4538 An Act relating to county election boards; amending
4639 26 O.S. 2021, Section 2 -117, which relates to

5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6053 SECTION 1. AMENDATORY 26 O.S. 2021, Section 2 -117, is
6154 amended to read as follows:
6255 Section 2-117. A. The secretary of the county election board
6356 shall be the administrative offic er of the county election board and
6457 shall have general supervisory authority over all precinct officials
6558 and absentee voting board members within the county.
6659 B. The secretary shall employ an assistant secretary and such
6760 other employees as are nece ssary to perform the duties of the county
61+election board. In the event a vacancy exists in the office of the
62+secretary of the county election board, the Secretary of the State
63+Election Board shall have the authority to stand in the place of the

95-election board. In the event a vacancy exists in the office of the
96-secretary of the county election board, the Secre tary of the State
97-Election Board shall have the authority to stand in the place of the
9890 secretary of the county election board for the purpose of employing
9991 necessary county election board personnel.
10092 C. The secretary of the county election board shall be charged
10193 with the operational responsibilities of the board , including, but
10294 not limited to:
10395 1. The supervision, defining job positions and
10496 responsibilities, and discharge of the employees of the county
10597 election board;
10698 2. The preparation of the annual budget;
10799 3. The preparation and filing of all reports; and
108100 4. The implementation of policy, findings , and actions required
109101 by law or lawfully prescribed or determined by the county election
110102 board.
111103 D. The minimum salary of the assistant secretary shall be equal
112104 to ninety percent (90%) of the scheduled salary of the secretary in
113105 the same county, but shall not exceed the salary of the highest
114106 salaried first or chief deputy or assistant to any county officer,
115107 excluding the under sheriff, in the same county. Provided, the
116108 minimum salary may be prorated if a county election board office is
117109 open to the public for fewer hours per day than the average of the
118110 regular public office hours of other county offices. The salary
111+limitation contained in this section shall not operate to reduce the
112+salary of any person employed as an assistant secretary or chief
113+clerk on October 31, 2019.

146-limitation contained in this section shall not o perate to reduce the
147-salary of any person employed as an assistant secretary or chief
148-clerk on October 31, 2019.
149140 E. Salaries of additional personnel, including personnel
150141 employed temporarily, shall not exceed the salary of the assistant
151142 secretary and shall be comparable to salaries paid for the same
152143 positions in other offices within the county.
153144 F. The salaries of the assistant secretary and other personnel
154145 shall be paid from county funds on a monthly basis. In the event
155146 that the secretary, assistant secretary or any other essential
156147 county election board employee must be away from work for a period
157148 of time due to personal illness, family illness, or family
158149 emergency, the county shall be required to fund compensation of
159150 appropriate temporary personnel during the employee ’s absence.
160151 G. 1. The secretary of the county election board shall notify
161152 the Secretary of the State Election Board of the person employed
162153 pursuant to subsection B of this section as the assistant secretary
163154 of the county election board. The assistant secretary shall be
164155 subject to the direction of the secretary of the county election
165156 board.
166157 2. The assistant secretary shall execute the duties of the
167158 secretary during the absence of the secretary due to illness,
168159 disqualification, recusal, or any other reason approved in writing
169160 by the Secretary of the State Election Board.
161+3. In the event of a vacancy in the office of the secretary of
162+the county election board due to the death, removal, or resignation
163+of the secretary, the assistant secretary shall execute the duties

197-3. In the event of a vacancy in the office of the secretary of
198-the county election board due to the death, removal, or resignation
199-of the secretary, the assistant secretary shall execute the duties
200190 of the secretary until a successor is appointed as prescribed by
201191 law.
202192 4. In the event of an absence or vacancy described in this
203193 subsection, the assistant secretary may stand in the place of the
204194 secretary of the county election board as a voting member of the
205195 county election board at public meetings of the board with the
206196 written authority of the Secretary of the State Election Board.
207197 SECTION 2. This act shall become effective November 1, 2025.
