154 | 154 | | 3. Institutions of higher education within The Oklahoma State |

155 | 155 | | System of Higher Education should seek and foster intellectual |
---|
156 | 156 | | diversity among administrators, f aculty, students, and employees; |
---|
157 | 157 | | 4. Positively or negatively incentivizing, i nformally |
---|
158 | 158 | | pressuring, or otherwise compelling students or employees of |
---|
159 | 159 | | institutions of higher education within The Oklahoma State System of |
---|
160 | 160 | | Higher Education to embrace divisive c oncepts is contrary to the |
---|
161 | 161 | | mutual respect and collegial processes essential to the free |
---|
162 | 162 | | exchange of ideas; |

163 | 163 | | 5. Measures taken to ensure nondiscrimination cannot be allowed |
---|
164 | 164 | | to undermine the principles of merit and excellence in the core |
---|
165 | 165 | | activities of instit utions of higher education within The Oklahoma |
---|
166 | 166 | | State System of Higher Educatio n; and |
---|
167 | 167 | | 6. Increased institutional transparency and oversight are |

168 | 168 | | needed to lessen the risk of diminished excellence resulting from |

224 | 224 | | A. This act shall be known and may be cited as the “Oklahoma |
---|
225 | 225 | | Higher Education Freedom of Expression and Transparency Act ”. |
---|
226 | 226 | | B. For the purposes of this section : |
---|
227 | 227 | | 1. “Divisive concept” means a concept that: |
---|
228 | 228 | | a. one race or sex is inherently superior to another race |
---|
229 | 229 | | or sex, |
---|
230 | 230 | | b. an individual, by virtue of his or her race or sex, is |
---|
231 | 231 | | inherently racist, sexist , or oppressive, whether |
---|
232 | 232 | | consciously or unconsciously, |
---|
233 | 233 | | c. an individual should be discriminated against or |
---|
234 | 234 | | receive adverse treatment solely or partly because of |
---|
235 | 235 | | his or her race or sex, |
---|
236 | 236 | | d. members of one race or sex cannot and should not |
---|
237 | 237 | | attempt to treat others without respect to r ace or |
---|
238 | 238 | | sex, |
---|
239 | 239 | | e. an individual’s moral character is necessarily |
---|
240 | 240 | | determined by his or her race or sex, and |
---|
241 | 241 | | f. an individual, by virtue of his or her race or sex, |
---|

---|
296 | 296 | | higher education within The Oklahoma State System of Higher |
---|

298 | 298 | | C. For purposes of approving or scheduling usage of an |
---|
299 | 299 | | institution of higher education ’s property, an institution of hig her |
---|
300 | 300 | | education shall not show bias or favoritism: |
---|
301 | 301 | | 1. Based upon a guest speaker ’s or a guest speaker ’s student- |
---|
302 | 302 | | sponsoring group’s viewpoint, race, creed, color, religion, |
---|
303 | 303 | | nonviolent political ideology, or nonviolent political party |
---|
304 | 304 | | affiliation; or |
---|
305 | 305 | | 2. For a student group that, or a guest speaker who, intends to |
---|
306 | 306 | | maintain a peaceful campus presence and peaceful use of the |
---|
307 | 307 | | institution of higher education ’s property because the instit ution |
---|
308 | 308 | | of higher education receives threatened simple breaches of the peace |
---|
309 | 309 | | or nondestructive disruptions from groups or individuals who oppose |
---|
310 | 310 | | the student group’s or guest speaker’s presence on campus. |
---|
311 | 311 | | D. An institution of higher education shall not: |
---|
312 | 312 | | 1. Require a student group to pay fees or security deposits |
---|
313 | 313 | | that are not charged to all other student groups; or |
---|
314 | 314 | | 2. Deny a student group access to the institution of higher |
---|
315 | 315 | | education’s property, if the property is routinely used by other |
---|
316 | 316 | | student groups. |
---|
317 | 317 | | E. Notwithstanding the provisions of subsection C of this |
---|
318 | 318 | | section, an institution of higher education may restrict or deny use |
---|

374 | 374 | | F. 1. To assess the extent to which a divisive concept may |
---|
375 | 375 | | have been included or has otherwise affected curriculum, beginning |
---|
376 | 376 | | with the 2025-2026 academic year, each institution of higher |
---|
377 | 377 | | education shall publish a current syllabus for each course offered |
---|
378 | 378 | | in the current semester on the institution of higher education ’s |
---|
379 | 379 | | website no later than the seventh business day following the first |
---|
380 | 380 | | day of class for the s emester. |
---|
381 | 381 | | 2. Each syllabus published pursuant to paragraph 1 of this |
---|
382 | 382 | | subsection shall include , but not be limited to : |
---|
383 | 383 | | a. the title and catalog description of the course, |
---|
384 | 384 | | b. the course instructor ’s name, |
---|
385 | 385 | | c. the course’s required or elective status for relev ant |
---|
386 | 386 | | majors or general education, |
---|
387 | 387 | | d. a brief description of each assignment, ex amination, |
---|
388 | 388 | | lecture, discussion, or other class activity, |
---|
389 | 389 | | e. the title of each book that is assigned or recommended |
---|
390 | 390 | | for the course including any textbook or workbook, and |
---|
391 | 391 | | f. the final grades for the three (3) most recent |
---|
392 | 392 | | semesters during which the course was offered. |

---|
445 | 445 | | been affected by the inclusion of a divisive concept in the student |
---|
446 | 446 | | learning experience, the Oklahoma Stat e Regents for Higher Education |
---|
447 | 447 | | shall promulgate rules to require institutions of higher education |
---|
448 | 448 | | to submit data and information requested by the State Regents in a |
---|
449 | 449 | | standardized format to allow the State Regents to provide an online |
---|
450 | 450 | | organized data compilat ion that details the following: |
---|
451 | 451 | | 1. The number of students who completed a program at the |
---|
452 | 452 | | institution of higher education for the three (3) most recent |
---|
453 | 453 | | academic years, disaggregated by underserved minority students; and |
---|
454 | 454 | | 2. Results for students identified in paragraph 1 of this |
---|
455 | 455 | | subsection on nationally recognized assessments that as sess a |
---|
456 | 456 | | student’s readiness for postsecondary education, if available to the |
---|
457 | 457 | | institution of higher education, and such students ’ final grade |
---|
458 | 458 | | point average at the institution of hi gher education. |
---|
459 | 459 | | H. The Oklahoma State Regents for Higher Education shall |
---|
460 | 460 | | promulgate rules to implement the provisions of this section. The |
---|
461 | 461 | | rules shall: |
---|
462 | 462 | | 1. Establish a process by which a student enrolled in or an |
---|
463 | 463 | | employee of an institution of higher educ ation may submit a |
---|
464 | 464 | | complaint of an alleged violation of the provisions of this section |
---|
465 | 465 | | to the institution; |
