39	65		An Act relating to the Oklahoma Riot Control and
40	66		Prevention Act; amending 21 O.S. 2021, Section
41	67		1321.4, which relates to acts which ma y be proclaimed
42	68		prohibited; adding certain entities that are
43	69		prohibited from taking certain actions; authorizing
44	70		activity in certain place during state of emergency;
45	71		modifying scope for which relief may be sought;
46	72		updating statutory reference; and providing an
47	73		effective date.

53	79		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	80		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1321.4, is
55	81		amended to read as follows:
56	82		Section 1321.4. A. The Governor during the existence of a
57	83		state of emergency, by proclamation, may, in the area described by
58	84		the proclamation, which proclamation shall not cover any part or
59	85		portion of the state not affected by public disorder, disaster, or
60	86		riot at the time the proclamation is issued, prohibit:
61	87		1. Any person being on the public streets, or in the public
62	88		parks, or at any other public place during the hours declared by the
63	89		Governor to be a period of curfew;

91	141		2. A designated number of persons, as designated by the
92	142		Governor, from assembling or gather ing on the public streets, parks,
93	143		or other open areas of this state, either public or private;
94	144		3. The manufacture, transfer, use, possession , or
95	145		transportation of a molotov cocktail or any other device,
96	146		instrument, or object designed to explode or produce uncontained
97	147		combustion;
98	148		4. The transporting, possessing , or using of gasoline,
99	149		kerosene, or combustible, flammable, or explosive liquids or
100	150		materials in a glass or uncapped container of any kind except in
101	151		connection with the normal operation of motor veh icles, normal home
102	152		use, or legitimate commercial use;
103	153		5. The sale, purchase , or dispensing of alcoholic beverages;
104	154		6. The sale, purchase , or dispensing of other commodities or
105	155		goods, as the Governor reasonably believes should be prohibited to
106	156		help preserve and maintain life, health, property , or the public
107	157		peace;
108	158		7. The use of certain streets, highways , or public ways by the
109	159		public; and
110	160		8. Such other activities as the Governor reasonably believes
111	161		should be prohibited to help preserve and maintain life, health,
112	162		property, or the public peace.
113	163		B. Notwithstanding this section or any other law of this state,

142	216		municipality, county, or political subdivision of this state, or any
143	217		other state entity during the existence of a state of emergency,
144	218		shall not prohibit or suspend the sale:
145	219		1. The sale, ownership, possession, transportation, carrying,
146	220		transfer, and storage of firearms, ammunition , and ammunition
147	221		accessories during a declared state of emergency, that are otherwise
148	222		legal under state law ; or
149	223		2. Any activity in a place of worship during a declared state
150	224		of emergency that is other wise legal under state law .
151	225		C. In imposing the restrictions provided for by the Oklahoma
152	226		Riot Control and Prevention Act , the Governor may impose them for
153	227		such times, upon such conditions, with such exceptions, and in such
154	228		areas of this state the Governor from time to time deems necessary.
155	229		D. Any individual aggrieved by a violation of subsection B of
156	230		this section may seek relief in an action at law or in equity for
157	231		redress against any person or against an official of a municipality,
158	232		county, political subdivision, or other state entity who subjects
159	233		such individual or causes such individual to be subjected to an
160	234		action prohibited by subsection B of this section. In addition to
161	235		any other remedy at law or in equity, an individual aggrieved by the
162	236		seizure or confiscation of a firearm or ammunition in violation of
163	237		paragraph 1 of subsection B of this section may bring an action fo r
164	238		the return of such firearm or ammunition in the district court of
165	239		the county in which that individual resides or in which such firearm

194	292		the provisions of this section, the court shall award the prevailing
195	293		plaintiff costs and reasonable attorney fees.
196	294		SECTION 2. This act shall become effective November 1, 2025.
