87	87		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
88	88		SECTION 1. AMENDATORY 69 O.S. 2021, Section 1705, is
89	89		amended to read as follows:
90	90		Section 1705. The Oklahoma Turnpike Authority is hereby
91	91		authorized and empowered:
92	92		(a) To adopt bylaws for the regulation of its affairs and
93	93		conduct of its business.

145	145		(b) To adopt an official seal and alter the same at pleasure.
146	146		(c) To maintain an office at such place or places within the
147	147		state as it may designate.
148	148		(d) To sue and be sued in contract, reverse condemnation,
149	149		equity, mandamus, and similar actions in its own name, plead and be
150	150		impleaded; provided, that any and all actions at law or in equity
151	151		against the Authority shall be brought in the county in which the
152	152		principal office of the Authority shall be located, or in the county
153	153		of the residence of the plaintiff, or the county where the cause of
154	154		action arose. All privileges granted to the Authority and duties
155	155		enjoined upon the Authority by the provisions of Sections 1701
156	156		through 1734 1736 of this title may be enforced in a court of
157	157		competent jurisdiction in an action in mandamus.
158	158		(e) To construct, maintain, repair , and operate turnpike
159	159		projects and highways, wit h their access and connecting roads, at
160	160		such locations and on such routes as it shall determine to be
161	161		feasible and economically sound; provided, that until specifically
162	162		authorized by the Legislature, the Authority shall be authorized to
163	163		construct and operate toll turnpikes only at the following
164	164		locations:
165	165		(1) The Turner Turnpike between Oklahoma City and Tulsa.
166	166		(2) The Southwestern (H.E. Bailey) Turnpike between Oklahoma
167	167		City and Wichita Falls, Texas.

221	221		(4) The Eastern (Indian Nation) Turnpike between Tulsa and
222	222		Paris, Texas, including all or any part thereof between McAlester
223	223		and the Red River south o f Hugo.
224	224		(5) The Cimarron Turnpike between Tulsa and Interstate Highway
225	225		35 north of Perry, including a connection to Stillwater.
226	226		(6) The Muskogee Turnpike between Broken Arrow and Interstate
227	227		Highway 40 west of Webbers Falls.
228	228		(7) All or any part of an ext ension of the Muskogee Turnpike,
229	229		beginning at a point on Interstate Highway 40 near the present south
230	230		terminus of the Muskogee Turnpike, and extending in a southeasterly
231	231		direction on an alignment near Stigler, Poteau , and Heavener to the
232	232		vicinity of the Arkansas State Line state line to furnish access to
233	233		Hot Springs, Texarkana, Shreveport , and New Orleans.
234	234		(8) A tollgate on the Turner Turnpike in the vicinity of
235	235		Luther, Oklahoma, and in the vicinity of the intersection of State
236	236		Highway 33 and Turner Turnpi ke in Creek County, Oklahoma, or in the
237	237		vicinity of the intersection of State Highway 33 and Turner Turnpike
238	238		or U.S. Highway 66 in Creek County, Oklahoma, from any monies
239	239		available to the Authority.
240	240		(9) Add on the Will Rogers Turnpike a northbound automat ic
241	241		tollgate onto State Highway 28 and a southbound on -ramp from State
242	242		Highway 28.

296	296		Davis, and extending in a northeasterly direct ion, by way of the

303	303		Oklahoma state boundary line east of the Arkansas River and west of
304	304		the point where Oklahoma State Highway No. 18 intersects said such
305	305		state boundary line, and extending in a s outheasterly direction to a
306	306		connection with the Tulsa Urban Expressway System in the general
307	307		area of the Port of Catoosa.
308	308		(12) All or any part of an Oklahoma City toll expresswa y system
309	309		connecting the residential, industrial , and State Capitol Complex in
310	310		the north part of Oklahoma City with the residential, industrial ,
311	311		and Will Rogers World Airport Complex in the south and southwest
312	312		parts of Oklahoma City.
313	313		(13) A turnpike (The I ndustrial Parkway) or any part or parts
314	314		thereof beginning at a point on the Ok lahoma-Kansas state boundary
315	315		line between the point where U.S. Highway 66 intersects the boundary
316	316		line and the northeast corner of Oklahoma and ending by means of a
317	317		connection or connections with Shreveport, Louisiana, and Houston,

