177	174		SECTION 1. AMENDATORY 59 O.S. 202 1, Section 328.2, is
178	175		amended to read as follows:
179	176		Section 328.2. The practice of dentistry in the State of
180	177		Oklahoma is hereby declared to affect the public health, safety and
181	178		general welfare and to be subject to regulation and control in the
182	179		public’s best interest. It is further declared to be a matter of
183	180		public interest and concern that the dental profession, through
184	181		advancement and achievement, merits and receives the confidence of
185	182		the public and that only properly qualified dentists be permitted to
186	183		practice dentistry and supervise dental hygienists , and dental
187	184		assistants and oral maxillofacial surgery assistants in the State of
188	185		Oklahoma this state. All provisions of this act relating to the
189	186		practice of dentistry, the practice of dental hygiene, and the
190	187		procedures performed by dental assistants and oral maxillofacial
191	188		surgery assistants, and the fabrication of dental appliances in
192	189		dental laboratories by dental laboratory technicians shall be
193	190		liberally construed to carry out these objects and purposes.
194	191		SECTION 2. AMENDATORY 59 O.S. 2021, Section 328.3, as
195	192		last amended by Section 1, Chapter 46, O.S.L. 2024 (59 O.S. Supp.
196	193		2024, Section 328.3), is amended to read as follows:
197	194		Section 328.3. As used in the State Dental Act, the followin g
198	195		words, phrases, or terms, unless the context otherwise indicates,
199	196		shall have the following meanings:

227	223		1. “Accredited dental college” means an institution whose
228	224		dental educational program is accredited by the Commission on Dental
229	225		Accreditation of the Amer ican Dental Association;
230	226		2. “Accredited dental hygiene program” means a dental hygiene
231	227		educational program which is accredited by the Commission on Dental
232	228		Accreditation of the American Dental Association;
233	229		3. “Accredited dental assisting program or class” means a
234	230		dental assisting program which is accredited by the Commission on
235	231		Dental Accreditation of the American Dental Association or a class
236	232		approved by the Board of Dentistry;
237	233		4. “Advanced procedure” means a dental procedure for which a
238	234		dental hygienist has received special training in a course of study
239	235		approved by the Board;
240	236		5. “Board” means the Board of Dentistry;
241	237		6. “Certified dental assistant” means a dental assistant who
242	238		has earned and maintains current certified dental assistant
243	239		certification from the Dental Assisting National Board (DANB);
244	240		7. “Coronal polishing” means a procedure limited to the removal
245	241		of plaque and stain from exposed tooth surfaces, utilizing a slow
246	242		speed hand piece with a prophy/polishing cup or brush and polishing
247	243		agent and is not prophylaxis. To be considered prophylaxis,
248	244		examination for calculus and scaling must be done by a dental
249	245		hygienist or dentist;

277	272		8. “Deep sedation” means a drug -induced depression of
278	273		consciousness during which patients cannot be easily aroused but
279	274		respond purposefully following repeated or painful stimulation. The
280	275		ability to independently maintain ventilator function may be
281	276		impaired. Patients may require assistance in maintaining a patent
282	277		airway, and spontaneous ventilation may be inadequate.
283	278		Cardiovascular function is usually maintained;
284	279		9. “Dentistry” means the practice of dentistry in all of its
285	280		branches;
286	281		10. “Dentist” means a graduate of an accredited dental college
287	282		who has been issued a license by the Board to practice dentistry as
288	283		defined in Section 328.19 of this title;
289	284		11. “Dental ambulatory surgical center (DASC)” means a facility
290	285		that operates exclusively for the purpose of furnishing outpatient
291	286		surgical services to patients. A DASC shall have the same
292	287		privileges and requirements as a d ental office and additionally must
293	288		be an accredited facility by the appropriate entity;
294	289		12. “Dental appliance” means a dental appliance, prosthetic
295	290		denture, bridge, restoration , or other device made for an individual
296	291		patient for a purpose listed in Sectio n 328.19 of this title;
297	292		13. “Dental office” means an establishment owned and operated
298	293		by a dentist for the practice of dentistry, which may be composed of
299	294		reception rooms, business offices, private offices, laboratories,
300	295		and dental operating rooms where d ental operations are performed;

328	322		13. 14. “Dental hygiene” means the science and practice of the
329	323		promotion of oral health and prevention and treatment of oral
330	324		disease through the provision of educational, therapeutic, clinical,
331	325		and preventive services;
332	326		14. 15. “Dental hygienist” means an individual who has
333	327		fulfilled the educational requirements and is a graduate of an
334	328		accredited dental hygiene program and who has passed an examination
335	329		and has been issued a license by the Board and who is authorized to
336	330		practice dental hygiene as defined in this section;
337	331		15. 16. “Dental assistant” or “oral maxillofacial surgery
338	332		assistant” means an individual working for a dentist, under the
339	333		dentist’s direct supervision or direct visual supervision, and
340	334		performing duties in th e dental office or a treatment facility
341	335		including the limited treatment of patients in accordance with the
342	336		provisions of the State Dental Act. A dental assistant or oral
343	337		maxillofacial surgery assistant may assist a dentist with the
344	338		patient; provided, this shall be done only under the direct
345	339		supervision or direct visual supervision and control of the dentist
346	340		and only in accordance with the educational requirements and rules
347	341		promulgated by the Board;
348	342		16. 17. “Dental laboratory” means a location, whether in a
349	343		dental office or not, where a dentist or a dental laboratory
350	344		technician performs dental laboratory technology;

378	371		17. 18. “Dental laboratory technician” means an individual
379	372		whose name is duly filed in the official records of the Board, which
380	373		authorizes the technician, upon the laboratory prescription of a
381	374		dentist, to perform dental laboratory technology, which services
382	375		must be rendered only to the prescribing dentist and not to the
383	376		public;
384	377		18. 19. “Dental laboratory technology” means using materials
385	378		and mechanical devices for the construction, reproduction or repair
386	379		of dental restorations, appliances or other devices to be worn in a
387	380		human mouth;
388	381		19. 20. “Dental specialty” means a specialized practice of a
389	382		branch of dentistry, recognized by the Board, where the dental
390	383		college and specialty program are accredited by the Commission on
391	384		Dental Accreditation (CODA), or a dental specialty recognized by the
392	385		Board, requiring a minimum number of hours of approved education and
393	386		training and/or recognition by a nationa lly recognized association
394	387		or accreditation board;
395	388		20. 21. “Direct supervision” means the supervisory dentist is
396	389		in the dental office or treatment facility and, during the
397	390		appointment, personally examines the patient, diagnoses any
398	391		conditions to be treate d, and authorizes the procedures to be
399	392		performed by a dental hygienist , or dental assistant, or oral
400	393		maxillofacial surgery assistant . The supervising dentist is
401	394		continuously on-site and physically present in the dental office or

429	421		treatment facility while t he procedures are being performed and,
430	422		before dismissal of the patient, evaluates the results of the dental
431	423		treatment;
432	424		21. 22. “Direct visual supervision” means the supervisory
433	425		dentist has direct ongoing visual oversight which shall be
434	426		maintained at all times during any procedure authorized to be
435	427		performed by a dental assistant or an oral maxillofacial surgery
436	428		assistant;
437	429		22. 23. “Expanded duty” means a dental procedure for which a
438	430		dental assistant has received special training in a course of study
439	431		approved by the Board;
440	432		23. 24. “Fellowship” means a program designed for post -
441	433		residency graduates to gain knowledge and experience in a
442	434		specialized field;
443	435		24. 25. “General anesthesia” means a drug -induced loss of
444	436		consciousness during which patients are not arou sable, even by
445	437		painful stimulation. The ability to independently maintain
446	438		ventilator function is often impaired. Patients often require
447	439		assistance in maintaining a patent airway, and positive pressure
448	440		ventilation may be required because of depressed spon taneous
449	441		ventilation or drug-induced depression of neuromuscular function.
450	442		Cardiovascular function may be impaired;
451	443		25. 26. “General supervision” means the supervisory dentist has
452	444		diagnosed any conditions to be treated within the past thirteen (13)

