7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104, as
7979 last amended by Section 1, Chapter 442, O.S.L. 2024 (47 O.S. Supp.
8080 2024, Section 1104), is amended to read as follows:
8181 Section 1104. A. Unless otherwise provided by law, all fees,
8282 taxes, and penalties collected or received pursuant to the Oklahoma
8383 Vehicle License and Registration Act or Section 1 -101 et seq. of
8484 this title shall be apportioned and distributed mon thly by the
8585 Oklahoma Tax Commission in accordance with this section. Service
8686 Oklahoma shall provide to the Oklahoma Tax Commission monthly
8787 reports of motor vehicle collection information, including, but not
8888 limited to, motor vehicle monthly apportionment information,

141141 program amounts, driver license records, prorate amounts, and sales
142142 tax amounts. The reports shall be delivered electronically pursuant
143143 to the current calendar year apportionment disbursement schedule
144144 provided to Service Oklahoma by the Oklahoma Tax Commi ssion on or
145145 before December 1st annually.
146146 One percent (1%) of fees collected shall be apportioned to the
147147 Licensed Operator Performance Fund created in Section 3 -106 of this
148148 title, in accordance with the applicable metrics determined by
149149 Service Oklahoma.
150150 B. 1. The following percentages of the monies referred to in
151151 subsection A of this section shall be apportioned to the various
152152 school districts in accordance with paragraph 2 of th is subsection:
153153 a. from October 1, 2000, until June 30, 2001, thirty -five
154154 and forty-six one-hundredths percent (35.46%),
155155 b. for the year beginning July 1, 2001, and ending June
156156 30, 2002, thirty-five and ninety-one one-hundredths
157157 percent (35.91%),
158158 c. for the year beginning July 1, 2002, through the year
159159 ending on June 30, 2015, thirty -six and twenty one-
160160 hundredths percent (36.20%),
161161 d. for the year beginning July 1, 2015, through the year
162162 ending on June 30, 2019, thirty -six and twenty one-
163163 hundredths percent (3 6.20%), but in no event shall the

216216 subparagraph exceed the total amount apportioned for
217217 the fiscal year ending on June 30, 2015. Any amounts
218218 in excess of such limitation shall be placed to the
219219 credit of the General Revenue Fund, and
220220 e. for the year beginning July 1, 2019, and all
221221 subsequent years, thirty -six and twenty one-hundredths
222222 percent (36.20%), but in no event shall the amount
223223 apportioned in any fiscal year pursuant to this
224224 subparagraph exceed th e total amount apportioned for
225225 the fiscal year ending on June 30, 2015. Any amounts
226226 in excess of such limitation shall be placed to the
227227 credit of the Rebuilding Oklahoma Access and Driver
228228 Safety Fund created in Section 1521 of Title 69 of the
229229 Oklahoma Statutes.
230230 2. The monies apportioned pursuant to subparagraphs a through e
231231 of paragraph 1 of this subsection shall be apportioned to the
232232 various school districts so that each district shall receive an
233233 amount based upon the proportion that each district ’s average daily
234234 attendance bears to the total average daily attendance of those
235235 districts entitled to receive funds pursuant to this section as
236236 certified by the State Department of Education.

288288 Each district’s allocation of funds shall be remitted to the
289289 county treasurer of the county wherein the administrative
290290 headquarters of the district are located.
291291 No district shall be eligible for the funds herein provided
292292 unless the district makes an ad valorem tax levy of fifteen (15)
293293 mills and maintains nine (9) years of in struction and, pursuant to
294294 the rules of the State Board of Education, is auth orized to maintain
295295 ten (10) years of instruction.
296296 C. The following percentages of the monies referred to in
297297 subsection A of this section shall be remitted to the State
298298 Treasurer to be credited to the General Revenue Fund of the State
299299 Treasury:
300300 1. From October 1, 2000, until June 30, 2001, forty -five and
301301 ninety-seven one-hundredths percent (45.97%);
302302 2. For the year beginning July 1, 2001, and ending June 30,
303303 2002, forty-five and twenty-nine one-hundredths percent (45.29%);
304304 3. For the year beginning July 1, 2002, and for the subsequent
305305 fiscal years ending June 30, 2007, forty -four and eighty-four one-
306306 hundredths percent (44.84%);
307307 4. For the year beginning July 1, 2007, and ending June 30,
308308 2008, thirty-nine and eighty-four one-hundredths percent (39.84%);
309309 5. For the year beginning July 1, 2008, and ending June 30,

