75	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76		SECTION 1. AMENDATORY 51 O.S. 2021, S ection 152, as last
77	77		amended by Section 111, Chapter 452, O.S.L. 2024 (51 O.S. Supp.
78	78		2024, Section 152), is amended to read as follows:
79	79		Section 152. As used in The Governmental Tort Claims Act:
80	80		1. “Action” means a proceeding in a court of competent
81	81		jurisdiction by which one party brings a suit against another;
82	82		2. “Agency” means any board, commission, committee, department
83	83		or other instrumentality or entity designated to act in behalf of
84	84		the state or a political subdivision;
85	85		3. “Charitable health care pro vider” means a person who is
86	86		licensed, certified, or otherwise authorized by t he laws of this
87	87		state to administer health care in the ordinary course of business

139	139		or the practice of a profession and who provides care to a medically
140	140		indigent person, as define d in paragraph 9 of this section, with no
141	141		expectation of or acceptance of compensation of any kind;
142	142		4. “Claim” means any written demand presented by a claimant or
143	143		the claimant’s authorized representative in accordance with the
144	144		Governmental Tort Claims Act to recover money from the state or
145	145		political subdivision as compensation for an act or omission of a
146	146		political subdivision or the state or an employee;
147	147		5. “Claimant” means the person or the person ’s authorized
148	148		representative who files notice of a claim i n accordance with The
149	149		Governmental Tort Claims Act. Only the following persons and no
150	150		others may be claimants:
151	151		a. any person holding an interest in real or personal
152	152		property which suffers a loss, provided that the claim
153	153		of the person shall be aggregated w ith claims of all
154	154		other persons holding an interest in the property and
155	155		the claims of all other persons which are derivative
156	156		of the loss, and that multiple claimants shall be
157	157		considered a single claimant,
158	158		b. the individual actually involved in the accident or
159	159		occurrence who suffers a loss, provided that the
160	160		individual shall aggregate in the claim the losses of
161	161		all other persons which are derivative of the loss, or

214	214		administrator or a personal representative who shall
215	215		aggregate in the claim all losses of all persons which
216	216		are derivative of the death;
217	217		6. “Community health care provider ” means:
218	218		a. a health care provider who volunteers services at a
219	219		community health center that has been deemed by the
220	220		U.S. Department of Health and Human Services as a
221	221		federally qualified health center as defined by 42
222	222		U.S.C., Section 1396d(l)(2)(B),
223	223		b. a health provider who provides services to an
224	224		organization that has been deemed a federally
225	225		qualified look-alike community health c enter, and
226	226		c. a health care provider who provides services to a
227	227		community health center that has made application to
228	228		the U.S. Department of Health and Human Services for
229	229		approval and deeming as a federally qualified look -
230	230		alike community health center in co mpliance with
231	231		federal application guidance, and has received
232	232		comments from the U.S. Department of Health and Human
233	233		Services as to the status of such application with the
234	234		established intent of resubmitting a modified
235	235		application, or, if denied, a new applic ation, no
236	236		later than six (6) months from the date of the

289	289		Health and Human Services requiring resubmission of a
290	290		new application;
291	291		7. “Employee” means any person who is authorized to act in
292	292		behalf of a political subdivision or the state whether that person
293	293		is acting on a permanent or temporary basis, with or without being
294	294		compensated or on a full -time or part-time basis.
295	295		a. Employee also includes:
296	296		(1) all elected or appointed officers, members of
297	297		governing bodies and other persons designated to
298	298		act for an agency or political subdivision , but
299	299		the term does not mean a person or other legal
300	300		entity while acting in the capacity of an
301	301		independent contractor or an employee of an
302	302		independent contractor,
303	303		(2) from September 1, 1991, through June 30, 1996,
304	304		licensed physicians, licensed osteopathic
305	305		physicians and certified nurse -midwives providing
306	306		prenatal, delivery or infant care services to
307	307		State Department of Health clients pursuant to a
308	308		contract entered into with the St ate Department
309	309		of Health in accordance with paragraph 3 of
310	310		subsection B of Section 1-106 of Title 63 of the
311	311		Oklahoma Statutes but only insofar as services

364	364		the contract and the requirements of Section 1 -
365	365		233 of Title 63 of the Oklahoma Statutes, and
366	366		(3) any volunteer, full-time or part-time firefighter
367	367		when performing duties for a fire department
368	368		provided for in subparagraph j of paragraph 11 of
369	369		this section.
370	370		b. For the purposes of The Governmental Tort Claims Act,
371	371		the following are employees of this state, regardless
372	372		of the place in this state where duties as employees
373	373		are performed:
374	374		(1) physicians acting in an administrative capacity,
375	375		(2) resident physicians and resident interns
376	376		participating in a graduate me dical education
377	377		program of the University of Oklahoma Health
378	378		Sciences Center, the College of Osteopathic
379	379		Medicine of Oklahoma State University, or the
380	380		Department of Mental Health and Substance Abuse
381	381		Services,
382	382		(3) faculty members and staff of the University of
383	383		Oklahoma Health Sciences Center and the College
384	384		of Osteopathic Medicine of Oklahoma State
385	385		University, while engaged in teaching duties,

