6764 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6865 SECTION 1. AMENDATORY 63 O. S. 2021, Section 424, is

7067 Section 424. A. A medical marijuana transportation transporter

99-marijuana retail, growing, or processing license. The
10096 transportation transporter license will be issued at the time of
10197 approval of a retail, growing, or processing license.
10298 B. A transportation transporter license will allow th e holder
10399 to transport medical marijuana from an Oklahoma licensed medical
104100 marijuana retailer, licensed g rowing facility, or licensed processor
105101 facility to an Oklahoma licensed medical marijuana retailer,
106102 licensed growing facility, or licensed processing fa cility.
107103 C. All marijuana or marijuana products shall be transported in
108104 a locked container and clearly labeled “Medical Marijuana or
109105 Derivative”.
110106 D. A medical marijuana transport er license issued to a licensed
111107 dispensary or pursuant to Section 427.16 of this title shall allow
112108 the licensee to transport medical marijuana from a medical marijuana
113109 dispensary licensed in this state to a medical marijuana patient
114110 licensed in this state with a Veterans Affairs Benefit Summary
115111 Letter with a disability rating of on e hundred percent (100%) .
116112 SECTION 2. AMENDATORY 63 O.S. 2021, Section 427.16, as
117113 last amended by Section 140, Chapter 452, O.S.L. 2024 (63 O.S. Supp.
118114 2024, Section 427.16), is amended to read as follows:
119115 A. There is hereby create d a medical marijuana transporter
120116 license as a category of the medical marijuana business license.
121117 B. Pursuant to Section 424 of this title, the Oklahoma Medical
122118 Marijuana Authority shall issue a medical marijuana transporter

151146 and dispensaries upon issuance of such licenses and upon each
152147 renewal. Medical marijuana transporter licenses shall also be
153148 issued to licensed medical marijuana research facilities, medical
154149 marijuana education facil ities and medical marijuana testing
155150 laboratories upon issuance of such licenses and upon each renew al.
156151 C. A medical marijuana transporter license may also be issued
157152 to qualifying applicants who are registered with the Secretary of
158153 State and otherwise meet the requirements for a medical marijuana
159154 business license set forth in the Oklahoma Medical Marijuana and
160155 Patient Protection Act and the requirements set forth in this
161156 section to provide logistics, distribution and storage of medical
162157 marijuana, medical ma rijuana concentrate and medical marijuana
163158 products.
164159 D. A medical marijuana transporter license shall be valid for
165160 one (1) year and shall not be transferred with a change of
166161 ownership. A licensed medical marijuana transporter shall be
167162 responsible for all medical marijuana, medical marijuana concentrate
168163 and medical marijuana products once the transporter takes control of
169164 the product.
170165 E. A transporter license shall be required for any person or
171166 entity to transport or transfer medical marijuana, medical mari juana
172167 concentrate or medical marijuana products from a licensed medical
173168 marijuana business to another me dical marijuana business, or from a
169+medical marijuana business to a medical marijuana research facility

202196 or medical marijuana education facility , or from a licensed medical
203197 marijuana dispensary to a licensed medical marijuana patient with a
204198 Veterans Affairs Benefit Summary Letter with a disability rating of
205199 one hundred percent (100%) .
206200 F. A medical marijuana transporter licensee may contract with
207201 multiple licensed medical marijuana businesses.
208202 G. A medical marijuana transporter may maintain a licensed
209203 premises to temporarily store medical marijuana, medical marijuana
210204 concentrate and medical marijuana products and to use as a
211205 centralized distribution point. A medical marijuana transporter may
212206 store and distribute medical marijuana, medical marijuana
213207 concentrate and medical marijuana products from the licensed
214208 premises. The licensed premises shall meet all security
215209 requirements applicable to a medical marij uana business. The
216210 Authority shall issue licenses upon proper application by a licensee
217211 and determination by the Authority that the proposed site and
218212 facility are physically and technically suitable.
219213 H. A medical marijuana transporter licensee shall use the seed-
220214 to-sale tracking system developed pursuant to the Oklahoma Medical
221215 Marijuana and Patient Protection Act to create shipping manifests
222216 documenting the transport or temporary storage of medical marijuana,
223217 medical marijuana concentrate and medical mar ijuana products
224218 throughout the state.

