46	39		26 O.S. 2021, Section 2 -117, which relates to

50	43		execution of duties under certain circumstances;

59	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	53		SECTION 1. AMENDATORY 26 O.S. 2021, Section 2 -117, is
61	54		amended to read as follows:
62	55		Section 2-117. A. The secretary of the county election board
63	56		shall be the administrative offic er of the county election board and
64	57		shall have general supervisory authority over all precinct officials
65	58		and absentee voting board members within the county.
66	59		B. The secretary shall employ an assistant secretary and such
67	60		other employees as are nece ssary to perform the duties of the county
	61	+	election board. In the event a vacancy exists in the office of the
	62	+	secretary of the county election board, the Secretary of the State
	63	+	Election Board shall have the authority to stand in the place of the

95		-	election board. In the event a vacancy exists in the office of the
96		-	secretary of the county election board, the Secre tary of the State
97		-	Election Board shall have the authority to stand in the place of the
98	90		secretary of the county election board for the purpose of employing
99	91		necessary county election board personnel.
100	92		C. The secretary of the county election board shall be charged
101	93		with the operational responsibilities of the board , including, but
102	94		not limited to:
103	95		1. The supervision, defining job positions and
104	96		responsibilities, and discharge of the employees of the county
105	97		election board;
106	98		2. The preparation of the annual budget;
107	99		3. The preparation and filing of all reports; and
108	100		4. The implementation of policy, findings , and actions required
109	101		by law or lawfully prescribed or determined by the county election
110	102		board.
111	103		D. The minimum salary of the assistant secretary shall be equal
112	104		to ninety percent (90%) of the scheduled salary of the secretary in
113	105		the same county, but shall not exceed the salary of the highest
114	106		salaried first or chief deputy or assistant to any county officer,
115	107		excluding the under sheriff, in the same county. Provided, the
116	108		minimum salary may be prorated if a county election board office is
117	109		open to the public for fewer hours per day than the average of the
118	110		regular public office hours of other county offices. The salary
	111	+	limitation contained in this section shall not operate to reduce the
	112	+	salary of any person employed as an assistant secretary or chief
	113	+	clerk on October 31, 2019.

146		-	limitation contained in this section shall not o perate to reduce the
147		-	salary of any person employed as an assistant secretary or chief
148		-	clerk on October 31, 2019.
149	140		E. Salaries of additional personnel, including personnel
150	141		employed temporarily, shall not exceed the salary of the assistant
151	142		secretary and shall be comparable to salaries paid for the same
152	143		positions in other offices within the county.
153	144		F. The salaries of the assistant secretary and other personnel
154	145		shall be paid from county funds on a monthly basis. In the event
155	146		that the secretary, assistant secretary or any other essential
156	147		county election board employee must be away from work for a period
157	148		of time due to personal illness, family illness, or family
158	149		emergency, the county shall be required to fund compensation of
159	150		appropriate temporary personnel during the employee ’s absence.
160	151		G. 1. The secretary of the county election board shall notify
161	152		the Secretary of the State Election Board of the person employed
162	153		pursuant to subsection B of this section as the assistant secretary
163	154		of the county election board. The assistant secretary shall be
164	155		subject to the direction of the secretary of the county election
165	156		board.
166	157		2. The assistant secretary shall execute the duties of the
167	158		secretary during the absence of the secretary due to illness,
168	159		disqualification, recusal, or any other reason approved in writing
169	160		by the Secretary of the State Election Board.
	161	+	3. In the event of a vacancy in the office of the secretary of
	162	+	the county election board due to the death, removal, or resignation
	163	+	of the secretary, the assistant secretary shall execute the duties

197		-	3. In the event of a vacancy in the office of the secretary of
198		-	the county election board due to the death, removal, or resignation
199		-	of the secretary, the assistant secretary shall execute the duties
200	190		of the secretary until a successor is appointed as prescribed by
201	191		law.
202	192		4. In the event of an absence or vacancy described in this
203	193		subsection, the assistant secretary may stand in the place of the
204	194		secretary of the county election board as a voting member of the
205	195		county election board at public meetings of the board with the
206	196		written authority of the Secretary of the State Election Board.
207	197		SECTION 2. This act shall become effective November 1, 2025.
