59 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

60 | 53 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.16, as |
---|
61 | 54 | | last amended by Section 140, Chapter 452, O.S .L. 2024 (63 O.S. Supp. |

62 | 55 | | 2024, Section 427.16), is amended to read as follows: |

63 | 56 | | Section 427.16. A. There is hereby created a medical marijuana |
---|
64 | 57 | | transporter license as a category of the medical marijuana business |
---|
65 | 58 | | license. |
---|
66 | 59 | | B. Pursuant to Section 424 of this title, the Oklahoma Medical |
---|
67 | 60 | | Marijuana Authority shall issue a medical m arijuana transporter |
---|
98 | 90 | | issued to licensed medical marijuana research facilities, medical |
---|
99 | 91 | | marijuana education facilities and medical marijuana testing |
---|
100 | 92 | | laboratories upon issuance of such licenses and upon each renewal. |
---|
101 | 93 | | C. A medical marijuana transpor ter license may also be issued |
---|
102 | 94 | | to qualifying applicants who are registe red with the Secretary of |
---|
103 | 95 | | State and otherwise meet the requirements for a medical marijuana |
---|
104 | 96 | | business license set forth in the Oklahoma Medical Marijuana and |
---|
105 | 97 | | Patient Protection Act and t he requirements set forth in this |
---|
106 | 98 | | section to provide logistics, distribution and storage of medical |
---|
107 | 99 | | marijuana, medical marijuana concentrate and medical marijuana |
---|
108 | 100 | | products. |
---|
109 | 101 | | D. A medical marijuana transporter license shall be valid for |
---|
110 | 102 | | one (1) year and sha ll not be transferred with a change of |
---|
111 | 103 | | ownership. A licensed medical m arijuana transporter shall be |
---|
112 | 104 | | responsible for all medical marijuana, medical marijuana concentrate |
---|
113 | 105 | | and medical marijuana products once the transporter takes control of |
---|
114 | 106 | | the product. |
---|
115 | 107 | | E. A transporter license shall be required for any person or |
---|
116 | 108 | | entity to transport or transfer medical marijuana, medical marijuana |
---|
117 | 109 | | concentrate or medical marijuana products from a licensed medical |
---|
118 | 110 | | marijuana business to another medical marijuana business, or fr om a |
---|
148 | 139 | | F. A medical marijuana transporter licensee may contract with |
---|
149 | 140 | | multiple licensed medical marijuana businesses. |
---|
150 | 141 | | G. A medical marijuana transpo rter may maintain a licensed |
---|
151 | 142 | | premises to temporarily store medical marijuana, medical marijuana |
---|
152 | 143 | | concentrate and medical marijuana products and to use as a |
---|
153 | 144 | | centralized distribution point. A medical marijuana transporter may |
---|
154 | 145 | | store and distribute medical mar ijuana, medical marijuana |
---|
155 | 146 | | concentrate and medical marijuana products fr om the licensed |
---|
156 | 147 | | premises. The licensed premises shall meet all security |
---|
157 | 148 | | requirements applicable to a medical marijuana business. The |
---|
158 | 149 | | Authority shall issue licenses upon proper applica tion by a licensee |
---|
159 | 150 | | and determination by the Authority that the proposed site and |
---|
160 | 151 | | facility are physically and technically suitable. |
---|
161 | 152 | | H. A medical marijuana transporter licensee shall use the seed - |
---|
162 | 153 | | to-sale tracking system developed pursuant to the Oklahoma Me dical |
---|
163 | 154 | | Marijuana and Patient Protection Act to create shipping inventory |
---|
164 | 155 | | manifests documenting the transport or temporary storage of medical |
---|
165 | 156 | | marijuana, medical marijuana concentrate and medical marijuana |
---|
166 | 157 | | products throughout the state. |
---|
167 | 158 | | I. A licensed medical marijuana transporter may maintain and |
---|
168 | 159 | | operate one or more warehouses in the state to handle medical |
---|
169 | 160 | | marijuana, medical marijuana concentrate and medical marijuana |
---|
199 | 189 | | each warehouse location. Th e Authority shall issue an annual permit |
---|
200 | 190 | | for each warehouse location operated by a licensee that is equal to |
---|
201 | 191 | | the annual medical marijuana transport license term, and there shall |
---|
202 | 192 | | be no limit to the number of permits issued under a medical |
---|
