5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6053 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.16, as
6154 last amended by Section 140, Chapter 452, O.S .L. 2024 (63 O.S. Supp.
6255 2024, Section 427.16), is amended to read as follows:
6356 Section 427.16. A. There is hereby created a medical marijuana
6457 transporter license as a category of the medical marijuana business
6558 license.
6659 B. Pursuant to Section 424 of this title, the Oklahoma Medical
6760 Marijuana Authority shall issue a medical m arijuana transporter
61+license to licensed medical marijuana commercial growers, processors
62+and dispensaries upon issuance of such licenses and upon each
63+renewal. Medical marijuana trans porter licenses shall also be

97-renewal. Medical marijuana transporter licenses shall also be
9890 issued to licensed medical marijuana research facilities, medical

10092 laboratories upon issuance of such licenses and upon each renewal.
10193 C. A medical marijuana transpor ter license may also be issued
10294 to qualifying applicants who are registe red with the Secretary of
10395 State and otherwise meet the requirements for a medical marijuana
10496 business license set forth in the Oklahoma Medical Marijuana and
10597 Patient Protection Act and t he requirements set forth in this
10698 section to provide logistics, distribution and storage of medical
10799 marijuana, medical marijuana concentrate and medical marijuana
108100 products.
109101 D. A medical marijuana transporter license shall be valid for
110102 one (1) year and sha ll not be transferred with a change of
111103 ownership. A licensed medical m arijuana transporter shall be
112104 responsible for all medical marijuana, medical marijuana concentrate
113105 and medical marijuana products once the transporter takes control of
114106 the product.
115107 E. A transporter license shall be required for any person or
116108 entity to transport or transfer medical marijuana, medical marijuana
117109 concentrate or medical marijuana products from a licensed medical
118110 marijuana business to another medical marijuana business, or fr om a
111+medical marijuana business to a medical marijuana research facilit y
112+or medical marijuana education facility.

148139 F. A medical marijuana transporter licensee may contract with
149140 multiple licensed medical marijuana businesses.
150141 G. A medical marijuana transpo rter may maintain a licensed
151142 premises to temporarily store medical marijuana, medical marijuana
152143 concentrate and medical marijuana products and to use as a
153144 centralized distribution point. A medical marijuana transporter may
154145 store and distribute medical mar ijuana, medical marijuana
155146 concentrate and medical marijuana products fr om the licensed
156147 premises. The licensed premises shall meet all security
157148 requirements applicable to a medical marijuana business. The
158149 Authority shall issue licenses upon proper applica tion by a licensee
159150 and determination by the Authority that the proposed site and
160151 facility are physically and technically suitable.
161152 H. A medical marijuana transporter licensee shall use the seed -
162153 to-sale tracking system developed pursuant to the Oklahoma Me dical
163154 Marijuana and Patient Protection Act to create shipping inventory
164155 manifests documenting the transport or temporary storage of medical
165156 marijuana, medical marijuana concentrate and medical marijuana
166157 products throughout the state.
167158 I. A licensed medical marijuana transporter may maintain and
168159 operate one or more warehouses in the state to handle medical
169160 marijuana, medical marijuana concentrate and medical marijuana
161+products, provided they posses s a valid, unexpired medical marijuana
162+transport license and have applied for and received a permit for

197-products, provided they posses s a valid, unexpired medical marijuana
198-transport license and have applied for and received a permit for
199189 each warehouse location. Th e Authority shall issue an annual permit
200190 for each warehouse location operated by a licensee that is equal to
201191 the annual medical marijuana transport license term, and there shall
202192 be no limit to the number of permits issued under a medical
203193 marijuana transporter license. A permit shall be issued only upon
204194 proper application by a licensee and determination by the Authority
205195 that the proposed site and facility are physically and technically
206196 suitable. Upon a finding that the proposed site and facility are
207197 not physically or technically suitable, the Authority shall deny the
208198 permit. Each warehouse location shall be registered approved and
209199 inspected by the Authority prior to its use. Medical marijuana
210200 transporter warehouses that are licensed and approved by the
211201 Authority may temporarily store medical marijuana, medical marijuana
212202 concentrate, and medical marijuana products, provided all temporary
213203 storage is documented, tracked, and traceable.
214204 J. With the exception of a lawful transfer between medical
215205 marijuana businesses who are licensed to operate at the same
216206 physical address, all medical marijuana, medical marijuana
217207 concentrate and medical marijuana products shall be transported:
218208 1. In vehicles equipped with Global Positioning System (GPS)
219209 trackers;
210+2. In a locked container and clearly labeled “Medical Marijuana
211+or Derivative”; and

249238 3. In a secured area of the vehicle that is not accessible by
250239 the driver during transit.
251240 K. A transporter agent may possess marijuana at any location
252241 while the transporter agent is t ransferring marijuana to or from a
253242 licensed medical marijuana business, licensed medical marijuana
254243 research facility or licensed medical marijuana education facility.
255244 The Authority shall administer the provisions of this section and
256245 the Authority, the Oklahoma State Bureau of Narcotics and Dangerous
257246 Drugs Control, the Oklahoma State Bureau of Investigation, and the
258247 Attorney General shall have the authority to enforce the provisions
259248 of this section concerning transportation.
260249 L. The Authority shall issue a transporter agent license to
261250 individual agents, employees, officers or owners of a transporter
262251 license in order for the individual to qualify to transport medical
263252 marijuana, medical mar ijuana concentrate or medical marijuana
264253 products.
265254 M. The annual fee for a transporter agent license shall be
266255 Twenty-five Dollars ($25.00) and shall be paid by the transporter
267256 license-holder or the individual applicant. Transporter agent
268257 license reprints shall be Twenty Dollars ($20.00).
269258 N. The Authority shall issue each tr ansporter agent a registry
270259 identification card within thirty (30) days of receipt of:
260+1. The name, address and date of birth of the person;
261+2. Proof of current state residency;

298-1. The name, address and date of birth of the person;
299-2. Proof of current state residency;
300288 3. Proof of identity as required for a medical marijuana
301289 business license;
302290 4. Possession of a valid state -issued driver license;
303291 5. Verification of employment with a licensed transporter;
304292 6. The application and affiliated fee; and
305293 7. A copy of the criminal background check conducted by the
306294 Oklahoma State Bureau of Investigatio n, paid for by the applicant.
307295 O. If the transporter agent application is denied, the
308296 Authority shall notify the transporter in writing of the reason for
309297 denying the registry identifica tion card.
310298 P. A registry identification card for a transporter shall
311299 expire one (1) year after the date of issuance or upon notification
312300 from the holder of the transporter license that the transporter
313301 agent ceases to work as a transporter.
314302 Q. The Authority may revoke the registry identification card of
315303 a transporter agent w ho knowingly violates any provision of this
316304 section, and the transporter is subject to any other penalties
317305 established by law for the violation.
318306 R. The Authority may revoke or suspend the transporter license
319307 of a transporter that the Authority determines knowingly aided or
320308 facilitated a violation of any provision of this section, and the
309+license holder is subject to any other penalties established in law
310+for the violation.

348-license holder is subject to any other penalties established in law
349-for the violation.
350337 S. Vehicles used in the transport of medical marijuana or
351338 medical marijuana product shall be:
352339 1. Insured at or above the legal requirements in this state;
353340 2. Capable of securing medical marijuana during transport; and
354341 3. In possession of a shipping container as def ined in Section
355342 427.2 of this title capable of securing all transported products.
356343 T. Prior to the transport of any medical marijuana, medical
357344 marijuana concentrate or medical marijuana products, an inventory
358345 manifest shall be prepared at the origination p oint of the medical
359346 marijuana. The inventory manifest shall include th e following
360347 information:
361348 1. For the origination point of the medical marijuana:
362349 a. the licensee number for the commercial grower,
363350 processor or dispensary,
364351 b. address of origination of transport, and
365352 c. name and contact information for the originating
366353 licensee;
367354 2. For temporary storage at a medical marijuana transporter
368355 licensed premises or warehouse location that is licensed and
369356 approved by the Authority:
370357 a. the license number for the commercial grower,
371358 processor, or dispensary,
359+b. the address of originat ion of transport,

405391 and notation that the medical marijuana, medical
406392 marijuana concentrates, and medical marijuana products
407393 are being temporarily stored ;
408394 3. For the end recipient license holder of the medical
409395 marijuana:
410396 a. the license number for the dispensary, commercial
411397 grower, processor, rese arch facility or education
412398 facility destination,
413399 b. address of the destination, and
414400 c. name and contact information for the destination
415401 licensee;
416402 3. 4. Quantities by weight or unit of each type of medical
417403 marijuana product contained in transport;
418404 4. 5. The date of the transport and the approximate time of
419405 departure;
420406 5. 6. The arrival date and estimated time of arrival;
421407 6. 7. Printed names and signatures of the personnel
422408 accompanying the transport; and
409+7. 8. Notation of the transporting licensee.

450-7. 8. Notation of the transporting licensee.
451436 U. 1. A separate inventory manifest shall be prepared for each
452437 licensee receiving the medical marijuana.
453438 2. The transporter agent shall provide the other medical
454439 marijuana business with a copy of the inventory manifest at the time
455440 the product changes hands and after the other licensee prints his or
456441 her name and signs the inventory manifest.
457442 3. A receiving licensee shall refuse to accept any medical
458443 marijuana, medical marijuana concentrate or medical marijuana
459444 products that are not accompanied by an inventory manifest.
460445 4. Originating and receiving licensees , including medical
461446 marijuana transporter warehouses temporarily storing medical
462447 marijuana, medical marijuana concentrate, and medical m arijuana
463448 products, shall maintain copies of inventory manifests and logs of
464449 quantities of medical marijuana received for seven (7) years from
465450 date of receipt.
466451 SECTION 2. This act shall become effective November 1, 2025.
