79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 59 O.S. 2021, Section 1000.4a, as
81	81	amended by Section 3, Chapter 185, O.S.L. 2023 (59 O.S. Supp. 2024,
82	82	Section 1000.4a), is amended to read as follows:
83	83	Section 1000.4a. A. The Construction Industries Board shall
84	84	have the additional powers to:
85	85	1. Receive and convey information relating to the skilled
86	86	trades regulated by the Construction Industries Board including, but
87	87	not limited to, workforce development; and
88	88	2. Enter into contracts with the O klahoma Department of Career
89	89	and Technology Education or any Oklahoma State Board of Career and

142	142	school, or any accredited system of education institution in the
143	143	State of Oklahoma this state receiving state appropriations and
144	144	offering programs in primary, secondary and, or postsecondary
145	145	instruction that provide electrical, mechanical, plumbing or roofing
146	146	trade coursework for any of the following purposes, or combination
147	147	thereof:
148	148	a. developing and implementing instructional courses on
149	149	Oklahoma Statutes and rules that govern the
150	150	electrical, mechanical, plumbing and roofing trades,
151	151	which courses can be in conjunction with in struction
152	152	in performing trade work or instruction on statewide -
153	153	adopted trade codes, or both, for the advancement of
154	154	the electrical, mechanical, plumbing and roofing
155	155	trades, or
156	156	b. developing and implementing a workforce development
157	157	program that will create interest in the pursuit of a
158	158	skilled trade career and public awareness . The
159	159	workforce development program may consist of, but is
160	160	not limited to, use of the Internet, community and
161	161	school presentations, and research and instruction on
162	162	the electrical, mecha nical, plumbing and roofing
163	163	trades, and public information campaigns .

215	215	B. All contracts pursuant to this section shall be approved by
216	216	the Construction Industries Board in accordance with the Oklahoma
217	217	Open Meeting Act. Costs of the contracts for education and
218	218	workforce development programs shall be paid from the Skilled Trade
219	219	Education and Workforce Development Fund established herein and
220	220	funded by administrative fines or penalties as described in this
221	221	section. Applications for proposals are to be submitte d to the
222	222	Board on forms provided requiring sufficient justification and
223	223	information to evaluate costs, return on investment, value, and
224	224	viability of the proposal. Any contracts will include the
225	225	requirement that the recipient of the funds will, upon the
226	226	completion of the contract, provide a written report to the Board
227	227	providing an accounting of expenditures, describing an explanation
228	228	of the funds used for the services provided and the success of
229	229	outreach demonstrating a return on the investment including, b ut not
230	230	limited to, an accounting of accomplishments.
231	231	C. Fines or penalties collected by the Board and deposited in
232	232	the Oklahoma Mechanical Licensing Revolving Fund, the Electrical
233	233	Revolving Fund, the Plumbing Licensing Revolving Fund and the
234	234	Roofing Contractor Registration Revolving Fund may be transferred to
235	235	the Skilled Trade Educ ation and Workforce Development Fund created
236	236	in subsection E of this section for the following purposes:

288	288	1. To develop instructional materials on Oklahoma laws,
289	289	statutes and rules, as they relate to the plumbing, mechanical,
290	290	electrical and roofing trades and state licensing standards;
291	291	2. To cover the cost of equipment, materials, personnel and any
292	292	other costs of developing and implementing the trade curriculum; and
293	293	3. To cover the cost of equipment, materials, personnel and any
294	294	other costs of developing and implementing the workforce development
295	295	program used to promote the plumbing, mechanical, electrical and
296	296	roofing trades as a career in Oklahoma.
297	297	D. The Skilled Trade Educatio n and Workforce Development Fund
298	298	monies shall be used only for the advancement of trade -related
299	299	education and workforce development, and only if available based
300	300	upon statutory limitations.
301	301	E. 1. There is hereby created in the State Treasury a
302	302	revolving fund for the Construction Industries Board to be
303	303	designated the “Skilled Trade Education and Workforce Development
304	304	Fund”. The fund shall be a continuing fund, not subject to fiscal
305	305	year limitations. The fund shall consist of an annual transfer of
306	306	fully adjudicated fine revenue received in the Oklahoma Mechanical
307	307	Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
308	308	Licensing Revolving Fund or Roofing Contractor Registration
309	309	Revolving Fund as determined pursuant to this section. Funds may be
310	310	transferred only from the prior fiscal year.

362	362	2. If actual receipts, not including f ine receipts, exceed
363	363	actual expenses and outstanding encumbrances, then one hundred
364	364	percent (100%) of all fully adjudicated fine revenue received shall
365	365	be transferred from each s pecific trade revolving fund: the
366	366	Oklahoma Mechanical Licensing Revolving Fund, Electrical Revolving
367	367	Fund, Plumbing Licensing Revolving Fund or Roofing Contractor
368	368	Registration Revolving Fund.
369	369	3. If at any time the receipts in the Oklahoma Mechanical
370	370	Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
371	371	Licensing Revolving Fund or Roofing Contractor Registration
372	372	Revolving Fund, not including fine receipts, are less than actual
373	373	expenses and outstanding encumbrances, then the difference of fine
374	374	receipts over actual expenses and outstanding encumbrances, if any,
375	375	shall be transferred.
376	376	4. If at any time the annual receipts in the Oklahoma
377	377	Mechanical Licensing Revolving Fund, Electrical Revolving Fund,
378	378	Plumbing Licensing Revolving Fund or Roofing Contrac tor Registration
379	379	Revolving Fund, including fine receipts, are less than the ac tual
380	380	expenses and outstanding encumbrances, there shall be no transfer of
381	381	funds for that period.
382	382	5. All monies accruing to the credit of the Skilled Trade
383	383	Education and Workforc e Development Fund may be budgeted and
384	384	expended by the Construction Industries Board for workforce
385	385	development as it relates to the skilled trades and to contract for

437	437	the services identified in this act section and Sections 1018,
438	438	1151.20, 1694, and 1850.13 of this title. Expenditures from the
439	439	fund shall be made upon warrants issued by the State Treasurer
440	440	against claims filed as prescribed by law with the Director of the
441	441	Office of Management and Enterprise Services for approval and
442	442	payment.
443	443	6. All unexpended or outstanding funds from the Skilled Trade
444	444	Education and Workforce Development Funds Fund from any written
445	445	agreement where work or services have not been previously approved
446	446	by specific quote or cost estimate and have not been performed
447	447	within eighteen (18) months of the date the agreement was signed are
448	448	hereby released from the agreement and are available for future
449	449	agreements approved by the Board pursuant to this act section and
450	450	Sections 1000.2 and 1000.4 of this title , except for specific
451	451	quotes, estimates, or invoices that previously have been approved
452	452	for payment, and for which performance has been initiated , and
453	453	completed within twenty -four (24) months of the signed agreement.
454	454	SECTION 2. This act shall become effective November 1, 2025.
