5177 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5278 SECTION 1. AMENDATORY 43 O.S. 2021, Secti on 110, as
5379 amended by Section 3, Chapter 189, O.S.L. 2024 (43 O.S. Supp. 2024,
5480 Section 110), is amended to read as follows:
5581 Section 110. A. 1. Except as otherwise provided by this
5682 subsection, upon the filing of a petition for dissolution of
5783 marriage, annulment of a marriage or legal separation by the
5884 petitioner and upon personal service of the petition and summons on
5985 the respondent, or upon waiver and acceptance of service by t he
6086 respondent, an automatic temporary injunction shall be in effect
6187 against both parties pursuant to the provisions of this section:
62-a. restraining the parties from transferring,
63-encumbering, concealing, or in any way disposing of,

140+encumbering, concealing, or in any way disposing of,
91141 without the written cons ent of the other party or an
92142 order of the court, any marital property, except in
93143 the usual course of business, for the purpose of
94144 retaining an attorney for the case or for the
95145 necessities of life and requiring each party to notify
96146 the other party of any pr oposed extraordinary
97147 expenditures and to account to the court for all
98148 extraordinary expenditures made after the injunction
99149 is in effect,
100150 b. restraining the parties from:
101151 (1) intentionally or knowingly damaging or destroying
102152 the tangible property of the par ties, or of
103153 either of them, specifically including, but not
104154 limited to, any electronically stored materials,
105155 electronic communications, social network data,
106156 financial records, and any document that
107157 represents or embodies anything of value,
108158 (2) making any withdrawal for any purpose from any
109159 retirement, profit-sharing, pension, death, or
110160 other employee benefit plan or employee savings
111161 plan or from any individual retirement account or
112162 Keogh account,

215+part of the cash surrender value of any life
142216 insurance policies on either party or their
143217 children,
144218 (4) changing or in any manner altering the
145219 beneficiary designation on any life insurance
146220 policies on the life of either party or any of
147221 their children,
148222 (5) canceling, altering, or in any manner affecting
149223 any casualty, automobile, or health in surance
150224 policies insuring the parties ’ property or
151225 persons,
152226 (6) opening or diverting mail addressed to the other
153227 party, and
154228 (7) signing or endorsing the other party ’s name on
155229 any negotiable instrument, check, or draft, such
156230 as tax refunds, insurance payments, and
157231 dividends, or attempting to negotiate any
158232 negotiable instruments payable to either party
159233 without the personal signature of the other
160234 party,
161235 c. requiring the parties to ma intain all presently
162236 existing health, property, life and other insurance
163237 which the individual is presently carrying on any
164-member of this family unit, and to cooperate as
165-necessary in the filing and processing of claims. Any

289+member of this family unit, and to cooperate as
290+necessary in the filing and processing of claims. Any
193291 employer-provided health insur ance currently in
194292 existence shall remain in full force and effect for
195293 all family members,
196294 d. enjoining both parties from molesting or disturbing
197295 the peace of the other party or of the children to the
198296 marriage,
199297 e. restraining both parties from disrupting or
200298 withdrawing their children from an educational
201299 facility and programs where th e children historically
202300 have been enrolled, or day care,
203301 f. restraining both parties from hiding or secreting
204302 their children from the other party,
205303 g. restraining both parties fro m removing the minor
206304 children of the parties, if any, beyond the
207305 jurisdiction of the State of Oklahoma, acting directly
208306 or in concert with others, except for vacations of two
209307 (2) weeks or less duration, without the prior written
210308 consent of the other party, which shall not be
211309 unreasonably withheld, and
212310 h. requiring, unless otherwise agreed upon by the parties
213311 in writing, the delivery by each party to the other
214312 within thirty (30) days from the earlier of either the
215-date of service of the summons or the filing of an

364+date of service of the summons or the filing of an
243365 initial pleading by the respondent, the following
244366 documents:
245367 (1) the federal and state income tax returns of each
246368 party for the past two (2) years and any
247369 nonpublic, limited partnership and privately held
248370 corporate returns for any entity in which ei ther
249371 party has an interest, together with all
250372 supporting documentation for the tax returns,
251373 including but not limited to W -2 forms, 1099
252374 forms, K-1 forms, Schedule C and Schedule E. If
253375 a return is not completed at the time of
254376 disclosure, the parties shall provide the
255377 documents necessary to prepare the tax return of
256378 the party, to include W -2 forms, 1099 forms, K -1
257379 forms, copies of extension requests and estimated
258380 tax payments,
259381 (2) two (2) months of the most recent pay stubs from
260382 each employer for whom the p arty worked,
261383 (3) statements for the past six (6) months for all
262384 bank accounts held in the name of either party
263385 individually or jointly, or in the name of
264386 another person for the benefit of either party,
265-or held by either party for the benefit of the
266-minor child or children of the parties,

