3841 An Act relating to public utilities; defining term;
3942 requiring the governing body of a public utility to
4043 adopt a plan for components of maintenance and
4144 operation of public utilities; providing for contents

6467 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6568 SECTION 1. NEW LAW A new section of law to be codified
6669 in the Oklahoma Statutes as Section 37 -235 of Title 11, unless there
6770 is created a duplication in numbering, reads as follows:

9498 A. As used in this section, “public utility” means a
9599 municipally owned utility or other publicly owned utility providing
96100 sewage services through a sanitary sewer system.
97101 B. The governing body of the public utility shall adopt a plan
98102 that includes, but is not limited to, the following:
99103 1. Mapping and recordkeeping of a s anitary sewer system for
100104 maintenance and operation of the system;
101105 2. A policy of inspections, cleaning, and root control of sewer
102106 lines that contains the following elements:
103107 a. an inspection program of sewer lines to determine
104108 whether sewage flows are cle ar, moderately occluded,
105109 or severely occluded,
106110 b. a program of routine maintenance of sewer lines, and
107111 c. a treatment program for sewer lines identified as
108112 having blockages due to root infiltration, of which
109113 the public utility has notice , with root control
110114 through either mechanical or chemical treatments;
111115 3. A policy of responding to calls for sanitary sewer overflows
112116 (SSOs) to clear municipal sewer mains, flush with water and
113117 deodorize the land upon which SSO has occurred, and remove SSO
114118 debris from land upon which SSO has occurred;
115119 4. Adoption of a “Fats, Oils, and Grease (FOG) Ordinance ” that
116120 makes unlawful the improper introduction of fats, oils, or grease
117121 from nonresidential e ntities that are connected to the sanitary

144149 sewer system and incorporating pr e-treatment regulations adopted by
145150 the Department of Environmental Quality for such entities. Public
146151 utilities shall periodically notify sanitary sewer system
147152 participants and dischargers of the restrictions within this
148153 paragraph;
149154 5. Adoption of an ordin ance requiring new construction or
150155 remodels of existing buildings to be connected to the sanitary sewer
151156 system, including the installation of a backflow prevention device
152157 on the private service line connecting the structure to the sanitary
153158 sewer main line;
154159 6. Adoption of a policy that will notify private residential
155160 property owners who are connected to the sanitary sewer system of
156161 the option to provide additional personal protection through
157162 installation of a backflow prevention system on the private servic e
158163 line connecting the property to the sanitary sewer main line. At
159164 the discretion of the governing body of the public utility, after
160165 considering available funding, private residen tial property owners
161166 connected to the sewer system may be offered public ass istance with
162167 installation and inspection of backflow prevention devices;
163168 7. Adoption of a funding availability model that identifies:
164169 a. the total revenue from ratepayers that can reasonably
165170 be expected over a fiscal year,
166171 b. other funding sources from mu nicipal revenues that can
167172 reasonably be expected to be contributed to the

196202 c. external sources of funding fro m local, state,
197203 federal, or tribal entities that could be available
198204 for sanitary sewer system operations, maintenance, or
199205 capital improvements, and
200206 d. bonding capacities, whether revenue bonds or general
201207 obligation bonds, that could be available for sanitary
202208 sewer system operations, maintenance, or capital
203209 improvements.
204210 Funding availability models shall be reviewed at least every five
205211 (5) years to include a rate study recommending reasonable rates for
206212 those connected to the sanitary sewer system; and
207213 8. Adoption of a five-year capital improvement plan that
208214 considers dedication of funding available to:
209215 a. repair or replace sanitary sewer lines that have been
210216 identified as severely occluded,
211217 b. repair or replace municipal sanitary sewer lift
212218 stations necessary for the continued operation of the
213219 system, and
214220 c. access or purchase equip ment for operation of the
215221 municipal sanitary sewer system serving the citizens
216222 of the municipality that are connected to the
217223 municipal sanitary sewer system.

