parts thereof at Fletcher,
600600 Oklahoma, in the vicinity of the Interstate 44 and State Highway 277
601601 intersection. Any existing on - or off-ramp or any parts thereof in
602602 the vicinity of Fletcher, Oklahoma, shall not be removed and shall
603603 be maintained pursuant to Section 1701 et seq. of t his title.
604604 (32) A new bridge crossing the Arkansas River between South
605605 Delaware Avenue and Memorial Drive in Tulsa County. This project
606606 shall commence upon a determination by the Oklahoma Transportation
607607 Turnpike Authority that such bridge shall be self -sufficient at some
608608 point over a thirty-year time period from the toll charges
609609 associated with the bridge project.
610610 (33) An exit ramp or any parts thereof from the eastbound lane
611611 of the Turner Turnpike at 96th Street in Tulsa.
612612 (34) An on- and off-ramp or any parts thereof on the Cimarron
613613 Turnpike in the vicinity of the northside of t he Glencoe, Oklahoma,
614614 municipal limits.
615615 (35) A new turnpike or any parts thereof beginning at
616616 Interstate 44 at or near its intersection with 49th West Avenue,
617617 past State U.S. Highway 64/412, turning northeasterly, crossing 41st

671671 All access roads, interchanges, or lead roads connecting such
672672 turnpikes with existing highways must be built by funds furnished by
673673 the Authority.
674674 The minimum and maximum wages for the constructio n of the roads,
675675 highways and projects provided for in Sections 1701 through 1734
676676 1736 of this title shall be in accordance with the schedules of
677677 wages used or adopted by the Comm ission in construction of state
678678 highways.
679679 The Authority is hereby authorized to enter into contracts or
680680 agreements with agencies and instrumentalities of other states or
681681 the national government for construction, maintenance , and operation
682682 of interstate turnpikes or highways.
683683 The Authority is hereby required to construct and install
684684 automatic tollgates on the Will Rogers Turnpike at State Highway No.
685685 28 near Adair.
686686 (f) To issue turnpike revenue bonds of the Authority, payable
687687 solely from revenues, including the revenues accruing to the trust
688688 fund created by Sections 1701 through 1734 1736 of this title, for
689689 the purpose of paying all or any part of the cost of any one or more
690690 turnpike projects. Provided that any bonds issued for the
691691 construction of the propo sed turnpike referred to in subparagraphs
692692 (10), (20), (21), and (22) of paragraph (e) of this section shall be

744744 issued as one issue for all four of the proposed turnpikes and shall
745745 be financed, constructed , and operated under one bond indenture.
746746 (g) To fix and revise from time to time tolls for the use of
747747 any turnpike projects.
748748 Any common carrier having authority at the time of opening any
749749 turnpike project to operate upon a highway approximately paralleling
750750 the turnpike project shall be granted without furt her showing
751751 authority to operate over the turnpike project to all municipaliti es
752752 which such carrier is serving at the time the turnpike project is
753753 opened to traffic. But nothing herein shall be construed as
754754 granting any new operation rights to any common carriers.
755755 (h) To acquire, hold, and dispose of real and personal property
756756 in the exercise of its powers and the performance of its duties.
757757 (i) To acquire in the name of the Authority by purchase or
758758 otherwise on such terms and conditions and in such manne r as it may
759759 deem proper, or by exercise of the right of condemnation in manner
760760 hereinafter provided, such public or private lands, including public
761761 parks, playgrounds, or reservations, or parts thereof or rights
762762 therein, rights-of-way, property, rights, ea sements, and interests,
763763 as it may deem necessary for carrying out the provisions of Sections
764764 1701 through 1734 1736 of this title; provided, that all public
765765 property damaged in carrying out the powers granted by Sections 1701
766766 through 1734 1736 of this title shall be restored or repaired and
767767 placed in its original condition as nearly as practicable.

819819 (j) To designate, except as is provided for herein, the
820820 location, and establish, limit , and control such points of ingress
821821 to and egress from each turnpike proj ect as may be necessary or
822822 desirable in the judgment of the Authority to insure the proper
823823 operation and maintenance of such project, and to prohibit entrance
824824 to such project from any point or points not so designated.
825825 (k) To make and enter into all contr acts and agreements
826826 necessary or incidental to the performance of its duties a nd the
827827 execution of its powers, and to employ consulting engineers,
828828 attorneys, accountants, construction and financial experts,
829829 superintendents, managers, and such other employee s and agents as
830830 may be necessary in its judgment, and to fix their compensation;
831831 provided, that all such expenses shall be payable solely from the
832832 proceeds of turnpike revenue bonds issued under the provisions of
833833 Sections 1701 through 1734 1736 of this title or from revenues;
834834 provided, further, no attorney employed by the Authority, nor any
835835 member of any law firm of which the attorney may be connected, shall
836836 ever be paid any fee or compensation for any special or
837837 extraordinary services.
838838 (l) To receive and accept from any federal agency grants for or
839839 in aid of the construction of any turnpike project, provided, the
840840 acceptance of such grants will not reduce the amount of federal aid
841841 for the construction, repair, or maintenance of farm -to-market roads
842842 and other highways and bridges in this state; and to receive and

