5577 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5678 SECTION 1. NEW LAW A ne w section of law to be codified
5779 in the Oklahoma Statutes as Section 329.1 of T itle 59, unless there
5880 is created a duplication in numbering, reads as follows:
5981 The Dentist and Dental Hygienist Compact is hereby enacted into
6082 law and the Governor shall enter in to the Compact on behalf of the
6183 State of Oklahoma with any jurisdiction legally joined therein, in
6284 the form substantially as set forth in this act.
6385 SECTION 2. NEW LAW A new section of law to be codified
6486 in the Oklahoma Statutes as S ection 329.2 of Title 59, unless there
6587 is created a duplication in numbering, reads as follows:

94140 SECTION 1: TITLE AND PURPOSE
95141 This statute shall be known and cited as the “Dentist and Dental
96142 Hygienist Compact”. The purposes of this Compact are to facilitate
97143 the interstate practice of dentistry and dental hygiene and improve
98144 public access to dentistry and dental hygiene services by providing
99145 Dentists and Dental Hygienists licensed in a Participating State the
100146 ability to practice in Participating States in which they are not
101147 licensed. The Compact does this by establishing a pathway for
102148 Dentists and Dental Hygienists licensed in a Participating State to
103149 obtain a Compact Privilege that authorizes them to practice in
104150 another Participating State in which they are not licensed. The
105151 Compact enables Participating States to protect the public health
106152 and safety with respect to the practice of such Dentists and Dental
107153 Hygienists, through the State ’s authority to regulate the practi ce
108154 of dentistry and dental hygiene in the State. The Compact:
109155 A. Enables Dentists and Dental Hygienists who qualify for a
110156 Compact Privilege to practice in other Participating States without
111157 satisfying burdensome and duplicative requirements associated wi th
112158 securing a License to practice in those States .
113159 B. Promotes mobility and addresses workforce shortages through
114160 each Participating State ’s acceptance of a Compact Privilege to
115161 practice in that State .

156226 the practice of dentistry and dental hygiene within its borders to
157227 Dentists and Dental Hygienists who practice in the State through a
158228 Compact Privilege.
159229 I. Promotes the cooperation of Participating State s in
160230 regulating the practice of dentistry and dental hygiene within those
161231 States.
162232 J. Facilitates the relocation of military members and their
163233 spouses who are licensed to practice dentistry or dental hygiene .
164234 SECTION 2: DEFINITIONS
165235 As used in this Compact, unless the context requires otherwise,
166236 the following definitions shall apply:

194288 A. “Active Military Member ” means any person with full -time
195289 duty status in the armed forc es of the United States, including
196290 members of the National Guard and Reserve .
197291 B. “Adverse Action” means disciplinary action or encumbrance
198292 imposed on a License or Compact Privilege by a State Licensing
199293 Authority.
200294 C. “Alternative Program” means a non-disciplinary monitoring or
201295 practice remediation process applicable to a Dentist or Dental
202296 Hygienist approved by a State Licensing Authority of a Participating
203297 State in which the Dentist or Dental Hygienist is licensed. This
204298 includes, but is not limited to, pr ograms to which Licensees with
205299 substance abuse or addiction issues are referred in lieu of Adverse
206300 Action.
207301 D. “Clinical Assessment” means examination or process, required
208302 for licensure as a Dentist or Dental Hygienist as applicable, that
209303 provides evidence of clinical competence in dentistry or dental
210304 hygiene.
211305 E. “Commissioner” means the individual appointed by a
212306 Participating State to serve as the member of the Commission for
213307 that Participating State .
214308 F. “Compact” means this Dentist and Dental Hygienist Compact.
215309 G. “Compact Privilege” means the authorization granted by a
216310 Remote State to allow a Licensee from a Participating State to
217311 practice as a Dentist or Dental Hygienist in a Remote State .

245363 H. “Continuing Professional Development ” means a requirement,
246364 as a condition of License renewal , to provide evidence of successful
247365 participation in educational or professional activities relevant to
248366 practice or area of work .
249367 I. “Criminal Background Check ” means the submission of
250368 fingerprints or other biometric -based information for a License
251369 applicant for the purpose of obtaining that applicant ’s criminal
252370 history record information, as defined in 28 C.F.R. , Section 20.3(d)
253371 from the Federal Bureau of Investigation and the State ’s criminal
254372 history record repository as defined in 28 C.F.R. , Section 20.3(f).
255373 J. “Data System” means the Commission ’s repository of
256374 information about Licensees, including but not limited to
257375 examination, licensure, investigative, Compact Privilege, Adverse
258376 Action, and Alternative Program .
259377 K. “Dental Hygienist” means an individual who is licensed by a
260378 State Licensing Authority to practice dental hygiene .
261379 L. “Dentist” means an individual who is licensed by a State
262380 Licensing Authority to practice dentistry .
263381 M. “Dentist and Dental Hygienist Comp act Commission” or
264382 “Commission” means a joint government agency established by this
265383 Compact comprised of each State that has enacted the Compact and a
266384 national administrative body comprised of a Commissioner from each
267385 State that has enacted the Compact .