480	471		months, has personally authorized the procedures to be performed by
481	472		a dental hygienist, and will evaluate the results of the dental
482	473		treatment within a reasonable time as determined by the nature of
483	474		the procedures performed, the needs of the patient, and the
484	475		professional judgment of the supervisory dentist. General
485	476		supervision may only be used to supervise a dental hygienist and may
486	477		not be used to supervise an oral maxillofacial surgery assistant or
487	478		a dental assistant except as provided by Section 328.58 of this
488	479		title;
489	480		26. 27. “Indirect supervision” means the supervisory dentist is
490	481		in the dental office or treatment facility and has personally
491	482		diagnosed any conditions to be treated, authorizes the procedures to
492	483		be performed by a dental hygienist, remains in the de ntal office or
493	484		treatment facility while the procedures are being performed, and
494	485		will evaluate the results of the dental treatment within a
495	486		reasonable time as determined by the nature of the procedures
496	487		performed, the needs of the patient, and the profession al judgment
497	488		of the supervisory dentist. Indirect supervision may not be used
498	489		for an oral maxillofacial surgery assistant or a dental assistant;
499	490		27. 28. “Investigations” means an investigation proceeding,
500	491		authorized under Sections 328.15A and 328.43a of t his title, to
501	492		investigate alleged violations of the State Dental Act or the rules
502	493		of the Board;

530	520		28. 29. “Laboratory prescription” means a written description,
531	521		dated and signed by a dentist, of dental laboratory technology to be
532	522		performed by a dental labor atory technician;
533	523		29. 30. “Minimal sedation” means a minimally depressed level of
534	524		consciousness, produced by a pharmacological method, that retains
535	525		the patient’s ability to independently and continuously maintain an
536	526		airway and respond normally to tactile stimulation and verbal
537	527		command. Although cognitive function and coordination may be
538	528		modestly impaired, ventilator and cardiovascular functions are
539	529		unaffected;
540	530		30. 31. “Mobile dental anesthesia provider” means a licensed
541	531		and anesthesia-permitted dentist, physician or Certified Registered
542	532		Nurse Anesthetist (CRNA) that has a mobile dental unit and provides
543	533		anesthesia in dental offices and facilities in the state;
544	534		31. 32. “Mobile dental clinic” means a permitted motor vehicle
545	535		or trailer utilized as a dental clinic, and/or that contains dental
546	536		equipment and is used to provide dental services to patients on -site
547	537		and shall not include a mobile dental anesthesia provider. A mobile
548	538		dental clinic shall also mean and include a volunteer mobile dental
549	539		facility that is directly affiliated with a church or religious
550	540		organization as defined by Section 501(c)(3) or 501(d) of the United
551	541		States Internal Revenue Code, the church or religious organization
552	542		with which it is affiliated is clearly indicated on the exterior of
553	543		the volunteer mobile dental facility, and such facility does not

581	570		receive any form of payment either directly or indirectly for work
582	571		provided to patients other than donations through the affiliated
583	572		church or religious organization; provided, that the voluntee r
584	573		mobile dental facility shall be exempt from any registration fee
585	574		required under the State Dental Act;
586	575		32. 33. “Moderate sedation” means a drug -induced depression of
587	576		consciousness during which patients respond purposefully to verbal
588	577		commands, either alon e or accompanied by light tactile stimulation.
589	578		No interventions are required to maintain a patent airway, and
590	579		spontaneous ventilation is adequate. Cardiovascular function is
591	580		usually maintained;
592	581		33. 34. “Prophylaxis” means the removal of any and all
593	582		calcareous deposits, stains, accretions or concretions from the
594	583		supragingival and subgingival surfaces of human teeth, utilizing
595	584		instrumentation by scaler or periodontal curette on the crown and
596	585		root surfaces of human teeth including rotary or power -driven
597	586		instruments. This procedure may only be performed by a dentist or
598	587		dental hygienist;
599	588		34. 35. “Patient” or “patient of record” means an individual
600	589		who has given a medical history and has been examined and accepted
601	590		by a dentist for dental care;
602	591		35. 36. “Residencies” are programs designed for advanced
603	592		clinical and didactic training in general dentistry or other
604	593		specialties or other specialists at the post -doctoral level

634	622		36. 37. “Supervision” means direct supervision, direct visual
635	623		supervision, indirect supervision or general supervision;
636	624		37. 38. “Teledentistry” means the remote delivery of dental
637	625		patient care via telecommunications and other technology for the
638	626		exchange of clinical inform ation and images for dental consultation,
639	627		preliminary treatment planning and patient monitoring; and
640	628		38. 39. “Treatment facility” means:
641	629		a. a federal, tribal, state or local public health
642	630		facility,
643	631		b. a Federally Qualified Health Center (FQHC),
644	632		c. a private health facility,
645	633		d. a group home or residential care facility serving the
646	634		elderly, disabled or juveniles,
647	635		e. a hospital or dental ambulatory surgery center (DASC),
648	636		f. a nursing home,
649	637		g. a penal institution operated by or under contract with
650	638		the federal or state government,
651	639		h. a public or private school,
652	640		i. a patient of record’s private residence,

953	935		16. Diagnosing, making, and adjusting appliances to artificial
954	936		casts of malposed teeth for treatment of the malposed teeth in the
955	937		human mouth, without instructions;

984	965		dental laboratory technician for the construction, reproduction or
985	966		repair of any appliance or structure to be worn in the human m outh;
986	967		18. Owning, maintaining, or operating an office or offices by
987	968		holding a financial interest in same for the practice of dentistry;
988	969		or
989	970		19. Any other procedure otherwise defined in the State Dental
990	971		Act requiring a valid license or permit to perform wh ile the person
991	972		does not hold such valid license or permit issued by the Board.
992	973		B. The fact that a person uses any dental degree, or
993	974		designation, or any card, device, directory, poster, sign or other
994	975		media representing oneself to be a dentist shall be prim a facie
995	976		evidence that the person is engaged in the practice of dentistry;
996	977		provided that nothing in this section shall be so construed as to
997	978		prevent the following:
998	979		1. Physicians or surgeons, who are licensed under the laws of
999	980		this state, from administering any kind of treatment coming within
1000	981		the province of medicine or surgery;
1001	982		2. The practice of dentistry in the discharge of the person’s
1002	983		official duties by dentists in the United States Army, the United
1003	984		States Navy, the United States Air Force, the United States Marine
1004	985		Corps, the United States Coast Guard, the United States Public
1005	986		Health Service, or the United States Veterans Administration;

1042	1022		person granted a license by the Board;
1043	1023		6. The performing of acts by a d ental assistant or oral
1044	1024		maxillofacial surgery assistant who performs the acts under the
1045	1025		direct supervision or direct visual supervision of a dentist and in
1046	1026		accordance with the provisions of the State Dental Act and the rules
1047	1027		promulgated by the Board; or
1048	1028		7. The fabrication of dental appliances pursuant to a
1049	1029		laboratory prescription of a dentist, by a dental laboratory
1050	1030		technician in a dental laboratory using inert materials and
1051	1031		mechanical devices for the fabrication of any restoration, appliance
1052	1032		or thing to be worn in the human mouth.

