7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 43 O.S. 2021, Section 3, is
7777 amended to read as follows:
7878 Section 3. A. Any unmarried person who is at least eighteen
7979 (18) years of age and not otherwise disqualified is capable of
8080 contracting and consenting to marriage with a person of the opposite
8181 sex.
8282 B. 1. Except as otherwise provided by t his subsection, no
8383 person under the age of eighteen (18) years shall enter into the
8484 marriage relation, nor shall any license issue therefor, except:
8585 a. upon the consent and authority expressly given by the
8686 parent or guardian of such underage applicant in t he
8787 presence of the authority issuing such license,

139139 b. upon the written consent of the parent or guardian of
140140 such underage applicant executed and acknowledged in
141141 person before a judge of the district court or the
142142 court clerk of any county within the State o f
143143 Oklahoma,
144144 c. if the parent or guardian resides outside of the State
145145 of Oklahoma, upon the written consent of the parent or
146146 guardian executed before a judge or clerk of a court
147147 of record. The executed foreign consent shall be duly
148148 authenticated in the sa me manner as proof of documents
149149 from foreign jurisdictions,
150150 d. if the certificate of a duly licensed medical doctor
151151 or osteopath, acknowledged in the manner provided by
152152 law for the acknowledgment of deeds, and stating that
153153 such parent or guardian is unable by reason of health
154154 or incapacity to be present in person, is presented to
155155 such licensing authority, upon the written consent of
156156 the parent or guardian, acknowledged in the same
157157 manner as the accompanying medical certificate,
158158 e. if the parent or guardian is on active duty with the
159159 Armed Forces of the United States, upon the written
160160 permission of the parent or guardian, acknowledged in
161161 the manner provided by law for acknowledgment of deeds
162162 by military personnel authorized to administer oaths.

214214 Such permission shall be presented to the licensing
215215 authority, accompanied by a certificate executed by a
216216 commissioned officer in command of the applicant, to
217217 the effect that the parent or guardian is on active
218218 duty in the Armed Forces of the United States, or
219219 f. upon affidavit of three (3) reputable persons stating
220220 that both parents of the mino r are deceased, or
221221 mentally incompetent, or their whereabouts are unknown
222222 to the minor, and that no guardian has theretofore
223223 been appointed for the minor. The judge of the
224224 district court issuing the license may in his or her
225225 discretion consent to the marriage in the same manner
226226 as in all cases in which consent may be given by a
227227 parent or guardian.
228228 2. Every person under the age of sixteen (16) years is
229229 expressly forbidden and pro hibited from entering into the marriage
230230 relation except when authorized by the court:
231231 a. in settlement of a suit for seduction or paternity, or
232232 b. if the unmarried female is pregnant, or has given
233233 birth to an illegitimate child and at least one parent
234234 of each minor, or the guardian or custodian of such
235235 child, is present before the court and has an
236236 opportunity to present evidence in the event such
237237 parent, guardian, or custodian objects to the issuance

289289 of a marriage license. If they are not present the
290290 parent, guardian, or custodian may be given notice of
291291 the hearing at the discretion of the court.
292292 3. A parent or a guardian of any child under the age of
293293 eighteen (18) years who is in the custody of the Department of Human
294294 Services or the Department of Juvenil e Justice shall not be eligible
295295 to consent to the marriage of such minor child as required by the
296296 provisions of this subsection.
297297 4. Any certificate or written permission required by this
298298 subsection shall be retained by the official issuing the marriage
299299 license.
300300 C. No marriage may be authorized when such marriage would be
301301 incestuous under this chapter title.
302302 SECTION 2. This act shall become effective November 1, 2025.
