7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 19 O.S. 2021, Section 901.25a, is
7777 amended to read as follows:
7878 Section 901.25a. A. When the respective territories of any
7979 city or town and any district are contiguous they may be included in
8080 the limits of the district in the same manner a s provided for the
8181 organization of fire protection districts. Such territory shall not
8282 be included or added to the territory of the district without the
8383 consent of the board of directors, certified to the board of county
8484 commissioners. In case any such t erritory is added to the district
8585 the property therein shall immediately becom e subject to the lien
8686 for the payment of bonds theretofore authorized by the district in

139139 authorization of such bond s.
140140 B. 1. If the board of directors of two or more fire protection
141141 districts should determine that the citizens they serve would be
142142 equally or better served by the mutual consolidation of the
143143 districts into one district, the board of directors of the
144144 consolidating districts shall develop a plan for consolidation,
145145 including combining board members as provided in Section 901.5 of
146146 this title, determining the millage levy of the proposed district,
147147 and changing ownership of assets and indebtedness. The board of
148148 directors shall present the plan with a resolution for consolidation
149149 to the board of county commissioners of any involved counties for
150150 their approval.
151151 2. Upon the presentation of such petition, the board of county
152152 commissioners shall set a hearing for s uch petition at a time not
153153 less than twenty (20) days nor more than forty (40) days from the
154154 date of the presentation and shall direct the county clerk to give
155155 notice of such hearing by publication in a newspaper of general
156156 circulation in the county in whi ch such proposed district is
157157 located. Such notice shall be published for two (2) consecutive
158158 weeks preceding the date of such hearing. Such notice shall
159159 describe the boundaries of the proposed district, shall state the
160160 time and place of the hearing, and shall state that any person may

212212 appear and protest the consolidation of the di stricts or the
213213 boundaries of the proposed district.
214214 3. The board of county commissioners shall have jurisdiction to
215215 hear and determine all protests to the consolidation of the
216216 districts and all matters pertaining to the same. At the conclusion
217217 of such hearing, the board of county commissioners shall determine
218218 whether the consolidation of such districts would be conducive to
219219 the public safety of the area incorporated within the b oundaries of
220220 the proposed district. If the board of county commissioners
221221 determines that such district will be conducive to the public safety
222222 of the area incorporated therein, then the board of county
223223 commissioners shall approve the proposed district.
224224 4. Upon approval of the proposed district, the board of county
225225 commissioners shall give such proposed district a name and shall
226226 call an election of the qualified electors in the territory
227227 comprising such proposed district on the question of whether the
228228 proposed district shall be consolidated. The county clerk shall
229229 cause notice of the election to be given by publication once a week
230230 for two (2) successive weeks in a newspaper of general circulation
231231 in the territory comprising the proposed district. Such noti ce
232232 shall state the time and place of holding the election and set forth
233233 the description of the boundaries of the proposed district, its
234234 general purpose and intention, and the proposed millage levy of such
235235 district. Such notice shall require the electors t o cast ballots

287287 which contain the words: “Consolidated Fire Protection District -
288288 Yes”, and “Consolidated Fire Protection District – No”, or words
289289 equivalent thereto. All persons resident of such proposed district,
290290 who are qualified electors in their respe ctive precincts, shall be
291291 qualified to vote on such proposition.
292292 5. Such elections shall be conducted in accordance with the
293293 general election laws of the state and the regular election
294294 officials shall be in charge at the usual polling place of each
295295 regular precinct, or part of a precinct, which shall include lands
296296 within the boundaries of such proposed district. The returns of
297297 such election shall be made direct to the board of county
298298 commissioners who shall meet on the second Monday following such
299299 election and proceed to canvass the vote cast. If, upon canvass, it
300300 appears that at least three -fifths (3/5) of all the votes cast are
301301 “Consolidated Fire Protection District – Yes”, the board of county
302302 commissioners shall, by order, declare such territory duly o rganized
303303 as a single fire protection district under the designated name.
304304 Such order shall be filed for record in the office of the county
305305 clerk by the board of county commissioners and from that date such
306306 district shall be complete.
307307 SECTION 2. This act shall become effective November 1, 2025.