295437 N. “Encumbered License” means a License that a State Licensing
296438 Authority has limited in any way other than through an Alternative
297439 Program.
298440 O. “Executive Board” means the Chair, Vice Chair, Secretary and
299441 Treasurer and any other Commissioners as may be deter mined by
300442 Commission Rule or bylaw .
301443 P. “Jurisprudence Requirement ” means the assessment of an
302444 individual’s knowledge of the laws and Rules governing the practice
303445 of dentistry or dental hygiene, as applicable, in a State .
304446 Q. “License” means current authori zation by a State, other than
305447 authorization pursuant to a Compact Privilege, or other privilege,
306448 for an individual to practice as a Dentist or Dental Hygienist in
307449 that State.
308450 R. “Licensee” means an individual who holds an unrestricted
309451 License from a Parti cipating State to practice as a Dentist or
310452 Dental Hygienist in that State .
311453 S. “Model Compact” means the model for the Dentist and Dental
312454 Hygienist Compact on file with the Council of State Governments or
313455 other entity as designated by the Commission .
314456 T. “Participating State” means a State that has enacted the
315457 Compact and been admitted to the Commission in accordance with the
316458 provisions herein and Commission Rules .

344510 U. “Qualifying License” means a License that is not an
345511 Encumbered License issued by a Partic ipating State to practice
346512 dentistry or dental hygiene .
347513 V. “Remote State” means a Participating State where a Licensee
348514 who is not licensed as a Dentist or Dental Hygienist is exercising
349515 or seeking to exercise the Compact Privilege .
350516 W. “Rule” means a regulation promulgated by an entity that has
351517 the force of law.
352518 X. “Scope of Practice” means the procedures, actions, and
353519 processes a Dentist or Dental Hygienist licensed in a State is
354520 permitted to undertake in that State and the circumstances under
355521 which the Licensee is permitted to undertake those procedures,
356522 actions and processes. Such procedures, actions and processes and
357523 the circumstances under which they may be undertaken may be
358524 established through means, including, but not limited to, statute,
359525 regulations, case law, and other processes available to the State
360526 Licensing Authority or other government agency .
361527 Y. “Significant Investigative Information ” means information,
362528 records, and documents received or generated by a State Licensing
363529 Authority pursuant to a n investigation for which a determination has
364530 been made that there is probable cause to believe that the Licensee
365531 has violated a statute or regulation that is considered more than a
366532 minor infraction for which the State Licensing Authority could
367533 pursue Adverse Action against the Licensee .

395585 Z. “State” means any state, commonwealth, district, or
396586 territory of the United States of America that regulates the
397587 practices of dentistry and dental hygiene .
398588 AA. “State Licensing Authority ” means an agency or other entit y
399589 of a State that is responsible for the licensing and regulation of
400590 Dentists or Dental Hygienists.
401591 SECTION 3: STATE PARTICIPATION IN THE COMPACT
402592 A. In order to join the Compact and thereafter continue as a
403593 Participating State, a State must:
404594 1. Enact a compact that is not materially different from the
405595 Model Compact as determined in accordance with Commission Rules;
406596 2. Participate fully in the Commission ’s Data System;
407597 3. Have a mechanism in place for receiving and investigating
408598 complaints about its Lic ensees and License applicants;
409599 4. Notify the Commission, in compliance with t he terms of the
410600 Compact and Commission Rules, of any Adverse Action or the
411601 availability of Significant Investigative Information regarding a
412602 Licensee and License applicant;
413603 5. Fully implement a Criminal Background Check requirement,
414604 within a time frame established by Commission Rule, by receiving the
415605 results of a qualifying Criminal Background Check;
416606 6. Comply with the Commission Rules applicable to a
417607 Participating State;

445659 7. Accept the National Board Examinations of the Joint
446660 Commission on National Denta l Examinations or another examination
447661 accepted by Commission Rule as a licensure examination;
448662 8. Accept for licensure that applicants for a Dentist License
449663 graduate from a predo ctoral dental education program accredited by
450664 the Commission on Dental Accreditation, or another accrediting
451665 agency recognized by the United States Department of Education for
452666 the accreditation of dentistry and dental hygiene education
453667 programs, leading to the Doctor of Dental Surgery (D.D.S.) or Doctor
454668 of Dental Medicine (D.M.D.) d egree;
455669 9. Accept for licensure that applicants for a Dental Hygienist
456670 License graduate from a dental hygiene education program accredited
457671 by the Commission on Dental Accreditati on or another accrediting
458672 agency recognized by the United States Department of Education for
459673 the accreditation of dentistry and dental hygiene education
460674 programs;
461675 10. Require for licensure that applicants successfully complete
462676 a Clinical Assessment;
463677 11. Have Continuing Professional Development requirements as a
464678 condition for License renewal; and
465679 12. Pay a participation fee to the Commission as established by
466680 Commission Rule.

494732 B. Providing alternative pathways for an individual to obtain
495733 an unrestricted License does not disqualify a State from
496734 participating in the Compact.
497735 C. When conducting a Criminal Background Check the State
498736 Licensing Authority shall:
499737 1. Consider that information in making a licensure decision;
500738 2. Maintain documentation of completio n of the Criminal
501739 Background Check and background check information to the ext ent
502740 allowed by State and federal law; and
503741 3. Report to the Commission whether it has completed the
504742 Criminal Background Check and whether the individual was granted or
505743 denied a License.
506744 D. A Licensee of a Participating State who has a Qualifying
507745 License in that State and does not hold an Encumbered License in any
508746 other Participating State, shall be issued a Compact Privilege in a
509747 Remote State in accordance with the terms of the C ompact and
510748 Commission Rules. If a Remote State has a Jurisprudence Requiremen t
511749 a Compact Privilege will not be issued to the Licensee unless the
512750 Licensee has satisfied the Jurisprudence Requirement.
513751 SECTION 4: COMPACT PRIVILEGE
514752 A. To obtain and exercise the Compact Privilege under the terms
515753 and provisions of the Compact, the Licensee shall:
516754 1. Have a Qualifying License as a Dentist or Dental Hygienist
517755 in a Participating State;

