42	68		under certain circumstances ; requiring removal of

44	70		certain determination ; and providing an effective

51	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	78		SECTION 1. AMENDATORY 11 O.S. 2021, Section 22 -123, is
53	79		amended to read as follows:
54	80		Section 22-123. A. As used in this act, “vagrant” means a
55	81		person who is in, remains in, or wanders about a public or private
56	82		place for any illegal purpose.
57	83		B. The A municipal governing body may provide by ordinance for
58	84		the arrest, fine, and imprisonment of vagrants.
59	85		C. The proprietor or manager of a business has the right to
60	86		contact law enforcement to remove a vagrant if the vagrant is within
61	87		twelve (12) feet of any doorway of the business, even if such
62	88		vagrant is on public property.

90	140		D. Upon arrival at the business, the la w enforcement officer
91	141		shall determine, through personal observation or viewing of video
92	142		footage, whether the person accused of being a vagra nt meets the
93	143		definition provided in subsection A of this section. Upon
94	144		determination that the person meets the definition of a vagrant, the
95	145		officer shall relocate the vagrant to public property that is at
96	146		least one-half (1/2) mile away from the location o f the business
97	147		which made the initial contact to law enforcement . The location for
98	148		relocation shall not be within one -quarter (1/4) mile of a ny other
99	149		business.
100	150		SECTION 2. This act shall become effective November 1, 2025.
