4849 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4950 SECTION 1. AMENDATORY 43A O.S. 2021, Section 1 -103, as
5051 last amended by Section 1, Chapter 96, O.S.L. 2024 (43A O.S. Supp.
5152 2024, Section 1-103), is amended to read as follows:
5253 Section 1-103. When used in this title, unless otherwise
5354 expressly stated, or unless the context or subject matter otherwise
5455 requires:
5556 1. “Department” means the Department of Mental Health and
5657 Substance Abuse Services;
5758 2. “Chair” means the chair of the Board of Mental Health and
5859 Substance Abuse Services;
5960 3. “Mental illness” means a substantial disorder of thought,
6061 mood, perception, psychological orientation or memory th at

8789 significantly impairs judgment, behavior, capacity to recognize
8890 reality or ability to meet the ordinary demands of life;
8991 4. “Board” means the Board of Mental Health and Substance Abuse
9092 Services as established by the Mental Health Law;
9193 5. “Commissioner” means the Commissioner of Mental Health and
9294 Substance Abuse Services;
9395 6. “Indigent person” means a person who does not have
9496 sufficient assets or resources to support the person and to support
9597 members of the family of the person lawfully dependent on the person
9698 for support;
9799 7. “Facility” means any hospital, school, building, house or
98100 retreat, authorized by law to have the care, treatment or custody of
99101 an individual with mental illness, drug or alcohol dependency,
100102 gambling addiction, or an eating disorder including, but not limited
101103 to, public or private hospitals, community mental he alth centers,
102104 clinics, satellites, and community -based structured crisis centers;
103105 provided, that facility shall not mean a child guidance center
104106 operated by the State Departmen t of Health;
105107 8. “Consumer” means a person under care or treatment in a
106108 facility pursuant to the Mental Health Law, or in an outpatient
107109 status;
108110 9. “Care and treatment” means medical care and behavioral
109111 health services, as well as food, clothing and mainte nance,

137140 10. Whenever in this law or in any other law, or in any rule or
138141 order made or promulgated pursuant to this law or to any other law,
139142 or in the printed forms prepared for the admission of consumers or
140143 for statistical reports, t he words “insane”, “insanity”, “lunacy”,
141144 “mentally sick”, “mental disease” or “mental disorder” are used,
142145 such terms shall have equal significance to the words “mental
143146 illness”;
144147 11. “Licensed mental health professional ” means:
145148 a. a psychiatrist who is a d iplomate of the American
146149 Board of Psychiatry and Neurology,
147150 b. a psychiatrist who is a diplomate of the American
148151 Osteopathic Board of Neurology and Psychiatry,
149152 c. a physician licensed pursuant to the Oklahoma
150153 Allopathic Medical and Surgical Licensure and
151154 Supervision Act or the Oklahoma Osteopathic Medicine
152155 Act,
153156 d. a clinical psychologist who is duly licensed to
154157 practice by the State Board of Examiners of
155158 Psychologists,
156159 e. a professional counselor licensed pursuant to the
157160 Licensed Professional Counselors Act ,
158161 f. a person licensed as a clinical social worker pursuant
159162 to the provisions of the Social Worker’s Licensing

187191 g. a licensed marital and family therapist as defined in
188192 the Marital and Family Therapist Licensure Act,
189193 h. a licensed behavioral practition er as defined in the
190194 Licensed Behavioral Practitioner Act ,
191195 i. an advanced practice nurse as defined in the Oklahoma
192196 Nursing Practice Act,
193197 j. a physician’s assistant who is licensed in good
194198 standing in this state, or
195199 k. a licensed alcohol and drug counselor /mental health
196200 (LADC/MH) as defined in the Licensed Alcohol and Drug
197201 Counselors Act;
198202 12. “Mentally incompetent person ” means any person who has been
199203 adjudicated mentally or legally incompetent by an appropriate
200204 district court;
201205 13. a. “Person requiring tre atment” means a person who
202206 because of his or her mental illness or drug or
203207 alcohol dependency meets at least one of the
204208 following:
205209 (1) poses a substantial risk of immediate physical
206210 harm to self as manifested by evidence or serious
207211 threats of or attempts a t suicide or other
208212 significant self-inflicted bodily harm,
209213 (2) poses a substantial risk of immediate physical
210214 harm to another person or persons as manifested