1092	1071		age, or over, if the a pplicant is to practice dental hygiene;
1093	1072		3. Has passed a written theoretical examination and a clinical
1094	1073		examination approved by the Board within the previous five (5)

1096	1075		4. Has passed a written jurisprudence examination over the
1097	1076		rules and laws affecting dentistry in this state.
1098	1077		C. An application from a candidate who desires to secure a
1099	1078		license from the Board to practice dentistry or dental hygiene in
1100	1079		this state shall be accompanied by satisfactory proof that the
1101	1080		applicant:
1102	1081		1. Is a graduate of an accredited dental college, if the
1103	1082		applicant is to practice dentistry;
1104	1083		2. Is a graduate of an accredited dental hygiene program, if
1105	1084		the applicant is to practice dental hygiene; and

1142	1120		anterior all porcelain crown and the preparation of a
1143	1121		three-unit posterior bridge,
1144	1122		b. a periodontal component,
1145	1123		c. an endodontic component,
1146	1124		d. an anterior class III and posterior class II
1147	1125		restorative component,
1148	1126		e. a diagnosis and treatment planning section as approved
1149	1127		by the Board, as specified in Section 328.15 of this
1150	1128		title, and
1151	1129		f. the Board may determine equivalencies based on
1152	1130		components of other exams for the purpose of
1153	1131		credentialing; or
1154	1132		2. For dental hygienists licensing the following components on
1155	1133		a live patient or manikin:

1184	1161		specific clinical skills, and
1185	1162		b. evaluation of the candidate’s compliance with

1189	1166		(1) extra/intra oral assessment,
1190	1167		(2) periodontal probing, and
1191	1168		(3) scaling/subgingival calculus removal and

1193	1170		E. When the applicant and the accompanying proof are found
1194	1171		satisfactory, the Board shall notify the applicant to appear for the
1195	1172		jurisprudence examination at the time and place to be fixed by the
1196	1173		Board. A dental student or a dental hygiene student in the
1197	1174		student’s last semester of a dental or dental hygiene program,
1198	1175		having met all other requirements, may make application and take the
1199	1176		jurisprudence examination with a letter from the dean of the dental
1200	1177		school or director of the hygiene program stating that the applicant
1201	1178		is a candidate for graduation within the next six (6) months.
1202	1179		F. The Board shall require every applicant for a license to
1203	1180		practice dentistry or dental hygiene to submit, for the files of the
1204	1181		Board, a copy of a dental degree or dental hygiene degree, an
1205	1182		official transcript, a recent photograph duly identified and
1206	1183		attested, and any other information as required by the Board.

1238	1214		H. A dentist or dental hygienist currently licensed in another
1239	1215		state having met the qualificatio ns in paragraphs 1 through 3 of
1240	1216		subsections B and C of this section may apply for a license by
1241	1217		credentials upon meeting the following:
1242	1218		1. A dentist holding a general dentist license in good standing
1243	1219		and having practiced for at least five hundred (500) hou rs within
1244	1220		the previous five (5) years immediately prior to application and
1245	1221		having passed a regional examination substantially equivalent to the
1246	1222		requirements for this state may apply for licensure by credentials;
1247	1223		2. A dental hygienist holding a dental hygi ene license in good
1248	1224		standing and having practiced for at least four hundred twenty (420)
1249	1225		hours within the previous five (5) years immediately prior to
1250	1226		application and having passed a regional examination substantially
1251	1227		equivalent to the requirements for thi s state may apply for
1252	1228		licensure by credentials. Applicants for credentialing must
1253	1229		include:
1254	1230		a. a letter of good standing from all states in which the
1255	1231		applicant has ever been licensed, and
1256	1232		b. any other requirements as set forth by the rules; and

1293	1268		I. 1. There shall be seven types of advanced procedures
1294	1269		available for dental hygienists upon completion of a Commission on
1295	1270		Dental Accreditation (CODA) approved program, course, or
1296	1271		certification program that has been approved by the Board :
1297	1272		a. administration of nitrous oxide,
1298	1273		b. administration of local anesthesia,
1299	1274		c. neuromodulator administration,
1300	1275		d. therapeutic use of lasers,
1301	1276		e. phlebotomy,
1302	1277		f. venipuncture, and
1303	1278		g. elder care and public health pursuant to Section
1304	1279		328.58 of this title.
1305	1280		2. A dental hygienist holding an advanced procedure permit or
1306	1281		credential in any other state for two (2) years shall be eligible
1307	1282		for the advanced procedure permit by credentials; provided, that

1339	1313		local anesthesia, a dental hygienist may apply by filling out an
1340	1314		application with required documentation of training as required by
1341	1315		state law and rules of the Board. A dental hygienist licensed by
1342	1316		the Board prior to January 30, 2024, shall be eligible for the
1343	1317		advanced procedure of therapeutic use of lasers upon submiss ion of
1344	1318		an affidavit attesting to two (2) years of practice using lasers.
1345	1319		4. All advanced procedures shall be added to the dental hygiene
1346	1320		license upon approval.
1347	1321		J. All licensees and permit holders shall display the current

1350	1324		K. The Board shall have the authority to temporarily change
1351	1325		requirements of an examination due to availability or changes in the
1352	1326		examination format, not to exceed one (1) year.
1353	1327		L. During a year in whic h governmental officials have declared
1354	1328		a health pandemic, a state or federal disaster, or other natural or
1355	1329		man-made disaster, the Board shall have the authority through a
1356	1330		resolution to change or make allowances in requirements of all
1357	1331		candidates for licensu re and issue temporary licenses for extended
1358	1332		periods of time or as needed until the event passes. The resolution

1389	1362		M. Every licensee or permit holder shall have an official
1390	1363		address and email address listed with the Board. Every licensee or
1391	1364		permit holder shall update the address within thirty (30) calendar
1392	1365		days of moving. Official notificat ion of any action of the Board
1393	1366		adverse to a licensee or permit holder including but not limited to
1394	1367		notification of license or permit cancellation due to nonrenewal,
1395	1368		notice of a formal complaint, or a decision of the hearing panel or
1396	1369		board, shall be served to the licensee or permit holder by
1397	1370		registered mail at the official address, in person, to the
1398	1371		licensee’s or permit holder’s attorney, by agreement of the
1399	1372		individual, by a process server, or by an investigator of the Board
1400	1373		pursuant to Section 2004 of Title 12 of the Oklahoma Statutes.
1401	1374		SECTION 6. AMENDATORY 59 O.S. 2021, Section 328.24, as
1402	1375		last amended by Section 5, Chapter 46, O.S.L. 2024 (59 O.S. Supp.
1403	1376		2024, Section 328.24), is amended to read as follows:
1404	1377		Section 328.24. A. No p erson shall practice as a dental
1405	1378		assistant or oral maxillofacial surgery assistant for more than one
1406	1379		(1) day in a calendar year without having applied for a permit as a
1407	1380		dental assistant or oral maxillofacial surgery assistant from the

1438	1410		applying for and obtaining a permit from the Board of Dentistry .
1439	1411		B. The application shall be made to the Board in writing and
1440	1412		shall be accompanied by the fee established by the Board, together
1441	1413		with satisfactory proof that the applicant passes a background check
1442	1414		with criteria established by the Board.
1443	1415		C. Beginning January 1, 202 0, every Every dental assistant
1444	1416		receiving a permit shall complete a class on infection control as
1445	1417		approved by the Board within one (1) year from the date of receipt
1446	1418		of the permit. Any person holding a valid dental assistant permit
1447	1419		prior to January 1, 2020 , shall complete an infection-control class
1448	1420		as approved by the Board before December 31, 2020 . Failure to
1449	1421		complete the class shall be grounds for discipline pursuant to
1450	1422		Section 328.29a of this title.
1451	1423		D. There shall be eight types of expanded duty permits
1452	1424		available for dental assistants or oral maxillofacial surgery
1453	1425		assistants upon completion of a program approved by the Commission
1454	1426		on Dental Accreditation (CODA) or a course that has been approved by
1455	1427		the Board:
1456	1428		1. Radiation safety;
1457	1429		2. Coronal polishing an d topical fluoride;
1458	1430		3. Sealants;
1459	1431		4. Assisting in the administration of nitrous oxide;

1493	1464		of this title and assists a dentist, pediatric dentist, or oral
1494	1465		maxillofacial surgeon who holds a parenteral or pediatric general
1495	1466		anesthesia permit; provided, on ly the dentist, pediatric dentist, or
1496	1467		oral maxillofacial surgeon, or an anesthesiologist or a Certified
1497	1468		Registered Nurse Anesthetist, may administer anesthesia and assess
1498	1469		the patient’s level of sedation and only the dentist, pediatric
1499	1470		dentist, or oral maxi llofacial surgeon may perform surgery .
1500	1471		All expanded duties shall be added to the dental assistant
1501	1472		license or oral maxillofacial surgery assistant license permit upon
1502	1473		approval by the Board.
1503	1474		E. The training requirements for all expanded duty permits
1504	1475		shall be set forth by the Board. A program that is not CODA -
1505	1476		certified must meet the standards set forth and be approved by the
1506	1477		Board.
1507	1478		F. An applicant for a dental assistant permit who has graduated
1508	1479		from a dental assisting program accredited by CODA and has pass ed
1509	1480		the jurisprudence examination shall receive all expanded duty
1510	1481		permits provided for in subsection D of this section if the course
1511	1482		materials approved by the Board are covered in the program.

