AS INTRODUCED 
 
An Act relating to unconstitutional actions in 
Oklahoma; creating the Ethan Haim Act; providing 
short title; providing legislative inten t; defining 
terms; providing for unlawful action; specifying 
violations; providing for certain penalties; allowing 
certain damages and relief; prohibiting certain 
contracts and actions; authorizing certain entities 
with powers; providing for certain discla imer; 
stating severability; providing for noncodification; 
providing for codification; providing an effective 
date; and declaring an emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law not to be 
codified in the Oklahoma Statutes reads as follows: 
This act shall be known and may be cited as the “Ethan Haim 
Act”. 
SECTION 2.     NEW LAW     A new section of law not to be

The Legislature finds that:

1.  The Tenth Amendment to the Un ited States Constitution 
reserves to the states and the people all powers not delegated to 
the federal government ; 
2.  The federal executive branch has expanded far beyond its 
constitutional boundaries, with numerous agencies assuming powers 
and responsibilities not granted by the United States Constitution; 
3.  This expansion has infringed on the rights of states and 
their citizens, undermining federalism and Oklahoma’s sovereign ty; 
4.  The United States Constitution guarantees inalienable 
rights, including those enumerated in the First, Second, and Fourth 
Amendments, as well as protections of individual autonomy in matters 
such as medical freedom ; 
5.  Whistleblowers play a critic al role in exposing illegal, 
unethical, or unconstitutional actions and must be protected from 
retaliation or prosecution ; and 
6.  Any actions by federal agents or entities that infringe upon 
these rights or exceed the federal government’s enumerated power s 
are unconstitutional and an affront to the liberty of Oklahoma 
residents. 
It is the intent of this act to establish penalties, including 
deportation, to deter unconstitutional actions, protect 
whistleblowers, and affirm Oklahoma’s responsibility to defen d its 
citizens’ rights and sovereignty.

SECTION 3.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 13000 of Title 74, unless there 
is created a duplication in numbering, reads as follows: 
For purposes of this act: 
1.  “Agent” refers to any representative, employee, or 
contractor of a federal agency ; 
2.  “Entity” includes federal agencies, organizations, or other 
bodies acting under federal authority ; 
3.  “Unconstitutional action” means: 
a. any activity, investigation, enforcement, or operation 
that infringes upon rights guaranteed under the United 
States Constitution or the Oklahoma Constitution , or 
b. any action usurping powers not expressly granted to 
the federal government under the United States 
Constitution; and 
4.  “Whistleblower” refers to any individual who, in good faith , 
reports or discloses illegal, unconstitutional, or unethical actions 
within federal or state agencies. 
SECTION 4.     NEW LAW     A new section of law to be cod ified 
in the Oklahoma Statutes as Section 13001 of Title 74, unless there 
is created a duplication in numbering, reads as follows: 
A.  It shall be unlawful for any agent or entity to engage in 
activities that violate the constitutional rights of Oklahoma 
residents while operating within the state.

B.  Specific violations include, bu t are not limited to: 
1.  Actions infringing upon freedom of speech, religion, or the 
press; 
2.  Seizure or restriction of firearms not supported by 
constitutional authority ; 
3.  Search and seizure actions without probable cause or due 
process; 
4.  Coercion or retaliation against individuals for protected 
expressions or lawful decisions ; and 
5.  Prosecution, intimidation, or retaliation against 
whistleblowers who expose illegal or unconstitutional actions. 
C.  Any federal agent found guilty of engaging in 
unconstitutional actions within Oklahoma shall be ordered to leave 
the state immediately and shall be prohibited from returning to the 
state for a minimum of one (1) year, shall b e subject to civil 
liability for damages caused by his or her unconstitutional actions, 
and shall be fined Thirty-five Thousand Dollars ($35,000.00) per day 
of violation. 
D.  Any entity operating in violation of this act shall cease 
all operations within t he state and remove all representatives, 
employees, or agents within thirty (3 0) days of a court order, shall 
be prohibited from re -establishing operations within Oklahoma for a 
minimum of one (1) year, shall be subject to civil liability for

damages caused by their unconstitutional actions, and shall be fin ed 
Five Hundred Thousand Dollars ($500,000.00) per day of violation. 
E.  Oklahoma residents harmed by unconstitutional actions may 
bring civil suits against individuals, agents, or entities.  Civil 
suits may seek compensatory and punitive damages, as well as 
injunctive relief. 
F.  Any individual or entity deported under this act shall be 
barred from entering into contracts or enforcement actions within 
the state during the prohibition period. 
G.  The Attorney General is authorized to investigate, 
prosecute, and enforce penalties, including deportation, for 
violations of this act.  District attorneys shall have concurrent 
jurisdiction with the Attorney General to prosecute violations of 
this act and petitio n for deportation.  Upon a finding of guilt, the 
court may order the immediate deportation of the individual or 
entity from Oklahoma for a period of time sufficient to prevent 
further violations.  Local law enforcement agencies may detain 
individuals suspected of unconstitutional actions until adjudication 
or deportation. 
H.  This act does not apply to actions explicitly authorized by 
the United States Constitution and adjudicated as lawful by the 
Oklahoma Supreme Court or the United States Supreme Court. 
I.  If any provision of this act is found to be 
unconstitutional, the remaining provisions shall remain in effect.

SECTION 5.  This act shall become effective July 1, 2025. 
SECTION 6.  It being immediately necessary for the p reservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
