121 | 117 | | B. Pursuant to Section 424 of this title, the Oklahoma Medical |

122 | 118 | | Marijuana Authority shall issue a medical marijuana transporter |

152 | 147 | | renewal. Medical marijuana transporter licenses shall also be |

156 | 151 | | C. A medical marijuana transporter license may also be issued |

157 | 152 | | to qualifying applicants who are registered with the Secretary of |

158 | 153 | | State and otherwise meet the requirements for a medical marijuana |
---|
159 | 154 | | business license set forth in the Oklahoma Medical Marijuana and |
---|
160 | 155 | | Patient Protection Act and the requirements set forth in this |
---|
161 | 156 | | section to provide logistics, distribution and storage of medical |
---|
162 | 157 | | marijuana, medical ma rijuana concentrate and medical marijuana |
---|
163 | 158 | | products. |
---|
164 | 159 | | D. A medical marijuana transporter license shall be valid for |
---|
165 | 160 | | one (1) year and shall not be transferred with a change of |
---|
166 | 161 | | ownership. A licensed medical marijuana transporter shall be |
---|
167 | 162 | | responsible for all medical marijuana, medical marijuana concentrate |
---|
168 | 163 | | and medical marijuana products once the transporter takes control of |
---|
169 | 164 | | the product. |
---|
170 | 165 | | E. A transporter license shall be required for any person or |
---|
171 | 166 | | entity to transport or transfer medical marijuana, medical mari juana |
---|
172 | 167 | | concentrate or medical marijuana products from a licensed medical |
---|
173 | 168 | | marijuana business to another me dical marijuana business, or from a |
---|
202 | 196 | | or medical marijuana education facility , or from a licensed medical |
---|
203 | 197 | | marijuana dispensary to a licensed medical marijuana patient with a |

206 | 200 | | F. A medical marijuana transporter licensee may contract with |

207 | 201 | | multiple licensed medical marijuana businesses. |

208 | 202 | | G. A medical marijuana transporter may maintain a licensed |

209 | 203 | | premises to temporarily store medical marijuana, medical marijuana |
---|
210 | 204 | | concentrate and medical marijuana products and to use as a |
---|
211 | 205 | | centralized distribution point. A medical marijuana transporter may |
---|
212 | 206 | | store and distribute medical marijuana, medical marijuana |
---|
213 | 207 | | concentrate and medical marijuana products from the licensed |
---|
214 | 208 | | premises. The licensed premises shall meet all security |
---|
215 | 209 | | requirements applicable to a medical marij uana business. The |
---|
216 | 210 | | Authority shall issue licenses upon proper application by a licensee |
---|
217 | 211 | | and determination by the Authority that the proposed site and |
---|
218 | 212 | | facility are physically and technically suitable. |
---|
219 | 213 | | H. A medical marijuana transporter licensee shall use the seed- |
---|
220 | 214 | | to-sale tracking system developed pursuant to the Oklahoma Medical |
---|
221 | 215 | | Marijuana and Patient Protection Act to create shipping manifests |
---|
222 | 216 | | documenting the transport or temporary storage of medical marijuana, |
---|
223 | 217 | | medical marijuana concentrate and medical mar ijuana products |
---|

255 | 248 | | products, provided the licensee possesses a valid, unexpired medical |
---|
256 | 249 | | marijuana transporter license and ha s applied for and received a |
---|
257 | 250 | | permit for each warehouse location. The Authority shall issue an |
---|
258 | 251 | | annual permit for each warehouse location operated by a licensee |
---|
259 | 252 | | that is equal to the a nnual medical marijuana transporter li cense |
---|
260 | 253 | | term. There shall be no limit to the number of permits issu ed under |
---|
261 | 254 | | a medical marijuana transporter license. A permit shall be issued |
---|
262 | 255 | | only upon proper application by a licensee and determination by the |
---|
263 | 256 | | Authority that the proposed site and facility are physically and |
---|
264 | 257 | | technically suitable. Upon determination that the proposed site and |
---|
265 | 258 | | facility are not physically and technically suitable, the Authority |
---|
266 | 259 | | may deny the permit. Each warehouse location shall be registered |
---|
267 | 260 | | approved and inspected by the Auth ority prior to its use. Medical |
---|
268 | 261 | | marijuana transporter warehouses that are licensed and approved by |
---|
269 | 262 | | the Authority may temporarily store medical marijuana, medical |
---|
270 | 263 | | marijuana concentrate, and medical marijuana products, provided all |
---|
271 | 264 | | temporary storage is documented, tracked, and traceable in the |
---|
272 | 265 | | state-mandated seed-to-sale tracking system . |
---|
273 | 266 | | J. With the exception of a lawful transfer between medical |