237242 by evidence of violent behavior directed toward
238243 another person or persons,
239244 (3) has placed another person or persons in a
240245 reasonable fear of violent behavior directed
241246 towards such person or persons or serious
242247 physical harm to them as manifested by serious
243248 and immediate threats,
244249 (4) is in a condition of severe deterioration that is
245250 continuing, as has bee n observed within the
246251 previous seventy-two (72) hour period such that,
247252 without immediate intervention, there exists a
248253 substantial risk that severe impairment or injury
249254 will result to the person , or
250255 (5) poses a substantial risk of immediate serious
251256 physical injury harm to self or death as
252257 manifested by evidence that the person is unable
253258 to provide for and is not providing for his or
254259 her basic physical needs.
255260 b. To the extent it is reasonably available, the relevant
256261 mental health or substance abuse history of the person
257262 shall be considered and may be proffered as part of
258263 the evidence to determine whether the person is a
259264 person requiring treatment or an assisted outpatient.

287293 person shall not be the sole basis for this
288294 determination.
289295 c. Unless a person also meets the criteria established in
290296 subparagraph a or b of this paragraph, “person
291297 requiring treatment” or an “assisted outpatient” shall
292298 not mean:
293299 (1) a person whose mental processes have been
294300 weakened or impaired by reason of advanced years,
295301 dementia, or Alzheimer ’s disease,
296302 (2) a person with intellectual or developmental
297303 disability as defined in Title 10 of the Oklahoma
298304 Statutes,
299305 (3) a person with seizure disorder, or
300306 (4) a person with a traumatic brain injur y, or
301307 (5) a person who is homeless .
302308 d. (1) A person who meets the criteria established in
303309 this paragraph but who is medically unstable may
304310 be discharged and transported in accordance with
305311 Section 1-110 of this title. Alternatively, if
306312 the facility holding the person is able to treat
307313 the additional medical conditions of that person,
308314 the facility may treat the additional medical
309315 conditions in an effort to medically stabilize
310316 the patient.

337344 (2) If the facility holding the person is unable to
338345 treat the additional medical conditions of a
339346 person who meets the criteria established in this
340347 paragraph, the patient shall be discharged and
341348 transported in accordance with Section 1 -110 of
342349 this title.
343350 (3) All time elapsed during medical stabilization
344351 tolls the twelve (12) h our time for an initial
345352 assessment pursuant to paragraph 1 of subsection
346353 A of Section 5-208 of this title, and the one -
347354 hundred-twenty-hour emergency detention time
348355 pursuant to paragraph 3 of subsection A of
349356 Section 5-208 of this title;
350357 14. “Petitioner” means a person who files a petition alleging
351358 that an individual is a person requiring treatment or an assisted
352359 outpatient;
353360 15. “Executive director” means the person in charge of a
354361 facility as defined in this section;
355362 16. “Private hospital or facility ” means any general hospital
356363 maintaining a neuro-psychiatric unit or ward, or any priv ate
357364 hospital or facility for care and treatment of a person having a
358365 mental illness, which is not supported by the state or federal
359366 government. The term “private hospital” or “facility” shall not

386394 include nursing homes or other facilities maintained primarily for
387395 the care of elderly and disabled persons;
388396 17. “Individualized treatment plan ” means a proposal developed
389397 during the stay of an individual in a facility, under the prov isions
390398 of this title, which is specifically tailored to the treatment needs
391399 of the individual. Each plan shall clearly include the following:
392400 a. a statement of treatment goals or objectives, based
393401 upon and related to a clinical evaluation, which can
394402 be reasonably achieved within a designated time
395403 interval,
396404 b. treatment methods and procedures to be used to obtain
397405 these goals, which methods and procedures are related
398406 to each of these goals and which include specific
399407 prognosis for achieving each of these goal s,
400408 c. identification of the types of professional personnel
401409 who will carry out t he treatment procedures including
402410 appropriate medical or other professional involvement
403411 by a physician or other health professional properly
404412 qualified to fulfill legal requirem ents mandated under
405413 state and federal law,
406414 d. documentation of involvement by the individual
407415 receiving treatment and, if applicable, the accordance
408416 of the individual with the treatment plan, and

