65	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
66	55		SECTION 1. AMENDATORY 47 O.S. 2021, Section 2 -106.3, is
67	56		amended to read as follows:
68	57		Section 2-106.3. A. Subject to the availability of funding,
69	58		the Department of Public Safety shall establish a Fraudulent
70	59		Documents Identificatio n (FDI) Unit an Identity Verification Unit
	60	+	(IVU) for the primary purpose of investigating and apprehending
	61	+	persons or entities that participate in the sale or distribution of
	62	+	fraudulent documents u sed for identification purposes. The unit
	63	+	shall additionally specialize in fraudulent identification documents
	64	+	created and prepared for persons who are unlawfully residing within

103	91		the State of Oklahoma this state. The Department shall employ
104	92		sufficient employees to investigate and implement an FDI Unit
105	93		Identity Verification Unit.
106	94		B. The Commissioner of Public Safety shall promulgate rules to
107	95		administer the provisions of this section.
108	96		SECTION 2. AMENDATORY 47 O.S. 2021, Section 6 -110.2, as
109	97		amended by Section 51, Chapter 282, O.S.L. 2022 ( 47 O.S. Supp. 2024,
110	98		Section 6-110.2), is amended to read as follows:
111	99		Section 6-110.2. A. Service Oklahoma shall implement a
112	100		procedure for computerized finger imaging by means of an inkless
113	101		finger image scanning device and shall require every applicant fo r
114	102		an original, renewal , or replacement driver license or
115	103		identification card to submit to finger imaging for the purposes of
116	104		proof of identity and to ensure the security of the driver license
117	105		or identification card issued to the applicant. If the finger i mage
118	106		of a person over sixty -five (65) years of age cannot be scanned and
119	107		the issuing agent can personally verify the individual ’s identity
120	108		with alternative identification, the finger imaging shall be
	109	+	overridden. Means must be provided to trace to the agen t who
	110	+	authorized the override.
	111	+	B. No unemancipated person under eighteen (18) years of age
	112	+	shall be issued a driver license or identification card by Service
	113	+	Oklahoma unless an authorization form, prescribed and furnished by
	114	+	Service Oklahoma, or notarized affidavit authorizing the finger

150		-	B. No unemancipated person under eighteen (18) years of age

154	141		imaging of the person and signed by the legal custodial parent,
155	142		legal guardian, or legal custodian of the person, is in the
156	143		possession of Service Oklahoma.
157	144		C. No law enforcement agency of the state or federal government
158	145		other than Service Oklahoma the Department of Public Safety shall
159	146		have access to any information collected through the use of
160	147		computerized finger imaging without first obtaining a court order
161	148		from a judge of competent jurisdiction; provided, however, the
162	149		Oklahoma State Bureau of Investigation shall have access to such
163	150		imaging for the purpose of identifying a person who is deceased,
164	151		missing, or endangered. Each application for an order authorizing
165	152		the access to any information collected through the use of
166	153		computerized finger imaging shall be made in writing upon oath or
167	154		affirmation to a judge of competent jurisdiction. Each application
168	155		shall establish probable cause for belief that a named individual is
169	156		committing, has committed , or is about to commit a part icular
170	157		violation of law.
	158	+	D. Service Oklahoma shall adopt rules as may be necessary to
	159	+	carry out the provisions of this section.
	160	+	SECTION 3. AMENDATORY 47 O.S. 2021, Section 6 -301, as
	161	+	amended by Section 76, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2024,
	162	+	Section 6-301), is amended to read as follows:
	163	+	Section 6-301. It shall be unlawful for any person to commit
	164	+	any of the acts specified in paragraph 1 or 2 of this section in

200		-	SECTION 3. AMENDATORY 47 O.S. 2021, Section 6 -301, as
201		-	amended by Section 76, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2024,
202		-	Section 6-301), is amended to read as follows:
203		-	Section 6-301. It shall be unlawful for any person to commit
204		-	any of the acts specified in paragraph 1 or 2 of this section in
205	191		relation to an Oklahoma driver license or identification car d
206	192		authorized to be issued by Service Oklahoma pursuant to the
207	193		provisions of Sections 6 -101 through 6-309 of this title or any
208	194		driver license or other evidence of driving privilege or
209	195		identification card authorized to be issued by the state of origin.
210	196		1. It is a misdemeanor for any licensee:
211	197		a. to display or cause or permit to be displayed one ’s
212	198		own license after such license has been suspended,
213	199		revoked, or canceled or to possess one ’s own license
214	200		after having received notice of its suspension,
215	201		revocation, or cancellation,
216	202		b. to lend one’s own license or identification card to
217	203		any other person or knowingly permit the use thereof
218	204		by another,
219	205		c. to display or cause or permit to be displayed or to
220	206		possess a license or identification card issued to
221	207		oneself which bears altered information concerning the
	208	+	date of birth, expiration date, sex, height, eye
	209	+	color, weight, or license or card number,
	210	+	d. to fail or refuse to surrender to Service Oklahoma
	211	+	upon its lawful demand any license or identification
	212	+	card which has been suspended, revoked , or canceled,
	213	+	e. to permit any unlawful use of a license or
	214	+	identification card issued to oneself,