375375 subsection A of this section shall be remit ted to the State
376376 Treasurer to be credited to the State Transportation Fund:
377377 1. From October 1, 2000, until June 30, 2001, thirty one -
378378 hundredths percent (0.30%);
379379 2. For the year beginning July 1, 2001, through the year ending
380380 on June 30, 2015, thirty -one one-hundredths percent (0.31%);
381381 3. For the year beginning July 1, 2015, through the year ending
382382 on June 30, 2019, thirty -one one-hundredths percent (0.31%), but in
383383 no event shall the amount apportioned in any fiscal year pursuant to
384384 this paragraph exceed the total amount apportioned for the fiscal
385385 year ending on June 30, 2015. Any amounts in excess of such

440440 years, thirty-one one-hundredths percent (0.31%), but in no event
441441 shall the amount apportioned in any fiscal year pursuant to this
442442 paragraph exceed the total amount apportioned for the fiscal year
443443 ending on June 30, 2015. Any amounts in excess of such limitation
444444 shall be placed to the credit of the Rebuilding Oklahoma Access and
445445 Driver Safety Fund created in Section 1521 of Title 69 of the
446446 Oklahoma Statutes.
447447 E. 1. The following percentages of th e monies referred to in
448448 subsection A of this section shall be apportioned to the various
449449 counties as set forth in paragraph 2 of this subsection:
450450 a. from October 1, 2000, until June 30, 2001, seven and
451451 nine one-hundredths percent (7.09%),
452452 b. for the year beginning July 1, 2001, and ending June
453453 30, 2002, seven and eighteen one -hundredths percent
454454 (7.18%),
455455 c. for the year beginning July 1, 2002, through the year
456456 ending on June 30, 2015, seven and twenty -four one-
457457 hundredths percent (7.24%),
458458 d. for the year beginning July 1, 2015, through the year
459459 ending on June 30, 2019, seven and twenty -four one-
460460 hundredths percent (7.24%), but in no event shall the

513513 subparagraph exceed the total amount apportioned for
514514 the fiscal year ending on June 30, 2015. Any amounts
515515 in excess of such limitation shall be placed to the
516516 credit of the General Revenue Fund, and
517517 e. for the year beginning July 1, 2019, and all
518518 subsequent years, seven and twenty -four one-hundredths
519519 percent (7.24%), but in no event shall the amount
520520 apportioned in fiscal years 2019 through 2024 pursuant
521521 to this subparagraph exceed the total amount
522522 apportioned for the fiscal year ending on June 30,
523523 2015, and in no event shall the amount apportioned in
524524 fiscal year 2026 and subsequent fiscal years exceed
525525 the amount apportioned for the fiscal y ear ending on
526526 June 30, 2025. Any amounts in excess of such
527527 limitation shall be placed to the credit of the
528528 Rebuilding Oklahoma Access and Driver Safety Fund
529529 created in Section 15 21 of Title 69 of the Oklahoma
530530 Statutes.
531531 2. The monies apportioned pursuant to subparagraphs a through e
532532 of paragraph 1 of this subsection shall be apportioned as follows:
533533 forty percent (40%) of such sum shall be distributed to the various
534534 counties in that proportion which the county road mileage of each
535535 county bears to the entir e state road mileage as certified by the

587587 Transportation Commission and the remaining sixty percent (60%) of
588588 such sum shall be distributed to the various counties on the basis
589589 which the population and area of each county bears to the total
590590 population and area of the state. The population shall be as shown
591591 by the last Federal Decennial Census or the most recent annual
592592 estimate provided by the United States Bureau of the Census. The
593593 funds shall be used for the purpose of constructing and maintaining
594594 county highways; provided, however, the county treasurer may deposit
595595 so much of the funds in the sinking fund as may be necessary for the
596596 retirement of interest and annual accrual of inde btedness created by
597597 the issuance of county or township bonds for road purposes. Such
598598 deposits to the sinking fund shall not exceed forty percent (40%) of
599599 the funds allocated to a county pursuant to this paragraph.
600600 F. 1. The following percentages of the monies referred to in
601601 subsection A of this section shall be remitted to the c ounty
602602 treasurers of the respective counties and by them deposited in a
603603 separate special revenue fund to be used by the county commissioners
604604 in accordance with paragraph 2 of this subsection:
605605 a. from October 1, 2000, until June 30, 2001, two and
606606 fifty-three one-hundredths percent (2.53%),
607607 b. for the year beginning July 1, 2001, and ending June
608608 30, 2002, two and fifty -six one-hundredths percent

677677 apportioned for the fiscal year ending on June 30,
678678 2015, and in no event shall the amount apportioned in
679679 fiscal year 2026 and subsequent fiscal years exceed
680680 the amount apportioned for the fiscal year ending on
681681 June 30, 2025. Any amounts in excess of such
682682 limitation shall be placed to the credit of the
683683 Rebuilding Oklahoma Access and Driver Safety Fund

