54	51		certain medical marijuana products; requiring certain
55	52		information to be included in inventory manifest;
56	53		requiring certain sale s receipt prior to certai n
57	54		services; requiring certain sales to be accomplished
58	55		through a third-party vendor; providing certain
59	56		requirements for certain delivery; updating statutory
60	57		language; creating certain pilot program; providing
61	58		for codification; and providing an effective date.

67	64		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
68	65		SECTION 1. AMENDATORY 63 O. S. 2021, Section 424, is
69	66		amended to read as follows:
70	67		Section 424. A. A medical marijuana transportation transporter
71	68		license will be issued to qualifyi ng applicants for a medical
	69	+	marijuana retail, growing, or processing license. The

100	96		transportation transporter license will be issued at the time of
101	97		approval of a retail, growing, or processing license.
102	98		B. A transportation transporter license will allow th e holder
103	99		to transport medical marijuana from an Oklahoma licensed medical
104	100		marijuana retailer, licensed g rowing facility, or licensed processor
105	101		facility to an Oklahoma licensed medical marijuana retailer,
106	102		licensed growing facility, or licensed processing fa cility.
107	103		C. All marijuana or marijuana products shall be transported in
108	104		a locked container and clearly labeled “Medical Marijuana or
109	105		Derivative”.
110	106		D. A medical marijuana transport er license issued to a licensed
111	107		dispensary or pursuant to Section 427.16 of this title shall allow
112	108		the licensee to transport medical marijuana from a medical marijuana
113	109		dispensary licensed in this state to a medical marijuana patient
114	110		licensed in this state with a Veterans Affairs Benefit Summary
115	111		Letter with a disability rating of on e hundred percent (100%) .
116	112		SECTION 2. AMENDATORY 63 O.S. 2021, Section 427.16, as
117	113		last amended by Section 140, Chapter 452, O.S.L. 2024 (63 O.S. Supp.
118	114		2024, Section 427.16), is amended to read as follows:
119	115		A. There is hereby create d a medical marijuana transporter
120	116		license as a category of the medical marijuana business license.
121	117		B. Pursuant to Section 424 of this title, the Oklahoma Medical
122	118		Marijuana Authority shall issue a medical marijuana transporter
	119	+	license to licensed medical m arijuana commercial growers, processors

150		-	license to licensed medical marijuana commercial growers, processors
151	146		and dispensaries upon issuance of such licenses and upon each
152	147		renewal. Medical marijuana transporter licenses shall also be
153	148		issued to licensed medical marijuana research facilities, medical
154	149		marijuana education facil ities and medical marijuana testing
155	150		laboratories upon issuance of such licenses and upon each renew al.
156	151		C. A medical marijuana transporter license may also be issued
157	152		to qualifying applicants who are registered with the Secretary of
158	153		State and otherwise meet the requirements for a medical marijuana
159	154		business license set forth in the Oklahoma Medical Marijuana and
160	155		Patient Protection Act and the requirements set forth in this
161	156		section to provide logistics, distribution and storage of medical
162	157		marijuana, medical ma rijuana concentrate and medical marijuana
163	158		products.
164	159		D. A medical marijuana transporter license shall be valid for
165	160		one (1) year and shall not be transferred with a change of
166	161		ownership. A licensed medical marijuana transporter shall be
167	162		responsible for all medical marijuana, medical marijuana concentrate
168	163		and medical marijuana products once the transporter takes control of
169	164		the product.
170	165		E. A transporter license shall be required for any person or
171	166		entity to transport or transfer medical marijuana, medical mari juana
172	167		concentrate or medical marijuana products from a licensed medical
173	168		marijuana business to another me dical marijuana business, or from a
	169	+	medical marijuana business to a medical marijuana research facility

