225225 B. The following statements are admissible in criminal and
226226 juvenile delinquent trials if the child or incapacitated person
227227 testifies at the trial whether in person, via videoconferencing
228228 equipment, or other alternative means; if the child or incapacitated
229229 person does not testify at the trial and is unavailable as defined
230230 by subsection A of Section 2804 of this title and the requirements
231231 for admissibility pursuant to subsection B of Section 2804 of this
232232 title are satisfied; or if the child or incapacitated perso n does
233233 not testify at the trial and the court determines that the statement
234234 is nontestimonial:
235235 1. A statement made by a child who has not attained sixteen
236236 (16) years of age at the time the statement is made, a child sixteen
237237 (16) years of age or older who has a disability, or a person who is
238238 an incapacitated person as defined by Sec tion 10-103 of Title 43A of
239239 the Oklahoma Statutes, which describes any act of physical abuse,

309309 1118, 1119, 1123, or 1125 of Title 21 of the Oklahoma Statutes, any
310310 act of domestic abuse, or any act or omission resulting in death or
311311 great bodily injury to a human being, provided that the child or
312312 incapacitated person witnessed the act or omission.
313313 C. The provisions of the Oklahoma Criminal Discovery Code,
314314 Section 2002 of Title 22 of the Oklahoma Statutes, shall govern the
315315 disclosure and notice requirements of statements offered pursuant to
316316 this section.
317317 D. As used in this section, “disability” means a physical or
318318 mental impairment which substantially limits one or more of the

372372 SECTION 2. AMENDATORY Section 5, Chapter 366, O.S.L.
373373 2024 (21 O.S. Supp. 2024, Section 20E), is amended to read as
374374 follows:
375375 Section 20E. A. Upon the effective date of this act, Class A3
376376 shall include the fo llowing criminal offenses:
377377 1. Domestic assault and battery with a deadly weapon, as
378378 provided for in paragraph 2 of subsection D of Section 644 of Title
379379 21 of the Oklahoma Statutes;
380380 2. Second or subsequent conviction of domestic abuse against a
381381 pregnant woman with knowledge of the pregnancy, as provided for in
382382 subsection E of Secti on 644 of Title 21 of the Oklahoma Statutes;
383383 3. Aggravated assault and battery upon a police officer,
384384 sheriff, deputy sheriff or highway patrolman, corrections personnel,
385385 or any state peace officer, as provided for in subsection A of
386386 Section 650 of Title 21 of the Oklahoma Statutes;
387387 4. Shooting with the intent to kill, as provided for in
388388 subsection A of Section 652 of Title 21 of the Oklahoma Statutes;
389389 5. Using a vehicle to fac ilitate the intentional discharge of a
390390 firearm, crossbow, or other weapon, as provided for in subsection B
391391 of Section 652 of Title 21 of the Oklahoma Statutes;
392392 6. Assault and battery with a deadly weapon, as provided for in
393393 subsection C of Section 652 of Title 21 of the Oklahoma Statutes;

455455 11. Child sexual abuse, as provided for in subsection E of
456456 Section 843.5 of Title 21 of the Oklahoma Statutes;
457457 12. Enabling Failure to protect from child sexual abuse, as
458458 provided for in subsection G of Section 843.5 of Title 21 of the
459459 Oklahoma Statutes;
460460 13. Child sexual exploitation, as provided for in subsection H
461461 of Section 843.5 of Title 21 of the Oklahoma Statutes;
462462 14. Enabling Failure to protect from child sexual exploitation,
463463 as provided for in subsection J of Section 843.5 of Title 21 of the
464464 Oklahoma Statutes;
465465 15. Lewd or indecent proposals or acts to a child, as provided
466466 for in subsection A of Section 1123 of Title 21 of the Oklahoma

523523 18. Any person above the age of eighteen (18) who, on campuses
524524 or public school grounds, advocates revolution, sabotage, force and
525525 violation, sedition, treason, or the overthrow of the United States
526526 government, as provided for in subsection B of Section 1327 of Title
527527 21 of the Oklahoma Statutes;
528528 19. Arson in the first degree, as provided for in subsection A
529529 of Section 1401 of Title 21 of the Oklaho ma Statutes;
530530 20. Arson while manufacturing, attempting to manufacture, or
531531 endeavoring to manufacture a controlled dangerous substance, as
532532 provided for in subsection B of Section 1401 of Title 21 of the
533533 Oklahoma Statutes; and
534534 21. Causing personal injury w hile committing an act of arson,
535535 as provided for in Section 1405 of Title 21 of the Oklahoma
536536 Statutes.
537537 B. Any person convicted of a Class A3 criminal offense set
538538 forth in this section shall be punished in accordance with the
539539 corresponding penalties provid ed for in the Oklahoma Statutes.