203 | 193 | | marijuana transporter license. A permit shall be issued only upon |
---|
204 | 194 | | proper application by a licensee and determination by the Authority |
---|
205 | 195 | | that the proposed site and facility are physically and technically |
---|
206 | 196 | | suitable. Upon a finding that the proposed site and facility are |
---|
207 | 197 | | not physically or technically suitable, the Authority shall deny the |
---|
208 | 198 | | permit. Each warehouse location shall be registered approved and |
---|
209 | 199 | | inspected by the Authority prior to its use. Medical marijuana |
---|
210 | 200 | | transporter warehouses that are licensed and approved by the |
---|
211 | 201 | | Authority may temporarily store medical marijuana, medical marijuana |
---|
212 | 202 | | concentrate, and medical marijuana products, provided all temporary |
---|
213 | 203 | | storage is documented, tracked, and traceable. |
---|
214 | 204 | | J. With the exception of a lawful transfer between medical |
---|
215 | 205 | | marijuana businesses who are licensed to operate at the same |
---|
216 | 206 | | physical address, all medical marijuana, medical marijuana |
---|
217 | 207 | | concentrate and medical marijuana products shall be transported: |
---|
218 | 208 | | 1. In vehicles equipped with Global Positioning System (GPS) |
---|
219 | 209 | | trackers; |
---|
249 | 238 | | 3. In a secured area of the vehicle that is not accessible by |
---|
250 | 239 | | the driver during transit. |
---|
251 | 240 | | K. A transporter agent may possess marijuana at any location |
---|
252 | 241 | | while the transporter agent is t ransferring marijuana to or from a |
---|
253 | 242 | | licensed medical marijuana business, licensed medical marijuana |
---|
254 | 243 | | research facility or licensed medical marijuana education facility. |
---|
255 | 244 | | The Authority shall administer the provisions of this section and |
---|
256 | 245 | | the Authority, the Oklahoma State Bureau of Narcotics and Dangerous |
---|
257 | 246 | | Drugs Control, the Oklahoma State Bureau of Investigation, and the |
---|
258 | 247 | | Attorney General shall have the authority to enforce the provisions |
---|
259 | 248 | | of this section concerning transportation. |
---|
260 | 249 | | L. The Authority shall issue a transporter agent license to |
---|
261 | 250 | | individual agents, employees, officers or owners of a transporter |
---|
262 | 251 | | license in order for the individual to qualify to transport medical |
---|
263 | 252 | | marijuana, medical mar ijuana concentrate or medical marijuana |
---|
264 | 253 | | products. |
---|
265 | 254 | | M. The annual fee for a transporter agent license shall be |
---|
266 | 255 | | Twenty-five Dollars ($25.00) and shall be paid by the transporter |
---|
267 | 256 | | license-holder or the individual applicant. Transporter agent |
---|
268 | 257 | | license reprints shall be Twenty Dollars ($20.00). |
---|
269 | 258 | | N. The Authority shall issue each tr ansporter agent a registry |
---|
270 | 259 | | identification card within thirty (30) days of receipt of: |
---|
300 | 288 | | 3. Proof of identity as required for a medical marijuana |
---|
301 | 289 | | business license; |
---|
302 | 290 | | 4. Possession of a valid state -issued driver license; |
---|
303 | 291 | | 5. Verification of employment with a licensed transporter; |
---|
304 | 292 | | 6. The application and affiliated fee; and |
---|
305 | 293 | | 7. A copy of the criminal background check conducted by the |
---|
306 | 294 | | Oklahoma State Bureau of Investigatio n, paid for by the applicant. |
---|
307 | 295 | | O. If the transporter agent application is denied, the |
---|
308 | 296 | | Authority shall notify the transporter in writing of the reason for |
---|
309 | 297 | | denying the registry identifica tion card. |
---|
310 | 298 | | P. A registry identification card for a transporter shall |
---|
311 | 299 | | expire one (1) year after the date of issuance or upon notification |
---|
312 | 300 | | from the holder of the transporter license that the transporter |
---|
313 | 301 | | agent ceases to work as a transporter. |
---|
314 | 302 | | Q. The Authority may revoke the registry identification card of |
---|
315 | 303 | | a transporter agent w ho knowingly violates any provision of this |
---|
316 | 304 | | section, and the transporter is subject to any other penalties |
---|
317 | 305 | | established by law for the violation. |