252245 I. A licensed medical marijuana transporter may maintain and
253246 operate one or more warehouses in the state to handle medical
254247 marijuana, medical marijuana concentrate and medical marijuana
255248 products, provided the licensee possesses a valid, unexpired medical
256249 marijuana transporter license and ha s applied for and received a
257250 permit for each warehouse location. The Authority shall issue an
258251 annual permit for each warehouse location operated by a licensee
259252 that is equal to the a nnual medical marijuana transporter li cense
260253 term. There shall be no limit to the number of permits issu ed under
261254 a medical marijuana transporter license. A permit shall be issued
262255 only upon proper application by a licensee and determination by the
263256 Authority that the proposed site and facility are physically and
264257 technically suitable. Upon determination that the proposed site and
265258 facility are not physically and technically suitable, the Authority
266259 may deny the permit. Each warehouse location shall be registered
267260 approved and inspected by the Auth ority prior to its use. Medical
268261 marijuana transporter warehouses that are licensed and approved by
269262 the Authority may temporarily store medical marijuana, medical
270263 marijuana concentrate, and medical marijuana products, provided all
271264 temporary storage is documented, tracked, and traceable in the
272265 state-mandated seed-to-sale tracking system .
273266 J. With the exception of a lawful transfer between medical
274267 marijuana businesses who that are licensed to operate at the same

302294 physical address, all medical marijuana, medical marijuana
303295 concentrate and medical marijuana products shall be tr ansported:
304296 1. In vehicles equipped with Global Positioning System (GPS)
305297 trackers;
306298 2. In a locked container and clearly labeled “Medical Marijuana
307299 or Derivative”; and
308300 3. In a secured area of the vehicle that is not accessible by
309301 the driver during transit.
310302 K. A transporter agent may possess medical marijuana at any
311303 location while the transporter agent is transferring medical
312304 marijuana to or from a licen sed medical marijuana business, licensed
313305 medical marijuana research facility or licensed medical marijua na
314306 education facility, or from a licensed medical marijuana dispensary
315307 to a licensed medical marijuana patient with a Veterans Affairs
316308 Benefit Summary Letter with a disability rating of one hundred
317309 percent (100%). The Authority shall administer the provisio ns of
318310 this section and the Authority, the Oklahoma State Bureau of
319311 Narcotics and Dangerous Drugs Control, the Oklahoma State Bureau of
320312 Investigation, and the Attorney General shall have the authority to
321313 enforce the provisions of this section concerning t ransportation.
322314 L. The Authority shall issue a transporter agent license to
323315 individual agents, employees, officers or owners of a transporter
324316 license in order for the individual to qualify to transport medical

354345 M. The annual fee for a transporter agent license shall be
355346 Twenty-five Dollars ($25.00) and shall be paid by the transporter
356347 license-holder or the individual applicant. Transporter agent
357348 license reprints shall be Twenty Dollars ($20.00).
358349 N. The Authority shall issue each transporter agent a registry
359350 identification card within thirty (30) days of receipt of:
360351 1. The name, address and date of birth of the person;
361352 2. Proof of current state residency;
362353 3. Proof of identity as required for a medical marijuana
363354 business license;
364355 4. Possession of a valid state -issued driver license;
365356 5. Verification of employment with a licensed transporter;
366357 6. The application and affiliated fee; and
367358 7. A copy of the criminal background check conduct ed by the
368359 Oklahoma State Bureau of Investigation, paid for by the applicant.
369360 O. If the transporter agent application is denied, the
370361 Authority shall notify the transporter in writing of the reason for
371362 denying the registry identification card.
372363 P. A registry identification card for a transporter agent shall
373364 expire one (1) year after the date of issuance or upon notification
374365 from the holder of the transport er license that the transporter
375366 agent ceases to work as a transporter.

403393 Q. The Authority may revoke the registry identification card of
404394 a transporter agent who knowingly violates any provision of this
405395 section, and the transporter is subject to any other pe nalties
406396 established by law for the violation.
407397 R. The Authority may revoke or suspend the transporter license
408398 of a transporter that the Authority determines knowingly aided or
409399 facilitated a violation of any provision of this section, and the
410400 license holder is subject to any other penalties established in law
411401 for the violation.
412402 S. Vehicles used in the transp ort of medical marijuana or
413403 medical marijuana product shall be:
414404 1. Insured at or above the legal requirements in this state;
415405 2. Capable of securing me dical marijuana during transport; and
416406 3. In possession of a shipping container as defined in Section
417407 427.2 of this title capable of securing all transported products.
418408 T. Prior to the transport of any medical marijuana, medical
419409 marijuana concentrate or me dical marijuana products, an inventory
420410 manifest shall be prepared at the origination point of the medica l
421411 marijuana. The inventory manifest shall include the following
422412 information:
423413 1. For the origination point of the medical marijuana:
424414 a. the licensee number for the commercial grower,
425415 processor, or dispensary,
426416 b. the address of origination of transport, and

458447 approved by the Authority :
459448 a. the licensee number for the medical marijuana
460449 commercial grower, medical marijuana processor, or
461450 medical marijuana dispensary,
462451 b. the address of origination of transport,
463452 c. the name and contact information for the originating
464453 licensee, and
465454 d. the license number, physical address, and name and
466455 contact information of the medical marijuana
467456 transporter licensed premises or warehouse location
468457 and notation that the medical marijuana, medical
469458 marijuana concentrate, and medical marijuana products
470459 are being temporarily stored;
471460 3. For the end recipient license holder of the medical
472461 marijuana:
473462 a. the license number for the dispensary, commercial
474463 grower, processor, research facility , or education
475464 facility destination,
476465 b. the address of the destination, and