206	200		F. A medical marijuana transporter licensee may contract with
207	201		multiple licensed medical marijuana businesses.
208	202		G. A medical marijuana transporter may maintain a licensed
209	203		premises to temporarily store medical marijuana, medical marijuana
210	204		concentrate and medical marijuana products and to use as a
211	205		centralized distribution point. A medical marijuana transporter may
212	206		store and distribute medical marijuana, medical marijuana
213	207		concentrate and medical marijuana products from the licensed
214	208		premises. The licensed premises shall meet all security
215	209		requirements applicable to a medical marij uana business. The
216	210		Authority shall issue licenses upon proper application by a licensee
217	211		and determination by the Authority that the proposed site and
218	212		facility are physically and technically suitable.
219	213		H. A medical marijuana transporter licensee shall use the seed-
220	214		to-sale tracking system developed pursuant to the Oklahoma Medical
221	215		Marijuana and Patient Protection Act to create shipping manifests
222	216		documenting the transport or temporary storage of medical marijuana,
223	217		medical marijuana concentrate and medical mar ijuana products
224	218		throughout the state.

252	245		I. A licensed medical marijuana transporter may maintain and
253	246		operate one or more warehouses in the state to handle medical
254	247		marijuana, medical marijuana concentrate and medical marijuana
255	248		products, provided the licensee possesses a valid, unexpired medical
256	249		marijuana transporter license and ha s applied for and received a
257	250		permit for each warehouse location. The Authority shall issue an
258	251		annual permit for each warehouse location operated by a licensee
259	252		that is equal to the a nnual medical marijuana transporter li cense
260	253		term. There shall be no limit to the number of permits issu ed under
261	254		a medical marijuana transporter license. A permit shall be issued
262	255		only upon proper application by a licensee and determination by the
263	256		Authority that the proposed site and facility are physically and
264	257		technically suitable. Upon determination that the proposed site and
265	258		facility are not physically and technically suitable, the Authority
266	259		may deny the permit. Each warehouse location shall be registered
267	260		approved and inspected by the Auth ority prior to its use. Medical
268	261		marijuana transporter warehouses that are licensed and approved by
269	262		the Authority may temporarily store medical marijuana, medical
270	263		marijuana concentrate, and medical marijuana products, provided all
271	264		temporary storage is documented, tracked, and traceable in the
272	265		state-mandated seed-to-sale tracking system .
273	266		J. With the exception of a lawful transfer between medical
274	267		marijuana businesses who that are licensed to operate at the same

302	294		physical address, all medical marijuana, medical marijuana
303	295		concentrate and medical marijuana products shall be tr ansported:
304	296		1. In vehicles equipped with Global Positioning System (GPS)
305	297		trackers;
306	298		2. In a locked container and clearly labeled “Medical Marijuana
307	299		or Derivative”; and
308	300		3. In a secured area of the vehicle that is not accessible by
309	301		the driver during transit.
310	302		K. A transporter agent may possess medical marijuana at any
311	303		location while the transporter agent is transferring medical
312	304		marijuana to or from a licen sed medical marijuana business, licensed
313	305		medical marijuana research facility or licensed medical marijua na
314	306		education facility, or from a licensed medical marijuana dispensary
315	307		to a licensed medical marijuana patient with a Veterans Affairs
316	308		Benefit Summary Letter with a disability rating of one hundred
317	309		percent (100%). The Authority shall administer the provisio ns of
318	310		this section and the Authority, the Oklahoma State Bureau of
319	311		Narcotics and Dangerous Drugs Control, the Oklahoma State Bureau of
320	312		Investigation, and the Attorney General shall have the authority to
321	313		enforce the provisions of this section concerning t ransportation.
322	314		L. The Authority shall issue a transporter agent license to
323	315		individual agents, employees, officers or owners of a transporter
324	316		license in order for the individual to qualify to transport medical