310 | 302 | | K. A transporter agent may possess medical marijuana at any |

311 | 303 | | location while the transporter agent is transferring medical |
---|
312 | 304 | | marijuana to or from a licen sed medical marijuana business, licensed |
---|
313 | 305 | | medical marijuana research facility or licensed medical marijua na |
---|
314 | 306 | | education facility, or from a licensed medical marijuana dispensary |
---|
315 | 307 | | to a licensed medical marijuana patient with a Veterans Affairs |
---|
316 | 308 | | Benefit Summary Letter with a disability rating of one hundred |
---|
317 | 309 | | percent (100%). The Authority shall administer the provisio ns of |
---|
318 | 310 | | this section and the Authority, the Oklahoma State Bureau of |
---|
319 | 311 | | Narcotics and Dangerous Drugs Control, the Oklahoma State Bureau of |
---|
320 | 312 | | Investigation, and the Attorney General shall have the authority to |
---|
321 | 313 | | enforce the provisions of this section concerning t ransportation. |
---|
322 | 314 | | L. The Authority shall issue a transporter agent license to |
---|
323 | 315 | | individual agents, employees, officers or owners of a transporter |
---|
324 | 316 | | license in order for the individual to qualify to transport medical |
---|

358 | 349 | | N. The Authority shall issue each transporter agent a registry |
---|
359 | 350 | | identification card within thirty (30) days of receipt of: |
---|
360 | 351 | | 1. The name, address and date of birth of the person; |
---|
361 | 352 | | 2. Proof of current state residency; |
---|
362 | 353 | | 3. Proof of identity as required for a medical marijuana |
---|
363 | 354 | | business license; |
---|
364 | 355 | | 4. Possession of a valid state -issued driver license; |
---|
365 | 356 | | 5. Verification of employment with a licensed transporter; |
---|
366 | 357 | | 6. The application and affiliated fee; and |
---|
367 | 358 | | 7. A copy of the criminal background check conduct ed by the |
---|
368 | 359 | | Oklahoma State Bureau of Investigation, paid for by the applicant. |
---|
369 | 360 | | O. If the transporter agent application is denied, the |
---|
370 | 361 | | Authority shall notify the transporter in writing of the reason for |
---|
371 | 362 | | denying the registry identification card. |
---|
372 | 363 | | P. A registry identification card for a transporter agent shall |
---|
373 | 364 | | expire one (1) year after the date of issuance or upon notification |
---|
374 | 365 | | from the holder of the transport er license that the transporter |
---|
375 | 366 | | agent ceases to work as a transporter. |

407 | 397 | | R. The Authority may revoke or suspend the transporter license |

410 | 400 | | license holder is subject to any other penalties established in law |

411 | 401 | | for the violation. |
---|
412 | 402 | | S. Vehicles used in the transp ort of medical marijuana or |
---|
413 | 403 | | medical marijuana product shall be: |
---|
414 | 404 | | 1. Insured at or above the legal requirements in this state; |
---|
415 | 405 | | 2. Capable of securing me dical marijuana during transport; and |
---|
416 | 406 | | 3. In possession of a shipping container as defined in Section |
---|
417 | 407 | | 427.2 of this title capable of securing all transported products. |
---|
418 | 408 | | T. Prior to the transport of any medical marijuana, medical |
---|
419 | 409 | | marijuana concentrate or me dical marijuana products, an inventory |
---|
420 | 410 | | manifest shall be prepared at the origination point of the medica l |
---|
421 | 411 | | marijuana. The inventory manifest shall include the following |
---|

520 | 508 | | 3. A receiving business licensee shall refuse to accept any |

522 | 510 | | marijuana products that are not accompanied by an inventory |

566 | 553 | | receipt shall be prepared at the medical marijuana dispensary |