1540	1510		assistant permit with expanded duties may apply for credentialing
1541	1511		and reciprocity for a dental assistant permit including any expanded
1542	1512		duty by demonstrating the following:
1543	1513		1. The dental assistant has had a valid dental assistant permit
1544	1514		in another state for a mini mum of two (2) years and is in good
1545	1515		standing;
1546	1516		2. The dental assistant has had a valid expanded duty in
1547	1517		another state for a minimum of one (1) year; and
1548	1518		3. The dental assistant provides a certificate or proof of
1549	1519		completion of an educational class for the expanded duty and that
1550	1520		the dental assistant has been providing this treatment to dental
1551	1521		patients while working as a dental assistant in a dental office for
1552	1522		one (1) year.
1553	1523		H. Any person having served in the military as a dental
1554	1524		assistant shall receive crede ntialing and reciprocity for expanded
1555	1525		functions by demonstrating the following:
1556	1526		1. Proof of military service in excess of two (2) years with
1557	1527		any certifications or training in the expanded function areas; and
1558	1528		2. Verification from the commanding officer of the medical
1559	1529		program or the appropriate supervisor stating that the dental
1560	1530		assistant provided the expanded functions on patients in the
1561	1531		military dental facility for a minimum of one (1) year within the
1562	1532		past five (5) years.

1601	1570		forth by the Board.
1602	1571		C. The application shall be made to the Board in writing and
1603	1572		shall be accompanied by the fee established by the Board, together
1604	1573		with the satisfactory proof that the applicant:
1605	1574		1. Passes a background check with criteria established by the
1606	1575		Board; and
1607	1576		2. Has completed all of the training requirements for the oral
1608	1577		maxillofacial surgery assistant permit expanded duty permit as
1609	1578		established by the Board.
1610	1579		D. C. An oral maxillofacial surgery assistant expanded duty
1611	1580		permit shall be considered a temporary training permit until all of

1648	1616		by a licensed oral maxillofacial surgeon .
1649	1617		G. If an oral maxillofacial surgery assistant is not curr ently
1650	1618		employed by an oral maxillofacial surgeon, the oral maxillofacial
1651	1619		surgery assistant permit shall automatically revert to a dental
1652	1620		assistant permit as set forth in Section 328.24 of this title and
1653	1621		may be eligible for an expanded function assisting a , dentist, or
1654	1622		pediatric dentist who holds a parenteral or pediatric general
1655	1623		anesthesia permit; provided, only the oral maxillofacial surgeon,
1656	1624		dentist, or pediatric dentist, or an anesthesiologist or a Certified
1657	1625		Registered Nurse Anesthetist, may administer anesthesia and assess
1658	1626		the patient’s level of sedation . The oral maxillofacial surgery
1659	1627		assistant permit may be reinstated upon employment under a licensed
1660	1628		oral maxillofacial surgeon.
1661	1629		H. Any oral maxillofacial surgeon shall notify the Board within

1692	1659		I. F. An applicant for an oral maxillofacial surgery assistant
1693	1660		expanded duty permit shall provide satisfactory proof of:
1694	1661		1. Successful completion of the Dental Anesthesia Assistant
1695	1662		National Certification Examination (DAANCE) provided by the American
1696	1663		Association of Oral Maxillofacial Surgeons (AAOMS) or another
1697	1664		program or examination as approved by the Board;
1698	1665		2. A valid BLS certification;
1699	1666		3. Employment and completion of a minimum of six (6) months of
1700	1667		training under the direct supervision of a licensed oral
1701	1668		maxillofacial surgeon prior to starting DAANCE or another program or
1702	1669		examination as approved by the Board;
1703	1670		4. Completion of a standardized course approved by the Board
1704	1671		including a minimum of four (4) hours of didactic training that must
1705	1672		include anatomy, intravenous access or phlebotomy, technique, risks
1706	1673		and complications, and hands-on experience starting and maintaining
1707	1674		intravenous lines on a human or simulator/manikin, and pharmacology;
1708	1675		and
1709	1676		5. Completion of an infection -control course as approved by the
1710	1677		Board.
1711	1678		J. An oral maxillofacial surgery assistant who has completed
1712	1679		all the requirements shall receive a permit to practice as an oral

1745	1711		in classes approved by AAOMS that are certified by the American
1746	1712		Dental Association CERP program or another program approved by the
1747	1713		Board. The continuing education requirement shall include at least
1748	1714		one (1) hour on infection control.
1749	1715		L. H. The Anesthesia Committee provided pursuant to Section
1750	1716		328.17 of this title may make a recommendation to the Board for an a
1751	1717		dental assistant with an oral maxillofacial surgery assistant
1752	1718		expanded duty permit holding a temporary training permit to
1753	1719		substitute training received from another state university, dental
1754	1720		school or technical training institute or training acquired in a
1755	1721		surgery center or hospital while wo rking under the authority of a
1756	1722		licensed physician, to qualify as a partial substitute for the
1757	1723		requirements to attain an oral maxillofacial surgery assistant
1758	1724		permit expanded duty permit .
1759	1725		M. An I. A dental assistant with an oral maxillofacial surgery
1760	1726		assistant expanded duty permit may only accept delegation from an
1761	1727		oral and maxillofacial surgeon , dentist, or pediatric dentist with a
1762	1728		valid general or parenteral anesthesia permit :

1802	1767		determining medicines to be used and the dosage,
1803	1768		timing, route of delivery and administration of
1804	1769		medication and the assessment of the level of
1805	1770		anesthesia and monitoring the physiological results of
1806	1771		such care; provided, only an oral surgeon or dentist
1807	1772		possessing a current general anesthesia permit may
1808	1773		administer or assess the level of sedation or general
1809	1774		anesthesia and monitor the results of such care,
1810	1775		b. follow instructions of the oral surgeon to adjust the
1811	1776		rate of intravenous fluids to maintain or keep the
1812	1777		line patent or open and adjust an electr onic device to
1813	1778		provide medications such as an infusion pump, and

1849	1813		supervising oral and maxillofacial surgeon.
1850	1814		O. K. Nothing in the State Dental Act shall be construed as to
1851	1815		allow an oral surgery assistant or a dental assistant with an oral
1852	1816		maxillofacial expanded duty permit to administer anesthesia care to
1853	1817		a patient.
1854	1818		SECTION 8. AMENDATORY 59 O.S. 2021, Section 328.26, is
1855	1819		amended to read as follows:
1856	1820		Section 328.26. A. The Board of Dentistry may, without
1857	1821		examination, issue a dental student intern, resident or fellowship
1858	1822		permit to a student or graduate of an approved dental school or
1859	1823		college, or a residency program approved by the Commission on Dental
1860	1824		Accreditation (CODA). Upon meeting the qualifications and upon
1861	1825		approval of the dean or the governing body of any public or private
1862	1826		institution any person may request a dental student or dental
1863	1827		hygiene student intern, resident or fellow permit to be issued from