---|
318 | 306 | | R. The Authority may revoke or suspend the transporter license |
---|
319 | 307 | | of a transporter that the Authority determines knowingly aided or |
---|
320 | 308 | | facilitated a violation of any provision of this section, and the |
---|
350 | 337 | | S. Vehicles used in the transport of medical marijuana or |
---|
351 | 338 | | medical marijuana product shall be: |
---|
352 | 339 | | 1. Insured at or above the legal requirements in this state; |
---|
353 | 340 | | 2. Capable of securing medical marijuana during transport; and |
---|
354 | 341 | | 3. In possession of a shipping container as def ined in Section |
---|
355 | 342 | | 427.2 of this title capable of securing all transported products. |
---|
356 | 343 | | T. Prior to the transport of any medical marijuana, medical |
---|
357 | 344 | | marijuana concentrate or medical marijuana products, an inventory |
---|
358 | 345 | | manifest shall be prepared at the origination p oint of the medical |
---|
359 | 346 | | marijuana. The inventory manifest shall include th e following |
---|
360 | 347 | | information: |
---|
361 | 348 | | 1. For the origination point of the medical marijuana: |
---|
362 | 349 | | a. the licensee number for the commercial grower, |
---|
363 | 350 | | processor or dispensary, |
---|
364 | 351 | | b. address of origination of transport, and |
---|
365 | 352 | | c. name and contact information for the originating |
---|
366 | 353 | | licensee; |
---|
367 | 354 | | 2. For temporary storage at a medical marijuana transporter |
---|
368 | 355 | | licensed premises or warehouse location that is licensed and |
---|
369 | 356 | | approved by the Authority: |
---|
370 | 357 | | a. the license number for the commercial grower, |
---|
371 | 358 | | processor, or dispensary, |
---|
400 | 386 | | c. name and contact information for the originating |
---|
401 | 387 | | licensee, and |
---|
402 | 388 | | d. the license number, physical address, and name and |
---|
403 | 389 | | contact information of the medical marijuana |
---|
404 | 390 | | transporter licensed premises or warehouse location |
---|
405 | 391 | | and notation that the medical marijuana, medical |
---|
406 | 392 | | marijuana concentrates, and medical marijuana products |
---|
407 | 393 | | are being temporarily stored ; |
---|
408 | 394 | | 3. For the end recipient license holder of the medical |
---|
409 | 395 | | marijuana: |
---|
410 | 396 | | a. the license number for the dispensary, commercial |
---|
411 | 397 | | grower, processor, rese arch facility or education |
---|
412 | 398 | | facility destination, |
---|
413 | 399 | | b. address of the destination, and |
---|
414 | 400 | | c. name and contact information for the destination |
---|
415 | 401 | | licensee; |
---|
416 | 402 | | 3. 4. Quantities by weight or unit of each type of medical |
---|
417 | 403 | | marijuana product contained in transport; |
---|
418 | 404 | | 4. 5. The date of the transport and the approximate time of |
---|
419 | 405 | | departure; |
---|
420 | 406 | | 5. 6. The arrival date and estimated time of arrival; |
---|
421 | 407 | | 6. 7. Printed names and signatures of the personnel |
---|
422 | 408 | | accompanying the transport; and |
---|
451 | 436 | | U. 1. A separate inventory manifest shall be prepared for each |
---|
452 | 437 | | licensee receiving the medical marijuana. |
---|
453 | 438 | | 2. The transporter agent shall provide the other medical |
---|
454 | 439 | | marijuana business with a copy of the inventory manifest at the time |
---|
455 | 440 | | the product changes hands and after the other licensee prints his or |
---|
456 | 441 | | her name and signs the inventory manifest. |
---|
457 | 442 | | 3. A receiving licensee shall refuse to accept any medical |
---|
458 | 443 | | marijuana, medical marijuana concentrate or medical marijuana |
---|
459 | 444 | | products that are not accompanied by an inventory manifest. |
---|
460 | 445 | | 4. Originating and receiving licensees , including medical |
---|
461 | 446 | | marijuana transporter warehouses temporarily storing medical |
---|
462 | 447 | | marijuana, medical marijuana concentrate, and medical m arijuana |
---|
463 | 448 | | products, shall maintain copies of inventory manifests and logs of |
---|
464 | 449 | | quantities of medical marijuana received for seven (7) years from |
---|
465 | 450 | | date of receipt. |
---|
466 | 451 | | SECTION 2. This act shall become effective November 1, 2025. |