594594 Section 20F. A. Upon the effective date of this act, Class B1
595595 shall include the following criminal offenses:
596596 1. Accessory to murder in the second degree, as provided for in
597597 paragraph 5 of Section 175 of Title 21 of the Oklahoma Statutes;
598598 2. Rescuing or attempting to rescue a prisoner charged or
599599 convicted of a felony, as pro vided for in paragraph 1 of Section 521
600600 of Title 21 of the Oklahoma Statutes;
601601 3. Aiding suicide, as provided for in Section 813 of Title 21
602602 of the Oklahoma Statutes;
603603 4. Aiding suicide by furnishing the person with deadly weapons
604604 or poisonous drugs, as pr ovided for in Section 814 of Title 21 of
605605 the Oklahoma Statutes;
606606 5. Mingling poison, controlled dangerous substances, or sharp
607607 objects harmful to human life with any food, drink, medicine, or
608608 water, as provided for in Section 832 of Title 21 of the Oklahom a
609609 Statutes;
610610 6. Abuse, financial neglect, neglect, or exploitation by a
611611 caretaker, as provided for in paragraph 1 of subsection B of Section
612612 843.1 of Title 21 of the Oklahoma Statutes;
613613 7. Exploitation of an elderly person or disabled adult, as
614614 provided for in Section 843.4 of Title 21 of the Oklahoma Statutes;
615615 8. Engaging in child neglect, as provided for in subsection C
616616 of Section 843.5 of Title 21 of the Oklahoma Statutes;

684684 14. Sodomy upon a person under the legal custody, supervision,
685685 or authority of a state agency, county, municipality, or political
686686 subdivision of the state, as provided for in paragraph 4 of
687687 subsection B of Section 888 of Title 21 of the Oklahoma Statutes;
688688 15. Sodomy upon a person at least sixteen (16) years of age but
689689 less than twenty (20) years of age and who is a student of any
690690 public or private secondary school, junior high, high school, or

757757 19. Permitting or consenting to the participation of a minor in
758758 child pornography by a parent, guardian, or individual having
759759 custody, as provided for in Section 1021.3 of Title 21 of the

761761 20. Buying, procuring, or possessing child pornogr aphy, as

830830 26. Keeping, holding, detaining, restraining, or compelling a
831831 child to engage in prostitution, as provided for in paragraph 2 of
832832 subsection A of Section 1088 of Title 21 of the Oklahoma Statutes;
833833 27. Keeping, holding, detaining, restraining, or compelling a
834834 child to engage in prostitution for purposes of compelling the ch ild
835835 to pay, liquidate, or cancel any debts, dues, or obligations
836836 incurred by the child, as provided for in paragraph 3 of subsection

10541054 B. Any person convicted of a Class B1 criminal offense set
10551055 forth in this section shall be punished in accordance with the
10561056 corresponding penalties provided for in the Oklahoma Statutes.

12801280 one (1) year, or by a fine of not less than Five Hundred Dollars

13531353 G. Any parent or other person who shall willfully o r

13551355 abuse shall, upon conviction, be punished by imprisonment in the

14981498 K. Notwithstanding any other provision of law, any person
14991499 convicted of forcible anal or oral sodomy, rape, rape by
15001500 instrumentation, or lewd molestation of a child under fourteen (14)
15011501 years of age subsequent to a previous conviction for any offense of
15021502 forcible anal or oral sodomy, rape, rape by instrumentation, or lewd
15031503 molestation of a child under fourteen (14) years of age shall be
15041504 punished by death or by imprisonment for life or life without
15051505 parole.
15061506 L. Provided, however, that nothing Nothing contained in this
15071507 section shall prohibit any parent or guardian from using reasonable
15081508 and ordinary force pursuant to Section 844 of this title.
15091509 M. Consent shall not be a defense for any violation provided
15101510 for in this section.
15111511 N. Notwithstanding the age requirements of other statutes
15121512 referenced within this section, this section shall apply to any
15131513 child under eighteen (18) years of age.

15651565 O. It is an affirmative defen se to subsections B and D of this
15661566 section if the accused:
15671567 1. Had a reasonable apprehension that any action to stop the
15681568 abuse or neglect would result in great bodily injury or de ath to the
15691569 accused or the child;
15701570 2. Experienced domestic violence resulting in great bodily,
15711571 mental, or emotional injury which impaired the ability of the
15721572 accused to take action to stop the child abuse or neglect; or
15731573 3. Voluntarily took immediate steps t o end the abuse or neglect
15741574 of the child, including prompt notification of a me dical or law
15751575 enforcement authority.
15761576 P. The penalties provided in subsections A, B, C, and D of this
15771577 section shall be retroactive. Other provisions of law
15781578 notwithstanding, any p erson who committed an offense, the penalty
15791579 for which is provided in subsection A, B, C, or D of this section,
15801580 before January 1, 2026, may institute an application for
15811581 postconviction relief pursuant to paragraph 3 of Section 1080 of
15821582 Title 22 of the Oklahom a Statutes. Nothing in this subsection shall
15831583 be construed to create a civil c ause of action related to a change
15841584 in the law governing an applicant ’s conviction.
15851585 Q. As used in this section:
15861586 1. “Child abuse” means:
15871587 a. the willful or malicious harm or threa tened harm or