1900	1863		C. A dental student or dental hygiene student intern, resident
1901	1864		or fellowship permit shall not authorize the holder to open an
1902	1865		office for the private practice of dentist ry, or to receive
1903	1866		compensation for the practice of dentistry, except a salary paid by
1904	1867		the federal government or this state, or their subdivisions, or the
1905	1868		public or private institution where the holder of the dental student
1906	1869		intern, resident or fellowship pe rmit will be employed.
1907	1870		D. A dental student or dental hygiene student intern with a
1908	1871		valid dental student intern permit may work under the direct
1909	1872		supervision of a licensed dentist for compensation upon meeting the
1910	1873		following criteria:
1911	1874		1. The dental student or dental hygiene student intern shall
1912	1875		notify the Board of the supervising dentist;
1913	1876		2. A dental student or dental hygiene student intern, having
1914	1877		finished the first year of dental school, may assist in all duties

1949	1911		of the third year of dental school, may provide scaling, root
1950	1912		planing, and local anesthesia .
1951	1913		E. A dental or dental hygiene student intern, resident or
1952	1914		fellowship permit shall automatically expire when the perm it holder
1953	1915		is no longer participating in the program offered by the college of
1954	1916		dentistry, the accredited dental college or the institution.
1955	1917		F. The issuance of a dental student intern, resident or
1956	1918		fellowship permit by the Board shall in no way be considered a
1957	1919		guarantee or predetermination of any person to receive a full
1958	1920		license issued by the Board.
1959	1921		G. Dental student intern or resident or fellowship permits may
1960	1922		be renewed annually at the request of the dean of the college or

2054	2014		dental hygiene program located in this state that the applicant is a
2055	2015		full-time member of the teaching staff of that college or program.
2056	2016		3. Within the first two (2) years of employment, the faculty
2057	2017		license or faculty specialty license holder shall show proof of
2058	2018		passing an appropriate clinical board examination, as provided in
2059	2019		Section 328.21 of this title, recognized by the Board of Dentistry.
2060	2020		4. A faculty license or faculty specialty license shall b e
2061	2021		valid for one (1) year and may be renewed by the Board at the
2062	2022		written request of the dean of an accredited dental program or the
2063	2023		director of an accredited dental hygiene program.
2064	2024		5. A faculty license or faculty specialty license shall
2065	2025		automatically expire when the license holder is no longer employed
2066	2026		as a faculty member at the institution that requested the license.

2095	2054		shall be entitled to perform services and procedures in the same
2096	2055		manner as a person holding a license to practice dentistry or dental
2097	2056		hygiene in this state, but all services and procedures performed by
2098	2057		the faculty license or faculty specialty license holder shall be
2099	2058		without compensation other than that received in salary from a
2100	2059		faculty position or through faculty practice as authorized by the
2101	2060		Board. The holder of a faculty license or faculty specialty license
2102	2061		shall be limited to practicing in the specialty area as designated
2103	2062		on the license. Such services and procedures shall be performed
2104	2063		only within the facilities of an accredited dental college or
2105	2064		accredited dental hygiene program or within the facilities
2106	2065		designated by the accredited dental college and teaching hospitals
2107	2066		approved by the Board.
2108	2067		B. The dean of an accredited denta l or hygiene program may
2109	2068		petition the Board to allow a faculty member to have a limited
2110	2069		faculty or research faculty permit, based on a showing of criteria
2111	2070		that the individual possesses specialty knowledge in a specific area
2112	2071		that would benefit the college o r program. The holder of a limited
2113	2072		faculty or research faculty permit shall not have privileges to
2114	2073		perform procedures in the faculty practice at the University of
2115	2074		Oklahoma College of Dentistry, but may oversee the student clinic.
2116	2075		A limited faculty permit shall be valid for one (1) year and may be
2117	2076		renewed by the Board at the written request of the dean of an

2147	2105		C. Upon request of the dean, the Board President may issue a
2148	2106		dentist or hygienist licensed in another state or country a
2149	2107		temporary license pursuant to Section 328.23 of this title for the
2150	2108		purpose of attending, presenting or participating in a seminar or
2151	2109		live training in dental techniques or dental anesthesia, given at
2152	2110		the University of Oklahoma College of Dentistry to licensed dentists
2153	2111		and hygienists for continuing education credits and students
2154	2112		enrolled in the University of Oklahoma College of Dentistry. A
2155	2113		temporary permit issued for this purpose shall not exceed seven (7)
2156	2114		days and may not be issued to the same person more than four (4)
2157	2115		times in a calendar year.
2158	2116		D. Upon the request of the Oklahoma Dental Association
2159	2117		President or the Oklahoma Dental Hygienist Association President,
2160	2118		the Board President may issue a dentist or a hygienist licensed in
2161	2119		another state a temporary license pursuant to Section 328.23 of this
2162	2120		title for the purpose of presenting or participating in live patient
2163	2121		demonstrations presented by the Oklahoma Dental Association or
2164	2122		Oklahoma Dental Hygienist A ssociation or other professional
2165	2123		organizations approved by the Board at its annual meeting. A
2166	2124		temporary permit issued for this purpose shall not exceed four (4)
2167	2125		days per calendar year.

2197	2154		interactive online, in -classroom, lab or blended format. All
2198	2155		expanded-duty courses shall include a dentist or dental hygienist

2200	2157		approved by the Commission on Dental Accreditation and currently on
2201	2158		file with the Board. Courses offered pursuant to this subsection
2202	2159		shall meet all criteria in administrative rules approved by the

2204	2161		SECTION 10. AMENDATORY 59 O.S. 2021, Section 328.28a, is
2205	2162		amended to read as follows:
2206	2163		Section 328.28a. Beginning January 2016, every Every applicant
2207	2164		for any type of license or permit issued by the Board of Dentistry
2208	2165		shall be subject to a national criminal background check. The Board
2209	2166		may deny a license or permit for any applicant who fails to disclose
2210	2167		a criminal history or if any applicant has pled guilty or nolo
2211	2168		contendere to or has been convicted of a felony or misdemeanor
2212	2169		involving moral turpitude a disqualifying violation of the law
2213	2170		pursuant to Section 328.32 of this title , Medicaid fraud, or a
2214	2171		violation of federal or state controlled dangerous substances laws.

2246	2202		dental assistant or oral maxillofacial surgery assistant shall
2247	2203		constitute grounds for which the penalties specified in S ection
2248	2204		328.44a of this title may be imposed by the Board of Dentistry or be
2249	2205		the basis for denying a new applicant any license or permit issued
2250	2206		by the Board:
2251	2207		1. Any of the causes now existing in the laws of this state;
2252	2208		2. A violation of the provisions of the State Dental Act; or
2253	2209		3. A violation of the rules of the Board promulgated pursuant
2254	2210		to the State Dental Act.
2255	2211		B. The Board shall also have the power to act upon a petition
2256	2212		by a dental assistant or oral maxillofacial surgery assistant for
2257	2213		reinstatement to good standing. The Board shall keep a record of
2258	2214		the evidence and proceedings in all matters involving the revocation
2259	2215		or suspension of a permit, censure or probation of a dental
2260	2216		assistant or oral maxillofacial surgery assistant . The Board shall
2261	2217		make findings of fact and a decision thereon. Notification of the
2262	2218		licensee or permit holder shall occur pursuant to Section 328.21 of
2263	2219		this title.
2264	2220		C. The decision shall be final unless the dental assistant or
2265	2221		oral maxillofacial surgery assistant appeals the decision as
2266	2222		provided by the State Dental Act.
2267	2223		D. The Board shall have power to revoke or suspend the permit,
2268	2224		censure, or place on probation a dental assistant or oral