244251 C. Notification as de scribed in paragraphs 4 and 6 of
245252 subsection B of this section shall be satis fied by annual
246253 publication in a newspaper of general circulation within the service
247254 area of the public utility, publication on the public utility
248255 sponsored website, or annual inserts in ratepayer monthly utility
249256 bills. Nothing in this subsection shall be construed to prohibit a
250257 public utility from making multiple notifications to ratepayers in
251258 the one-year period.
252259 D. Public utilities that implement policies prescribed in
253260 subsection B of this section shall be considered in compliance with
254261 the provisions of this section.
255262 E. The Oklahoma Water Resources Board and other state agencies
256263 that provide funding to public utilities for water and wastewater
257264 improvements shall ensure that any ranking structure for approval of
258265 applications for funding considers the sustainability efforts of
259266 systems that adopted the plans identified in this statute.
260267 F. There shall be no right of recovery for personal injury from
261268 a sanitary sewer overflow, provid ed that the utility charged with
262269 operation of the sanitary sewer system is w orking to maintain its
263270 sanitary sewer system in accordance with the guidance and criteria
264271 promulgated by the governing body pursuant to subsection B of this
265272 section and any criteria or guidelines promulgated by a governmental
266273 entity under an interlocal coo perative agreement pursuant to Section
267274 1001 et seq. of Title 74 of the Oklahoma Statutes, as such

294302 components are determined by the governing body to be fiscally
295303 achievable considering available revenue streams to the public
296304 utility to fund the same. While those municipalities qualifying for
297305 relief under this section shall be exempt from personal injury
298306 damage claims of annoyance and inconvenience associated with a
299307 sanitary sewer overflow that alleges a nuisance -based cause of
300308 action, nothing herein shall o therwise prohibit a right of recovery
301309 for property damages associated with a sanitary sewer overflow in
302310 accordance with The Governmental Tort Claims Act.
303311 SECTION 2. AMENDATORY 51 O.S. 2021, Section 152, as last
304312 amended by Section 111, Chapter 452, O.S.L. 2024 (51 O.S. Supp.
305313 2024, Section 152), is amended to read as follows:
306314 Section 152. As used in The Governmental Tort Claims Act:
307315 1. “Action” means a proceeding in a court of competent
308316 jurisdiction by which one party brings a suit against another;
309317 2. “Agency” means any board, commission, committee, department
310318 or other instrumentality or entity designated to act in behalf of
311319 the state or a political subdivi sion;
312320 3. “Charitable health care provider ” means a person who is
313321 licensed, certified, or otherwise authorized by the laws of this
314322 state to administer health care in the ordinary course of business
315323 or the practice of a profession and who provides care to a medically
316324 indigent person, as defined in paragraph 9 of this section, with no
317325 expectation of or acceptance of compensation of any kind;

344353 4. “Claim” means any written demand presented by a claimant or
345354 the claimant’s authorized representative in accordance with the The
346355 Governmental Tort Claims Act to recover money from the state or
347356 political subdivision as compensation for an act or omission of a
348357 political subdivision or the state or an employee;
349358 5. “Claimant” means the person or the person ’s authorized
350359 representative who files notice of a claim in accordance with The
351360 Governmental Tort Claims Act. Only the following persons and no
352361 others may be claimants:
353362 a. any person holding an interest in real or personal
354363 property which suffers a loss, provided that the claim
355364 of the person shall be aggregated with claims of all
356365 other persons holding an interest in the property and
357366 the claims of all other persons which are derivative
358367 of the loss, and that multiple claimants shall be
359368 considered a single claimant,
360369 b. the individual actually involved in the accident or
361370 occurrence who suffers a loss, provided that the
362371 individual shall aggregate in the claim the losses of
363372 all other persons which are derivative of the loss, or
364373 c. in the case of death, an administrator, special
365374 administrator or a personal representative who shall
366375 aggregate in the claim al l losses of all persons which
367376 are derivative of the death;

394404 6. “Community health care provider ” means:
395405 a. a health care provider who volunteers services at a
396406 community health center that has been deemed by the
397407 U.S. Department of Health and Human Services a s a
398408 federally qualified health center as defined by 42
399409 U.S.C., Section 1396d(l)(2)(B),
400410 b. a health provider who provides services to an
401411 organization that has been deemed a federall y
402412 qualified look-alike community health center, and
403413 c. a health care provide r who provides services to a
404414 community health center that has made application to
405415 the U.S. Department of Health and Human Services for
406416 approval and deeming as a federally qualified look -
407417 alike community health center in compliance with
408418 federal application g uidance, and has received
409419 comments from the U.S. Department of Health and Human
410420 Services as to the status of such application with the
411421 established intent of resubmitting a modified
412422 application, or, if denied, a new application, no
413423 later than six (6) months from the date of the
414424 official notification from the U.S. Department of
415425 Health and Human Services requiring resubmission of a
416426 new application;