507495 marijuana product contained in transport;
508496 4. 5. The date of the transpor t and the approximate time of

510498 5. 6. The arrival date and estimated time of arrival;
511499 6. 7. Printed names and signatures of the personnel
512500 accompanying the transport; and
513501 7. 8. Notation of the transporting licensee.
514502 U. 1. A separate inventory manifest shall be prepared for each
515503 business licensee receiving the medical marijuana .
516504 2. The transporter agent shall provide the other medical
517505 marijuana business with a copy of the inventory manifest at the time
518506 the product changes hands and after the ot her licensee prints his or
519507 her name and signs the inventory manifest .
520508 3. A receiving business licensee shall refuse to accept any
521509 medical marijuana, medical marijuana concentrate or medical
522510 marijuana products that are not accompanied by an inventory
523511 manifest.
524512 4. Originating and receiving business licensees, including
525513 medical marijuana transporter warehouses temporarily storing medical
526514 marijuana, medical marijuana concentrate, and medical marijuana
527515 products, shall maintain copies of inventory manifests and logs of

556543 date of receipt.
557544 V. 1. A medical marijuana transporter license issued to a
558545 licensed dispensary or a licensed medical marijuana transporter
559546 issued pursuant to this section shall al low the holder to transport
560547 medical marijuana for a medical marijuana dispensary licensed in
561548 this state to a medical marijuana patient licensed in this state
562549 with a Veterans Affairs Benefit Summary Letter with a disability
563550 rating of one hundred percent (10 0%).
564551 2. Prior to the transport of any medical marijuana, medical
565552 marijuana concentrate, and medical marijuana products, a sales
566553 receipt shall be prepared at the medical marijuana dispensary
567554 licensed in this state. A separate receipt shall be prepared for
568555 each medical marijuana patient licensee receiving the medical
569556 marijuana delivery. A quick response (QR) code displayed on the
570557 package may be used in place of a paper receipt .
571558 3. The inventory manifest shall include the following
572559 information:
573560 a. for the origination point of the medical marijuana:
574561 (1) the license number for the dispensary,
575562 (2) the address of origination of transport, and
576563 (3) the name and contact information for the
577564 originating dispensary ,
578565 b. for the end recipient medical marijuana licensee :

613599 marijuana product contained in transport,
614600 d. the date of the transport and the approximate time of
615601 departure,
616602 e. the arrival date and estimated time of arrival,
617603 f. printed names and signatures, and
618604 g. notation of the transporter licensee.
619605 4. All delivery sales from a licensed medi cal marijuana
620606 dispensary to a licensed medical marijuana patient shall be
621607 accomplished through a third -party vendor and shall require:
622608 a. the patient to download an applicatio n on his or her
623609 electronic device,
624610 b. the patient to upload a valid driver license, a
625611 medical marijuana patient license, a three-dimensional
626612 (3D) facial map to the application prior to placing an
627613 order, and a current Veterans Affairs Benefit Summary
628614 Letter with a disability rating of one hundred percent

659644 d. the software to verify the patient card with the
660645 Authority’s database to confirm that the pat ient’s
661646 license is active each time a delivery order is
662647 initiated,
663648 e. the patient to render payment throu gh the application
664649 upon verification of an active license ,
665650 f. the information to be securely transmitted to a
666651 licensed medical marijuana dispensary following the
667652 verification of payment,
668653 g. a location finder, allowing the patient and
669654 transporter agent to identify the location of the
670655 other, and
671656 h. the patient to perform a final 3D facial mapping upon
672657 the transporter agent’s arrival to verify that the
673658 individual accepting the delivery is the licensed
674659 patient who placed the order .
675660 5. After completing this fin al verification, the delivery can
676661 be finalized.
677662 SECTION 3. NEW LAW A new section of law to be codified
678663 in the Oklahoma Statutes as Section 427.16a of Title 63, unless
679664 there is created a duplication in numbering, reads as follows:

707691 A. There is hereby created within the Oklahoma Medical
708692 Marijuana Authority a Medical Marijuana Veterans Transporter Pilot
709693 Program. The program s hall permit qualifying entities to transport
710694 medical marijuana from a licensed medical marijuana dispensary to a
711695 licensed medical marijuana patient with a current Veterans Affairs
712696 Benefit Summary Letter with a disability rating of one hundred
713697 percent (100%). The pilot program shall expire at the conclusion of
714698 two (2) years from the effective date of this act.
715699 B. The Authority shall promulgate rules necessary to implement
716700 the pilot program.
717701 SECTION 4. This act shall become effective November 1, 20 25.