2298	2253		1. Pleading guilty or nolo contendere to, or being convicted
2299	2254		of, a felony crime that substantially relates to the occupation of a
2300	2255		dental assistant or oral maxillofacial surgery assistant and poses a
2301	2256		reasonable threat to public safety, or a violation of federal or
2302	2257		state controlled dangerous substances laws;
2303	2258		2. Presenting to the Board a false application or documentation
2304	2259		for a permit;
2305	2260		3. Being, by reason of persistent inebriety or addiction to
2306	2261		drugs, incompetent to continue to function as a dental assistant or
2307	2262		oral maxillofacial surgery assistant ;
2308	2263		4. Functioning outside the direct or direct visual supervision
2309	2264		of a dentist;
2310	2265		5. Performing any function prohibited by Chapter 15 of the
2311	2266		Oklahoma Administrative Code or any violation that would be a
2312	2267		violation for a dentist or hygienist under Section 328.32 or 328.33
2313	2268		of this title, or any other duty not assignable to a dental
2314	2269		assistant; or
2315	2270		6. Failure to secure an annual registration as specified in
2316	2271		Section 328.41 of this title.
2317	2272		E. The Board’s review panel, as set forth in S ection 328.43a of
2318	2273		this title, upon concurrence with the president of the Board, may
2319	2274		determine that an emergency exists to temporarily suspend the permit

2351	2305		temporary suspension.
2352	2306		F. As used in this section:
2353	2307		1. “Substantially relates” means the nature of criminal conduct
2354	2308		for which the person was convicted has a direct bearing on the
2355	2309		fitness or ability to perform one or more of the duties or
2356	2310		responsibilities necessarily related to the occupation; and
2357	2311		2. “Poses a reasonable threat” means the nature of crim inal
2358	2312		conduct for which the person was convicted involved an act or threat
2359	2313		of harm against another and has a bearing on the fitness or ability
2360	2314		to serve the public or work with others in the occupation.
2361	2315		SECTION 12. AMENDATORY 59 O.S. 2021, Section 328.31a, is

2363	2317		Section 328.31a. A. One dentist or multiple dentists may use a
2364	2318		trade name in connection with the practice of dentistry provided

2404	2357		a copy of the advertisement, including but not limited to any
2405	2358		electronic form of the advertising, shall be kept by the dentist or
2406	2359		dentists for three (3) years from the first publication date of the
2407	2360		advertisement.
2408	2361		B. Beginning July 1, 2016, all All advertisements for dentistry
2409	2362		shall include the name of the dentist or dentists that shall be
2410	2363		providing treatment and shall list the type of dental or specialty
2411	2364		license on the advertisement.
2412	2365		C. The Board of Dentistry shall pro mulgate rules regulating
2413	2366		advertisements in which one dentist or multiple dentists use a trade
2414	2367		name.

2452	2404		B. Each licensed dentist shall maintain writt en records on each
2453	2405		patient that shall contain, at a minimum, the following information
2454	2406		about the patient:
2455	2407		1. A current health history listing known illnesses, other
2456	2408		treating physicians and current medications prescribed;
2457	2409		2. Results of a clinical examinat ion, including a physical
2458	2410		intraoral examination and head and neck examination, tests
2459	2411		conducted, and any lab results including the identification, or lack
2460	2412		thereof, of any oral pathology or diseases;
2461	2413		3. Treatment plan proposed by the dentist; and
2462	2414		4. Treatment rendered to the patient. The patient record shall
2463	2415		clearly identify the dentist and the dental hygienist or dental
2464	2416		assistant providing the treatment with the dentist, specialty or
2465	2417		dental hygienist license number. The patient record shall include
2466	2418		documentation of any medications prescribed, administered or
2467	2419		dispensed to the patient.
2468	2420		C. Prior to a dentist prescribing, diagnosing, or overseeing
2469	2421		patient treatment for any dental appliance, the patient shall be a
2470	2422		patient of record and the dentist shall condu ct an in-person patient
2471	2423		examination.

2508	2459		the original records or copies thereof and a notation shall be made
2509	2460		in the retained records indicating to whom the records were released
2510	2461		or transferred.
2511	2462		D. F. All claims being submitted for insuranc e must be signed,
2512	2463		stamped or have an electronic signature by the treating dentist.
2513	2464		E. G. Patient records may be kept in an electronic data format,
2514	2465		provided that the dentist maintains a backup copy of information
2515	2466		stored in the data processing system using disk, tape or other
2516	2467		electronic back-up system and that backup is updated on a regular
2517	2468		basis, at least weekly, to assure that data is not lost due to
2518	2469		system failure. Any electronic data system shall be capable of
2519	2470		producing a hard copy on demand.
2520	2471		F. H. All patient records shall be maintained for seven (7)
2521	2472		years from the date of treatment.

2666	2614		15. Being shown to be grossly immoral and that such condition
2667	2615		represents a threat to patient care or treatment;

2714	2661		23. Having more than the equivalent of three full-time dental
2715	2662		hygienists for each dentist actively practicing in the same dental
2716	2663		office;
2717	2664		24. Allowing a person not holding a permit or license issued by
2718	2665		the Board to assist in the treatment of a patient without having a
2719	2666		license or permit issued b y the Board;
2720	2667		25. Knowingly patronizing or using the services of a dental
2721	2668		laboratory or dental laboratory technician who has not complied with
2722	2669		the provisions of the State Dental Act and the rules of the Board;

2762	2708		having established a valid dentist -patient relationship;
2763	2709		30. Using or administering nitrous oxide gas in a dental office
2764	2710		in an inappropriate or unauthorized manner;
2765	2711		31. Engaging in nonconsensual physical contact with a patient
2766	2712		which is sexual in nature, or engaging in a verbal communication
2767	2713		which is intended to be sexually demeaning to a patient;
2768	2714		32. Practicing dentistry without displaying, at the dentist’s
2769	2715		primary place of practice, the license issued to the dentist by the
2770	2716		Board to practice dentistry and the current renewal certificate;
2771	2717		33. Being dishonest in a material way with a patient or during
2772	2718		the practice of dentistry;

2801	2746		(7) years from the date of the last treatment as provided by Section
2802	2747		328.31b of this title, except that the failure to retain records
2803	2748		shall not be a violation of the State Dental Act if the dentist
2804	2749		shows that the records were lost, destroyed, or removed by another,
2805	2750		without the consent of the dentist;
2806	2751		35. Failing to retain the dentist’s copy of any laboratory
2807	2752		prescription for at least seven (7) years, except that the failure
2808	2753		to retain records shall not be a violation of the State Dental Act
2809	2754		if the dentist shows that the records were lost, destroyed, or
2810	2755		removed by another, without the consent of the dentist;
2811	2756		36. Allowing any corporation, organization, group, person, or
2812	2757		other legal entity, except another dentist or a professional entity
2813	2758		that is in compliance with the registration requirements of
2814	2759		subsection B of Section 328.31 of this title, to direct, control, or
2815	2760		interfere with the dentist’s clinical judgment. Clinical judgment
2816	2761		shall include, but not be limited to, such matters as selection of a
2817	2762		course of treatment, control of patient records, policies and
2818	2763		decisions relating to pricing, credit, refunds, warranties and
2819	2764		advertising, and decisions relating to office personnel and hours of
2820	2765		practice. Nothing in this paragraph shall be construed to:
2821	2766		a. limit a patient’s right of informed consent, or
2822	2767		b. prohibit insurers, preferred provider organizations
2823	2768		and managed care plans from operating pursuant to the