894894 accept aid or contrib utions from any source of either money,
895895 property, labor, or other things of value, to be held, used, and
896896 applied only for the purposes for which such grants and
897897 contributions may be made.
898898 (m) To adopt such rules, and to do any and all things necessary
899899 to comply with rules, regulations, or requirements of the Bureau of
900900 Public Roads, Multistate Economic Development Regional Commission,
901901 as defined in Sections 1151 through 1153, incl usive, of Title 74 of
902902 the Oklahoma Statutes, Ozarka Region Commission Federal Highway
903903 Administration or any other federal agency administering any law
904904 enacted by the Congress of the United States to aid or encourage the
905905 construction of highways.
906906 (n) To do all things necessary or convenient to carry out the
907907 powers expressly granted in Sections 1701 through 1734 1736 of this
908908 title. The design standards for all paving shall comply with the
909909 design standards of the American Association of State Highway and
910910 Transportation Officials as modified by the Oklahoma Department of
911911 Transportation. All contracts for construction work on turnpike
912912 projects shall be let to the lowest responsible bidder, or bidders,
913913 after notice by publication in a newspaper published in the county
914914 where the work is to be done in two consecutive weekly issues of the
915915 newspaper. In all cases where more than eight (8) miles of
916916 construction is let at the same time and is not an advertisement for
917917 a surface-treatment-only project, such advertiseme nt shall provide

969969 for bids on sections of the turnpike not to exceed eight (8) miles.
970970 If the project advertised is a surface -treatment-only project of
971971 more than twenty (20) miles of road, the advertisement shall provide
972972 for bids on sections of the road no longer than twenty (20) miles,
973973 as well as bids on the project as a whole. Subject to the following
974974 restrictions and limitations, the Authority shall, when contracting
975975 for construction work, divide such work into paving projects, bridge
976976 projects, including underpasses and overpasses, and earthmoving or
977977 miscellaneous projects, accord ing to the type of work to be done.
978978 Each project shall be let under a separate contract or contracts and
979979 no contract or project shall include more than one of such types of
980980 construction work. Each contract for construction work shall
981981 contain a provision that ninety percent (90%) of all labor employed
982982 on the project shall be residents of Oklahoma. However, contracts
983983 for bridges may include earthwork and structures for the approa ches
984984 thereto.
985985 (o) It shall be unlawful for any member, officer or employee of
986986 the Authority to transact with the Authority, either directly or
987987 indirectly, any business for profit of such member, officer, or
988988 employee; and any person, firm, or corporation k nowingly
989989 participating therein shall be equally liable for violation of this
990990 provision.

10421042 The term “business for profit” shall include, but not be limited
10431043 to, the acceptance or payment of any fee, commission, gift, or
10441044 consideration to such member, officer, o r employee.
10451045 Violation of this provision shall constitute a felony punishable
10461046 by incarceration in the State Penitentiary custody of the Department
10471047 of Corrections for a term not to exceed five (5) years or a fine of
10481048 not less than Five Hundred Dollars ($500.0 0) and not more than Five
10491049 Thousand Dollars ($5,000.00), or both such imprisonment and fine.
10501050 (p) In the event of a national emergency, the Authority,
10511051 subject to any vested rights or claims, may enter into contracts
10521052 with the federal government or any author ized agency thereof to
10531053 allow the federal government or agency thereof to use s uch turnpikes
10541054 partly or exclusively during the existence of such emergency,
10551055 provided, that the federal government agrees in such contract to
10561056 pay, during the term of such contract , an amount sufficient, when
10571057 added to any tolls collected, to meet all operating and maintenance
10581058 expenses, interest payments, and the minimum sinking fund and
10591059 reserve requirements of the trust agreement for the turnpike covered
10601060 by the contract.
10611061 (q) All meetings of the Authority shall be open public
10621062 meetings, and all records shall b e public records, except when
10631063 considering personnel or litigation.
10641064 SECTION 2. It being immediately necessary for the preservation
10651065 of the public peace, health or safety, an emergency is hereby