353	344		products.
354	345		M. The annual fee for a transporter agent license shall be
355	346		Twenty-five Dollars ($25.00) and shall be paid by the transporter
356	347		license-holder or the individual applicant. Transporter agent
357	348		license reprints shall be Twenty Dollars ($20.00).
358	349		N. The Authority shall issue each transporter agent a registry
359	350		identification card within thirty (30) days of receipt of:
360	351		1. The name, address and date of birth of the person;
361	352		2. Proof of current state residency;
362	353		3. Proof of identity as required for a medical marijuana
363	354		business license;
364	355		4. Possession of a valid state -issued driver license;
365	356		5. Verification of employment with a licensed transporter;
366	357		6. The application and affiliated fee; and
367	358		7. A copy of the criminal background check conduct ed by the
368	359		Oklahoma State Bureau of Investigation, paid for by the applicant.
369	360		O. If the transporter agent application is denied, the
370	361		Authority shall notify the transporter in writing of the reason for
371	362		denying the registry identification card.
372	363		P. A registry identification card for a transporter agent shall
373	364		expire one (1) year after the date of issuance or upon notification
374	365		from the holder of the transport er license that the transporter
375	366		agent ceases to work as a transporter.

403	393		Q. The Authority may revoke the registry identification card of
404	394		a transporter agent who knowingly violates any provision of this
405	395		section, and the transporter is subject to any other pe nalties
406	396		established by law for the violation.
407	397		R. The Authority may revoke or suspend the transporter license
408	398		of a transporter that the Authority determines knowingly aided or
409	399		facilitated a violation of any provision of this section, and the
410	400		license holder is subject to any other penalties established in law
411	401		for the violation.
412	402		S. Vehicles used in the transp ort of medical marijuana or
413	403		medical marijuana product shall be:
414	404		1. Insured at or above the legal requirements in this state;
415	405		2. Capable of securing me dical marijuana during transport; and
416	406		3. In possession of a shipping container as defined in Section
417	407		427.2 of this title capable of securing all transported products.
418	408		T. Prior to the transport of any medical marijuana, medical
419	409		marijuana concentrate or me dical marijuana products, an inventory
420	410		manifest shall be prepared at the origination point of the medica l
421	411		marijuana. The inventory manifest shall include the following
422	412		information:
423	413		1. For the origination point of the medical marijuana:
424	414		a. the licensee number for the commercial grower,
425	415		processor, or dispensary,
426	416		b. the address of origination of transport, and

456	445		2. For temporary storage at a medical marijuana transporter
457	446		licensed premises or wa rehouse location that is licensed and
458	447		approved by the Authority :
459	448		a. the licensee number for the medical marijuana
460	449		commercial grower, medical marijuana processor, or
461	450		medical marijuana dispensary,
462	451		b. the address of origination of transport,
463	452		c. the name and contact information for the originating
464	453		licensee, and
465	454		d. the license number, physical address, and name and
466	455		contact information of the medical marijuana
467	456		transporter licensed premises or warehouse location
468	457		and notation that the medical marijuana, medical
469	458		marijuana concentrate, and medical marijuana products
470	459		are being temporarily stored;
471	460		3. For the end recipient license holder of the medical
472	461		marijuana:
473	462		a. the license number for the dispensary, commercial
474	463		grower, processor, research facility , or education
475	464		facility destination,
476	465		b. the address of the destination, and

506	494		3. 4. Quantities by weight or unit of each type of medical
507	495		marijuana product contained in transport;
508	496		4. 5. The date of the transpor t and the approximate time of

510	498		5. 6. The arrival date and estimated time of arrival;
511	499		6. 7. Printed names and signatures of the personnel
512	500		accompanying the transport; and
513	501		7. 8. Notation of the transporting licensee.
514	502		U. 1. A separate inventory manifest shall be prepared for each
515	503		business licensee receiving the medical marijuana .
516	504		2. The transporter agent shall provide the other medical
517	505		marijuana business with a copy of the inventory manifest at the time
518	506		the product changes hands and after the ot her licensee prints his or
519	507		her name and signs the inventory manifest .
520	508		3. A receiving business licensee shall refuse to accept any
521	509		medical marijuana, medical marijuana concentrate or medical
522	510		marijuana products that are not accompanied by an inventory
523	511		manifest.
524	512		4. Originating and receiving business licensees, including
525	513		medical marijuana transporter warehouses temporarily storing medical
526	514		marijuana, medical marijuana concentrate, and medical marijuana
527	515		products, shall maintain copies of inventory manifests and logs of