2853	2797		37. Violating the state dental act of another state resulting
2854	2798		in a plea of guilty or nolo contendere, conviction or suspension or
2855	2799		revocation or other sanction by another state board, of the license
2856	2800		of the dentist under the laws of that state;
2857	2801		38. Violating or attempting to violate the provisions of the
2858	2802		State Dental Act or the rules of the Board, a state or federal
2859	2803		statute or rule relating to scheduled drugs, fraud, a violent crime
2860	2804		or any crime for which the penalty includes the requirement of
2861	2805		registration as a sex offender in this state as a principal,
2862	2806		accessory or accomplice;
2863	2807		39. Failing to comply with the terms and conditions o f an order
2864	2808		imposing suspension of a license or placement on probation issued
2865	2809		pursuant to Section 328.44a of this title;
2866	2810		40. Failing to cooperate during an investigation or providing
2867	2811		false information, verbally or in writing, to the Board, the Board’s
2868	2812		investigator or an agent of the Board;
2869	2813		41. Having multiple administrative or civil actions reported to
2870	2814		the National Practitioner Data Bank;
2871	2815		42. Failing to complete an approved two -hour course on opioid
2872	2816		and scheduled drug prescribing within one (1) year of ob taining a
2873	2817		license or a violation of a law related to controlled dangerous
2874	2818

2902	2845		Title 63 of the Oklahoma Statutes;
2903	2846		43. Falling below the basic standard of care of a licensed
2904	2847		dentist or dentist practicing in his or her specialty, a dental
2905	2848		hygienist, dental assistant, or other licensee or permit holder
2906	2849		pursuant to the State Dental Act and Section 20.1 of Title 76 of the
2907	2850		Oklahoma Statutes; or
2908	2851		44. Failing to provide patient records as provided by S ections
2909	2852		19 and 20 of Title 76 of the Oklahoma Statutes.
2910	2853		B. Any person making a report in good faith to the Board or to
2911	2854		a peer assistance group regarding a professional suspected of
2912	2855		practicing dentistry while being impaired pursuant to paragraph 3 of
2913	2856		subsection A of this section shall be immune from any civil or
2914	2857		criminal liability arising from such reports.
2915	2858		C. The provisions of the State Dental Act shall not be
2916	2859		construed to prohibit any dentist from displaying or otherwise
2917	2860		advertising that the dentist is a lso currently licensed, registered,
2918	2861		certified or otherwise credentialed pursuant to the laws of this
2919	2862		state or a nationally recognized credentialing board, if authorized
2920	2863		by the laws of the state or credentialing board to display or
2921	2864		otherwise advertise as a licensed, registered, certified, or
2922	2865		credentialed dentist.

2951	2893		last amended by Section 8, Chapter 46, O.S.L. 2024 (59 O.S. Supp.

2953	2895		Section 328.41. A. 1. On or before the last day of December
2954	2896		of each year, every dentist, dental hygienist, dental assistant,
2955	2897		oral maxillofacial surgery assistant and other licensee or permit
2956	2898		holders previously licensed or permitted by the Board of De ntistry
2957	2899		to practice in this state, with the exception of those listed in
2958	2900		paragraph 2 of this subsection, shall submit a completed renewal
2959	2901		application with information as may be required by the Board,
2960	2902		together with an annual renewal fee established by the r ules of the
2961	2903		Board. Upon receipt of the annual renewal fee, the Board shall
2962	2904		issue a renewal certificate authorizing the dentist, dental
2963	2905		hygienist, or dental assistant or oral maxillofacial surgery
2964	2906		assistant to continue the practice of dentistry or dental h ygiene,
2965	2907		respectively, in this state for a period of one (1) year. Every
2966	2908		license or permit issued by the Board shall begin on January 1 and
2967	2909		expire on December 31 of each year.
2968	2910		2. Resident and fellowship permits shall be valid from July 1
2969	2911		through June 30 of each year and dental student intern permits shall
2970	2912		be valid from August 1 through July 31 of each year.
2971	2913		B. Continuing education requirements shall be due at the end of
2972	2914		each two-year period.

3001	2942		dental hygienist shall consist of:
3002	2943		a. a live, in-person cardiopulmonary resuscitation class
3003	2944		approved by the Board,
3004	2945		b. an ethics class approved by the Board,
3005	2946		c. for a dentist, two (2) hours of opioid and scheduled
3006	2947		drug prescribing classes, and
3007	2948		d. any combination of the following:
3008	2949		(1) completion of classes at a university, college or
3009	2950		technology center school accredited by the
3010	2951		Commission on Dental Accreditation (CODA) or
3011	2952		college courses related to dentistry, which shall
3012	2953		count equal to credit hours received on a
3013	2954		transcript,
3014	2955		(2) teaching one or more classes at a school or
3015	2956		program accredited by CODA, for which the dentist
3016	2957		or dental hygienist shall receive credit for the
3017	2958		semester credit hours and one (1) hour of credit
3018	2959		per eighteen (18) hours of clinical instruction,
3019	2960		(3) publishing papers, presenting clinics and
3020	2961		lecturing, for which the dentist or dental
3021	2962		hygienist shall receive six (6) credit hours for
3022	2963		each hour of the original presentation and hour -
3023	2964		for-hour credit for a subsequent presentation of

3059	2999		Armed Forces provided at a government facility,
3060	3000		(6) formal meetings by national or state professional
3061	3001		organizations for dental providers, or
3062	3002		university-sponsored professional alumni clinical
3063	3003		meetings approved by the Board,
3064	3004		(7) organized study clubs,
3065	3005		(8) uncompensated volunteer work at an event approved
3066	3006		by the Board not to exceed seven (7) hours for a
3067	3007		dentist or four (4) hours for a dental hygienist,
3068	3008		or
3069	3009		(9) practice-management-related courses not to exceed
3070	3010		four (4) hours for a dentist or two (2) hours for
3071	3011		a dental hygienist.
3072	3012		2. Full-time graduate study, internships, residencies and
3073	3013		dentists and dental hygienists engaged in a full -time program

3103	3042		3. New graduates of dental and hygiene programs shall not be
3104	3043		required to complete continuing education for the first year after
3105	3044		graduation. Continuing education requirements for dentists an d
3106	3045		dental hygienists who are new graduates shall begin July 1 of the
3107	3046		calendar year following the year of graduation. Hours shall be
3108	3047		prorated by year of new licensure.
3109	3048		4. A dentist or dental hygienist on active duty military
3110	3049		service shall be exempt from co ntinuing education if he or she is:
3111	3050		a. currently on full-time active duty service as a
3112	3051		dentist or dental hygienist for a minimum of eighteen
3113	3052		(18) months in a two -year continuing education cycle
3114	3053		and is deployed outside of the United States , or
3115	3054		b. a licensed dentist or dental hygienist serving in the
3116	3055		reserve components of the armed forces as specified in
3117	3056		10 U.S.C., Section 10101, who is actively deployed
3118	3057		outside of the United States for a minimum of eighteen
3119	3058		(18) months in a two -year continuing education cycl e.
3120	3059		D. 1. Dentists shall complete forty (40) hours of continuing
3121	3060		education with no more than twenty (20) hours to be completed
3122	3061		online. Dental hygienists shall complete twenty (20) hours of
3123	3062		continuing education with no more than ten (10) hours to be

3153	3091		2. Oral maxillofacial surgery assistants Dental assistants with
3154	3092		an oral maxillofacial expanded duty permit shall complete eight (8)
3155	3093		hours of continuing education including one (1) hour of infection
3156	3094		control.
3157	3095		3. Dental All other dental assistants shall complete two (2)
3158	3096		hours of infection control.
3159	3097		4. Any newly licensed dentist shall complete a two -hour opioid
3160	3098		and scheduled drug prescribing class wit hin one (1) year of
3161	3099		obtaining licensure.
3162	3100		E. Upon failure of a dentist, dental hygienist, or dental
3163	3101		assistant or oral maxillofacial surgery assistant to pay the annual
3164	3102		renewal fee within two (2) months after January 1 of each year, the
3165	3103		Board shall notify t he dentist, dental hygienist, dental assistant ,
3166	3104		oral maxillofacial surgery assistant , or other permit holder that
3167	3105		the license or permit will be officially canceled as of April 1
3168	3106		pursuant to subsection M of Section 328.21 of this title. A list of
3169	3107		canceled licenses or permits not otherwise renewed shall be
3170	3108		published at the following meeting of the Board.
3171	3109		F. Any dentist, dental hygienist, or dental assistant or oral
3172	3110		maxillofacial surgery assistant whose license or permit is
3173	3111		automatically canceled by reason o f failure, neglect or refusal to
3174	3112		secure the renewal certificate may be reinstated by the Board at any