545807 2. Be eligible for a Compact Privilege in any Remote State in
546808 accordance with subsections D, G and H of this section;
547809 3. Submit to an application process whenever the Licensee is
548810 seeking a Compact Privilege;
549811 4. Pay any applicable Commission and Remote State fees for a
550812 Compact Privilege in the Remote State;
551813 5. Meet any Jurisprudence Requirement established by a Remote
552814 State in which the Licensee is seeking a Compact Privilege;
553815 6. Have passed a National Board Examination of the Joint
554816 Commission on National Dental Examinations or another examination
555817 accepted by Commission Rule;
556818 7. For a Dentist, have graduated from a predoctoral dental
557819 education program ac credited by the Commission on Dental
558820 Accreditation, or another accrediting agency recognized by the
559821 United States Department of Education for the accreditation of
560822 dentistry and dental hygiene education programs, leading to the
561823 Doctor of Dental Surgery (D.D.S.) or Doctor of Dental Medicine
562824 (D.M.D.) degree;
563825 8. For a Dental Hygienist, have graduated from a dental hygiene
564826 education program accredited by the Commission on Dental
565827 Accreditation or another accrediting agency recognized by the United
566828 States Department of Education for the accreditation of dentistry
567829 and dental hygiene education programs;

595881 9. Have successfully completed a Clinical Assessment for
596882 licensure;
597883 10. Report to the Commission Adverse Action taken by any non -
598884 Participating State when applying for a Compact Privilege and,
599885 otherwise, within thirty (30) days from the date the Adverse Action
600886 is taken;
601887 11. Report to the Commission when applying for a Compact
602888 Privilege the address of the Licensee ’s primary residence and
603889 thereafter immediately report to the Commission any change in the
604890 address of the Licensee ’s primary residence; and
605891 12. Consent to accept service of process by mail at the
606892 Licensee’s primary residence on rec ord with the Commission with
607893 respect to any action brought against the Licensee by the Commission
608894 or a Participating State, and consent to accept service of a
609895 subpoena by mail at the Licensee ’s primary residence on record with
610896 the Commission with respect t o any action brought or investigation
611897 conducted by the Commission or a Partici pating State.
612898 B. The Licensee must comply with the requirements of subsection
613899 A of this section to maintain the Compact Privilege in the Remote
614900 State. If those requirements are met, the Compact Privilege will
615901 continue as long as the Licensee maintains a Qualifying License in
616902 the State through which the Licensee applied for the Compact
617903 Privilege and pays any applicable Compact Privilege renewal fees.

645955 C. A Licensee providing dent istry or dental hygiene in a Remote
646956 State under the Compact Privilege shall fu nction within the Scope of
647957 Practice authorized by the Remote State for a Dentist or Dental
648958 Hygienist licensed in that State.
649959 D. A Licensee providing dentistry or dental hygiene pursuant to
650960 a Compact Privilege in a Remote State is subject to that State ’s
651961 regulatory authority. A Remote State may, in accordance with due
652962 process and that State ’s laws, by Adverse Action revoke or remove a
653963 Licensee’s Compact Privilege in the Remote St ate for a specific
654964 period of time and impose fines or take any other necessary actions
655965 to protect the health and safety of its citizens. If a Remote State
656966 imposes an Adverse Action against a Compact Privilege that limits
657967 the Compact Privilege, that Advers e Action applies to all Compact
658968 Privileges in all Remote States. A Licensee whose Compact Privilege
659969 in a Remote State is removed for a specified period of time is not
660970 eligible for a Compact Privilege in any other Remote State until the
661971 specific time for removal of the Compact Privilege has passed and
662972 all encumbrance requirements ar e satisfied.
663973 E. If a License in a Participating State is an Encumbered
664974 License, the Licensee shall lose the Compact Privilege in a Remote
665975 State and shall not be eligible for a C ompact Privilege in any
666976 Remote State until the License is no longer encumbered.
667977 F. Once an Encumbered License in a Participating State is
668978 restored to good standing, the Licensee must meet the requirements

6981032 G. If a Licensee’s Compact Privilege in a Remo te State is
6991033 removed by the Remote State, the individual shall lose or be
7001034 ineligible for the Compact Privilege in any Remote State until the
7011035 following occur:
7021036 1. The specific period of time for which the Compact Privilege
7031037 was removed has ended; and
7041038 2. All conditions for removal of the Compact Privilege have
7051039 been satisfied.
7061040 H. Once the requirements of subsection G of this section have
7071041 been met, the Licensee must meet the requireme nts in subsection A of
7081042 this section to obtain a Compact Privilege in a Remote State.
7091043 SECTION 5: ACTIVE MILITARY MEMBER OR THEIR SPOUSES
7101044 An Active Military Member and their spouse shall not be required
7111045 to pay to the Commission for a Compact Privilege the f ee otherwise
7121046 charged by the Commission. If a Remote State chooses to charge a
7131047 fee for a Compact Privilege, it may choose to charge a reduced fee
7141048 or no fee to an Active Military Member and their spouse for a
7151049 Compact Privilege.
7161050 SECTION 6: ADVERSE ACTIONS
7171051 A. A Participating State in which a Licensee is licensed shall
7181052 have exclusive authority to impose Adverse Action against the
7191053 Qualifying License issued by that Participating State.