443454 7. “Employee” means any person who is authorized to act in
444455 behalf of a political subdivision or the state whethe r that person
445456 is acting on a permanent or temporary basis, with or without being
446457 compensated or on a full -time or part-time basis.
447458 a. Employee also includes:
448459 (1) all elected or appointed officers, members of
449460 governing bodies and other persons designated to
450461 act for an agency or political subdivision, but
451462 the term does not mean a person or other legal
452463 entity while acting in the capacity of an
453464 independent contractor or an employee of an
454465 independent contractor,
455466 (2) from September 1, 1991, through June 30, 1996,
456467 licensed physicians, licensed osteopathic
457468 physicians and certified nurse -midwives providing
458469 prenatal, delivery or infant care services to
459470 State Department of Health clients pursua nt to a
460471 contract entered into with the State Department
461472 of Health in accorda nce with paragraph 3 of
462473 subsection B C of Section 1-106 of Title 63 of
463474 the Oklahoma Statutes but only insofar as
464475 services authorized by and in conformity with the
465476 terms of the contract and the requirements of
466477

506518 Sciences Center, the Oklahoma State University
507519 College of Osteopathic Medicine of Oklahoma State
508520 University, or the Department of Mental Health
509521 and Substance Abuse Services,
510522 (3) faculty members and staff of the University of
511523 Oklahoma Health Sciences Center and the Oklahoma
512524 State University College of Osteopathic Medicine
513525 of Oklahoma State University , while engaged in
514526 teaching duties,

543556 agency of the State of Oklahoma,
544557 (5) physicians who provide medical care to inmates
545558 pursuant to a contract with the Department of

547560 (6) any person who is licensed to pr actice medicine
548561 pursuant to Title 59 of the Oklahoma Statutes,
549562 who is under an administrative professional
550563 services contract with the Oklahoma Health Care
551564 Authority under the auspices of the Oklahoma
552565 Health Care Authority Chief Medical Officer, and
553566 who is limited to performing administrative
554567 duties such as professional guidance fo r medical
555568 reviews, reimbursement rates, service
556569 utilization, health care delivery and benefit
557570 design for the Oklahoma Health Care Authority,
558571 only while acting within the scope of s uch
559572 contract,
560573 (7) licensed medical professionals under contract
561574 with city, county, or state entities who provide
562575 medical care to inmates or detainees in the
563576 custody or control of law enforcement agencies,

590604 (8) licensed mental health professionals as defined
591605 in Sections 1-103 and 5-502 of Title 43A of the
592606 Oklahoma Statutes, who are conducting initial
593607 examinations of individuals for the purpose of
594608 determining whether an individual meets the
595609 criteria for emergency detention as part of a
596610 contract with the Depart ment of Mental Health and
597611 Substance Abuse Services, and
598612 (9) licensed mental health professionals as defined
599613 in Sections 1-103 and 5-502 of Title 43A of the
600614 Oklahoma Statutes, who are providing mental
601615 health or substance abuse treatment services
602616 under a professional services contract with the
603617 Department of Mental Health and Substan ce Abuse
604618 Services and are providing such treatment
605619 services at a state-operated facility.
606620 Physician faculty members and physician staff of the
607621 University of Oklahoma Health Science s Center and the
608622 Oklahoma State University College of Osteopathic
609623 Medicine of Oklahoma State University not acting in an
610624 administrative capacity or engaged in teaching duties
611625 are not employees or agents of the state.
612626 c. For the purposes of The Governmental Tort Claims Act,
613627 employee shall include independent contractors and

641656 engaged in the transport of individuals in need of
642657 initial assessment, emergency detention, or protective
643658 custody as authorized by Sect ion 1-110 of Title 43A of
644659 the Oklahoma Statutes.
645660 d. Except as provided in su bparagraph b of this
646661 paragraph, in no event shall the state be held liable
647662 for the tortious conduct of any physician, resident
648663 physician or intern while practicing medicine or
649664 providing medical treatment to patients.
650665 e. For purposes of The Governmental Tor t Claims Act,
651666 members of the state military forces on state active
652667 duty orders or on Title 32 active duty orders are
653668 employees of this state, regardless of the place,
654669 within or outside this state, where their duties as
655670 employees are performed;
656671 8. “Loss” means death or injury to the body or rights of a
657672 person or damage to real or personal property or rights therein;
658673 9. “Medically indigent” means a person requiring medically
659674 necessary hospital or other health care services for the person or
660675 the dependents of the person who has no public or private third -
661676 party coverage, and whose personal resources are insufficient to
662677 provide for needed health care;