261	246		under conditions provided in subparagraph e of
262	247		paragraph 2 of this section, or
263	248		h. to add to, delete from, alter, or deface the required
264	249		information on a driver license or identification
265	250		card.
266	251		2. It is a felony for any person:
267	252		a. to create, publish, or otherwise manufacture an
268	253		Oklahoma or other state license or identification card
269	254		or facsimile thereof, or to create, manufacture , or
270	255		possess an engraved plate or other such device, card,
271	256		laminate, digital image or file, or software for the
272	257		printing of an Oklahoma or other state license or
	258	+	identification card or facsimile thereof, exce pt as
	259	+	authorized pursuant to this title,
	260	+	b. to display or cause or permit to be displayed or to
	261	+	knowingly possess any state counterfeit or fictitious
	262	+	license or identification card,

301		-	authorized pursuant to this title,
302		-	b. to display or cause or permit to be displayed or to
303		-	knowingly possess any state counterfeit or fictitious
304		-	license or identification card,
305	289		c. to display or cause to be displayed or to knowingly
306	290		possess any state license or identification card
307	291		bearing a fictitious or forge d name or signature,
308	292		d. to display or cause to be displayed or to knowingly
309	293		possess any state license or identification card
310	294		bearing the photograph of any person, other than the
311	295		person named thereon as licensee,
312	296		e. to display or represent as one ’s own, any license or
313	297		identification card not issued to him or her, for the
314	298		purpose of committing a fraud in any commercial
315	299		transaction or to mislead a peace officer in the
316	300		performance of his or her duties, or
317	301		f. to use a false or fictitious name in any application
318	302		for a license or identification card or to knowingly
319	303		make a false statement or to knowingly conceal a
320	304		material fact or otherwise commit a fraud in any such
321	305		application.
322	306		3. It is a felony for any e mployee or person authorized to
323	307		issue or approve the issuan ce of licenses or identification cards
	308	+	under this title to knowingly issue or attempt to issue a license or
	309	+	identification card or to knowingly give approval for, cause, or
	310	+	attempt to cause a license or identification card to be issued:
	311	+	a. to a person not entitled thereto,
	312	+	b. bearing erroneous information thereon, or

351		-	under this title to knowingly issue or attempt to issue a license or
352		-	identification card or to knowingly giv e approval for, cause, or
353		-	attempt to cause a license or identification card to be issued:
354		-	a. to a person not entitled thereto,
355		-	b. bearing erroneous information thereon, or
356	339		c. bearing the photograph of a person other than the
357	340		person named thereon.
358	341		Such conduct shall be grounds for termination of employment of the
359	342		employee.
360	343		4. The violation of any of the provision s of paragraph 1 of
361	344		this section shall constitute a misdemeanor and shall, upon
362	345		conviction thereof, be punishable by a fine of not less than Twenty -
363	346		five Dollars ($25.00), nor more than Two Hundred Dollars ($200.00);
364	347		the violation of any of the provisions o f paragraph 2 or 3 of this
365	348		section shall constitute a felony and shall, upon conviction
366	349		thereof, be punishable by a fine not exceeding to exceed Ten
367	350		Thousand Dollars ($10,000.00) or a term of impri sonment in the
368	351		custody of the Department of Corrections not to exceed seven (7)
369	352		years, or by both such fine and imprisonment.
370	353		5. Notwithstanding any provision of this section, Service
371	354		Oklahoma the Department of Public Safety, through the Identity
372	355		Verification Unit established pursuant to Section 2 -106.3 of this
373	356		title, may, upon the request of the chief administrator of a law
374	357		enforcement, military, or intelligence agency, authorize the
	358	+	issuance to and display , and possession by a person of a license
	359	+	which would otherwise be a violation of this section, for the sole
	360	+	purpose of aiding in a criminal investigation or a military or
	361	+	intelligence operation. While acting pursuant to such authorization
	362	+	by Service Oklahoma the Department, such person shall not be

402		-	issuance to and displa y, and possession by a person of a license
403		-	which would otherwise be a violation of this section, for the sole
404		-	purpose of aiding in a criminal investigation or a military or
405		-	intelligence operation. While acting pursuant to such authorization
406		-	by Service Oklahoma the Department, such person shall not be
407	389		prosecuted for a violation under this section unless the person
408	390		exceeds the scope or duration of the Department ’s authorization.
409	391		Upon termination of such investigation or operation or upon request
410	392		of the Department, Service Oklahoma shall forthwith cause suc h
411	393		license to be returned to Service Oklahoma the chief administrator
412	394		of the law enforcement agency that requests the issuance of the
413	395		license and the recipient of the license shall be jointly
414	396		responsible to ensure the license is promptly returned to the
415	397		Department. The Department and Service Oklahoma shall enter i nto
416	398		interagency agreements as may be necessary to fulfill the powers and
417	399		duties set forth in this paragraph. The Department may enter into
418	400		interagency agreements with law enforcement agencies that request
419	401		issuance of such a license to set forth the terms of the
420	402		authorization for use of the license, the terms for custody and
421	403		control of the license, and the terms for duration and revocation of
422	404		authorization to use or possess the license .
423	405		SECTION 4. It being immediately necessary for the pres ervation
424	406		of the public peace, health or safety, an emergency is hereby
	407	+	declared to exist, by reason whereof this act shall take effect and
	408	+	be in full force from and after its passage and approval.