3208	3145		license has expired, then the dentist, dental hygienist, dental
3209	3146		assistant or oral maxillofacial surgery assistant shall be required
3210	3147		to file an application for and take the examination or other
3211	3148		requirements provided for in the State Dental Act or the rules
3212	3149		promulgated by the Board before again commencing practice The Board
3213	3150		may require any training or continuing education requirements be met
3214	3151		prior to reinstatement .
3215	3152		G. The Board, by rule, shall provide for the remittance of fees
3216	3153		otherwise required by the State Dental Act while a A dentist, dental
3217	3154		assistant, or dental hygienist who is on active duty with any of the
3218	3155		Armed Forces of the United States and is deployed outside of the
3219	3156		United States shall be exempt from renewal fees .
3220	3157		H. In case of a lost or destroyed license or renewal
3221	3158		certificate and upon satisfactory proof of the loss or destruction
3222	3159		thereof, the Board may issue a duplicate, charging therefor a fee
3223	3160		established by the rules of the Board.
3224	3161		I. A dentist, dental hygienist, oral maxillofacial surgery
3225	3162		assistant or dental assistant that is in good standing and not under

3254	3190		nonrenewal of license or requests retirement status shall have a
3255	3191		right to renew or reinstate his or her license within five (5) years
3256	3192		from the date of notice. The Board may require any training or
3257	3193		continuing education requirements to be met prior to reinstatement.
3258	3194		J. A dentist, dental hygienist, oral maxillofacial dental
3259	3195		assistant or dental assistant that has not had an active license or
3260	3196		permit in excess of five (5) years shall be required to apply as a
3261	3197		new applicant.
3262	3198		K. Any application for a license or permit that has remained
3263	3199		inactive for more than one (1) year shall be closed.
3264	3200		SECTION 16. AMENDATORY 59 O.S. 2021, Section 328. 44a, as
3265	3201		amended by Section 10, Chapter 46, O.S.L. 2024 (59 O.S. Supp. 2024,
3266	3202		Section 328.44a), is amended to read as follows:
3267	3203		Section 328.44a. A. The Board of Dentistry is authorized,
3268	3204		after notice and opportunity for a hearing pursuant to Article II of
3269	3205		the Administrative Procedures Act, to issue an order imposing one or
3270	3206		more of the following penalties whenever the Board finds, by clear
3271	3207		and convincing evidence, that a dentist, dental hygienist, dental
3272	3208		assistant, oral maxillofacial surgery assistant , dental laboratory
3273	3209		technician, holder of a permit to operate a dental laboratory, or an
3274	3210		entity operating pursuant to the provisions of the Professional
3275	3211		Entity Act or the State Dental Act has committed any of the acts or

3304	3239		Board:
3305	3240		1. Refusal to issue a license or permit, or a renewal thereof,
3306	3241		provided for in the State Dental Act;
3307	3242		2. Suspension of a license or permit issued by the Board for a
3308	3243		period of time deemed appropriate by the Board;
3309	3244		3. Revocation of a license or permit issued by the Board;
3310	3245		4. Imposition of an administrative penalty not to exceed One
3311	3246		Thousand Five Hundred Dollars ($1,500.00) per violation;
3312	3247		5. Issuance of a censure;
3313	3248		6. Placement on probation for a period of time and under such
3314	3249		terms and conditions as deemed appropriate by the Board;
3315	3250		7. Probation monitoring fees, which shall be the responsibility
3316	3251		of the licensee on all probations; or
3317	3252		8. Restriction of the services that can be provided by a
3318	3253		dentist or dental hygienist, under such te rms and conditions as
3319	3254		deemed appropriate by the Board.
3320	3255		B. A dentist, dental hygienist, dental assistant , oral
3321	3256		maxillofacial surgery assistant , dental laboratory technician, or
3322	3257		holder of a permit to operate a dental laboratory, against whom a
3323	3258		penalty is imposed by an order of the Board pursuant to the
3324	3259		provisions of this section, shall have the right to seek a judicial
3325	3260		review of such order pursuant to Article II of the Administrative
3326	3261		Procedures Act.

3354	3288		C. The Board may issue a summary suspension on a licensee or
3355	3289		permit holder who is found guilty of a felony charge and is
3356	3290		sentenced to incarceration in a state or federal facility.
3357	3291		D. 1. A licensee or permit holder may petition the Board to
3358	3292		reopen and withdraw an order after the expiration of seven (7) years
3359	3293		from the date of issue if:
3360	3294		a. the order does not include allegations or a finding of
3361	3295		direct patient harm,
3362	3296		b. the licensee has maintained an active full -time
3363	3297		practice in good standing and has not received an
3364	3298		additional order or private reprimand since the issu e
3365	3299		of the order,
3366	3300		c. the licensee has not been the subject of any
3367	3301		settlement reports in the National Practitioner Data
3368	3302		Bank within the previous seven (7) years, and
3369	3303		d. the order concerns an administrative violation and
3370	3304		does not include a direct action agains t the licensee
3371	3305		including, but not limited to, probation or suspension
3372	3306		of the license.
3373	3307		2. Upon receipt of a motion to reopen and withdraw an order,
3374	3308		the president of the Board shall assign a panel for review and
3375	3309		investigation to be brought to the Board. Th e Board shall take into
3376	3310		consideration the issues causing the order; any changes to laws
3377	3311		relevant to the order since its issue that may have resulted in a
3378	3312

3406	3339		complaint; any actions by the lice nsee to better his or her
3407	3340		abilities as a practicing licensee; current patient outcomes;
3408	3341		service to his or her community or state; and any other issues,
3409	3342		testimony, or other information relating to the licensee found
3410	3343		during an investigation or submitted to t he Board.
3411	3344		3. The panel and the president may make a determination that
3412	3345		the case is not appropriate to bring before the Board and shall have
3413	3346		the authority to summarily deny the order and, if appropriate, to
3414	3347		advise the licensee of requirements to complete f or future
3415	3348		consideration. The panel may choose to keep the matter pending
3416	3349		while the licensee completes the requirements advised.
3417	3350		4. Upon a case brought before the Board, the Board shall vote
3418	3351		to withdraw or stay the order. If the order is withdrawn, it sh all
3419	3352		revert to a private settlement agreement pursuant to Section 328.43a
3420	3353		of this title.
3421	3354		SECTION 17. AMENDATORY 59 O.S. 2021, Section 328.51a, is
3422	3355		amended to read as follows:
3423	3356		Section 328.51a. A. The Board of Dentistry is authorized to
3424	3357		charge the following fees for the purpose of implementing and
3425	3358		enforcing the State Dental Act. The penalty and late fee shall be
3426	3359		twice the amount of the original fee for license renewals.

3659	3587		license if the licensee has paid the annual renewal fee for the
3660	3588		license to practice dentistry.
3661	3589		SECTION 18. AMENDATORY 59 O.S. 2021, Section 3 28.55, is
3662	3590		amended to read as follows:
3663	3591		Section 328.55. All licensees engaged in the practice of
3664	3592		dentistry in this state shall notify the Board within twenty -four
3665	3593		(24) hours of the discovery of a death of a patient , or an emergency
3666	3594		hospital visit where the patient is admitted, pursuant to treatment
3667	3595		in a dental office and potentially related to the practice of
3668	3596		dentistry by the licensee. A licensee shall submit a complete
3669	3597		report to the Board of any fatality or serious injury occurring
3670	3598		during the practice of d entistry or the discovery of the death of a
3671	3599		patient whose death is causally related to the practice of dentistry
3672	3600		by the licensee within thirty (30) days of such occurrence.
3673	3601		SECTION 19. This act shall become effective November 1, 2025.