737737 2. The monies apportioned pursuant to subparagraphs a through e
738738 of paragraph 1 of this subsection shall be used for the primary
739739 purpose of matching federal funds for the construction of federal
740740 aid projects on county roads, or constructing and maintaining county
741741 or township highways and permanent bridges of such counties. The
742742 distribution of monies a pportioned by this paragraph shall be made
743743 upon the basis of the current form ula based upon road mileage, area
744744 and population as related to county road improvement and maintenance
745745 costs. Provided, however, the Department of Transportation may
746746 update the formula factors from time to time as necessary to account
747747 for changing conditions.
748748 G. 1. The following percentages of the monies referred to in
749749 subsection A of this section shall be transmitted by the Oklahoma
750750 Tax Commission to the various counties as set forth in paragraph 2
751751 of this subsection:
752752 a. from October 1, 2000, until June 30, 2001, three and
753753 fifty-five one-hundredths percent (3.55%),
754754 b. for the year beginning July 1, 2001, and ending June
755755 30, 2002, three and fifty -nine one-hundredths percent

823823 to this subparagraph exceed the total amount
824824 apportioned for the fiscal year ending on June 30,
825825 2015, and in no event shall the amount apportioned in
826826 fiscal year 2026 and subsequent fiscal years exceed
827827 the amount apportioned for the fiscal year ending on
828828 June 30, 2025. Any amounts in excess of such
829829 limitation shall be placed to the credit of the

884884 2. The monies apportioned pursuant to subparagraphs a throug h e
885885 of paragraph 1 of this subsection shall be transmitted to the
886886 various counties on the basis of a formula to be developed by the
887887 Department of Transportation. Such formula shall be similar to that
888888 currently used for the distribution of County Bridge Pr ogram funds,
889889 but also taking into consideration the effect of terrain and traffic
890890 volume as related to county road improvement and maintenance costs.
891891 Provided, however, the Department of Transportation may update the
892892 formula factors from time to time as n ecessary to account for
893893 changing conditions. The funds shall be transmitted to the various
894894 county treasurers to be deposited in the county highway fund of
895895 their respective counties.
896896 H. 1. The following percentages of the monies referred to in
897897 subsection A of this section shall be apportioned to the various
898898 counties as set forth in paragraph 2 of this subsection:
899899 a. from October 1, 2000, until June 30, 2001, eighty -one
900900 one-hundredths percent (0.81%),
901901 b. for the year beginning July 1, 2001, and ending June
902902 30, 2002, eighty-two one-hundredths percent (0.82%),
903903 c. for the year beginni ng July 1, 2002, through the year
904904 ending on June 30, 2015, eighty -three one-hundredths

972972 the Rebuilding Oklahoma Access and Driver Safety Fund

10301030 Each county’s allocation of funds shall be remitted to the
10311031 various county treasurers to be deposited in the general fund of the
10321032 county and used for the support of county government.
10331033 I. 1. The following percentages of the monies refe rred to in
10341034 subsection A of this section shall be apportioned to the various
10351035 cities and incorporated towns as set forth in paragraph 2 of this
10361036 subsection:
10371037 a. from October 1, 2000, until June 30, 2001, three and
10381038 four one-hundredths percent (3.04%),
10391039 b. for the year beginning July 1, 2001, and ending June
10401040 30, 2002, three and eight one -hundredths percent
10411041 (3.08%),
10421042 c. for the year beginning July 1, 2002, through the year
10431043 ending on June 30, 2015, three and ten one -hundredths
10441044 percent (3.10%),
10451045 d. for the year beginni ng July 1, 2015, through the year
10461046 ending on June 30, 2019, three and ten one -hundredths
10471047 percent (3.10%), but in no event shall the amount
10481048 apportioned in any fiscal year pursuant to this
10491049 subparagraph exceed the total amount apportioned for
10501050 the fiscal year ending on June 30, 2015. Any amounts
10511051 in excess of such limitation shall be placed to the

11141114 2. The monies apportioned pursuant to subparagraphs a through e
11151115 of paragraph 1 of this subsection shall be apportioned to the
11161116 various cities and incorporated to wns based upon the proportion that
11171117 each city or incorporated town ’s population bears to the total
11181118 population of all cities and incorporated towns in the state. Such
11191119 funds shall be remitted to the various county treasurers for
11201120 allocation to the various cit ies and incorporated towns. All such
11211121 funds shall be used for the construction, maintenance, repair,
11221122 improvement and lighting of streets and alleys. Provided, however,
11231123 the governing board of any city or town may, with the approval of
11241124 the county excise boa rd, transfer any surplus funds to the general
11251125 revenue fund of such city or to wn whenever an emergency requires
11261126 such a transfer.