435444 e. a statement attesting that the executive director of
436445 the facility or clinical director has made a
437446 reasonable effort to meet the plan ’s individualized
438447 treatment goals in the least restrictive environment
439448 possible closest to the home community of the
440449 individual;
441450 18. “Telemedicine” means technology-enabled health and care
442451 management and delivery systems that extend capacity and access,
443452 which includes:
444453 a. synchronous mechanisms, which may include live
445454 audiovisual interaction between a patient and a health
446455 care professional or real -time provider to provider
447456 consultation through live interactive audiovisual
448457 means,
449458 b. asynchronous mechanisms, which include store and
450459 forward transfers, online exchange of health
451460 information between a patient and a health care
452461 professional and online exchange of health information
453462 between health care professionals, but shall not
454463 include the use of automated text messages or
455464 automated mobile applications that serve as the sole
456465 interaction between a patient and a health care
457466 professional,
458467 c. remote patient monitoring, and

485495 d. other electronic means that support clinical health
486496 care, professional consultation, patient and
487497 professional health-related education, public health
488498 and health administration;
489499 19. “Recovery and recovery support ” means nonclinical services
490500 that assist individuals and famil ies to recover from alcohol or drug
491501 problems. They include social support, linkage to and coordination
492502 among allied service providers including but not limited to
493503 transportation to and from treatment or employment, employment
494504 services and job training, ca se management and individual services
495505 coordination, life skills education, relap se prevention, housing
496506 assistance, child care, and substance abuse education;
497507 20. “Assisted outpatient” means a person who:
498508 a. is either currently under the care of a facility
499509 certified by the Department of Mental Health and
500510 Substance Abuse Services as a Community Mental Health
501511 Center, or is being discharged from the custody of the
502512 Oklahoma Department of Corrections, or is being
503513 discharged from a residential placement by the Of fice
504514 of Juvenile Affairs,
505515 b. is suffering from a mental illness,
506516 c. is unlikely to survive safely in the community without
507517 supervision, based on a clinical determination,

534545 d. has a history of lack of compliance with treatment for
535546 mental illness that has:
536547 (1) prior to the filing of a petition, at least twice
537548 within the last thirty -six (36) months been a
538549 significant factor in necessitating
539550 hospitalization or treatment in a hospital or
540551 residential facility including admission to a
541552 community-based structured cri sis center as
542553 certified by the Oklahoma Department of Mental
543554 Health and Substance Abuse Services, or receipt
544555 of services in a forensic or other mental health
545556 unit of a correctional facility, or a specialized
546557 treatment plan for treatment of mental illness i n
547558 a secure juvenile facility or placement in a
548559 specialized residential program for juveniles, or
549560 (2) prior to the filing of the petition, resulted in
550561 one or more acts of serious violent behavior
551562 toward self or others or threats of, or attempts
552563 at, serious physical harm to self or others
553564 within the last twenty-four (24) thirty-six (36)
554565 months,
555566 e. is, as a result of his or her mental illness, unlikely
556567 to voluntarily participate in outpatient treatment

583595 that would enable him or her to live safely in the
584596 community,
585597 f. in view of his or her treatment history and current
586598 behavior, is in need of assisted outpatient treatment
587599 in order to prevent a relapse or deterioration which
588600 would be likely to result in serious harm to the
589601 person or persons as defined in this sect ion, and
590602 g. is likely to benefit from assisted outpatient
591603 treatment;
592604 21. “Assisted outpatient treatment ” means outpatient services
593605 which have been ordered by the court pursuant to a treatment plan
594606 approved by the court to treat an assisted outpatient ’s mental
595607 illness and to assist the person in living and functioning in the
596608 community, or to attempt to prevent a relapse or deterioration that
597609 may reasonably be predicted to result in suicide or the need for
598610 hospitalization; and
599611 22. “Urgent recovery clinic ” means a clinic that offers
600612 voluntary services aimed at the assessment and immedia te
601613 stabilization of acute symptoms of mental illness, alcohol and other
602614 drug abuse, and emotional distress. Unless the person receiving
603615 treatment consents to a longer duration or unless the person is
604616 placed into emergency detention under Sections 5 -206 through 5-209
605617 of this title, no more than twenty -three (23) hours and fifty -nine