381	381		Porter, Oklahoma, a tollgate on the Will R ogers Turnpike in the
382	382		vicinity of Adair, Oklahoma, a tollgate on the Turner Tu rnpike in
383	383		the vicinity of Luther, Oklahoma, and a tollgate on the H.E. Bailey
384	384		Turnpike at Elgin, Oklahoma, from any monies available to the
385	385		Authority.
386	386		(18) A tollgate on the Tur ner Turnpike in the vicinity of
387	387		Wellston, Oklahoma, from any monies available to the Authority.
388	388		(19) A tollgate on the Muskogee Turnpike in the vicinity of
389	389		Brushy Mountain, Oklahoma, and in the vicinity of Elm Grove,
390	390		Oklahoma, from any monies available to the Authority.
391	391		(20) All or any part of an Oklahoma City Outer Loop expresswa y
392	392		system beginning in the vicinity of I-35 Interstate 35 and the

454	454		to a connection with the Mingo Valley Expressway; and then south
455	455		and/or or east to a point on the Tulsa -Wagoner County Line county
456	456		line near 131st street Street south in the city City of Broken
457	457		Arrow.
458	458		(22) A new turnpike or any part thereof from near the west gate
459	459		of the Will Rogers T urnpike south to the west end of south Tulsa
460	460		Turnpike at the Tulsa -Wagoner County Line county line.
461	461		(23) A new turnpike or any parts thereof from the vicinity of
462	462		the connection between State Highway 33 and U.S. Highway 69 easterly
463	463		to the Arkansas State Line state line.
464	464		(24) A four-lane extension of the Muskogee Turnpike from
465	465		Interstate Highway 40 west of Webbers Falls to the Poteau vicinity.
466	466		(25) A new turnpike or any part or parts thereof beginning at a
467	467		point in the vicinity of northwest Tulsa, and exte nding in a

527	527		from any monies availabl e to the Authority.
528	528		(27) A new turnpike beginning at a point directly west of the
529	529		Arkansas line and four -laning U.S. Highway 70 from that point to the
530	530		farthest western reach within the bounds of Oklahoma of U.S. Highway
531	531		70 creating a southern route throug h Oklahoma.
532	532		(28) A new turnpike and bridge or any parts thereof from a
533	533		point in the vicinity of the city intersection of Mustang Interstate
534	534		40 and the Kickapoo Turnpike southerly across the South Canadian
535	535		River and east of Lake Thunderbird State Park to the H.E. Bailey
536	536		Turnpike in the vicinity of the city town of Tuttle Etowah; and then
537	537		easterly across the South Canadian River westerly to a point in the
538	538		vicinity of the city City of Norman Slaughterville. Such turnpike
539	539		and bridge or any parts thereof shall not be placed west of Lake
540	540		Thunderbird State Park .
541	541		(29) A new turnpike or any parts thereof beginning at a point
542	542		in the vicinity of the city City of Altus and extending in a

596	596		(30) A new turnpike or any parts thereof beginning at a point
597	597		in the vicinity of the city City of Enid and extending in a westerly
598	598		direction to a point in the vicinity of the city City of Woodward.
599	599		(31) An on- and off-ramp or any parts thereof at Fletcher,
600	600		Oklahoma, in the vicinity of the Interstate 44 and State Highway 277
601	601		intersection. Any existing on - or off-ramp or any parts thereof in
602	602		the vicinity of Fletcher, Oklahoma, shall not be removed and shall
603	603		be maintained pursuant to Section 1701 et seq. of t his title.
604	604		(32) A new bridge crossing the Arkansas River between South
605	605		Delaware Avenue and Memorial Drive in Tulsa County. This project
606	606		shall commence upon a determination by the Oklahoma Transportation
607	607		Turnpike Authority that such bridge shall be self -sufficient at some
608	608		point over a thirty-year time period from the toll charges
609	609		associated with the bridge project.
610	610		(33) An exit ramp or any parts thereof from the eastbound lane
611	611		of the Turner Turnpike at 96th Street in Tulsa.
612	612		(34) An on- and off-ramp or any parts thereof on the Cimarron
613	613		Turnpike in the vicinity of the northside of t he Glencoe, Oklahoma,
614	614		municipal limits.
615	615		(35) A new turnpike or any parts thereof beginning at
616	616		Interstate 44 at or near its intersection with 49th West Avenue,
617	617		past State U.S. Highway 64/412, turning northeasterly, crossing 41st

