7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 74 O.S. 2021, Secti on 5017.1, is
7979 amended to read as follows:
8080 Section 5017.1. A. The Oklahoma Department of Commerce shall
8181 have the authority to establish, administer and enforce state and
8282 federal energy conservation programs including, but not limited to,
8383 implementing The Energy Conservation Act of 1975 (P.L. 94 -163),
8484 National Energy Extension Service Act (P.L. 95 -39, 42 U.S.C. Section
8585 7001 et seq.) and the National Conservation Policy Act (P.L. 9 5-
8686 619), except as otherwise provided by law.
8787 B. The Energy Conservation Servi ces Division of the Oklahoma
8888 Corporation Commission is hereby abolished. All personnel,

140140 equipment, files, fixtures, funds, furniture, publications and
141141 supplies, and all duties, functions, authority and contractual
142142 obligations that relate to the Energy Conservation Services Division
143143 of the Oklahoma Corporation Commission are hereby transferred to and
144144 vested in the Oklahoma Department of Commerce.
145145 C. Employees transferred to the Oklahoma Department of Commerce
146146 shall be classified and subject to the provisio ns of the Merit
147147 System of Personnel Administration as provided for in the Oklahoma
148148 Personnel Act. The salaries, grade and/or class of the employees
149149 transferred shall be adjusted to be commensurate with comparable
150150 positions in the Oklahoma Department of Commerce.
151151 D. The full-time-equivalent employee positions funded through
152152 the federal energy conservation programs outlined in this section
153153 shall terminate upon the exhaustion of said the federal funding.
154154 E. The Department shall make publicly available on it s website,
155155 to be updated annually, information related to federal, state,
156156 local, and tribal energy efficiency incentive programs. The
157157 information provided shall include, but not be limited to:
158158 1. Information regarding ongoing programs for individual
159159 households, multi-family housing, and any other energy efficiency
160160 incentive programs; and
161161 2. Information that would improve collaboration between retail
162162 energy providers and busines ses, local governments, tribal
163163 governments, and consumers, which may include:
