5946 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6047 SECTION 1. AMENDATORY 62 O.S. 2021, Section 35.3, is
6148 amended to read as follows:
6249 Section 35.3. As used in the Information Technology
6350 Consolidation and Coordination Act:
6451 1. “Appropriated state agency ” means any state agency that
6552 receives funding through the annual legislative appropriations
6653 process;
54+2. “Information technology assets ” means any equipment or
55+interconnected system or subsystem of equipment that is used in t he
56+acquisition, storage, manipulation, management, movement, control,
57+display, switching, interchange, transmission, or reception of data
58+or information. The term shall include computers, ancillary
59+equipment, software, firmware and similar procedures, services,

94-2. “Information technology assets” means any equipment or

198-4. “Nonappropriated state agency” means any state agency that

208192 6. “State agency” means any office, elected or appointed
209193 officer, bureau, board, commission, counsel, unit, division, body,
210194 authority, or institution of the executive branch of state
211195 government excluding institutions within The Oklahoma State System
212196 of Higher Education, the Oklahoma Municipal Power Authority, the
213197 Oklahoma State Regents for Higher Education , the Oklahoma State
214198 Bureau of Investigation, the District Attorneys Council, the Office
215199 of the Attorney General, the Office of the State Audito r and
216200 Inspector, and the telecommunications network known as OneNet.
217201 SECTION 2. NEW LAW A new section of law to be codified
218202 in the Oklahoma Statutes as Section 35.7a of Title 62, unless there
219203 is created a duplication in numbering, reads as follows:
204+A. Except as otherwise provided by the Information Tech nology
205+Consolidation and Coordination Act, any state agency may employ
206+information technology personnel to develop and implement the
207+agency’s technology strategy, provided that the ag ency remains
208+subject to the standards, policies, and oversight establishe d by the
209+Chief Information Officer of this state for the purposes of data
210+integrity and security.

247-A. Except as otherwise provided by the Information Technology
248-Consolidation and Coordination Act, any state agency may employ
249-information technology personnel to develop and implement the
250-agency’s technology strategy, provided that t he agency remains
251-subject to the standards, policies, and oversight established by the
252-Chief Information Officer of this state for the purposes of data
253-integrity and security.
254237 B. A state agency may employ information technology personnel
255238 pursuant to this section if it first enters into a memorandum of
256239 understanding with the Chief I nformation Officer detailing, at a
257240 minimum:
258241 1. The specific positions and job descriptions that the agency
259242 plans to hire;
260243 2. The qualifications of the positions;
261244 3. Agreement by the state agency to be bound by the standards,
262245 policies, and oversight set forth by the Chief Information Officer
263246 for security and data integrity purposes; and
264247 4. Any other terms deemed necessary by the Chief Information
265248 Officer or the state agency.
266249 No information technology personnel shall be hired or retained
267250 by the state agency until a memorandum of understanding has been
268251 fully executed by both the Chief Information Officer and the state
269252 agency.
253+C. The Chief Information Officer, at his or her discretion, may
254+audit the state agency ’s compliance with the provisions of the
255+memorandum of understanding and any other requirements of this
256+section.
257+D. The authorization described in this section shall not be
258+construed as a waiver or exemption of any other provisions of the
259+Information Technology Consolidation and Coordination Act.

297-C. The Chief Information Officer, at his or her discre tion, may

304286 SECTION 3. It being immediately necessary for the preservation
305287 of the public peace, health or safety, an emergency is hereby
306288 declared to exist, by reason whereof this ac t shall take effect and
307289 be in full force from and after its passage and a pproval.