689705 10. “Municipality” means any incorporated city or town, and all
690706 institutions, agencies or instrumentalities of a municipality;
691707 11. “Occurrence” means a loss arising out of an accident or
692708 event or a continuous or repeated exposure to substantially the same
693709 general harmful conditions. All losses arising out of an accident
694710 or event or a continuous or repeated expos ure to substantially the
695711 same general harmful conditions shall be deemed to have arisen out
696712 of one occurrence;
697713 12. “Political subdivision ” means:
698714 a. a municipality,
699715 b. a school district, including, but not limited to, a
700716 technology center school district e stablished pursuant
701717 to Section 4410, 4411, 4420 or 4420.1 of Title 70 of
702718 the Oklahoma Statutes,
703719 c. a county,
704720 d. a public trust where the sole beneficiary or
705721 beneficiaries are a city, town, school district or
706722 county. For purposes of The Governmental Tort C laims
707723 Act, a public trust shall include:
708724 (1) a municipal hospital created pursuant to Sections
709725 30-101 through 30-109 of Title 11 of the Oklahoma
710726 Statutes, a county hospital created pursuant to
711727 Sections 781 through 796 of Title 19 of the
712728 Oklahoma Statutes, or is created pursuant to a

740757 authorities, that is operated for the public
741758 benefit by a public trust created pursuant to
742759 Sections 176 through 180.4 of Title 60 of the
743760 Oklahoma Statutes and managed by a governing
744761 board appointed or elected by the municipality,
745762 county, or both, who exercises control of the
746763 hospital, subject to the approval of the
747764 governing body of the municipality, county, or
748765 both,
749766 (2) a public trust created pursuant to Sections 176
750767 through 180.4 of Title 60 of the Oklahoma
751768 Statutes after January 1, 2009, the primary
752769 purpose of which is to own, manage, or operate a
753770 public acute care hospital in this state that
754771 serves as a teaching hospital for a medical
755772 residency program provided by a college of
756773 osteopathic medicine and provides care to
757774 indigent persons, and
758775 (3) a corporation in which all of the capital stock
759776 is owned, or a limited liability company in which
760777 all of the member interes t is owned, by a public
761778 trust,

10031025 SECTION 3. AMENDATORY 51 O.S. 2021, Section 154, is

10071029 Governmental Tort Claims Act, arising out of an accident or

11031127 B. 1. Beginning on M ay 28, 2003, claims shall be allowed for
11041128 wrongful criminal felony conviction resulting in imprisonment if the
11051129 claimant has received a full pardon on the basis of a written
11061130 finding by the Governor of actual innocence for the crime for which
11071131 the claimant was sentenced or has been granted judicial relief
11081132 absolving the claimant of gui lt on the basis of actual innocence of
11091133 the crime for which the claimant was sentenced. The Governor or the
11101134 court shall specifically state, in the pardon or order, the evidence
11111135 or basis on which the finding of actual innocence is based.

11391164 recover based on “actual innocence”, the individual must meet the
11401165 following criteria:
11411166 a. the individual was charged, by indictment or
11421167 information, with the commission of a public offense
11431168 classified as a felony,
11441169 b. the individual did not plead guilty to the offense
11451170 charged, or to any lesser included offense, but was
11461171 convicted of the offense,
11471172 c. the individual was sentenced to incarceratio n for a
11481173 term of imprisonment as a result of the conviction,
11491174 d. the individual was imprisoned solely on the basis of
11501175 the conviction for the offense, and
11511176 e. (1) in the case of a pardon, a determination was made
11521177 by either the Pardon and Parole Board or the
11531178 Governor that the offense for which the

11551180 imprisoned, including any lesser offenses, was

11571182 (2) in the case of judicial relief, a court of

11951221 3. A claimant shall not be entitled to compensation for any
11961222 part of a sentence in prison during which the claimant was also
11971223 serving a concurrent sen tence for a crime not covered by this
11981224 subsection.
11991225 4. The total liability of the state and its political
12001226 subdivisions on any claim within the scope of The Governmental Tort
12011227 Claims Act arising out of wrongful criminal felony conviction
12021228 resulting in imprison ment shall not exceed One Hundred Seventy -five
12031229 Thousand Dollars ($175,000.00).
12041230 5. The provisions of this subsection shall apply to convictions
12051231 occurring on or before May 28, 2003, as well as convictions
12061232 occurring after May 28, 2003. If a court of compete nt jurisdiction
12071233 finds that retroactive application of this subsection is
12081234 unconstitutional, the prospective application of this subsection
12091235 shall remain valid.