670	670		in Tulsa, Oklahoma.
671	671		All access roads, interchanges, or lead roads connecting such
672	672		turnpikes with existing highways must be built by funds furnished by
673	673		the Authority.
674	674		The minimum and maximum wages for the constructio n of the roads,
675	675		highways and projects provided for in Sections 1701 through 1734
676	676		1736 of this title shall be in accordance with the schedules of
677	677		wages used or adopted by the Comm ission in construction of state
678	678		highways.
679	679		The Authority is hereby authorized to enter into contracts or
680	680		agreements with agencies and instrumentalities of other states or
681	681		the national government for construction, maintenance , and operation
682	682		of interstate turnpikes or highways.
683	683		The Authority is hereby required to construct and install
684	684		automatic tollgates on the Will Rogers Turnpike at State Highway No.
685	685		28 near Adair.
686	686		(f) To issue turnpike revenue bonds of the Authority, payable
687	687		solely from revenues, including the revenues accruing to the trust
688	688		fund created by Sections 1701 through 1734 1736 of this title, for
689	689		the purpose of paying all or any part of the cost of any one or more
690	690		turnpike projects. Provided that any bonds issued for the
691	691		construction of the propo sed turnpike referred to in subparagraphs
692	692		(10), (20), (21), and (22) of paragraph (e) of this section shall be

744	744		issued as one issue for all four of the proposed turnpikes and shall
745	745		be financed, constructed , and operated under one bond indenture.
746	746		(g) To fix and revise from time to time tolls for the use of
747	747		any turnpike projects.
748	748		Any common carrier having authority at the time of opening any
749	749		turnpike project to operate upon a highway approximately paralleling
750	750		the turnpike project shall be granted without furt her showing
751	751		authority to operate over the turnpike project to all municipaliti es
752	752		which such carrier is serving at the time the turnpike project is
753	753		opened to traffic. But nothing herein shall be construed as
754	754		granting any new operation rights to any common carriers.
755	755		(h) To acquire, hold, and dispose of real and personal property
756	756		in the exercise of its powers and the performance of its duties.
757	757		(i) To acquire in the name of the Authority by purchase or
758	758		otherwise on such terms and conditions and in such manne r as it may
759	759		deem proper, or by exercise of the right of condemnation in manner
760	760		hereinafter provided, such public or private lands, including public
761	761		parks, playgrounds, or reservations, or parts thereof or rights
762	762		therein, rights-of-way, property, rights, ea sements, and interests,
763	763		as it may deem necessary for carrying out the provisions of Sections
764	764		1701 through 1734 1736 of this title; provided, that all public
765	765		property damaged in carrying out the powers granted by Sections 1701
766	766		through 1734 1736 of this title shall be restored or repaired and
767	767		placed in its original condition as nearly as practicable.

819	819		(j) To designate, except as is provided for herein, the
820	820		location, and establish, limit , and control such points of ingress
821	821		to and egress from each turnpike proj ect as may be necessary or
822	822		desirable in the judgment of the Authority to insure the proper
823	823		operation and maintenance of such project, and to prohibit entrance
824	824		to such project from any point or points not so designated.
825	825		(k) To make and enter into all contr acts and agreements
826	826		necessary or incidental to the performance of its duties a nd the
827	827		execution of its powers, and to employ consulting engineers,
828	828		attorneys, accountants, construction and financial experts,
829	829		superintendents, managers, and such other employee s and agents as
830	830		may be necessary in its judgment, and to fix their compensation;
831	831		provided, that all such expenses shall be payable solely from the
832	832		proceeds of turnpike revenue bonds issued under the provisions of
833	833		Sections 1701 through 1734 1736 of this title or from revenues;
834	834		provided, further, no attorney employed by the Authority, nor any
835	835		member of any law firm of which the attorney may be connected, shall
836	836		ever be paid any fee or compensation for any special or
837	837		extraordinary services.
838	838		(l) To receive and accept from any federal agency grants for or

