5177 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5278 SECTION 1. AMENDATORY Section 1, Chapter 289, O.S.L.
5379 2023 (70 O.S. Supp. 2024, Section 18 -114.15), is amended to read as
5480 follows:
5581 Section 18-114.15. A. Beginning with the 2023 -2024 school
5682 year, certified personnel, as defined in Section 26 -103 of Title 70
5783 of the Oklahoma Statutes this title, in the public schools of
5884 Oklahoma this state shall receive in salary and/or fringe benefits
5985 not less than the amounts specified in the followin g schedule:

200298 B. 1. When determining the Minimum Salary Schedule minimum
201299 salary schedule, “fringe benefits” shall mean all or part of
202300 retirement benefits, excluding the contributions made pursuant to
203301 subsection A of Section 17 -108.1 of Title 70 of the Oklahoma
204302 Statutes this title and the flexible benefit allowance pursuant to
205303 Section 26-105 of Title 70 of the Oklahoma Sta tutes this title from
206304 the flexible benefit allowance funds disbursed by the State Board of
207305 Education and the State Board of Career and Technology Education
208306 pursuant to Section 26 -104 of Title 70 of the Oklahoma Statutes this
209307 title.
210308 2. If a school district intends to provide retirement benefits
211309 to a teacher such that the teacher ’s salary would be less than the
212310 amounts set forth in the minimum salary schedule specified in
213311 subsection A of this section, the district shall be required to
214312 provide written notific ation to the teacher prior to his or her
215313 employment or, if already employed by the district, no later than
216-thirty (30) days prior to the date the district elects to provide

365+thirty (30) days prior to the date the district elects to provide
244366 retirement benefits such that the teacher ’s salary would be less
245367 than the minimum salary schedule.
246368 C. Any of the degrees referred to in this section shall be fr om
247369 a college recognized by the State Board of Education. The Board
248370 shall accept teaching experience from out -of-state school districts
249371 that are accredited by the State Board of Education state board of
250372 education or appropriate state accrediting agency for the districts.
251373 The Board shall accept teaching experience from out -of-country
252374 schools that are accredited or otherwise endorsed by the appropriate
253375 national or regional accredit ing or endorsement authority. Out -of-
254376 country certification documentation in a language other than English
255377 shall be analyzed by an educational credential evaluation service in
256378 accordance with industry standards and guidelines and approved by
257379 the State Department of Education. The person seeking to have
258380 credit granted for out -of-country teaching experience shall be
259381 responsible for all costs of the analysis by a credential evaluation
260382 service. The Board shall accept teaching experience from primary
261383 and secondary schools that are operated by the United States
262384 Department of Defense or a re affiliated with the United States
263385 Department of State.
264386 D. 1. For the purpose of state salary increments and
265387 retirement, no teacher shall be granted credit for more than five
266388 (5) years of active duty in the military service or out-of-state or

440+out-of-country teaching experience as a certified teacher or its
295441 equivalent. Nothing in this section shall prohibit boards of
296442 education from crediting more years of experience on distric t salary
297443 schedules than those allowed for state purposes.
298444 2. For the purpose of state salary increments, no teacher shall
299445 be granted credit for more than ten (10) years of active duty in the
300446 military service. For the purpose of retirement, no teacher sha ll
301447 be granted credit for more than five (5) years of active duty in the
302448 military service.
303449 E. The State Board of Education shall recognize, for purposes
304450 of certification and salary increments, all the years of experience
305451 of a:
306452 1. Certified teacher who tea ches in the educational program of
307453 the Department of Corrections, beginning wi th fiscal year 1981;
308454 2. Vocational rehabilitation counselor under the Department of
309455 Human Services if the counselor was employed as a certified teacher
310456 by the State Department o f Education when the Division of Vocational
311457 Rehabilitation was transferred from the State Board of Career and
312458 Technology Education or the State Board of Education to the Oklahoma
313459 Public Welfare Commission on July 1, 1968;
314460 3. Vocational rehabilitation coun selor which were completed
315461 while employed by the Department of Human Services if such counselor
316462 was certified as a teacher or was eligible for certification as a
317463 teacher in Oklahoma this state;

345515 4. Certified teacher which were completed while employed by t he
346516 Child Study Center located at University Hospital, if the teacher
347517 was certified as a teacher in Oklahoma this state; and
348518 5. Certified school psychologist or psychometrist which were
349519 completed while employed as a doctoral intern, psychological
350520 assistant, or psychologist with any agency of the State of Oklahoma
351521 this state if the experience primarily involved work with persons of
352522 school- or preschool-age and if the person was, at the time the
353523 experience was acquired, certified as, or eligible for certifica tion
354524 as, a school psychologist or psychometrist.
355525 F. The provisions of this section shall not apply to teachers
356526 who have entered into postretirement employment with a public school
357527 in Oklahoma this state and are still receiving a monthly retirement
358528 benefit.
359529 G. If a person employed as certified personnel, as defined in
360530 Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
361531 school district during the 2022 -2023 school year was receiving a
362532 salary above the step level indicated by the State Minimum Salary
363533 Schedule state minimum salary schedule for the 2022-2023 school
364534 year, the person shall receive a salary increase amount equal to the
365535 amount indicated in subsection A of this section for the step level
366536 indicated for the person, provided they remain he or she remains
367537 employed by the same district, unless the hours or the duti es of the
368538 certified personnel are reduced proportionately.

396590 H. If a school district does not receive Foundation or Salary
397591 Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
398592 Oklahoma Statutes this title, funds shall be allocated by the State
399593 Board of Education to implement the salary increases indicated in
400594 subsection A of this section.
401595 I. Persons employed as classroom instructional employees of
402596 technology center school districts supervised by the State Board of
403597 Career and Technology Education sha ll receive a salary increase
404598 amount equal to the amount indicated in subsection A of this section
405599 for the step level indicated for the person persons, provided they
406600 remain employed by the same technology center school district,
407601 unless the hours or the duties of the classroom instructional
408602 employees are reduced proportionately.
409603 J. Persons employed as correctional teachers or vocational
410604 instructors by the Department of Corrections pursuant to Section
411605 510.6a of Title 57 of the Oklahoma Statutes or persons emp loyed as
412606 teachers by the Office of Juvenile Affairs shall receive a salary
413607 increase amount equal to the amount indicated in subsection A of
414608 this section for the step level indica ted for the person persons,
415609 provided they remain employed by the same Department of Corrections
416610 or Office of Juvenile Affairs facility, unless the hours or the
417611 duties of the correctional teachers, vocational instructors, or
418612 teachers are reduced proportiona tely.

447665 Rehabilitation Services shall receive a salary increase amount equal
448666 to the amount indicated in subsection A of this section for the step
449667 level indicated for the person persons, provided they remain
450668 employed by the State Department of Rehabilitation Services, unless
451669 the hours or the duties of the teachers are reduced proportionately.
452670 SECTION 2. This act shall become effective July 1, 2025.
453671 SECTION 3. It being immediately necessary for the preservation
454672 of the public peace, health, or sa fety, an emergency is hereby
455673 declared to exist, by reason whereof this act shall take effect and
456674 be in full force from and after its passage and approval.
