3839 An Act relating to workforce development; amending

5455 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5556 SECTION 1. AMENDATORY Section 5, Chapter 361, O.S.L.
5657 2023 (40 O.S. Supp. 2024, Section 904), is amended to read as
5758 follows:
5859 Section 904. The Oklahoma Workforce Commission shall have the
5960 following powers, duties, and responsibilities:
6061 1. To administer the provisions of this act the Oklahoma
6162 Workforce Transformation Act or any duty as directed by statute;
6263 2. To establish an office for the Commission within this state;
6364 3. To elect whatever other officers may be necessary to direct
6465 operations of the Commission;

9193 4. To employ or contract for personnel and administrative
9294 support as the Commission deems appropriate to c arry out the purpose
9395 and provisions of this act the Oklahoma Workforce Transformation
9496 Act, including, but not limited to, a nonprofit corporation to carry
9597 out the Commission’s objectives, an Executive Director executive
9698 director or other chief executive of ficer, and any other employees
9799 or contractors the Commiss ion deems appropriate, and to prescribe
98100 their duties and fix their compensation;
99101 5. To administer the Workforce Coordination Revolving Fund
100102 created in Section 255.4 of Title 62 of the Oklahoma Statu tes;
101103 6. To approve or disapprove the budget of the Commission;
102104 7. To promulgate rules to carry out the provisions of this act
103105 the Oklahoma Workforce Transformation Act ;
104106 8. To enter into contracts or agreements for studies,
105107 professional services, grant a dministration and procurement,
106108 research projects, supplie s, or any other services the Commission
107109 deems necessary to carry out its purpose, and to incur those
108110 expenses necessary to carry out those purposes;
109111 9. To cooperate with any private, local, state, o r national
110112 commission, organization, agency, or group and to make contracts and
111113 agreements for joint programs beneficial to Oklahoma ’s workforce

113115 10. To accept donations, grants, contributions, and gifts from

141144 Coordination Revolvi ng Fund, created in Section 255.4 of Title 62 of
142145 the Oklahoma Statutes;
143146 11. To oversee and direct to the extent permitted by law the
144147 activities and administration of the Governor ’s Council for
145148 Workforce and Economic Development, including , but not limited to,
146149 the creation and submission of state plans to the federal government
147150 pursuant to the provisions of the Workforce Innovation and
148151 Opportunity Act;
149152 12. To collect data from federal, state, and loc al agencies,
150153 departments, educational institutions, board s, commissions, or any
151154 other entities including, but not limited to:
152155 a. number of participants in workforce development
153156 programming,
154157 b. cost per participant,
155158 c. wages before and after participation i n programs,
156159 d. degree or certificate conferred on each participant,
157160 e. number of jobs open needing degrees or certificates,
158161 f. labor force and economic information, and
159162 g. any other information the Commission deems appropriate
160163 to guide funding decisions, f acilitate its work or the
161164 work of workforce development e ntities in the state,
162165 or to understand the impact of the state ’s workforce
163166 efforts and programming;

190194 13. To create and maintain a public dashboard and create
191195 reports with data concerning workforce de velopment efforts in the
192196 state. All state and local agencies, departments, educational
193197 institutions, boards, commissions, and other public entities shall
194198 cooperate with information and data requests from the Commission or
195199 its designees. It is the intent of the Legislature that the
196200 Oklahoma Workforce Commission serve as the centralized data and
197201 information repository for workforce development activities for the
198202 state; and
199203 14. To make recommendations to the Legislature to improve
200204 workforce development prog rams in the state; and
201205 15. To implement programs designed to expand workforce
202206 development.
203207 SECTION 2. NEW LAW A new section of law to be codified
204208 in the Oklahoma Statutes as Section 905 of Title 40, unless there is
205209 created a duplication in numbering, reads as follows:
206210 A. Pursuant to the provisions of Section 904 of Title 40 of the
207211 Oklahoma Statutes, the Oklahoma Workforce Commission shall implement
208212 programs in this state to address the following:
209213 1. High demand and critical occupa tion workforce development,
210214 which may:
211215 a. identify the needs of institutions of higher education
212216 suited for certain critical workforce areas,
213217 b. identify outcomes based on funding,

241246 d. improve program capacity development;
242247 2. Work-based learning opportunities, which may include, but
243248 not be limited to, internships, apprenticeships, and other career
244249 exploration and exposure; and
245250 3. K-12 district innovation for workforce success, which may:
246251 a. enhance pathway development,
247252 b. utilize development grants for basic skills
248253 development,
249254 c. utilize regulatory innovation grants, and
250255 d. develop career-connected high schools.
251256 B. The Commission may administer these programs through funds
252257 in the Workforce Coordination Revolving Fund created in S ection
253258 255.4 of Title 62 of the Oklahoma Statutes.
254259 C. The Commission shall promulgate rules necessary to implement
255260 the provisions of this section.
256261 SECTION 3. This act shall become effective November 1, 2025.