7481106 Significant Investigative Information of a Remote State, so long as
7491107 the Participating State follows its own procedures for imposing

7511109 C. Nothing in this Compact shall override a Participating
7521110 State’s decision that participation in an Alternative Program may be
7531111 used in lieu of Adverse Action and that such participation shall
7541112 remain non-public if required by the Participating State ’s laws.
7551113 Participating States must require Licensees who enter any
7561114 Alternative Program in lieu of discipline to agree not to pr actice
7571115 pursuant to a Compact Privilege in any other Participating State
7581116 during the term of the Alternative Program without prior
7591117 authorization from such other Participating State.
7601118 D. Any Participating State in which a Licensee is applying to
7611119 practice or is practicing pursuant to a Compact Privilege may
7621120 investigate actual or alleged violations of the statutes and
7631121 regulations authorizing the practice of dentistry or dental hygiene
7641122 in any other Participating State in which the Dentist or Dental
7651123 Hygienist holds a License or Compact Privilege.
7661124 E. A Remote State shall have the authority to:
7671125 1. Take Adverse Actions as set forth in Section 4.D against a
7681126 Licensee’s Compact Privilege in the State;
7691127 2. In furtherance of its rights and responsibilities under the
7701128 Compact and the Commission ’s Rules, issue subpoenas for both

8001182 issued by a State Licensing Authority in a Participating State for
8011183 the attendance and testimony of witnesses, or the production of
8021184 evidence from another Participating State, shall be enforced in the
8031185 latter State by any court of competent jurisdiction, according to
8041186 the practice and procedure of that court applicable to subpoena s
8051187 issued in proceedings pending before it. The issuing authority
8061188 shall pay any witness fees, travel expenses, mileage, and other fees
8071189 required by the service statutes of the State where the witnesses or
8081190 evidence are located; and
8091191 3. If otherwise permitted by State law, recover from the
8101192 Licensee the costs of investigations and disposition of cases
8111193 resulting from any Adverse Action taken against that Licensee.
8121194 F. Joint Investigations .
8131195 1. In addition to the authority granted to a Participating
8141196 State by its Dentist or Dental Hygienist licensure act or other
8151197 applicable State law, a Par ticipating State may jointly investigate
8161198 Licensees with other Participating States.
8171199 2. Participating States shall share any Significant
8181200 Investigative Information, litigation, or compliance materials in
8191201 furtherance of any joint or individual investigation initiated under
8201202 the Compact.
8211203 G. Authority to Continue Investigation .

8541260 Investigative Information had the Licensee continued to have a
8551261 Compact Privilege in that Remot e State, the Remote State shall
8561262 report the presence of such information to the Data System as
8571263 required by Section 8.B.6 as if it was Significant Investigative
8581264 Information.
8591265 SECTION 7: ESTABLISHMENT AND OPERATION OF THE COMMISSION
8601266 A. The Compact Participat ing States hereby create and establish
8611267 a joint government agency whose members hip consists of all
8621268 Participating States that have enacted the Compact. The Commission
8631269 is an instrumentality of the Participating States acting jointly and
8641270 not an instrumentalit y of any one State. The Commission shall come
8651271 into existence on or after the effective date of the Compact as set
8661272 forth in Section 11.A.
8671273 B. Participation, Voting, and Meetings .
8681274 1. Each Participating State shall have and be limited to one
8691275 (1) Commissioner selected by that Participating State ’s State
8701276 Licensing Authority or, if the State has more than one State
8711277 Licensing Authority, selected collectively by the State Licensing
8721278 Authorities.

9061336 or Authorities, as applicable, removal or s uspension of an
9071337 individual as the State ’s Commissioner.
9081338 5. A Participating State’s State Licensing Authority, or
9091339 Authorities, as applicable, shall fill any vacancy of its
9101340 Commissioner on the Commission within sixty (60) days of the
9111341 vacancy.
9121342 6. Each Commissioner shall be entitled to one vote on all
9131343 matters that are voted upon by the Commission.
9141344 7. The Commission shall meet at least once during each calendar
9151345 year. Additional meetings may be held as set forth in the bylaws.
9161346 The Commission may meet by tele communication, video conference or
9171347 other similar electronic means.
9181348 C. The Commission shall have the following powers:
9191349 1. Establish the fiscal year of the Commission;
9201350 2. Establish a code of conduct and conflict of interest
9211351 policies;
9221352 3. Adopt Rules and bylaws;

9601414 Commission, and designate a person to do so on the Commission ’s
9611415 behalf;
9621416 8. Purchase and maintain insurance and bonds;
9631417 9. Borrow, accept, or contract for services of personnel,
9641418 including, but not limited to, employees of a Participa ting State;
9651419 10. Conduct an annual financial review;
9661420 11. Hire employees, elec t or appoint officers, fix
9671421 compensation, define duties, grant such individuals appropriate
9681422 authority to carry out the purposes of the Compact, and establish
9691423 the Commission’s personnel policies and programs relating to
9701424 conflicts of interest, qualifications of personnel, and other
9711425 related personnel matters;
9721426 12. As set forth in the Commission Rules, charge a fee to a
9731427 Licensee for the grant of a Compact Privilege in a Remote State an d

10091487 13. Accept any and all appropriate gifts, donations, grants of
10101488 money, other sources of revenue, equipment, supplies, materials, and
10111489 services, and receive, utilize, and dispose of the same; provided
10121490 that at all times the Commission shall avoid any appearan ce of
10131491 impropriety and/or conflict of interest;
10141492 14. Lease, purchase, retain, own, hold, improve, or use any
10151493 property, real, personal, or mixed, or any undivided interest
10161494 therein;
10171495 15. Sell, convey, mortgage, pledge, lease, exchange, abandon,
10181496 or otherwise dispose of any property real, personal, or mixed;
10191497 16. Establish a budget and m ake expenditures;
10201498 17. Borrow money;
10211499 18. Appoint committees, including standing committees, which
10221500 may be composed of members, State regulators, State legislators or

