5577 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5678 SECTION 1. AMENDATORY 15 O.S. 2021, Section 753, as
5779 amended by Section 1, Chapter 368, O.S.L. 2023 (15 O.S. Supp. 2024,
5880 Section 753), is amended to read as follows:
5981 Section 753. A person engages in a practice which is declared
6082 to be unlawful under the Oklahoma Consumer Protection Act when, in
6183 the course of the person ’s business, the person:
6284 1. Represents, knowingly or with reason to know, that the
6385 subject of a consumer transaction is of a particular make or brand,
6486 when it is of another;

92138 2. Makes a false or misleading representation, knowingly or
93139 with reason to know, as t o the source, sponsorship, approval, or
94140 certification of the subject of a consumer transaction;
95141 3. Makes a false or misleading representation, knowingly or
96142 with reason to know, as to affiliation, connection, association
97143 with, or certification by another;
98144 4. Makes a false or misleading representation or designation,
99145 knowingly or with reason to know, of the geographic origin of the
100146 subject of a consumer transaction;
101147 5. Makes a false representation, knowingly or with reason to
102148 know, as to the characteristic s, ingredients, uses, benefits,
103149 alterations, or quantities of the subject of a consumer transaction
104150 or a false representation as to the sponsorship, approval, status,
105151 affiliation or connection of a person therewith;
106152 6. Knowingly or with reason to know, makes a false or
107153 misleading representation or gives the false or misleading
108154 impression of being affiliated with a state agency or an affiliate
109155 of a state agency through advertiseme nt or publication;
110156 7. Represents, knowingly or with reason to know, that the
111157 subject of a consumer transaction is original or new if the person
112158 knows that it is reconditioned, reclaimed, used, or secondhand;
113159 8. Represents, knowingly or with reason to kno w, that the
114160 subject of a consumer transaction is of a particular standard, style
115161 or model, if it is of another;

143213 9. Advertises, knowingly or with reason to know, the subject of
144214 a consumer transaction with intent not to sell it as advertised;
145215 10. Advertises, knowingly or with reason to know, the subject
146216 of a consumer transaction wit h intent not to supply reasonably
147217 expected public demand, unless the advertisement discloses a
148218 limitation of quantity;
149219 11. Advertises under the guise of obtaining sales personne l
150220 when in fact the purpose is to sell the subject of a consumer
151221 transaction to the sales personnel applicants;
152222 12. Makes false or misleading statements of fact, knowingly or
153223 with reason to know, concerning the price of the subject of a
154224 consumer transaction or the reason for, existence of, or amounts of
155225 price reduction;
156226 13. Employs “bait and switch” advertising, which consists of an
157227 offer to sell the subject of a consumer transaction which the seller
158228 does not intend to sell, which advertising is accompanie d by one or
159229 more of the following practices:
160230 a. refusal to show the subject of a consumer transaction
161231 advertised,
162232 b. disparagement of the advertised subject of a consumer
163233 transaction or the terms of sale,
164234 c. requiring undisclosed tie -in sales or other
165235 undisclosed conditions to be met prior to selling the
166236 advertised subject of a cons umer transaction,

194288 d. refusal to take orders for the subject of a consumer
195289 transaction advertised for delivery within a
196290 reasonable time,
197291 e. showing or demonstrating defective subj ect of a
198292 consumer transaction which the seller knows is
199293 unusable or impracticable for the purpose set forth in
200294 the advertisement,
201295 f. accepting a deposit for the subject of a consumer
202296 transaction and subsequently charging the buyer for a
203297 higher priced item, or
204298 g. willful failure to make deliveries of the subject of a
205299 consumer transaction within a reasonable time or to
206300 make a refund therefor upon the request of the
207301 purchaser;
208302 14. Conducts a closing out sale without having first obtained a
209303 license as required in the Oklahoma Consumer Protection Act;
210304 15. Resumes the business for which the closing out sale was
211305 conducted within thirty -six (36) months from the expiration date of
212306 the closing out sale license;
213307 16. Falsely states, knowingly or with reason to know, that
214308 services, replacements or repairs are needed;
215309 17. Violates any provision of the Oklahoma Health Spa Act;
216310 18. Violates any provision of the Home Repair Fraud Act;

244362 19. Violates any provision of the Consumer Disclosure of Prizes
245363 and Gifts Act;
246364 20. Violates any provision of Section 755.1 of this title or
247365 Section 1847a of Title 21 of the Oklahoma Statutes;
248366 21. Commits an unfair or deceptive trade practice as defined in
249367 Section 752 of this title;
250368 22. Violates any provision of Section 169.1 of Title 8 o f the
251369 Oklahoma Statutes in fraudulently or intentionally failing or
252370 refusing to honor the contract to provide certain cemetery services
253371 specified in the contract entered into pursuant to the Perpetual

255373 23. Misrepresents a mail solicitation a s an invoice or as a
256374 billing statement;
257375 24. Offers to purchase a mineral or royalty interest through an
258376 offer that resembles an oil and gas lease and that the consumer
259377 believed was an oil and gas lease;
260378 25. Refuses to honor gift certificates, warranties, or any
261379 other merchandise offered by a person in a consumer transaction
262380 executed prior to the closing of the business of the person without
263381 providing a purchaser a means of redeeming such merchandise or
264382 ensuring the warranties offered will be honored by an other person;
265383 26. Knowingly causes a charge to be made by any billing method
266384 to a consumer for services which the person knows was not authorized
267385 in advance by the consumer;

295437 27. Knowingly causes a charge to be made by any billing method
296438 to a consumer for a product or products which the person knows was
297439 not authorized in advance by the consumer;
298440 28. Violates Section 752A of this title;
299441 29. Makes deceptive use of another ’s name in notification or
300442 solicitation, as defined in Section 752 of this title;
301443 30. Falsely states or implies that any person, product or
302444 service is recommended or endorsed by a named third person;
303445 31. Falsely states that information about the consumer,
304446 including but not limited to, the name, address or phone number of
305447 the consumer has been provided by a third person, whether that
306448 person is named or unnamed;
307449 32. Acting as a debt collector, contacts a debtor and threatens
308450 to file a suit against the debtor over a debt barred by the statute
309451 of limitations which has passed for filing suit f or such debt; or
310452 33. Acting as a debt collector, contacts a debtor and uses
311453 obscene or profane language to collect a debt ; or
312454 34. Owns, operates, maintains, or advertises a massage therapy
313455 establishment that:
314456 a. employs massage therapists as defined by S ection
315457 4200.2 of Title 59 of the Oklahoma Statutes who are
316458 not appropriately licensed or are not in compliance
317459 with the applicable licensing requirements of the
318460 Massage Therapy Practice Act,

346512 b. employs persons who violate the provisions of Section
347513 4200.13 of Title 59 of the Oklahoma Statutes, or
348514 c. is not in compliance with any applicable provisions of
349515 the Massage Therapy Practice Act or any local
350516 ordinance or municipal code relating to the licensing
351517 or regulation of massage therapy establishments.
352518 For purposes of this paragraph, “massage therapy establishment ”
353519 means a place of busin ess where a licensed massage therapist
354520 provides massage therapy services to clients in exchange for
355521 payment. Massage therapy establishment does not include the home of
356522 a client.
357523 SECTION 2. This act shall become effective November 1, 2025.