557	544		V. 1. A medical marijuana transporter license issued to a
558	545		licensed dispensary or a licensed medical marijuana transporter
559	546		issued pursuant to this section shall al low the holder to transport
560	547		medical marijuana for a medical marijuana dispensary licensed in
561	548		this state to a medical marijuana patient licensed in this state
562	549		with a Veterans Affairs Benefit Summary Letter with a disability
563	550		rating of one hundred percent (10 0%).
564	551		2. Prior to the transport of any medical marijuana, medical
565	552		marijuana concentrate, and medical marijuana products, a sales
566	553		receipt shall be prepared at the medical marijuana dispensary
567	554		licensed in this state. A separate receipt shall be prepared for
568	555		each medical marijuana patient licensee receiving the medical
569	556		marijuana delivery. A quick response (QR) code displayed on the
570	557		package may be used in place of a paper receipt .
571	558		3. The inventory manifest shall include the following
572	559		information:
573	560		a. for the origination point of the medical marijuana:
574	561		(1) the license number for the dispensary,
575	562		(2) the address of origination of transport, and
576	563		(3) the name and contact information for the
577	564		originating dispensary ,
578	565		b. for the end recipient medical marijuana licensee :

613	599		marijuana product contained in transport,
614	600		d. the date of the transport and the approximate time of

616	602		e. the arrival date and estimated time of arrival,
617	603		f. printed names and signatures, and
618	604		g. notation of the transporter licensee.
619	605		4. All delivery sales from a licensed medi cal marijuana
620	606		dispensary to a licensed medical marijuana patient shall be
621	607		accomplished through a third -party vendor and shall require:
622	608		a. the patient to download an applicatio n on his or her
623	609		electronic device,
624	610		b. the patient to upload a valid driver license, a
625	611		medical marijuana patient license, a three-dimensional
626	612		(3D) facial map to the application prior to placing an
627	613		order, and a current Veterans Affairs Benefit Summary
628	614		Letter with a disability rating of one hundred percent
629	615		(100%),

658	643		enter a security code to access the application ,
659	644		d. the software to verify the patient card with the
660	645		Authority’s database to confirm that the pat ient’s
661	646		license is active each time a delivery order is
662	647		initiated,
663	648		e. the patient to render payment throu gh the application
664	649		upon verification of an active license ,
665	650		f. the information to be securely transmitted to a
666	651		licensed medical marijuana dispensary following the
667	652		verification of payment,
668	653		g. a location finder, allowing the patient and
669	654		transporter agent to identify the location of the
670	655		other, and
671	656		h. the patient to perform a final 3D facial mapping upon
672	657		the transporter agent’s arrival to verify that the
673	658		individual accepting the delivery is the licensed
674	659		patient who placed the order .
675	660		5. After completing this fin al verification, the delivery can
676	661		be finalized.
677	662		SECTION 3. NEW LAW A new section of law to be codified
678	663		in the Oklahoma Statutes as Section 427.16a of Title 63, unless
679	664		there is created a duplication in numbering, reads as follows:

707	691		A. There is hereby created within the Oklahoma Medical
708	692		Marijuana Authority a Medical Marijuana Veterans Transporter Pilot
709	693		Program. The program s hall permit qualifying entities to transport
710	694		medical marijuana from a licensed medical marijuana dispensary to a
711	695		licensed medical marijuana patient with a current Veterans Affairs

713	697		percent (100%). The pilot program shall expire at the conclusion of

715	699		B. The Authority shall promulgate rules necessary to implement

717	701		SECTION 4. This act shall become effective November 1, 20 25.