10581560 21. Establish and elect an Executive Board;
10591561 22. Adopt and provide to the Participating States an annual
10601562 report;
10611563 23. Determine whether a State ’s enacted compact is materially
10621564 different from the Model Compact language such that the State would
10631565 not qualify for participation in the Compact; and
10641566 24. Perform such other functions as may be necessary or
10651567 appropriate to achieve the purposes of this Compact.
10661568 D. Meetings of the Commission .
10671569 1. All meetings of the Commission that are not closed pursuant
10681570 to this subsection shall be open to the public. Notice of public
10691571 meetings shall be posted on the Commission ’s website at least thirty
10701572 (30) days prior to the public mee ting.
10711573 2. Notwithstanding subsection D.1 of this section, the
10721574 Commission may convene an emergency public meeting by providing at
10731575 least twenty-four (24) hours’ prior notice on the Commission ’s
10741576 website, and any other means as provided in the Commission ’s Rules,

11131639 a. non-compliance of a Participating State with its
11141640 obligations under the Compact ,
11151641 b. the employment, compensation, discipline or other
11161642 matters, practices or procedures related to specific
11171643 employees or other matters related to the Commission ’s
11181644 internal personnel practices and procedures ,
11191645 c. current or threatened discipline of a Licensee or
11201646 Compact Privilege holder by the Commission o r by a
11211647 Participating State’s Licensing Authority ,
11221648 d. current, threatened, or r easonably anticipated
11231649 litigation,
11241650 e. negotiation of contracts for the purchase, lease, or
11251651 sale of goods, services, or real estate ,

12111785 E. Financing of the Commission .
12121786 1. The Commission shall pay, or provide for the payment of, the
12131787 reasonable expenses of its establishment, organization, and ongoing
12141788 activities.
12151789 2. The Commission may accept any and all appropriate sources of
12161790 revenue, donations, and grants of money, equipment, supplies,
12171791 materials, and services.
12181792 3. The Commission may levy on and collect an annual assessment
12191793 from each Participati ng State and impose fees on Licensees of
12201794 Participating States when a Compact Privilege is granted, to cover
12211795 the cost of the operations and activities of the Commission and its
12221796 staff, which must be in a total amount sufficient to cover its
12231797 annual budget as approved each fiscal year for which sufficient
12241798 revenue is not provided by other sources. The aggregate annual
12251799 assessment amount for Participating States shall be allocated based
12261800 upon a formula that the Commission shall promulgate by Rule.

12561854 Commission pledge the credit of any Participating State, except by
12571855 and with the authority of the Participating State.
12581856 5. The Commission shall keep accurate accounts of all receipts
12591857 and disbursements. The receipts and disbursements of the Commission
12601858 shall be subject to the financial review and accounting procedures
12611859 established under its bylaws. All receipts and disbursements of
12621860 funds handled by the Commission shall be subject to an annual
12631861 financial review by a certified or licensed public accountant, and
12641862 the report of the financial review shall be included in and become
12651863 part of the annual report of the Commission.
12661864 F. The Executive Board.
12671865 1. The Executive Board shall have the power to act on behalf of
12681866 the Commission according to the terms of this Compact. The powers,
12691867 duties, and responsibilities of the Executive Board shall include:
12701868 a. overseeing the day-to-day activities of the
12711869 administration of the Compact including compliance
12721870 with the provisions of the Compact, the Commission ’s
12731871 Rules and bylaws,
12741872 b. recommending to the Commission changes to the Rules or
12751873 bylaws, changes to this Compact legislation, fees
12761874 charged to Compact Participating States, fees charged
12771875 to Licensees, and other fees ,

13211943 2. The Executive Board shall be composed of up to seven (7)
13221944 members:
13231945 a. the Chair, Vice Chair, Secretary and Treasurer of the
13241946 Commission and any other members of the Commission who
13251947 serve on the Executi ve Board shall be voting members
13261948 of the Executive Board , and
13271949 b. other than the Chair, Vice Chair, Secretary, and
13281950 Treasurer, the Commission may elect up to three (3)

13632009 open to the public, excep t that the Executive Board
13642010 may meet in a closed, non -public session of a public
13652011 meeting when dealing with any of the matters covered
13662012 under subsection D.4 of this section.
13672013 b. The Executive Board shall give five (5) business days ’
13682014 notice of its public meetin gs, posted on its website
13692015 and as it may otherwise determine to provide notice to
13702016 persons with an interest in the public matters the
13712017 Executive Board intends to address at those meetings.
13722018 5. The Executive Board may hold an emergency meeting when
13732019 acting for the Commission to:
13742020 a. meet an imminent threat to public health, safety, or
13752021 welfare,
13762022 b. prevent a loss of Commission or Participating State
13772023 funds, or
13782024 c. protect public health and safety.
13792025 G. Qualified Immunity, Defense, and Indemnification .

14072077 1. The members, officers, executive director, employees and

14092079 liability, both personally and in their official capacity, for any

14122082 act, error, or omission that occurred, or that the person against
14132083 whom the claim is made had a reasonable basis for believing occurred
14142084 within the scope of Commission employment, duties or
14152085 responsibilities; provided that nothing in this paragraph shall be
14162086 construed to protect any such person from suit or liability for any
14172087 damage, loss, injury, or liability caused by the intentional or
14182088 willful or wanton misconduct of that person. The procurement of
14192089 insurance of any type by the Commission shall not in any way
14202090 compromise or limit the immunity granted hereunder.
14212091 2. The Commission shall defend any member, officer, executive
14222092 director, employee, and representative of the Commission in any
14232093 civil action seeking t o impose liability arising out of any actual
14242094 or alleged act, error, or omissio n that occurred within the scope of
14252095 Commission employment, duties, or responsibilities, or as determined
14262096 by the Commission that the person against whom the claim is made had
14272097 a reasonable basis for believing occurred within the scope of
14282098 Commission employment, duties, or responsibilities; provided that
14292099 nothing herein shall be construed to prohibit that person from
14302100 retaining their own counsel at their own expense; and provided

14682162 for believing occurred within the scope of the individual ’s
14692163 employment, duties, or responsibilities for the Commission, the
14702164 Commission shall indemnify and hold harmless such indivi dual,
14712165 provided that the actual or alleged act, error, or omission did not
14722166 result from the intentional or willful or wanton misconduct of the
14732167 individual.
14742168 4. Nothing herein shall be construed as a limitation on the
14752169 liability of any Licensee for professional malpractice or
14762170 misconduct, which shall be governed solely by any other applic able
14772171 State laws.
14782172 5. Nothing in this Compact shall be interpreted to waive or
14792173 otherwise abrogate a Participating State ’s state action immunity or
14802174 state action affirmative defense with respect to antitrust claims

15122230 SECTION 8: DATA SYSTEM
15132231 A. The Commission shall pro vide for the development,
15142232 maintenance, operation, and utilization of a coordinated database
15152233 and reporting system containing licensure, Adverse Action, and the
15162234 presence of Significant Investigative Information on all Licensees
15172235 and applicants for a License in Participating States.
15182236 B. Notwithstanding any other provision of State law to the
15192237 contrary, a Participating State shall submit a uniform data set to
15202238 the Data System on all indi viduals to whom this Compact is
15212239 applicable as required by the Rules of the Com mission, including:
15222240 1. Identifying information;
15232241 2. Licensure data;
15242242 3. Adverse Actions against a Licensee, License applicant or
15252243 Compact Privilege and information related theret o;
15262244 4. Non-confidential information related to Alternative Program
15272245 participation, the beginning and ending dates of such participation,
15282246 and other information related to such participation;
15292247 5. Any denial of an application for licensure, and the
15302248 reason(s) for such denial (excluding the reporting of any criminal
15312249 history record informa tion where prohibited by law);

15672309 entitled to any associated hearsay exception in any relevant
15682310 judicial, quasi-judicial or administrative proceedings in a
15692311 Participating State.
15702312 D. Significant Investigative Information pertaining to a
15712313 Licensee in any Participating State will only be available to other
15722314 Participating States.
15732315 E. It is the responsibility of the Participating States to
15742316 monitor the database to determine whether Adverse Action has been
15752317 taken against a License e or License applicant. Adverse Action
15762318 information pertaining to a Licensee o r License applicant in any
15772319 Participating State will be available to any other Participating
15782320 State.
15792321 F. Participating States contributing information to the Data
15802322 System may designate information that may not be shared with the
15812323 public without the express permission of the contributing State.

16132379 SECTION 9: RULEMAKING
16142380 A. The Commission shall promulgate reasonable Rules in order to
16152381 effectively and efficiently implement and administer the purposes
16162382 and provisions of the Compact. A Commission Rule shall be invalid
16172383 and have no force or effect only if a court of competent
16182384 jurisdiction holds that the Rule is invalid because the Commission
16192385 exercised its rulemaking authority in a manner that is beyond the
16202386 scope and purposes of the Compact, or the powers granted hereunder,
16212387 or based upon another applicable standard of review.
16222388 B. The Rules of the Commission shall have the force of law in
16232389 each Participating State ; provided, however, that where the Rules of
16242390 the Commission conflict with the laws of the Participating State
16252391 that establish the Participating State ’s Scope of Practice as held
16262392 by a court of competent jurisdiction, the Rules of the Commission
16272393 shall be ineffective in that State to the extent of the conflict.
16282394 C. The Commission shall exer cise its Rulemaking powers pursuant
16292395 to the criteria set forth in this section and the Rules adopted
16302396 thereunder. Rules shall become binding as of the date specified by
16312397 the Commission for each Rule.

16592449 D. If a majority of the legislatures of the Participating
16602450 States rejects a Commission Rule or portion of a Commission Rule, by
16612451 enactment of a statute or resolution in the same manner used to
16622452 adopt the Compact, within four (4) years of the date of adoption of
16632453 the Rule, then such Rule shall have no further force a nd effect in
16642454 any Participating State or to any State applying to participate i n
16652455 the Compact.
16662456 E. Rules shall be adopted at a regular or special meeting of
16672457 the Commission.
16682458 F. Prior to adoption of a proposed Rule, the Commission shall
16692459 hold a public hearing and allow persons to provide oral and written
16702460 comments, data, facts, opinions, and arguments.
16712461 G. Prior to adoption of a proposed Rule by the Commission, and
16722462 at least thirty (30) days in advance of the meeting at which the
16732463 Commission will hold a public hea ring on the proposed Rule, the
16742464 Commission shall provide a Notice of Proposed R ulemaking:
16752465 1. On the website of the Commission or other publicly
16762466 accessible platform;
16772467 2. To persons who have requested notice of the Commission ’s
16782468 notices of proposed rulemaking ; and
16792469 3. In such other way(s) as the Commission may by Rule specify.
16802470 H. The Notice of Proposed Rulemaking shall include:
16812471 1. The time, date, and location of the public hearing at which
16822472 the Commission will hear public comments on the proposed Rule and,