438+or held by either party for the benefit of the
439+minor child or children of the parties,
294440 (4) documentation regarding the cost and nature of
295441 available health insurance coverage for the
296442 benefit of either party or the minor child or
297443 children of the parties,
298444 (5) documentation regarding the cost and nature of
299445 employment or educationally related child care
300446 expenses incurred for the benefit of the minor
301447 child or children of the parties, and
302448 (6) documentation regarding all debts in the name of
303449 either party individually or jointly, showing the
304450 most recent balance due and payment terms.
305451 2. If either party is not in possession of a document required
306452 pursuant to subparagraph h of paragraph 1 of this subsection or has
307453 not been able to obtain the document in a timely fashion, the party
308454 shall state in verified writing, under t he penalty of perjury, the
309455 specific document which is not available, the reaso ns the document
310456 is not available, and what efforts have been made to obtain the
311457 document. As more information becomes available, there is a
312458 continuing duty to supplement the dis closures.
313459 3. Nothing in this subsection shall prohibit a party from
314460 conducting further discovery pursuant to the Oklahoma Discovery
315461 Code.
316-4. a. The provisions of the automatic temporary injunction

513+4. a. The provisions of the automatic temporary injunction
514+shall be printed as an attachment to the summons and
345515 the petition and entitled “Automatic Temporary
346516 Injunction Notice”.
347517 b. The automatic temporary injunction notice shall
348518 contain a provision which will allow the parties to
349519 waive the automatic temporary injunction. In
350520 addition, the provision must state that unles s both
351521 parties have agreed and have signed their names in the
352522 space provided, that the automatic temporary
353523 injunction will be effective. Along with the waiver
354524 provision, the notice shall contain a check box and
355525 space available for the signatures of the pa rties.
356526 5. The automatic temporary injunction shall become an order of
357527 the court upon fulfillment of the requirements of paragraph 1 of
358528 this subsection unless and until:
359529 a. the automatic temporary injunction is waived by the
360530 parties. Both parties must ind icate on the automatic
361531 temporary injunction notice in the space provided that
362532 the parties have both agreed to waive the automatic
363533 temporary injunction. Each party must sign his or her
364534 own name on the notice in the space provided, or
365535 b. a party, no later than three (3) days after service on
366536 the party, files an objection to the injun ction and
367-requests a hearing. Provided, the automatic temporary

588+requests a hearing. Provided, the automatic temporary
395589 injunction shall remain in effect until the hearing
396590 and a judge orders the injunction removed.
397591 6. The automatic temporary injunction shall be dissolved upon
398592 the granting of the dissolution of marriage, final order of legal
399593 separation or other final order.
400594 7. Nothing in this subsection shall preclude either party from
401595 applying to the court for further temporary orde rs, pursuant to this
402596 section, an expanded automatic temporary injunction, or m odification
403597 or revocation thereto.
404598 8. a. With regard to an automatic temporary injunction, when
405599 a petition for dissolution of marriage, annulment of a
406600 marriage, or a legal separa tion is filed and served, a
407601 peace officer shall use every reasonable means to
408602 enforce the injunction which enjoins both parties from
409603 molesting or disturbing the peace of the other party
410604 or the children of the marriage against a petitioner
411605 or respondent, whenever:
412606 (1) there is exhibited by a respondent or by the
413607 petitioner to the pea ce officer a copy of the
414608 petition or summons, with an attached Temporary
415609 Injunction Notice, duly filed and issued pursuant
416610 to this section, together with a certified copy
417611 of the affidavit of service of process or a

445663 certified copy of the waiver and acceptance of
446664 service, and
447665 (2) the peace officer has cause to believe that a
448666 violation of the automatic temporary injunction
449667 has occurred.
450668 b. A peace officer shall not be held civilly or
451669 criminally liable for his or her action pursuant to
452670 this paragraph if his or her action is in good faith
453671 and without malice.
454672 B. After a petition has been filed in an action for dissolution
455673 of marriage or legal separation either party may request the cour t
456674 to issue:
457675 1. A temporary order:
458676 a. regarding child custody, support or visitation,
459677 b. regarding spousal maintenance,
460678 c. regarding payment of debt,
461679 d. regarding possession of property,
462680 e. regarding attorney fees, and
463681 f. providing other injunctive relief proper in the
464682 circumstances.
465683 All applications for temporary orders shall set f orth the
466684 factual basis for the application and shall be verified by the party
467685 seeking relief. The application and a notice of hearing shall be