12391266 D. When the amount awarded to or settled upon multiple
12401267 claimants exceeds the limitations of this section, any party may
12411268 apply to the district court which has jurisdiction of the cause to
12421269 apportion to each claiman t the claimant’s proper share of the total
12431270 amount as limited herein. The share apportioned to each claimant
12441271 shall be in the proportion that the ratio of the award or settlement
12451272 made to him each claimant bears to the aggregate awards and
12461273 settlements for all claims against the state or its political
12471274 subdivisions arising out of the occurrence. When the amount of the
12481275 aggregate losses presented by a single claimant exceeds the limits
12491276 of paragraph 1 or 2 of subsection A of this section, each person
12501277 suffering a loss shall be entitled to that person ’s proportionate
12511278 share.
12521279 E. The total liability of resident physicians and interns while
12531280 participating in a graduate medical education program of the
12541281 University of Oklahoma College of Medicine, its affiliated
12551282 institutions and the Oklahoma State University College of
12561283 Osteopathic Medicine and Surgery shall not exceed One Hundred
12571284 Thousand Dollars ($100,000.00).
12581285 F. The state or a political subdivisi on may petition the court

12951323 only be liable for that percentage of total damages that corresponds
12961324 to its percentage of total negligence. Nothing in this section
12971325 shall be construed as increasing the liability limits imposed on the
12981326 state or political subdivision under The Governmental Tort Claims
12991327 Act.

14011431 signs, signals or warning devices by third parties, action of
14021432 weather elements or as a result of traffic collision except on
14031433 failure of the state or political subdivision to correct the same
14041434 within a reasonable time after actual or constructive notice.
14051435 Nothing herein shall give rise to liability arising from the failure
14061436 of the state or any political subdivision to initially place any of
14071437 the above signs, signals or warning devices. The sign s, signals and
14081438 warning devices referred to herein are those used in connecti on with
14091439 hazards normally connected with the use of roadways or public ways

15371570 27. Any claim or action based on the theory of manufacturer ’s
15381571 products liability or breach of warranty, either expressed or

15401573 28. Any claim or action based on the theory of indemnification
15411574 or subrogation; provided, however, a political subdivision as
15421575 defined in subparagraph s of paragraph 11 12 of Section 152 of this
15431576 title may enter into a contract with a contract operator or any
15441577 railroad operating in interstate commerce that sells a property
15451578 interest or provides services to a regional transportation
15461579 authority, or allows the regional transportation authority to use
15471580 the railroad’s property or tracks for the provision of public
15481581 passenger rail service, prov iding for the allocation of financial
15491582 responsibility, indemnification, or th e procurement of insurance for
15501583 the parties for all types of claims or damages, provided that funds
15511584 have been appropriated to cover the resulting contractual obligation
15521585 at the time the contract is executed. The acquisition of commercial
15531586 liability insurance to cover the activities of the regional
15541587 transportation authority, contract operator or railroad shall not
15551588 operate as a waiver of any of the liabilities, immunities or
15561589 defenses provided for political subdivisions pursuant to the
15571590 provisions of The Governmen tal Tort Claims Act. A contract entered
15581591 into under this paragraph shall not affect rights of employees under

16041638 environmental remediation program, order, or requirement of a

16361671 36. Actions taken in good faith by a school district employ ee
16371672 for the out-of-school suspension of a student pursuant to applicable
16381673 Oklahoma Statutes; or
16391674 37. Use of a public facility opened to the general public
16401675 during an emergency;
16411676 38. Flooding, backups, or stoppages of storm sewers or sanitary
16421677 sewers that are caused by unordinary rainfall events, considering
16431678 duration and intensity of the rainfall event s, that result in flows
16441679 that exceed the design capacity of the sewer system;
16451680 39. Sanitary sewer overflows that have occurred on lines within
16461681 the sanitary sewer sy stem where no report of a blockage, backup, or
16471682 overflow has been made to the political subdivision or utility
16481683 operator within the preceding three (3) years; or
16491684 40. A sanitary sewer overflow occurring on private property,
16501685 provided that the utility operator is in compliance with Section 1
16511686 of this act. This paragraph shall not apply to claims for loss of
16521687 property.
16531688 SECTION 5. This act shall become effective November 1 , 2025.