17212535 I. All hearings will be recorded. A copy of the recording and
17222536 all written comments and documents received by the Commission in
17232537 response to the proposed Rule shall be available to the public.
17242538 J. Nothing in this section shall be con strued as requiring a
17252539 separate hearing on each Commission Rule. Rules may be grouped for
17262540 the convenience of the Commission at hearings required by this
17272541 section.
17282542 K. The Commission shall, by majority vote of all Commissioners,
17292543 take final action on the prop osed Rule based on the rulemaking
17302544 record.
17312545 1. The Commission may adopt changes to the proposed Rule
17322546 provided the changes do not enlarge the original purpose of the
17332547 proposed Rule.

17652603 3. The Commission shall determine a reasonable effective date
17662604 for the Rule. Except for an emergency as provided in subsection L
17672605 of this section, the effective date of the Rule shall be no sooner
17682606 than thirty (30) days after the Commission issuing the notice that
17692607 it adopted or amended the Rule.
17702608 L. Upon determination that an emergency exists, the Commission
17712609 may consider and adopt an e mergency Rule with twenty-four (24)
17722610 hours’ notice, with opportunity to comment, provided that the usual
17732611 rulemaking procedures provided in the Compact and in this section
17742612 shall be retroactively applied to the Rule as soon as reasonably
17752613 possible, in no event later than ninety (90) days after the
17762614 effective date of the Rule. For the purposes of this provision, an
17772615 emergency Rule is one that must be adopted immediately in order to:
17782616 1. Meet an imminent threat to public health, safety, or
17792617 welfare;
17802618 2. Prevent a loss of Commission or Participating State funds;
17812619 3. Meet a deadline for the promulgation of a Rule that is
17822620 established by federal law or rule; or
17832621 4. Protect public health and safety.

18122674 may direct revisions to a previously adopted Rule for purposes of
18132675 correcting typograph ical errors, errors in format, errors in
18142676 consistency, or grammatical errors. Public notice of any revisions
18152677 shall be posted on the website of the Commission. The revision
18162678 shall be subject to challenge by any person for a period of thirty
18172679 (30) days after posting. The revision may be challenged only on
18182680 grounds that the revision results in a material change to a Rule. A
18192681 challenge shall be made in writing and delivered to the Comm ission
18202682 prior to the end of the notice period. If no challenge is made, the
18212683 revision will take effect without further action. If the revision
18222684 is challenged, the revision may not take effect without the approval
18232685 of the Commission.
18242686 N. No Participating Stat e’s rulemaking requirements shall apply
18252687 under this Compact.
18262688 SECTION 10: OVERSIGHT, DISPUTE RESOLUTION, AND ENFORCEMENT
18272689 A. Oversight.
18282690 1. The executive and judicial branches of State government in
18292691 each Participating State shall enforce this Compact and ta ke all
18302692 actions necessary and appropriate to implement the Compact.
18312693 2. Venue is proper and judicial proceedings by or against the
18322694 Commission shall be brought solely and exclusively in a court of
18332695 competent jurisdiction where the principal office of the Comm ission

18672753 3. The Commission shall be entitled to receive service of
18682754 process in any proceeding regarding the enforcement or
18692755 interpretation of the Compact or Commission R ule and shall have
18702756 standing to intervene in such a proceeding for all purposes.
18712757 Failure to provide the Commission service of process shall render a
18722758 judgment or order void as to the Commission, this Compact, or
18732759 promulgated Rules.
18742760 B. Default, Technical Ass istance, and Termination .
18752761 1. If the Commission determines that a Participatin g State has
18762762 defaulted in the performance of its obligations or responsibilities
18772763 under this Compact or the promulgated Rules, the Commission shall
18782764 provide written notice to the de faulting State. The notice of
18792765 default shall describe the default, the proposed means of curing the
18802766 default, and any other action that the Commission may take, and
18812767 shall offer training and specific technical assistance regarding the
18822768 default.
18832769 2. The Commission shall provide a copy of the notice of default
18842770 to the other Participating States.

19122822 C. If a State in default fails to cure the default, the
19132823 defaulting State may be terminated from the Compact upon an
19142824 affirmative vote of a majority of the Commissioners, and all rights,
19152825 privileges and benefits conferred on that State by this Compact may
19162826 be terminated on the effective date of termination. A cure of the
19172827 default does not relieve the offending State of obligations or
19182828 liabilities incurred during the period of default.
19192829 D. Termination of participation in the Compact shall be imposed
19202830 only after all other means of securing compliance have been
19212831 exhausted. Notice of intent to suspend or terminate shall be given
19222832 by the Commission to the governor, the majority and mi nority leaders
19232833 of the defaulting State ’s legislature, the defaulting State ’s State
19242834 Licensing Authority or Authorities, as applicable, and each of the
19252835 Participating States ’ State Licensing Authority or Authorities, as
19262836 applicable.
19272837 E. A State that has been t erminated is responsible for all
19282838 assessments, obligations, and liabilities inc urred through the
19292839 effective date of termination, including obligations that extend
19302840 beyond the effective date of termination.
19312841 F. Upon the termination of a State ’s participation in this
19322842 Compact, that State shall immediately provide notice to all
19332843 Licensees of the State, including Licensees of other Participating
19342844 States issued a Compact Privilege to practice within that State, of
19352845 such termination. The terminated State shall continue to recognize

