78 | 78 | | SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.6, is |

223 | 223 | | C. The minimum sentence of imprisonment issued pursuan t to the |
---|
224 | 224 | | provisions of paragraph 2 of subsection A and paragraph 2 of |
---|
225 | 225 | | subsection B of this section shall not be subject to statutory |
---|
226 | 226 | | provisions for suspended sentences, deferred sentences or probation, |
---|
227 | 227 | | provided the court may subject any remaining penalty under the |
---|
228 | 228 | | jurisdiction of the court to the statutory provisions for suspended |
---|
229 | 229 | | sentences, deferred sentences or probation. |
---|
230 | 230 | | D. In addition to any other penalty specified by this se ction, |
---|
231 | 231 | | the court shall require a defendant to undergo the treatment or |
---|
232 | 232 | | participate in the counseling services necessary to bring about the |
---|
233 | 233 | | cessation of domestic abuse against the victim or to bring about the |
---|
234 | 234 | | cessation of stalking or harassment of the victi m. For every |
---|
235 | 235 | | conviction of violation of a protective order: |

291 | 291 | | 2. a. The court shall require the defendant to participate |

292 | 292 | | in counseling or undergo treatment for domestic abuse |
---|
293 | 293 | | by an individual licensed practitioner or a domestic |
---|
294 | 294 | | abuse treatment program certified b y the Attorney |
---|
295 | 295 | | General. If the defendant is ordered to participate |
---|
296 | 296 | | in a domestic abuse counseling or treatment program, |
---|
297 | 297 | | the order shall require the defendant to attend the |
---|
298 | 298 | | program for a minimum of fifty -two (52) weeks, |
---|
299 | 299 | | complete the program, and be evaluat ed before and |
---|
300 | 300 | | after attendance of the program by a program counselor |
---|
301 | 301 | | or a private counselor. |
---|
302 | 302 | | b. A program for anger management, couples counseling, or |
---|
303 | 303 | | family and marital counseling shall not solely qualify |
---|
304 | 304 | | for the counseling or treatment requirement for |
---|
305 | 305 | | domestic abuse pursuant to this subsection. The |
---|
306 | 306 | | counseling may be ordered in addition to counseling |
---|
307 | 307 | | specifically for the treatment of domestic abuse or |
---|
308 | 308 | | per evaluation as set forth below. If, after |
---|
309 | 309 | | sufficient evaluation and attendance at required |
---|
310 | 310 | | counseling sessions, the domestic violence treatment |
---|
311 | 311 | | program or licensed professional de termines that the |
---|
312 | 312 | | defendant does not evaluate as a perpetrator of |
---|

371 | 371 | | complete the counseling as per the recommendations of |

372 | 372 | | the domestic violence treatment prog ram or licensed |
---|
373 | 373 | | professional; |
---|
374 | 374 | | 3. a. The court shall set a review hearing no more than one |
---|
375 | 375 | | hundred twenty (120) days after the defendant is |
---|
376 | 376 | | ordered to participate in a domestic ab use counseling |
---|
377 | 377 | | program or undergo treatment for domestic abuse to |
---|
378 | 378 | | assure the attendance and compliance of the defendant |
---|
379 | 379 | | with the provisions of this subsection and the |
---|
380 | 380 | | domestic abuse counseling or treatment requirements. |
---|
381 | 381 | | b. The court shall set a second revi ew hearing after the |
---|
382 | 382 | | completion of the counseling or treatment to assure |
---|
383 | 383 | | the attendance and compliance of the defendant with |
---|
384 | 384 | | the provisions of this subsection and the domestic |
---|
385 | 385 | | abuse counseling or treatment requirements. The court |
---|
386 | 386 | | may suspend sentencing of the defendant until the |
---|

443 | 443 | | such program. Such proof shall be presented to the |

444 | 444 | | court by the defendant no later than one hundred |

445 | 445 | | twenty (120) days after the defendant is ordered to |

446 | 446 | | such counseling or treatment. At such time, the court |
---|
447 | 447 | | may complete sentencing, begi nning the period of the |
---|
448 | 448 | | sentence from the date that proof of enrollment is |
---|
449 | 449 | | presented to the court, and schedule reviews as |
---|
450 | 450 | | required by subparagraphs a and b of this paragraph |
---|
451 | 451 | | and paragraphs 4 and 5 of this subsection. The court |
---|
452 | 452 | | shall retain continuing jur isdiction over the |
---|
453 | 453 | | defendant during the course of ordered counseling |
---|
454 | 454 | | through the final review hearing; |
---|
455 | 455 | | 4. The court may set subsequent or other review hearings as the |
---|
456 | 456 | | court determines necessary to assure the defendant attends and fully |
---|
457 | 457 | | complies with the provisions of this subsection and the domestic |
---|
458 | 458 | | abuse counseling or treatment requirements; |
---|
459 | 459 | | 5. At any review hearing, if the defendant is not |
---|
460 | 460 | | satisfactorily attending individual counseling or a domestic abuse |
---|
461 | 461 | | counseling or treatment program or is not in com pliance with any |
---|
462 | 462 | | domestic abuse counseling or treatment requirements, the cour t may |

754 | 754 | | conviction for an offense under the Protection from Domestic Abuse |

755 | 755 | | Act or any other violent offense, or any other evidence that shows |
---|
756 | 756 | | by a preponderance of the evidence that the defendant is likely to |