495737 served on the other party in any m anner provided for in the Rules of
496738 Civil Procedure;
497739 2. A temporary order. If domestic abuse is not alleged, when
498740 setting a hearing to enter temporary orders, the court shall conduct
499741 a substantive hearing and issue a ruling on custody, visitation,
500742 child support, and other ancillary matters, including property. The
501743 court shall schedule the hearing to take place within thirty (30)
502744 days from the date that the application for temporary orders is
503745 presented to the court for scheduling by the moving party, unles s
504746 the parties agree in writing to waive this requirement, and said
505747 agreement is memorialized by an order of the court. The moving
506748 party shall provide at least five (5) days ’ notice of hearing to the
507749 nonmoving party;
508750 3. A temporary order. In an applicati on for a temporary order,
509751 any party alleging acts of domestic abuse, as define d by Section 109
510752 of this title, against the other party, or the minor child or
511753 children at issue and either of the following are present:
512754 a. the moving party has been granted a t emporary or
513755 permanent order of protection against the other party
514756 for domestic abuse committed against the moving party
515757 or the minor child or children at issue, or
516758 b. the party against whom domestic violence has been
517759 alleged has been charged in any crimina l proceeding,
518760 within the past five (5) years, with an act of

546812 domestic abuse wherein the moving party or a child of
547813 the party alleging domestic abuse is the victim,
548814 the court shall set a hearing upon application within ten (10) days
549815 of filing from the date that the application for a temporary order
550816 is presented to the court for scheduling by the moving party , with
551817 the moving party providing five (5) days ’ notice of hearing to the
552818 nonmoving party unless waived by both parties, and memorialized by
553819 an order of the court. The court shall conduct a substantive
554820 hearing and issue a ruling o n custody, visitation, child support,
555821 and other ancillary matters, including property. The requesting
556822 party shall attach a certified copy of the emergency protective
557823 order, probable cause affidavit, or charging information, if
558824 available, to the temporary orders application; and
559825 4. A temporary restraining order. If the court finds on the
560826 basis of a verified application and testimony of witnesses that
561827 irreparable harm will result to the moving party, or a child of a
562828 party if no order is issued before the a dverse party or attorney for
563829 the adverse party can be heard in opposition, the court may issue a
564830 temporary restraining order which shall become immediately effective
565831 and enforceable without requiring notice and opportunity to be heard
566832 to the other party. Provided, for the purposes of this section, no
567833 minor child or children temporarily residing in a licensed,
568834 certified domestic violence shelter in the state shall be removed by
569835 an ex parte order. If a temporary restraining order is issued

597887 pursuant to this paragraph, the motion for a temporary order shall
598888 be set within ten (10) days, but such hearing shall not be heard
599889 unless five (5) days ’ notice of hearing is given to the other p arty.
600890 C. Any temporary orders and the automatic temporary injunction,
601891 or specific terms thereof, may be vacated or modified prior to or in
602892 conjunction with a final decree on a showing by either party of
603893 facts necessary for vacation or modification. Tempo rary orders and
604894 the automatic temporary injunction terminate when the final ju dgment
605895 on all issues, except attorney fees and costs, is rendered or when
606896 the action is dismissed. The court may reserve jurisdiction to rule
607897 on an application for a contempt ci tation for a violation of a
608898 temporary order or the automatic temporary injunction which is filed
609899 any time prior to the time the temporary order or injunction
610900 terminates.
611901 D. Upon granting a decree of dissolution of marriage, annulment
612902 of a marriage, or leg al separation, the court may require either
613903 party to pay such reasonable expen ses of the other as may be just
614904 and proper under the circumstances.
615905 E. The court may in its discretion make additional orders
616906 relative to the expenses of any such subsequent act ions, including
617907 but not limited to writs of habeas corpus, brought by the parties or
618908 their attorneys, for the enforcement or modification of any
619909 interlocutory or final orders in the dissolution of marriage action
620910 made for the benefit of either party or the ir respective attorneys.