16511651 responsible for a child ’s health, safety, or welfare:
16521652 (1) adequate nurturance and affection, food,
16531653 clothing, shelter, sanitation, hygiene, or
16541654 appropriate education ,
16551655 (2) medical, dental, or behavioral health care, or
16561656 (3) special care made necessary for the child ’s
16571657 health and safety by the physical or mental
16581658 condition of the child,
16591659 b. the failure to protect a child from sight, sound, or
16601660 scent exposure to any of the following:
16611661 (1) the use, possession, sal e, or manufacture of
16621662 illegal drugs,
16631663 (2) any illegal activity, or

17211721 Child neglect shall not include a child who engages in
17221722 independent activities, as defined in this section, except if the
17231723 person responsible for the child ’s health, safety, or welfare
17241724 willfully disregards any harm or th reatened harm to the child, given
17251725 the child’s level of maturity, physical condition, or mental
17261726 abilities. Nothing in this paragraph shall be construed to mean a
17271727 child is abused or neglected for the sole reason the parent, legal
17281728 guardian, or person having custody or control of the child, in good
17291729 faith, selects and depends upon spiri tual means alone through
17301730 prayer, in accordance with the tenets and practice of a recognized
17311731 church or religious denomination, for the treatment or cure of
17321732 disease or remedial car e of such child;
17331733 3. “Child sexual abuse” means the willful or malicious sexual
17341734 abuse of a child under eighteen (18) years of age by a person
17351735 responsible for a child ’s health, safety, or welfare and includes,
17361736 but is not limited to:

18041804 c. procuring or causing the participation of a minor in
18051805 child pornography sexual abuse material, as provided
18061806 for in Section 1021.2 of this title,
18071807 d. purchase, procurement , or possession of child
18081808 pornography sexual abuse material , as provided for in
18091809 Section 1024.2 of this title,
18101810 e. engaging in or soliciting prostitution, as provided
18111811 for in Section 1029 of this title, if the offense

18811881 5. “Enabling “Failure to protect from child abuse” means the
18821882 causing, procuring or permitting of willful or malicious failure to
18831883 take reasonable action to remedy child abuse by a person responsible
18841884 for a child’s health, safety, or welfare;
18851885 6. “Enabling “Failure to protect from child neglect” means the
18861886 causing, procuring or permitting of child neglect by a person

19491949 8. “Enabling “Failure to protect from child sexual
19501950 exploitation” means the causing, procuring or permitting of willful
19511951 or malicious failure to remedy or prevent child sexual exploitation
19521952 by a person responsible for a child ’s health, safety, or welfare;
19531953 9. “Great bodily injury” means bone fracture, protracted a nd
19541954 obvious disfigurement, protracted loss or impairment of the function
19551955 of a body part, organ, or mental faculty, or substantial risk of
19561956 death;
19571957 10. “Harm or threatened harm to t he health or safety of a
19581958 child” means any real or threatened bodily, mental, or emotional
19591959 injury or damage to the body or mind that is not accidental,
19601960 including abuse, neglect, sexual abuse, or sexual exploitation;
19611961 11. “Independent activities ” means activities performed by a
19621962 child that shall include, but not be limited to:

20302030 a. making any oral, written , or electronic, or computer-
20312031 generated lewd or indecent proposal to a child for the
20322032 child to have unlawful sexual relations or sexual
20332033 intercourse with any person,
20342034 b. looking upon, touching, mauling , or feeling the body
20352035 or private parts of a child in a lewd or lascivious
20362036 manner or for the purpose of sexual gratification,

21742174 f. any other person eighteen (18) years of age or older
21752175 residing in the home of the child, who is at least
21762176 three (3) years older than the child,
21772177 g. an owner, operator, agent, employee , or volunteer of a
21782178 public or private residential home, institution,
21792179 facility, or day treatment program, as defined in
21802180 Section 175.20 of Title 10 of th e Oklahoma Statutes,
21812181 that the child attended,
21822182 h. g. an owner, operator, agent, employee , or volunteer of
21832183 a child care facility, as defined in Section 402 of
21842184 Title 10 of the Oklah oma Statutes, that the child

22402240 j. i. a person who has voluntarily accepted responsibility
22412241 for the care or supervision of a chi ld;
22422242 15. “Serious mental or emotional injury ” means a psychological
22432243 condition, which shall be established and may be rebutted, by a
22442244 physician or licensed psychologist, including refusal of treatment,
22452245 that does one or more of the following:
22462246 a. renders a child chronically and severely anxious,
22472247 agitated, depressed, socially withdraw n, psychotic, or
22482248 in reasonable fear that the child ’s safety is
22492249 threatened, or
22502250 b. seriously interferes with a child ’s ability to
22512251 accomplish age-appropriate developmental and social
22522252 tasks;
22532253 13. 16. “Sexual intercourse” means the actual penetration,
22542254 however slight, of the vagina or anus by the penis; and
22552255 14. 17. “Sodomy” means:
22562256 a. penetration, however slight, of the mouth of the child
22572257 by a penis,
22582258 b. penetration, however slight, of the vagina of a person
22592259 responsible for a child ’s health, safety, or welfare,
