50	39		amending 26 O.S. 2021, Section 3 -101, as amended by
51	40		Section 2, Chapter 329, O.S.L. 2023 (26 O.S. Supp.

53	42		elections; modifying permissible dates for certain
54	43		elections; authorizing special elections called for
55	44		certain purposes to be held on certain dates;
56	45		specifying applicability of provisions; and providing

63	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
64	53		SECTION 1. AMENDATORY 26 O.S. 2021, Section 3 -101, as
65	54		amended by Section 2, Chapter 329, O.S.L. 2023 (26 O.S. Supp. 2024,
66	55		Section 3-101), is amended to read as follows :
67	56		Section 3-101. A. No election required to be conducted by any
68	57		county election board shall be scheduled for a day other than
69	58		Tuesday.
	59	+	B. Except as otherwise provided by law, no regular or special
	60	+	election to fill an elective office for any purpose shall be held by
	61	+	any county, school district, technology center school district,
	62	+	municipality, fire protection district , or other political
	63	+	subdivision authorized to call elections except as follows:

97		-	B. Except as otherwise provided by law, no regular or special

110	98		6. 5. The second first Tuesday after the first Monday of June
111	99		of an odd-numbered November in any year for a special election to
112	100		fill a vacancy.
113	101		C. Except as otherwise provided by law or by Section 1 of this
114	102		act, no election for any purpose other than to fill an elective
115	103		office shall be held by any county, school district, technology
116	104		center school district, municipality, fire protection district or
117	105		other political subdivision authorized to call elections except on:
118	106		1. The second Tuesday of January, February, May, June, July,
119	107		August, September, October and November and the first Tuesday in
120	108		March and April in odd -numbered years; provided, a municipality with
	109	+	a population in excess of two hundred fifty thousand (250,000)
	110	+	persons, according to the most recent Federal Decennial Census, may
	111	+	also hold an election on the ; and
	112	+	6. The second Tuesday of December in an odd-numbered years; and

157	143		D. C. In the event that a regular or special election date
158	144		occurs on an official state holiday, the election shall b e scheduled
159	145		for the next following Tuesday. In the event that any day of a
160	146		candidate filing period occurs on a Saturday, Sunday , or any
161	147		official state holiday, that day of the filing period shall be
162	148		scheduled for the next business day.
163	149		D. For a special election called by the Governor as authorized
164	150		by law, the Governor shall be limited to the dates stated in
165	151		subsection B of this section. Provided, however, if a vacancy has
166	152		occurred in the office of United States Representative, State
167	153		Senator, or State Rep resentative, or in the event of a declared
168	154		national or state emergency that requires a special election, the
169	155		Governor may also call a special election as authorized by law on
170	156		the following dates:
171	157		1. The second Tuesday of January in any year;
	158	+	2. The first Tuesday of March in any year;
	159	+	3. The first Tuesday of May in an odd -numbered year;
	160	+	4. The second Tuesday of July in an odd -numbered year;
	161	+	5. The second Tuesday of September in an odd -numbered year;

199		-	2. The first Tuesday of March in any year;

205	190		E. Notwithstanding any other provision of law or any provision
206	191		of a municipal charter, any municipality, school district,
207	192		technology center district, county, rural fire protection district,
208	193		or any other entity seeking to hold a regular or special election to
209	194		be conducted by a county election board on the same date as a
210	195		regular or special federal or state election, shall file the
211	196		resolution calling for the election with the county election board
212	197		secretary no later than seventy -five (75) days prior to the election
213	198		date. A candidate filing period of three (3) days, if so required
214	199		by the resolution, shall begin no later than ten (10) days following
215	200		the deadline to file the resolution with the secretary of the county
216	201		election board; provided, the filing period for such municipal
217	202		office may be scheduled on the same dates as the filing period for
218	203		state or federal office to be filled at such election.
219	204		F. Any school district, technology center district,
220	205		municipality, including any municipality governed by charter, rural
221	206		fire protection district , or any other entity seeking to hold a
222	207		special election for the purpose of filling a vacancy shall schedule
	208	+	a candidate filing period of three (3) days to begin not more than
	209	+	twenty (20) days following the date the resolution calling the
	210	+	election is required to be filed with the secretary of the county
	211	+	election board.