438	438		administrative capacity as an employee of an
439	439		agency of the State o f Oklahoma,
440	440		(5) physicians who provide medical care to inmates
441	441		pursuant to a contract with the Department of
442	442		Corrections,
443	443		(6) any person who is licensed to practice medicine
444	444		pursuant to Title 59 of the Oklahoma Statutes,
445	445		who is under an administrative prof essional
446	446		services contract with the Oklahoma Health Care
447	447		Authority under the a uspices of the Oklahoma
448	448		Health Care Authority Chief Medical Officer, and
449	449		who is limited to performing administrative
450	450		duties such as professional guidance for medical
451	451		reviews, reimbursement rates, service
452	452		utilization, health care delivery and benefit
453	453		design for the Oklahoma Health Care Authority,
454	454		only while acting within the scope of such
455	455		contract,
456	456		(7) licensed medical professionals under contract
457	457		with city, county, or state entiti es who provide
458	458		medical care to inmates or detainees in the
459	459		custody or control of law enforcement agencies,

512	512		in Sections 1-103 and 5-502 of Title 43A of the
513	513		Oklahoma Statutes, who are conducting initial
514	514		examinations of individuals for the purpose of
515	515		determining whether an individual meets the
516	516		criteria for emergency detention as part of a
517	517		contract with the Department of Mental Health and
518	518		Substance Abuse Services, and
519	519		(9) licensed mental health professionals a s defined
520	520		in Sections 1-103 and 5-502 of Title 43A of the
521	521		Oklahoma Statutes, w ho are providing mental
522	522		health or substance abuse treatment services
523	523		under a professional services contract with the
524	524		Department of Mental Health and Substance Abuse
525	525		Services and are providing such treatment
526	526		services at a state-operated facility.
527	527		Physician faculty members and physician staff of the
528	528		University of Oklahoma Health Sciences Center and the
529	529		College of Osteopathic Medicine of Oklahoma State
530	530		University not acting in an adm inistrative capacity or
531	531		engaged in teaching duties are not employees or agents
532	532		of the state.
533	533		c. For the purposes of The Governmental Tort Claims Act,
534	534		employee shall include independent contractors and

587	587		engaged in the transport of individuals in need of
588	588		initial assessment, emergency detention, or protective
589	589		custody as authorized by Section 1 -110 of Title 43A of
590	590		the Oklahoma Statutes.
591	591		d. Except as provided in subparagraph b of this
592	592		paragraph, in no event shal l the state be held liable
593	593		for the tortious conduct of any physician, resident
594	594		physician or intern while practicing medicine or
595	595		providing medical treatment to patients.
596	596		e. For purposes of The Governmental Tort Claims Act,
597	597		members of the state military forc es on state active
598	598		duty orders or on Title 32 active duty orders are
599	599		employees of this state, regardless of the place,
600	600		within or outside this state, where their duties as
601	601		employees are performed;
602	602		8. “Loss” means death or injury to the body or rights of a
603	603		person or damage to real or personal property or rights therein;
604	604		9. “Medically indigent” means a person requiring medically
605	605		necessary hospital or other health care services for the person or
606	606		the dependents of the person who has no public or private third -
607	607		party coverage, and whose personal resources are insufficient to
608	608		provide for needed health care;

660	660		10. “Municipality” means any incorporated city or town, and all
661	661		institutions, agencies or instrumentalities of a municipality;
662	662		11. “Political subdivision ” means:
663	663		a. a municipality,
664	664		b. a school district, including, but not limited to, a
665	665		technology center school district established pursuant
666	666		to Section 4410, 4411, 4420 or 4420.1 of Title 70 of
667	667		the Oklahoma Statutes,
668	668		c. a county,
669	669		d. a public trust where the sole beneficiary or
670	670		beneficiaries are a city, town, school district or
671	671		county. For purposes of The Governmental Tort Claims
672	672		Act, a public trust shall include:
673	673		(1) a municipal hospital created pursuant to Sections
674	674		30-101 through 30-109 of Title 11 of the Oklaho ma
675	675		Statutes, a county hospital created pursuant to
676	676		Sections 781 through 796 of Title 19 of the
677	677		Oklahoma Statutes, or is created pursuant to a
678	678		joint agreement between such governing
679	679		authorities, that is operated for the public
680	680		benefit by a public trust crea ted pursuant to
681	681		Sections 176 through 180.4 of Title 60 of the
682	682		Oklahoma Statutes and managed by a governing
683	683		board appointed or elected by the municipality,