11801180 Treasurer to be credited to the Oklahoma Law Enforcement Retirement
11811181 Fund:
11821182 1. From October 1, 2000, until June 30, 2001, one and twenty -
11831183 two one-hundredths percent (1.22%);
11841184 2. For the year beginning July 1, 2001, and ending June 30,
11851185 2002, one and twenty -three one-hundredths percent (1.23%); and
11861186 3. For the year beginning July 1, 2002, and a ll subsequent
11871187 years, one and twenty -four one-hundredths percent (1.24%).
11881188 K. Three one-hundredths of one percent (3/100 of 1%) of the
11891189 monies referred to in subsection A of this se ction shall be remitted
11901190 to the State Treasurer to be credited to the Wildlife Conservation
11911191 Fund. Seventy-five percent (75%) of the funds shall be used for
11921192 fish habitat restoration and twenty -five percent (25%) of the funds
11931193 shall be used in the fish hatche ry system for fish production.
11941194 L. 1. For the year beginning July 1, 2007, a nd ending June 30,
11951195 2008, five percent (5%) of monies referred to in subsection A of
11961196 this section shall be remitted to the State Treasurer to be credited
11971197 to the County Improvements for Roads and Bridges Fund as created in
11981198 Section 507 of Title 69 of the Oklahoma Statutes.
11991199 2. For the year beginning July 1, 2008, and ending June 30,
12001200 2009, ten percent (10%) of monies referred to in subsection A of

12601260 4. For the period beginning January 1, 2013, and ending June
12611261 30, 2013, fifteen and fifty one -hundredths percent (15. 50%) of
12621262 monies referred to in subsection A of this section shall be remitted
12631263 to the State Treasurer to be credited to the County Improvements for
12641264 Roads and Bridges Fund as created in Section 507 of Title 69 of the
12651265 Oklahoma Statutes.
12661266 5. For the year beginning July 1, 2013, and ending June 30,
12671267 2014, eighteen percent (18%) of monies referred to in subsection A
12681268 of this section shall be remitted to the State Treasurer to be
12691269 credited to the County Improvements for Roads and Bridges Fund as
12701270 created in Section 507 of Title 69 of the Oklahoma Statutes.
12711271 6. For the year beginning July 1, 2014, twenty percent (20%) of
12721272 monies referred to in subsection A of this section shall be remitted
12731273 to the State Treasurer to be credited to the County Improvements for
12741274 Roads and Bridges Fund as created in Section 507 of Title 69 of the

13351335 Hundred Twenty Million Dollars ($120,000,000.00) shall be placed to
13361336 the credit of the General Reve nue Fund.
13371337 8. a. Except as provided in subparagraph b of this
13381338 paragraph, for the year beginning July 1, 2019, and
13391339 all subsequent years, twenty percent (20%) of monies
13401340 referred to in subsection A of this section shall be
13411341 remitted to the State Treasurer to be credited to the
13421342 County Improvements for Roads and Bridges Fund as
13431343 created in Section 507 of Title 69 of the Oklahoma
13441344 Statutes, but in no event shall the total amount
13451345 apportioned in any fiscal year pursuant to this
13461346 paragraph exceed the fiscal year limitati ons provided
13471347 in subparagraph c of this paragraph Two Hundred

14091409 percent (25%) of the monthly allocation,
14101410 otherwise scheduled to be credited to the County
14111411 Improvements for Roads and Bridges Fund, to the
14121412 various counties of the state. The Commission
14131413 shall distribute such funds monthly to each
14141414 county treasurer as follows:
14151415 (a) one-third (1/3) of such funds shall be
14161416 distributed to the various counties in the
14171417 proportion which the area of each county
14181418 bears to the total area of the state,
14191419 (b) one-third (1/3) of such funds shall be
14201420 distributed to the various counties in the

14221422 miles of each county bear to the total sum

16361636 N. Monies allocated to counties by this section may be
16371637 estimated by the county excise board in the budget for the county as
16381638 anticipated revenue to the extent of ninety percent (90%) of the
16391639 previous year’s income from such source; provided, not more than
16401640 fifteen percent (15%) can be encumbered during any month.
16411641 O. Notwithstanding any other provisions of this section, for
16421642 the fiscal year beginning July 1, 2003 , the first One Hundred
16431643 Thousand Dollars ($100,000.00) of the monies collected or received
16441644 by the Oklahoma Tax Commission pursuant to the registration of
16451645 motorcycles and mopeds in this state shall be placed to the credit
16461646 of the Oklahoma Tax Commission Revolving Fund.
16471647 SECTION 2. This act shall become effective July 1, 2025.
16481648 SECTION 3. It being immediately necessary for the preservation
16491649 of the public peace, health or safety, an emergency is hereby