894	894		accept aid or contrib utions from any source of either money,
895	895		property, labor, or other things of value, to be held, used, and
896	896		applied only for the purposes for which such grants and
897	897		contributions may be made.
898	898		(m) To adopt such rules, and to do any and all things necessary
899	899		to comply with rules, regulations, or requirements of the Bureau of
900	900		Public Roads, Multistate Economic Development Regional Commission,
901	901		as defined in Sections 1151 through 1153, incl usive, of Title 74 of
902	902		the Oklahoma Statutes, Ozarka Region Commission Federal Highway
903	903		Administration or any other federal agency administering any law
904	904		enacted by the Congress of the United States to aid or encourage the
905	905		construction of highways.
906	906		(n) To do all things necessary or convenient to carry out the
907	907		powers expressly granted in Sections 1701 through 1734 1736 of this
908	908		title. The design standards for all paving shall comply with the
909	909		design standards of the American Association of State Highway and
910	910		Transportation Officials as modified by the Oklahoma Department of
911	911		Transportation. All contracts for construction work on turnpike
912	912		projects shall be let to the lowest responsible bidder, or bidders,
913	913		after notice by publication in a newspaper published in the county
914	914		where the work is to be done in two consecutive weekly issues of the
915	915		newspaper. In all cases where more than eight (8) miles of
916	916		construction is let at the same time and is not an advertisement for
917	917		a surface-treatment-only project, such advertiseme nt shall provide

969	969		for bids on sections of the turnpike not to exceed eight (8) miles.
970	970		If the project advertised is a surface -treatment-only project of
971	971		more than twenty (20) miles of road, the advertisement shall provide
972	972		for bids on sections of the road no longer than twenty (20) miles,
973	973		as well as bids on the project as a whole. Subject to the following
974	974		restrictions and limitations, the Authority shall, when contracting
975	975		for construction work, divide such work into paving projects, bridge
976	976		projects, including underpasses and overpasses, and earthmoving or
977	977		miscellaneous projects, accord ing to the type of work to be done.
978	978		Each project shall be let under a separate contract or contracts and
979	979		no contract or project shall include more than one of such types of
980	980		construction work. Each contract for construction work shall
981	981		contain a provision that ninety percent (90%) of all labor employed
982	982		on the project shall be residents of Oklahoma. However, contracts
983	983		for bridges may include earthwork and structures for the approa ches
984	984		thereto.
985	985		(o) It shall be unlawful for any member, officer or employee of
986	986		the Authority to transact with the Authority, either directly or
987	987		indirectly, any business for profit of such member, officer, or
988	988		employee; and any person, firm, or corporation k nowingly
989	989		participating therein shall be equally liable for violation of this
990	990		provision.

1042	1042		The term “business for profit” shall include, but not be limited
1043	1043		to, the acceptance or payment of any fee, commission, gift, or
1044	1044		consideration to such member, officer, o r employee.
1045	1045		Violation of this provision shall constitute a felony punishable
1046	1046		by incarceration in the State Penitentiary custody of the Department
1047	1047		of Corrections for a term not to exceed five (5) years or a fine of
1048	1048		not less than Five Hundred Dollars ($500.0 0) and not more than Five
1049	1049		Thousand Dollars ($5,000.00), or both such imprisonment and fine.
1050	1050		(p) In the event of a national emergency, the Authority,
1051	1051		subject to any vested rights or claims, may enter into contracts
1052	1052		with the federal government or any author ized agency thereof to
1053	1053		allow the federal government or agency thereof to use s uch turnpikes
1054	1054		partly or exclusively during the existence of such emergency,
1055	1055		provided, that the federal government agrees in such contract to
1056	1056		pay, during the term of such contract , an amount sufficient, when
1057	1057		added to any tolls collected, to meet all operating and maintenance
1058	1058		expenses, interest payments, and the minimum sinking fund and
1059	1059		reserve requirements of the trust agreement for the turnpike covered
1060	1060		by the contract.
1061	1061		(q) All meetings of the Authority shall be open public
1062	1062		meetings, and all records shall b e public records, except when
1063	1063		considering personnel or litigation.
1064	1064		SECTION 2. It being immediately necessary for the preservation
1065	1065		of the public peace, health or safety, an emergency is hereby