739	739		(2) a public trust created pursuant to Sections 176
740	740		through 180.4 of Title 60 of the Oklahoma
741	741		Statutes after January 1, 2009, the primary
742	742		purpose of which is to own, manage, or operate a
743	743		public acute care hospital in this state that
744	744		serves as a teaching hospital for a medical
745	745		residency program provided by a college of
746	746		osteopathic medicine and provides care to
747	747		indigent persons, and
748	748		(3) a corporation in which all of the capital stock
749	749		is owned, or a limited liability comp any in which
750	750		all of the member interest is owned, by a public
751	751		trust,
752	752		e. for the purposes of The Governmental Tort Claims Act
753	753		only, a housing authority created pursuant to the
754	754		provisions of the Oklahoma Housing Authorities Act,
755	755		f. for the purposes of The Go vernmental Tort Claims Act
756	756		only, corporations organized not for profit pursuant
757	757		to the provisions of the Oklahoma General Corporation
758	758		Act for the primary purpose of developing and

818	818		i. for the purposes of The Governmental Tort Claims Act
819	819		only, a fire protection district created pursuant to
820	820		the provisions of Section 901.1 et seq. of Title 19 of
821	821		the Oklahoma Statutes,
822	822		j. for the purposes of The Governmental Tort Claims Act
823	823		only, a benevolent or charitable corporate volunteer
824	824		or full-time fire department for an unincorporated
825	825		area created pursuant to the provisions of Section 592
826	826		et seq. of Title 18 of the Oklahoma Statutes,
827	827		k. for purposes of The Governmental Tort Claims Act only,
828	828		an Emergency Services Provider rendering services
829	829		within the boundaries of a Supplemental Emergency
830	830		Services District pursuant to an existing contract
831	831		between the Emergency Services Provider and the State
832	832		Department of Health. Provided, however, that the
833	833		acquisition of commercial liability insurance covering

894	894		districts formed pursuant to the Oklahoma Irrigation
895	895		District Act,
896	896		n. for purposes of The Governmental Tort Claims Act only,
897	897		any community action agency established pursuant to
898	898		Sections 5035 through 5040 of Title 74 of the Oklahoma
899	899		Statutes,
900	900		o. for purposes of The Governmental Tort Claims Act only,
901	901		any organization that is designated as a youth
902	902		services agency, pursuant to Section 2 -7-306 of Title
903	903		10A of the Oklahoma Statutes,
904	904		p. for purposes of The Gover nmental Tort Claims Act only,
905	905		any judge presiding over a drug court, as define d by
906	906		Section 471.1 of Title 22 of the Oklahoma Statutes,

967	967		1001 et seq. of Title 74 of the Oklahoma Statutes, and
968	968		t. for purposes of The Governmental Tort Claims Act only,
969	969		a regional transportation authority created purs uant
970	970		to Section 1370.7 of Title 68 of the Oklahoma Statutes
971	971		including its contract operator and any railroad
972	972		operating in interstate commerce that sells a property
973	973		interest or provides services to a regional
974	974		transportation authority or allows the authority to
975	975		use the property or tracks of the railroad for the
976	976		provision of public pas senger rail service to the
977	977		extent claims against the contract operator or
978	978		railroad arise out of or are related to or in
979	979		connection with such property interest, services or
980	980		operation of the public passenger rail service.

1034	1034		transportation authority, contract operator or
1035	1035		railroad shall not operate as a waiver of any
1036	1036		liabilities, immunit ies or defenses provided pursuant
1037	1037		to the provisions of the Governmental Tort C laims Act,
1038	1038		and
1039	1039		u. for purposes of The Governmental Tort Claims Act only,
1040	1040		an emergency medical service district established
1041	1041		pursuant to Section 9C of Article X of the Oklahoma
1042	1042		Constitution,
1043	1043		and all their institutions, instrumentalities or agencies;
1044	1044		12. “Scope of employment” means performance by an employee
1045	1045		acting in good faith within the duties of the employee ’s office or
1046	1046		employment or of tasks lawfully assigned by a competent aut hority
1047	1047		including the operation or use of an agency vehicle or equipment
1048	1048		with actual or implied consent of the supervisor of the employee,
1049	1049		but shall not include corruption or fraud;
1050	1050		13. “State” means the State of Oklahoma or any office,
1051	1051		department, agency, authority, commission, board, institution,
1052	1052		hospital, college, university, public trust created pursuant to
1053	1053		Title 60 of the Oklahoma Statutes of which the State of Oklahoma is
1054	1054		the beneficiary, or other instrumentality thereof;
1055	1055		14. “State active duty” shall be defined in accordance with
1056	1056		Section 801 of Title 44 of the Oklahoma Statut es;

1108	1108		15. “State military forces ” shall be defined in accordance with
1109	1109		Section 801 of Title 44 of the Oklahoma Statutes;
1110	1110		16. “Title 32 active duty ” shall be defined in accordance with
1111	1111		Section 801 of Title 44 of the Oklahoma Statutes; and
1112	1112		17. “Tort” means a legal wrong, independent of contract,
1113	1113		involving violation of a duty imposed by general law, statute, the
1114	1114		Constitution of the State of Oklahoma, or otherwise, resulting in a
1115	1115		loss to any person, association or corporation as the proximate
1116	1116		result of an act or omission of a political subdivision or the state
1117	1117		or an employee acting within the scope of employment; provided,
1118	1118		however, a tort shall not include a claim for inverse condemnat ion.
1119	1119		SECTION 2. This act shall become effective November 1, 2025.