19702904 H. The defaulting State may appeal the action of the Commission
19712905 by petitioning the U.S. District Court for the District of Columbia
19722906 or the federal district where the Commission has its principal
19732907 offices. The prevailing party shall be awarded all costs of such
19742908 litigation, including reasonable attorney ’s fees.
19752909 I. Dispute Resolution.
19762910 1. Upon request by a Participating State, the Commiss ion shall
19772911 attempt to resolve disputes related to the Compact that arise among
19782912 Participating States and between Participating States and non -
19792913 Participating States.
19802914 2. The Commission shall promulgate a Rule providing for both
19812915 mediation and binding dispute re solution for disputes as
19822916 appropriate.
19832917 J. Enforcement.
19842918 1. The Commission, in the reasonable exercise of its
19852919 discretion, shall enforce the provisions of this Compact and the
19862920 Commission’s Rules.

20643046 A. The Compact shall come into effect on the date on which the
20653047 Compact statute is enacted into law in the seventh Participating

20673049 1. On or after the effective date of the Compact, t he
20683050 Commission shall convene and review the enactment of each of the
20693051 States that enacted the Compact prior to the Commission convening
20703052 (“Charter Participating States ”) to determine if the statute enacted
20713053 by each such Charter Participating State is materiall y different
20723054 than the Model Compact.
20733055 a. A Charter Participating State whose ena ctment is found
20743056 to be materially different from the Model Compact
20753057 shall be entitled to the default process set forth in
20763058 Section 10.
20773059 b. If any Participating State is later found t o be in
20783060 default, or is terminated or withdraws from the
20793061 Compact, the Commission shall remain in existence and
20803062 the Compact shall remain in effect even if the number
20813063 of Participating States should be less than seven (7).
20823064 2. Participating States enacting the Compact subsequent to the
20833065 Charter Participating States shall be subject to th e process set
20843066 forth in Section 7.C.23 to determine if their enactments are
20853067 materially different from the Model Compact and whether they qualify
20863068 for participation in the Compact.

21193125 4. Any State that joins the Compact subsequent to the
21203126 Commission’s initial adoption of the Rules and bylaws shall be
21213127 subject to the Commission ’s Rules and bylaws as they exist on the
21223128 date on which the Compact becomes law in that State. Any Rule that
21233129 has been previously adopted by the Commission shall have the full
21243130 force and effect of law on the day the Compact becomes law in that
21253131 State.
21263132 B. Any Participating State may withdraw from this Compact by
21273133 enacting a statute repealing that State ’s enactment of the Compact.
21283134 1. A Participating State’s withdrawal shall not take effect
21293135 until one hundred eighty (180) days after enactment of the repealing
21303136 statute.
21313137 2. Withdrawal shall not affect the continuing requ irement of
21323138 the withdrawing State ’s Licensing Authority or Authorities to comply
21333139 with the investigative and Adverse Action reporting requirements of
21343140 this Compact prior to the effective date of withdrawal.
21353141 3. Upon the enactment of a statute withdrawing from this
21363142 Compact, the State shall immediately provide notice of such
21373143 withdrawal to all Licensees within that State. Notwithstanding any

21723202 arrangement between a Participating State and a non -Participating
21733203 State that does not conflict with the provisions of this Compact.
21743204 D. This Compact may be amended by the Participating States. No
21753205 amendment to this Compact shall b ecome effective and binding upon
21763206 any Participating State until it is enacted into the laws of all
21773207 Participating States.
21783208 SECTION 12: CONSTRUCTION AND SEVERABILITY
21793209 A. This Compact and the Commission ’s rulemaking authority shall
21803210 be liberally construed so as to effectuate the purposes and the
21813211 implementation and administration of the C ompact. Provisions of the
21823212 Compact expressly authorizing or requiring the promulgation of Rules
21833213 shall not be construed to limit the Commission ’s rulemaking
21843214 authority solely for t hose purposes.
21853215 B. The provisions of this Compact shall be severable and if any
21863216 phrase, clause, sentence or provision of this Compact is held by a
21873217 court of competent jurisdiction to be contrary to the constitution
21883218 of any Participating State, a State seekin g participation in the

22183272 unconstitutional by a court of competent jurisdiction, the validity
22193273 of the remainder of this Compact and t he applicability thereof to

22213275 affected thereby.
22223276 C. Notwithstanding subsection B of this section, the Commission
22233277 may deny a State’s participation in the Compact or, in accordance
22243278 with the requirements of Section 10.B, terminate a Participating
22253279 State’s participation in t he Compact, if it determines that a
22263280 constitutional requirement of a Participating State is a material
22273281 departure from the Compact. Otherwise, if this Compact shall be
22283282 held to be contrary to the constitution of any Participating State,
22293283 the Compact shall remain in full force and effect as to the
22303284 remaining Participating States and in full force and effect as to
22313285 the Participating State affected as to all severable matters.
22323286 SECTION 13: CONSISTENT EFFECT AND CONFLICT WITH OTHER STATE
22333287 LAWS
22343288 A. Nothing herein shall prevent or inhibit the enforcement of
22353289 any other law of a Participating State that is not inconsistent with
22363290 the Compact.
22373291 B. Any laws, statutes, regulations, or other legal requ irements
22383292 in a Participating State in conflict with the Compact are superseded
22393293 to the extent of the conflict.
