210 | 308 | | 2. If a school district intends to provide retirement benefits |

211 | 309 | | to a teacher such that the teacher ’s salary would be less than the |

212 | 310 | | amounts set forth in the minimum salary schedule specified in |

213 | 311 | | subsection A of this section, the district shall be required to |
---|
214 | 312 | | provide written notific ation to the teacher prior to his or her |
---|
215 | 313 | | employment or, if already employed by the district, no later than |
---|
244 | 366 | | retirement benefits such that the teacher ’s salary would be less |
---|
245 | 367 | | than the minimum salary schedule. |
---|
246 | 368 | | C. Any of the degrees referred to in this section shall be fr om |
---|
247 | 369 | | a college recognized by the State Board of Education. The Board |
---|
248 | 370 | | shall accept teaching experience from out -of-state school districts |
---|
249 | 371 | | that are accredited by the State Board of Education state board of |
---|
250 | 372 | | education or appropriate state accrediting agency for the districts. |
---|
251 | 373 | | The Board shall accept teaching experience from out -of-country |
---|
252 | 374 | | schools that are accredited or otherwise endorsed by the appropriate |
---|
253 | 375 | | national or regional accredit ing or endorsement authority. Out -of- |
---|
254 | 376 | | country certification documentation in a language other than English |
---|
255 | 377 | | shall be analyzed by an educational credential evaluation service in |
---|
256 | 378 | | accordance with industry standards and guidelines and approved by |
---|
257 | 379 | | the State Department of Education. The person seeking to have |
---|
258 | 380 | | credit granted for out -of-country teaching experience shall be |
---|
259 | 381 | | responsible for all costs of the analysis by a credential evaluation |
---|
260 | 382 | | service. The Board shall accept teaching experience from primary |
---|
261 | 383 | | and secondary schools that are operated by the United States |
---|
262 | 384 | | Department of Defense or a re affiliated with the United States |
---|
263 | 385 | | Department of State. |
---|
264 | 386 | | D. 1. For the purpose of state salary increments and |
---|
265 | 387 | | retirement, no teacher shall be granted credit for more than five |
---|
266 | 388 | | (5) years of active duty in the military service or out-of-state or |
---|
295 | 441 | | equivalent. Nothing in this section shall prohibit boards of |
---|
296 | 442 | | education from crediting more years of experience on distric t salary |
---|
297 | 443 | | schedules than those allowed for state purposes. |

298 | 444 | | 2. For the purpose of state salary increments, no teacher shall |

---|

303 | 449 | | E. The State Board of Education shall recognize, for purposes |

304 | 450 | | of certification and salary increments, all the years of experience |

306 | 452 | | 1. Certified teacher who tea ches in the educational program of |

307 | 453 | | the Department of Corrections, beginning wi th fiscal year 1981; |

308 | 454 | | 2. Vocational rehabilitation counselor under the Department of |

309 | 455 | | Human Services if the counselor was employed as a certified teacher |
---|
310 | 456 | | by the State Department o f Education when the Division of Vocational |
---|
311 | 457 | | Rehabilitation was transferred from the State Board of Career and |
---|
312 | 458 | | Technology Education or the State Board of Education to the Oklahoma |
---|
313 | 459 | | Public Welfare Commission on July 1, 1968; |
---|
314 | 460 | | 3. Vocational rehabilitation coun selor which were completed |
---|
315 | 461 | | while employed by the Department of Human Services if such counselor |
---|
316 | 462 | | was certified as a teacher or was eligible for certification as a |
---|

355 | 525 | | F. The provisions of this section shall not apply to teachers |
---|
356 | 526 | | who have entered into postretirement employment with a public school |
---|
357 | 527 | | in Oklahoma this state and are still receiving a monthly retirement |
---|
358 | 528 | | benefit. |
---|
359 | 529 | | G. If a person employed as certified personnel, as defined in |
---|
360 | 530 | | Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a |
---|
361 | 531 | | school district during the 2022 -2023 school year was receiving a |
---|
362 | 532 | | salary above the step level indicated by the State Minimum Salary |
---|
363 | 533 | | Schedule state minimum salary schedule for the 2022-2023 school |
---|
364 | 534 | | year, the person shall receive a salary increase amount equal to the |
---|
365 | 535 | | amount indicated in subsection A of this section for the step level |
---|
366 | 536 | | indicated for the person, provided they remain he or she remains |
---|
367 | 537 | | employed by the same district, unless the hours or the duti es of the |

409 | 603 | | J. Persons employed as correctional teachers or vocational |

410 | 604 | | instructors by the Department of Corrections pursuant to Section |

411 | 605 | | 510.6a of Title 57 of the Oklahoma Statutes or persons emp loyed as |

454 | 672 | | of the public peace, health, or sa fety, an emergency is hereby |

455 | 673 | | declared to exist, by reason whereof this act shall take effect and |
---|
456 | 674 | | be in full force from and after its passage and approval. |
