83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. AMENDATORY 60 O.S. 2021, Section 121, as last
85	85	amended by Section 1, Chapter 373, O.S.L. 2024 (60 O.S. Supp. 2024,
86	86	Section 121), is amended to read as follows:
87	87	Section 121. A. As used in Sections 121 through 127 of this
88	88	title:
89	89	1. “Deed” means any instrument in writing whereby land is
90	90	assigned, transferred, or otherwise conveyed to, or vested in, the

144	144	2. “Country of Particular Concern” means any country designated
145	145	by the United States Secretary of State as hostile or a Country of
146	146	Particular Concern (CPC);
147	147	3. “Foreign adversary company ” means any company other than a
148	148	U.S. person or U.S. subs idiary as defined in 15 C.F.R. , Section
149	149	772.1 that:
150	150	a. is domiciled, incorporated, issued, or listed in a
151	151	CPC,
152	152	b. is headquartered in a CPC,
153	153	c. has its principal place of business in a CPC,
154	154	d. is controlled by the government of a CPC or the
155	155	military or ruling political party of a CPC , or
156	156	e. is majority-owned by an entity controlled by the
157	157	government of a CPC or the military or ruling
158	158	political party of a CPC.
159	159	If a parent company does not meet any of the criteria listed in
160	160	this paragraph and does not recogni ze more than fifty percent (50%)
161	161	of the total annual global revenue of the parent company and
162	162	subsidiaries from a CPC, the parent company shall not be considered
163	163	a foreign adversary company solely because one or more subsidiaries
164	164	or affiliates meets the cr iteria set forth in subparagraph a of this
165	165	paragraph;

217	217	4. “Foreign government adversary” means a government other than
218	218	the federal government of the United States, the government of any
219	219	state, political subdivision of the state, tribe, territory, or
220	220	possession of the United States and designated by the United States
221	221	Secretary of State as hostile or a Country of Particular Concern
222	222	(CPC);
223	223	3. 5. “Foreign government enterprise ” means a business entity,
224	224	sovereign wealth fund, or state -backed investment fund in which a
225	225	foreign government adversary holds a controlling interest;
226	226	4. 6. “Foreign government entity ” means a government other than
227	227	the federal government of the United States, the government of any
228	228	state, political subdivision of the state, tribe, territo ry, or
229	229	possession of the United States; and
230	230	5. 7. “Land” means the same as defined in Section 6 of this
231	231	title, but shall not include oil, gas, other minerals, or any
232	232	interest therein.
233	233	B. No alien or any person who is not a citizen of the United
234	234	States, foreign adversary company, or foreign government adversary
235	235	shall acquire title to or own land in this state either directly or
236	236	indirectly through a business entity, trust, or foreign government
237	237	enterprise, except as hereinafter provided, but they shall have and
238	238	enjoy in this state such rights as to personal property as are, or
239	239	shall be, accorded a citizen of the United States under the laws of
240	240	the nation to which such alien belongs, or by the treaties of such

293	293	the provisions of Section 121 et seq. of this title or the
294	294	Constitution of this state. Provided, however, the requirements of
295	295	this subsection shall not apply to a business entity that is engaged
296	296	in regulated interstate commerce or has a national security
297	297	agreement with the Committee on Foreign Investment in the United
298	298	States (CFIUS) in accordance with federal law.
299	299	C. On or after November 1, 2023, any deed recorded with a
300	300	county clerk shall include as an exhibit to the deed an affidavit
301	301	executed by the person, the person ’s attorney-in-fact, a court-
302	302	appointed guardian or personal representative, an authorized officer
303	303	of the entity, or trustee of the trust coming into title attesting
304	304	that the person, business entity, or trust is obtaining the land in
305	305	compliance with the requirements of this section and that no funding
306	306	source is being used in the sale or transfer in violation of this
307	307	section or any other state or federal law. A county clerk shall not
308	308	accept and record any deed without an af fidavit as required by this
309	309	section which is duly notarized pursuant to Title 49 of the Oklahoma
310	310	Statutes. The requirements of this subsection shall not apply to a:
311	311	1. Deed which, without additional consideration, confirms,
312	312	corrects, modifies, or supplem ents a deed previously recorded;
313	313	2. Deed made by a grantor to cure a defect in title or
314	314	effectuate a disclaimer of interest in real property;

366	366	3. Transfer-on-death deed made by a grantor designating a
367	367	grantee beneficiary pursuant to the Nontestamentary Tr ansfer of
368	368	Property Act, Section 1251 et seq. of Title 58 of the Oklahoma
369	369	Statutes;
370	370	4. State or federal court order in an action to quiet title or
371	371	to cure a defect in title;
372	372	5. State or federal court order or decree in probate,
373	373	partition, quiet title, and divorce actions;
374	374	6. Deed which secures a debt or other obligation, or which
375	375	releases such property as security for a debt or other obligation;
376	376	7. Deed of dedication to the public; or
377	377	8. Deed in favor of the United States or any of its political
378	378	subdivisions, a state or any of its political subdivisions, or a
379	379	tribe.
380	380	The applicable exemption shall be shown on the face of the deed
381	381	prior to the recording of the deed and no affidavit shall be
382	382	required.
383	383	D. The Attorney General shall promulgate a separate aff idavit
384	384	form for individuals and for business entities or trusts to comply
385	385	with the requirements of this section. The Attorney General may
386	386	establish additional exemptions which the Attorney General deems
387	387	necessary to substantially comply with the requireme nts of this
388	388	section. The county clerk may accept an affidavit in substantial
