5177 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5278 SECTION 1. AMENDATORY 11 O.S. 2021, Section 22 -123, is
5379 amended to read as follows:
5480 Section 22-123. A. As used in this act, “vagrant” means a
5581 person who is in, remains in, or wanders about a public or private
5682 place for any illegal purpose.
5783 B. The A municipal governing body may provide by ordinance for
5884 the arrest, fine, and imprisonment of vagrants.
5985 C. The proprietor or manager of a business has the right to
6086 contact law enforcement to remove a vagrant if the vagrant is within
6187 twelve (12) feet of any doorway of the business, even if such
6288 vagrant is on public property.

90140 D. Upon arrival at the business, the la w enforcement officer
91141 shall determine, through personal observation or viewing of video
92142 footage, whether the person accused of being a vagra nt meets the
93143 definition provided in subsection A of this section. Upon
94144 determination that the person meets the definition of a vagrant, the
95145 officer shall relocate the vagrant to public property that is at
96146 least one-half (1/2) mile away from the location o f the business
97147 which made the initial contact to law enforcement . The location for
98148 relocation shall not be within one -quarter (1/4) mile of a ny other
99149 business.
100150 SECTION 2. This act shall become effective November 1, 2025.
