51	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	78		SECTION 1. AMENDATORY Section 1, Chapter 289, O.S.L.
53	79		2023 (70 O.S. Supp. 2024, Section 18 -114.15), is amended to read as
54	80		follows:
55	81		Section 18-114.15. A. Beginning with the 2023 -2024 school
56	82		year, certified personnel, as defined in Section 26 -103 of Title 70
57	83		of the Oklahoma Statutes this title, in the public schools of
58	84		Oklahoma this state shall receive in salary and/or fringe benefits
59	85		not less than the amounts specified in the followin g schedule:

200	298		B. 1. When determining the Minimum Salary Schedule minimum
201	299		salary schedule, “fringe benefits” shall mean all or part of
202	300		retirement benefits, excluding the contributions made pursuant to
203	301		subsection A of Section 17 -108.1 of Title 70 of the Oklahoma
204	302		Statutes this title and the flexible benefit allowance pursuant to
205	303		Section 26-105 of Title 70 of the Oklahoma Sta tutes this title from
206	304		the flexible benefit allowance funds disbursed by the State Board of
207	305		Education and the State Board of Career and Technology Education
208	306		pursuant to Section 26 -104 of Title 70 of the Oklahoma Statutes this
209	307		title.
210	308		2. If a school district intends to provide retirement benefits
211	309		to a teacher such that the teacher ’s salary would be less than the
212	310		amounts set forth in the minimum salary schedule specified in
213	311		subsection A of this section, the district shall be required to
214	312		provide written notific ation to the teacher prior to his or her
215	313		employment or, if already employed by the district, no later than
216		-	thirty (30) days prior to the date the district elects to provide

	365	+	thirty (30) days prior to the date the district elects to provide
244	366		retirement benefits such that the teacher ’s salary would be less
245	367		than the minimum salary schedule.
246	368		C. Any of the degrees referred to in this section shall be fr om
247	369		a college recognized by the State Board of Education. The Board
248	370		shall accept teaching experience from out -of-state school districts
249	371		that are accredited by the State Board of Education state board of
250	372		education or appropriate state accrediting agency for the districts.
251	373		The Board shall accept teaching experience from out -of-country
252	374		schools that are accredited or otherwise endorsed by the appropriate
253	375		national or regional accredit ing or endorsement authority. Out -of-
254	376		country certification documentation in a language other than English
255	377		shall be analyzed by an educational credential evaluation service in
256	378		accordance with industry standards and guidelines and approved by
257	379		the State Department of Education. The person seeking to have
258	380		credit granted for out -of-country teaching experience shall be
259	381		responsible for all costs of the analysis by a credential evaluation
260	382		service. The Board shall accept teaching experience from primary
261	383		and secondary schools that are operated by the United States
262	384		Department of Defense or a re affiliated with the United States
263	385		Department of State.
264	386		D. 1. For the purpose of state salary increments and
265	387		retirement, no teacher shall be granted credit for more than five
266	388		(5) years of active duty in the military service or out-of-state or
267		-	out-of-country teaching experience as a certified teacher or its

	440	+	out-of-country teaching experience as a certified teacher or its
295	441		equivalent. Nothing in this section shall prohibit boards of
296	442		education from crediting more years of experience on distric t salary
297	443		schedules than those allowed for state purposes.
298	444		2. For the purpose of state salary increments, no teacher shall
299	445		be granted credit for more than ten (10) years of active duty in the
300	446		military service. For the purpose of retirement, no teacher sha ll
301	447		be granted credit for more than five (5) years of active duty in the
302	448		military service.
303	449		E. The State Board of Education shall recognize, for purposes
304	450		of certification and salary increments, all the years of experience
305	451		of a:
306	452		1. Certified teacher who tea ches in the educational program of
307	453		the Department of Corrections, beginning wi th fiscal year 1981;
308	454		2. Vocational rehabilitation counselor under the Department of
309	455		Human Services if the counselor was employed as a certified teacher
310	456		by the State Department o f Education when the Division of Vocational
311	457		Rehabilitation was transferred from the State Board of Career and
312	458		Technology Education or the State Board of Education to the Oklahoma
313	459		Public Welfare Commission on July 1, 1968;
314	460		3. Vocational rehabilitation coun selor which were completed
315	461		while employed by the Department of Human Services if such counselor
316	462		was certified as a teacher or was eligible for certification as a
317	463		teacher in Oklahoma this state;

345	515		4. Certified teacher which were completed while employed by t he
346	516		Child Study Center located at University Hospital, if the teacher
347	517		was certified as a teacher in Oklahoma this state; and
348	518		5. Certified school psychologist or psychometrist which were
349	519		completed while employed as a doctoral intern, psychological
350	520		assistant, or psychologist with any agency of the State of Oklahoma
351	521		this state if the experience primarily involved work with persons of
352	522		school- or preschool-age and if the person was, at the time the
353	523		experience was acquired, certified as, or eligible for certifica tion
354	524		as, a school psychologist or psychometrist.
355	525		F. The provisions of this section shall not apply to teachers
356	526		who have entered into postretirement employment with a public school
357	527		in Oklahoma this state and are still receiving a monthly retirement
358	528		benefit.
359	529		G. If a person employed as certified personnel, as defined in
360	530		Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
361	531		school district during the 2022 -2023 school year was receiving a
362	532		salary above the step level indicated by the State Minimum Salary
363	533		Schedule state minimum salary schedule for the 2022-2023 school
364	534		year, the person shall receive a salary increase amount equal to the
365	535		amount indicated in subsection A of this section for the step level
366	536		indicated for the person, provided they remain he or she remains
367	537		employed by the same district, unless the hours or the duti es of the
368	538		certified personnel are reduced proportionately.

396	590		H. If a school district does not receive Foundation or Salary
397	591		Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
398	592		Oklahoma Statutes this title, funds shall be allocated by the State
399	593		Board of Education to implement the salary increases indicated in
400	594		subsection A of this section.
401	595		I. Persons employed as classroom instructional employees of
402	596		technology center school districts supervised by the State Board of
403	597		Career and Technology Education sha ll receive a salary increase
404	598		amount equal to the amount indicated in subsection A of this section
405	599		for the step level indicated for the person persons, provided they
406	600		remain employed by the same technology center school district,
407	601		unless the hours or the duties of the classroom instructional
408	602		employees are reduced proportionately.
409	603		J. Persons employed as correctional teachers or vocational
410	604		instructors by the Department of Corrections pursuant to Section
411	605		510.6a of Title 57 of the Oklahoma Statutes or persons emp loyed as
412	606		teachers by the Office of Juvenile Affairs shall receive a salary
413	607		increase amount equal to the amount indicated in subsection A of
414	608		this section for the step level indica ted for the person persons,
415	609		provided they remain employed by the same Department of Corrections
416	610		or Office of Juvenile Affairs facility, unless the hours or the
417	611		duties of the correctional teachers, vocational instructors, or
418	612		teachers are reduced proportiona tely.

447	665		Rehabilitation Services shall receive a salary increase amount equal
448	666		to the amount indicated in subsection A of this section for the step
449	667		level indicated for the person persons, provided they remain
450	668		employed by the State Department of Rehabilitation Services, unless
451	669		the hours or the duties of the teachers are reduced proportionately.
452	670		SECTION 2. This act shall become effective July 1, 2025.
453	671		SECTION 3. It being immediately necessary for the preservation
454	672		of the public peace, health, or sa fety, an emergency is hereby
455	673		declared to exist, by reason whereof this act shall take effect and
456	674		be in full force from and after its passage and approval.
