7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 59 O.S. 2021, Section 1000.4a, as
8181 amended by Section 3, Chapter 185, O.S.L. 2023 (59 O.S. Supp. 2024,
8282 Section 1000.4a), is amended to read as follows:
8383 Section 1000.4a. A. The Construction Industries Board shall
8484 have the additional powers to:
8585 1. Receive and convey information relating to the skilled
8686 trades regulated by the Construction Industries Board including, but
8787 not limited to, workforce development; and
8888 2. Enter into contracts with the O klahoma Department of Career

141141 Technology Education fully accredited vocational or technical
142142 school, or any accredited system of education institution in the
143143 State of Oklahoma this state receiving state appropriations and
144144 offering programs in primary, secondary and, or postsecondary
145145 instruction that provide electrical, mechanical, plumbing or roofing
146146 trade coursework for any of the following purposes, or combination
147147 thereof:
148148 a. developing and implementing instructional courses on
149149 Oklahoma Statutes and rules that govern the
150150 electrical, mechanical, plumbing and roofing trades,
151151 which courses can be in conjunction with in struction
152152 in performing trade work or instruction on statewide -
153153 adopted trade codes, or both, for the advancement of
154154 the electrical, mechanical, plumbing and roofing
155155 trades, or
156156 b. developing and implementing a workforce development
157157 program that will create interest in the pursuit of a
158158 skilled trade career and public awareness . The
159159 workforce development program may consist of, but is
160160 not limited to, use of the Internet, community and
161161 school presentations, and research and instruction on
162162 the electrical, mecha nical, plumbing and roofing
163163 trades, and public information campaigns .

215215 B. All contracts pursuant to this section shall be approved by
216216 the Construction Industries Board in accordance with the Oklahoma
217217 Open Meeting Act. Costs of the contracts for education and
218218 workforce development programs shall be paid from the Skilled Trade
219219 Education and Workforce Development Fund established herein and
220220 funded by administrative fines or penalties as described in this
221221 section. Applications for proposals are to be submitte d to the
222222 Board on forms provided requiring sufficient justification and
223223 information to evaluate costs, return on investment, value, and
224224 viability of the proposal. Any contracts will include the
225225 requirement that the recipient of the funds will, upon the
226226 completion of the contract, provide a written report to the Board
227227 providing an accounting of expenditures, describing an explanation
228228 of the funds used for the services provided and the success of
229229 outreach demonstrating a return on the investment including, b ut not
230230 limited to, an accounting of accomplishments.
231231 C. Fines or penalties collected by the Board and deposited in
232232 the Oklahoma Mechanical Licensing Revolving Fund, the Electrical
233233 Revolving Fund, the Plumbing Licensing Revolving Fund and the
234234 Roofing Contractor Registration Revolving Fund may be transferred to
235235 the Skilled Trade Educ ation and Workforce Development Fund created
236236 in subsection E of this section for the following purposes:

288288 1. To develop instructional materials on Oklahoma laws,
289289 statutes and rules, as they relate to the plumbing, mechanical,
290290 electrical and roofing trades and state licensing standards;
291291 2. To cover the cost of equipment, materials, personnel and any
292292 other costs of developing and implementing the trade curriculum; and
293293 3. To cover the cost of equipment, materials, personnel and any
294294 other costs of developing and implementing the workforce development
295295 program used to promote the plumbing, mechanical, electrical and
296296 roofing trades as a career in Oklahoma.
297297 D. The Skilled Trade Educatio n and Workforce Development Fund
298298 monies shall be used only for the advancement of trade -related
299299 education and workforce development, and only if available based
300300 upon statutory limitations.
301301 E. 1. There is hereby created in the State Treasury a
302302 revolving fund for the Construction Industries Board to be
303303 designated the “Skilled Trade Education and Workforce Development
304304 Fund”. The fund shall be a continuing fund, not subject to fiscal
305305 year limitations. The fund shall consist of an annual transfer of
306306 fully adjudicated fine revenue received in the Oklahoma Mechanical
307307 Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
308308 Licensing Revolving Fund or Roofing Contractor Registration
309309 Revolving Fund as determined pursuant to this section. Funds may be
310310 transferred only from the prior fiscal year.

362362 2. If actual receipts, not including f ine receipts, exceed
363363 actual expenses and outstanding encumbrances, then one hundred
364364 percent (100%) of all fully adjudicated fine revenue received shall
365365 be transferred from each s pecific trade revolving fund: the
366366 Oklahoma Mechanical Licensing Revolving Fund, Electrical Revolving
367367 Fund, Plumbing Licensing Revolving Fund or Roofing Contractor
368368 Registration Revolving Fund.
369369 3. If at any time the receipts in the Oklahoma Mechanical
370370 Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
371371 Licensing Revolving Fund or Roofing Contractor Registration
372372 Revolving Fund, not including fine receipts, are less than actual
373373 expenses and outstanding encumbrances, then the difference of fine
374374 receipts over actual expenses and outstanding encumbrances, if any,
375375 shall be transferred.
376376 4. If at any time the annual receipts in the Oklahoma
377377 Mechanical Licensing Revolving Fund, Electrical Revolving Fund,
378378 Plumbing Licensing Revolving Fund or Roofing Contrac tor Registration
379379 Revolving Fund, including fine receipts, are less than the ac tual
380380 expenses and outstanding encumbrances, there shall be no transfer of
381381 funds for that period.
382382 5. All monies accruing to the credit of the Skilled Trade
383383 Education and Workforc e Development Fund may be budgeted and
384384 expended by the Construction Industries Board for workforce
385385 development as it relates to the skilled trades and to contract for

437437 the services identified in this act section and Sections 1018,
438438 1151.20, 1694, and 1850.13 of this title. Expenditures from the
439439 fund shall be made upon warrants issued by the State Treasurer
440440 against claims filed as prescribed by law with the Director of the
441441 Office of Management and Enterprise Services for approval and
442442 payment.
443443 6. All unexpended or outstanding funds from the Skilled Trade
444444 Education and Workforce Development Funds Fund from any written
445445 agreement where work or services have not been previously approved
446446 by specific quote or cost estimate and have not been performed
447447 within eighteen (18) months of the date the agreement was signed are
448448 hereby released from the agreement and are available for future
449449 agreements approved by the Board pursuant to this act section and
450450 Sections 1000.2 and 1000.4 of this title , except for specific
451451 quotes, estimates, or invoices that previously have been approved
452452 for payment, and for which performance has been initiated , and
453453 completed within twenty -four (24) months of the signed agreement.
454454 SECTION 2. This act shall become effective November 1, 2025.
