8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law not to be
9191 codified in the Oklahoma Statutes reads as f ollows:
9292 The Legislature finds that:
9393 1. Freedom of expression and inquiry at institutions of higher
9494 education within The Oklahoma State System of Higher Education are

147147 furtherance of the ordered individual liberty established in this
148148 nation’s founding documents;
149149 2. Institutions of higher education within The Oklahoma State
150150 System of Higher Education have a duty to promote and defend freedom
151151 of expression and inquiry and the societal consensus on the ordered
152152 individual liberty established in this nation’s founding documents
153153 that sustain it;
154154 3. Institutions of higher education within The Oklahoma State
155155 System of Higher Education should seek and foster intellectual
156156 diversity among administrators, f aculty, students, and employees;
157157 4. Positively or negatively incentivizing, i nformally
158158 pressuring, or otherwise compelling students or employees of
159159 institutions of higher education within The Oklahoma State System of
160160 Higher Education to embrace divisive c oncepts is contrary to the
161161 mutual respect and collegial processes essential to the free
162162 exchange of ideas;
163163 5. Measures taken to ensure nondiscrimination cannot be allowed
164164 to undermine the principles of merit and excellence in the core
165165 activities of instit utions of higher education within The Oklahoma
166166 State System of Higher Educatio n; and
167167 6. Increased institutional transparency and oversight are
168168 needed to lessen the risk of diminished excellence resulting from
169169 the imposition or advocacy of divisive concept s.

221221 SECTION 2. NEW LAW A new section of law to be codified
222222 in the Oklahoma Statutes as Section 3205.15 of Title 70, unless
223223 there is created a duplication in numbering, reads as follows:
224224 A. This act shall be known and may be cited as the “Oklahoma
225225 Higher Education Freedom of Expression and Transparency Act ”.
226226 B. For the purposes of this section :
227227 1. “Divisive concept” means a concept that:
228228 a. one race or sex is inherently superior to another race
229229 or sex,
230230 b. an individual, by virtue of his or her race or sex, is
231231 inherently racist, sexist , or oppressive, whether
232232 consciously or unconsciously,
233233 c. an individual should be discriminated against or
234234 receive adverse treatment solely or partly because of
235235 his or her race or sex,
236236 d. members of one race or sex cannot and should not
237237 attempt to treat others without respect to r ace or
238238 sex,
239239 e. an individual’s moral character is necessarily
240240 determined by his or her race or sex, and
241241 f. an individual, by virtue of his or her race or sex,
242242 bears responsibility for actions committed in the past
243243 by other members of the same race or sex; and

295295 2. “Institution of higher education ” means institutions of
296296 higher education within The Oklahoma State System of Higher
297297 Education.
298298 C. For purposes of approving or scheduling usage of an
299299 institution of higher education ’s property, an institution of hig her
300300 education shall not show bias or favoritism:
301301 1. Based upon a guest speaker ’s or a guest speaker ’s student-
302302 sponsoring group’s viewpoint, race, creed, color, religion,
303303 nonviolent political ideology, or nonviolent political party
304304 affiliation; or
305305 2. For a student group that, or a guest speaker who, intends to
306306 maintain a peaceful campus presence and peaceful use of the
307307 institution of higher education ’s property because the instit ution
308308 of higher education receives threatened simple breaches of the peace
309309 or nondestructive disruptions from groups or individuals who oppose
310310 the student group’s or guest speaker’s presence on campus.
311311 D. An institution of higher education shall not:
312312 1. Require a student group to pay fees or security deposits
313313 that are not charged to all other student groups; or
314314 2. Deny a student group access to the institution of higher
315315 education’s property, if the property is routinely used by other
316316 student groups.
317317 E. Notwithstanding the provisions of subsection C of this
318318 section, an institution of higher education may restrict or deny use

371371 displays, organized public gatherings, or public demonstrations if
372372 the display, gathering, or demonstration would violate Section 1021
373373 of Title 21 of the Oklahoma Statutes.
374374 F. 1. To assess the extent to which a divisive concept may
375375 have been included or has otherwise affected curriculum, beginning
376376 with the 2025-2026 academic year, each institution of higher
377377 education shall publish a current syllabus for each course offered
378378 in the current semester on the institution of higher education ’s
379379 website no later than the seventh business day following the first
380380 day of class for the s emester.
381381 2. Each syllabus published pursuant to paragraph 1 of this
382382 subsection shall include , but not be limited to :
383383 a. the title and catalog description of the course,
384384 b. the course instructor ’s name,
385385 c. the course’s required or elective status for relev ant
386386 majors or general education,
387387 d. a brief description of each assignment, ex amination,
388388 lecture, discussion, or other class activity,
389389 e. the title of each book that is assigned or recommended
390390 for the course including any textbook or workbook, and
391391 f. the final grades for the three (3) most recent
392392 semesters during which the course was offered.

444444 G. To assess the extent to which learning outcomes may have
445445 been affected by the inclusion of a divisive concept in the student
446446 learning experience, the Oklahoma Stat e Regents for Higher Education
447447 shall promulgate rules to require institutions of higher education
448448 to submit data and information requested by the State Regents in a
449449 standardized format to allow the State Regents to provide an online
450450 organized data compilat ion that details the following:
451451 1. The number of students who completed a program at the
452452 institution of higher education for the three (3) most recent
453453 academic years, disaggregated by underserved minority students; and
454454 2. Results for students identified in paragraph 1 of this
455455 subsection on nationally recognized assessments that as sess a
456456 student’s readiness for postsecondary education, if available to the
457457 institution of higher education, and such students ’ final grade
458458 point average at the institution of hi gher education.
459459 H. The Oklahoma State Regents for Higher Education shall
460460 promulgate rules to implement the provisions of this section. The
461461 rules shall:
462462 1. Establish a process by which a student enrolled in or an
463463 employee of an institution of higher educ ation may submit a
464464 complaint of an alleged violation of the provisions of this section

517517 2. Require each institution of higher education that receives a
518518 complaint pursuant to paragraph 1 of this subsection to investigate
519519 the report;
520520 3. Create a corrective action plan for an institution of higher
521521 education that is found to have violated the provisions of this
522522 section; and
523523 4. Create a reporting requirement for complaints filed, the
524524 findings of resulting investigations, and any corrective action
525525 plans developed pursuant to this subsection.
526526 SECTION 3. This act shall become effective July 1, 2025.
527527 SECTION 4. It being immediately necessary for the preservation
528528 of the public peace, health, or safety, an emergen cy is hereby
529529 declared to exist, by reason whereof this act shall take effect and
530530 be in full force from and after its passage and approval.
