8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1289.24, is
8383 amended to read as follows:

8585 FIREARM REGULATION – STATE PREEMPTION
8686 A. 1. The State Legislature hereby occupies and preempts the
8787 entire field of legislation in this st ate touching in any way
8888 firearms, air powered pistols, air powered rifles, kni ves, firearm
8989 and ammunition components, ammunition and supplies to the complete
9090 exclusion of any order, policy, ordinance or regulation by any

142142 municipality, agency, or other political subdivision of this state.
143143 Any existing or future orders, policies, ordinances or regulations
144144 in this field, except as provided for in paragraph 2 of this
145145 subsection and subsection C of this section, are null and void.
146146 2. A municipality may adopt a ny ordinance:
147147 a. relating to the discharge of firearms within the
148148 jurisdiction of the municipality,
149149 b. allowing the municipality to issue a traffic citation
150150 for transporting a firearm improperly as provided for
151151 in Section 1289.13A of this title, provided, however,
152152 that penalties contained for violation of any
153153 ordinance enacted pursuant to the provisions of this
154154 subparagraph shall not exceed the penalties
155155 established in the Oklahoma Self -Defense Act, and
156156 c. allowing the municipality to issue a citation to an
157157 individual or the parent or guardian of a minor who
158158 discharges an air powered pistol or air powered rifle
159159 in an intentional or negligent manner which causes the
160160 projectile to leave the intended premises.
161161 3. As provided in the preemption provisions of thi s section,
162162 the otherwise lawful carrying or possession of a firearm under the
163163 provisions of Chapter 53 of this title shall not be punishable by
164164 any municipality, agency, or other political subdivision of this

216216 state as disorderly conduct, disturbing the pea ce or similar offense
217217 against public order.
218218 4. A public or private school may create a policy regulating
219219 the possession of knives on school property or in any school bus or
220220 vehicle used by the school for purposes of transportation.
221221 B. No municipality, agency, or other political subdivision of
222222 this state shall adopt any order, policy, ordinance, resolution, or
223223 regulation concerning in any way the sale, purchase, purchase delay,
224224 transfer, ownership, use, keeping, possession, carrying, bearing,
225225 transportation, licensing, permit, registration, taxation other than
226226 sales and compensating use taxes or other controls on firearms,
227227 knives, firearm and ammunition components, ammunition and supplies.
228228 C. Except as hereinafter provided, this section shall not
229229 prohibit any order, policy, ordinance or regulation by any
230230 municipality concerning the confiscation of property used in
231231 violation of the ordinances of the municipality as provided for in
232232 Section 28-121 of Title 11 of the Oklahoma Statutes. Provided,
233233 however, no municipal ordinance relating to transporting a firearm
234234 or knife improperly may i nclude a provision for confiscation of
235235 property.
236236 D. When a person’s rights pursuant to the protection of the
237237 preemption provisions of this section have been violated by any
238238 order, policy, ordinance, resolution , or regulation promulgated or
239239 enforced by any person, municipality, agency , or other political

291291 subdivision of this state, the person so violated shall have the
292292 right to bring a civil action against the persons person, government
293293 employee if the government employee was acting beyond the scope of
294294 employment, municipality, and agency, or political subdivision
295295 jointly and severally for injunctive relief or monetary damages or
296296 both.
297297 E. A court may require the person, municipalit y, agency, or
298298 political subdivision to pay reasonable expenses to the aggrieved
299299 party in a civil action filed pursuant to the provisions of
300300 subsection D of this section if:
301301 1. The aggrieved party first provides written notice of the
302302 unlawful order, policy , ordinance, resolution , or regulation by
303303 certified, first-class mail or service of process to the clerk of
304304 the municipality or to the designated agent of the municipality,
305305 agency, or political subdivision and allows the person,
306306 municipality, agency , or political subdivision ninety (90) days to
307307 rescind, repeal, or otherwise abrogate the order, policy, ordinance,
308308 resolution, or regulation; and
309309 2. A court rules in favor of the aggrieved person whose rights
310310 were violated and the issue in controversy is govern ed by previously
311311 settled law.
312312 If the person, municipality, agency , or political subdivision
313313 fails to rescind, repeal , or otherwise abrogate the unlawful order,
314314 policy, ordinance, resolution , or regulation within ninety (90) days

366366 of the required notice, as provided in paragraph 1 of this
367367 subsection and the order, policy, ordinance, resolution , or
368368 regulation is subsequently rescinded, repealed , or otherwise
369369 abrogated after the aggrieved party files suit, the aggrieved party
370370 shall retain standing in the suit a nd may recover damages or
371371 reasonable expenses.
372372 F. As used in this section , air powered pistol:
373373 1. “Air-powered pistol” or air powered rifle “air-powered
374374 rifle” is any pistol or rifle that uses compressed air or other
375375 compressed gas to project plastic BB -like or pellet-like projectiles
376376 at a speed not exceeding 400 feet per second ; and
377377 2. “Reasonable expenses” includes, but is not limited to,
378378 attorney fees, expert witness fees , and court costs.
379379 SECTION 2. This act shall become effective No vember 1, 2025.
