7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 26 O.S. 2021, Section 2 -121, is
7777 amended to read as follows:
7878 Section 2-121. A. It shall be the mandatory duty of the county
7979 commissioners of each county to furnish, at county expense, in each
8080 county seat a suitable office for the county election board. The
8181 office shall provide adequate space for storage of election re cords
8282 and supplies, voting devices, ballot boxes , and adequate space for
8383 the exercise of other functions required by law of the county
8484 election board and shall be equipped with suitable furniture , and
8585 office equipment, and a telephone. The office shall be convenient
8686 to the public, shall have furniture, furnishings and fixtures , and

138138 other equipment comparable to other county offices within the
139139 county, and necessary to the operation of the office.
140140 B. 1. The county commissioners of each county shall, at cou nty
141141 expense, implement security measures at the county election board
142142 that are equivalent to security measures the county provides to its
143143 other county agencies, in order to ensure the county election board
144144 office is adequately protected from physical intru sions or attacks
145145 and to provide cybersecurity for county -owned computer system s
146146 operated by the county election board.
147147 2. County officials shall immediately notify the Secretary of
148148 the State Election Board upon learning of an attempted or successful
149149 physical or cyber attack or intrusion committed against the county
150150 election board.
151151 C. To ensure the security of election records, equipment,
152152 computers, software, ballots, supplies , and other materials
153153 necessary to conduct elections:
154154 1. The county election boa rd shall not share storage space
155155 where ballots, voter registration records , or election equipment are
156156 stored with any other county agency unless authorized by the
157157 Secretary of the State Election Board; and
158158 2. No county personnel other than those employed by the county
159159 election board shall be assigned workspace within the physical
160160 offices that are assigned to the county election board ; and

212212 3. The county election board shall provide sufficient training,
213213 approved by the Secretary of the State Election Board, to the county
214214 sheriff and law enforcement officers of the county in order to
215215 secure the election process pursuant to state law as well as secure
216216 ballots pursuant to subsection C of Section 14 -115.4 of this title.
217217 Provided, nothing in this subsection shall prohibit the county
218218 election board office from being located within the county
219219 courthouse or another county -owned building shared by multiple
220220 county agencies, nor shall it restrict the county election board
221221 from utilizing common areas intended for use by multiple county
222222 agencies other than as specifically prohibited in this subsect ion.
223223 D. The Secretary of the State Election Board shall have the
224224 authority to enforce the requirements of, and may promulgate
225225 administrative rules to implement the provisions of , this section.
226226 SECTION 2. This act shall become effective November 1, 2025.
