75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 43 O.S. 2021, Section 3, is
77	77	amended to read as follows:
78	78	Section 3. A. Any unmarried person who is at least eighteen
79	79	(18) years of age and not otherwise disqualified is capable of
80	80	contracting and consenting to marriage with a person of the opposite
81	81	sex.
82	82	B. 1. Except as otherwise provided by t his subsection, no
83	83	person under the age of eighteen (18) years shall enter into the
84	84	marriage relation, nor shall any license issue therefor, except:
85	85	a. upon the consent and authority expressly given by the
86	86	parent or guardian of such underage applicant in t he
87	87	presence of the authority issuing such license,

139	139	b. upon the written consent of the parent or guardian of
140	140	such underage applicant executed and acknowledged in
141	141	person before a judge of the district court or the
142	142	court clerk of any county within the State o f
143	143	Oklahoma,
144	144	c. if the parent or guardian resides outside of the State
145	145	of Oklahoma, upon the written consent of the parent or
146	146	guardian executed before a judge or clerk of a court
147	147	of record. The executed foreign consent shall be duly
148	148	authenticated in the sa me manner as proof of documents
149	149	from foreign jurisdictions,
150	150	d. if the certificate of a duly licensed medical doctor
151	151	or osteopath, acknowledged in the manner provided by
152	152	law for the acknowledgment of deeds, and stating that
153	153	such parent or guardian is unable by reason of health
154	154	or incapacity to be present in person, is presented to
155	155	such licensing authority, upon the written consent of
156	156	the parent or guardian, acknowledged in the same
157	157	manner as the accompanying medical certificate,
158	158	e. if the parent or guardian is on active duty with the
159	159	Armed Forces of the United States, upon the written
160	160	permission of the parent or guardian, acknowledged in
161	161	the manner provided by law for acknowledgment of deeds
162	162	by military personnel authorized to administer oaths.

214	214	Such permission shall be presented to the licensing
215	215	authority, accompanied by a certificate executed by a
216	216	commissioned officer in command of the applicant, to
217	217	the effect that the parent or guardian is on active
218	218	duty in the Armed Forces of the United States, or
219	219	f. upon affidavit of three (3) reputable persons stating
220	220	that both parents of the mino r are deceased, or
221	221	mentally incompetent, or their whereabouts are unknown
222	222	to the minor, and that no guardian has theretofore
223	223	been appointed for the minor. The judge of the
224	224	district court issuing the license may in his or her
225	225	discretion consent to the marriage in the same manner
226	226	as in all cases in which consent may be given by a
227	227	parent or guardian.
228	228	2. Every person under the age of sixteen (16) years is
229	229	expressly forbidden and pro hibited from entering into the marriage
230	230	relation except when authorized by the court:
231	231	a. in settlement of a suit for seduction or paternity, or
232	232	b. if the unmarried female is pregnant, or has given
233	233	birth to an illegitimate child and at least one parent
234	234	of each minor, or the guardian or custodian of such
235	235	child, is present before the court and has an
236	236	opportunity to present evidence in the event such
237	237	parent, guardian, or custodian objects to the issuance

290	290	parent, guardian, or custodian may be given notice of
291	291	the hearing at the discretion of the court.
292	292	3. A parent or a guardian of any child under the age of
293	293	eighteen (18) years who is in the custody of the Department of Human
294	294	Services or the Department of Juvenil e Justice shall not be eligible
295	295	to consent to the marriage of such minor child as required by the
296	296	provisions of this subsection.
297	297	4. Any certificate or written permission required by this
298	298	subsection shall be retained by the official issuing the marriage
299	299	license.
300	300	C. No marriage may be authorized when such marriage would be
301	301	incestuous under this chapter title.
302	302	SECTION 2. This act shall become effective November 1, 2025.
