8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified

9393 The Interstate Dental and Dental Hygiene Compact is hereby
9494 enacted into law and the Governor shall enter into the Compact on

148148 SECTION 2. NEW LAW A new section of law to be codified
149149 in the Oklahoma Statutes as Section 329.2 of Title 59, unless there
150150 is created a duplication in number ing, reads as follows:
151151 INTERSTATE DENTAL AND DENTAL HYGIENE COMPACT
152152 A. This Compact shall be known as the Interstate Dental and
153153 Dental Hygiene Compact. The purpose of the Compact is to expedite
154154 licensure and increase access to dental health care through state
155155 licensing agencies acting in cooperation. The Compact adopts the
156156 existing structures most utilized by state licensing agencies across
157157 the United States, while ensuring the safety of the public through
158158 the sharing of documents and information. The C ompact ensures that
159159 each state retains the right to impose an adverse action on a
160160 licensee as a home state or as a practicing state. Each state has
161161 an opportunity to share investigations and information with the home
162162 state of licensure. The Compact is ad ministered by state licensing
163163 agencies, thus allowing for each state to mainta in its sovereignty.
164164 B. The Interstate Dental and Dental Hygiene Compact:
165165 1. Allows for expedited licensure portability and ease of
166166 movement between states;
167167 2. Allows each stat e to continue to regulate the practice of
168168 dentistry and dental hygiene within its borders and maintain its
169169 sovereignty by allowing actions against a Compact license privilege

222222 allowing for Compact licensure privileges;
223223 3. Creates a common goal of protecting the pub lic by ensuring a
224224 uniform licensure standard and the sharing of information in the
225225 Compact;
226226 4. Allows for licensure in every participating state by passing
227227 a uniform licensure e xamination that tests psychomotor and cognitive
228228 dental skills exam that is currently accepted in fifty state
229229 licensing jurisdictions and United States territories;
230230 5. Gives licensees one location to maintain professional
231231 documentation to expedite Compact license privileges in member
232232 states;
233233 6. Facilitates a faster licensure proces s for relocation or
234234 separation of military members and their dependent spouses. There
235235 are no Compact fees for military members or their spouses;
236236 7. Alleviates a duplicative pro cess for licensure among
237237 multiple states;
238238 8. Saves applicants money by not having to obtain duplicate
239239 documents from a source that charges for the documents; and
240240 9. Utilizes existing infrastructure of the American Association
241241 of Dental Boards, which has been in existence for over one hundred
242242 (100) years representing dental licensi ng agencies.

297297 As used in this act:
298298 1. “AADB” means the American Association of Dental Boards or
299299 its named successor, formerly known as the American Association of
300300 Dental Examiners (AADE), originally chartered on September 10, 1896 ,
301301 and renewed in 1944, comprised of state dental licensing agencies in
302302 the United States and its territories;
303303 2. “Active-duty military member ” means an individual in full -
304304 time active-duty status in the active uniformed service of the
305305 United States includi ng members of the National Guard and Reserve.
306306 The legal spouse of the military member must be recognized by the
307307 military unit as a dependent while the service member is on active
308308 duty. Spouses shall receive the same privileges as military members
309309 for the purpose of this Compact;
310310 3. “Active investigation ” means an active investiga tion
311311 resulting in formal allegations or charges precipitating a judicial
312312 process by a licensing agency, oversight agency, or other law
313313 enforcement entity;
314314 4. “Adverse action” means an order issued by a state licensing
315315 agency or reported to the clearinghouse pursuant to the Compact
316316 bylaws and rules. The term includes, but is not limited to, a

368368 temporary emergency or substantially equivalent action, even when
369369 such order is later wi thdrawn by a licensing agency;
370370 5. “ADEX examination” means the American Board of Dental
371371 Examiners examination;
372372 6. “Bylaws” means the bylaws passed by the Compact Commission;
373373 7. “Clearinghouse” means the AADB clearinghouse and databank,
374374 or its successor entity, that houses prior adverse actions, orders,
375375 and denials of licensure or permits from state licensing agencies in
376376 the United States and its territories;
377377 8. “CODA” means the Commission on Dental Accreditation or its
378378 successor as approved by the Unite d States Department of Education;
379379 9. “Compact” means the Interstate Dental an d Dental Hygiene
380380 Compact;
381381 10. “Compact Commission” or “Commission” means the Interstate
382382 Dental and Dental Hygiene Compact Commission created pursuant to
383383 Section 4 of this Compac t;
384384 11. “Compact Commission Attorneys ’ Committee” means attorneys
385385 that currently represent a state licensing agency. The Attorneys ’
386386 Committee participates in the commission as a nonvoting member. An
387387 attorney that has previously served as an attorney for a state
388388 licensing agency may be invited on a year -to-year basis to serve on
389389 the committee if they have not engaged in an official case against a
390390 licensing agency of a Compact member state or have any other
391391 conflict of interest. The Attorneys ’ Committee may assist the

443443 investigators in working through joint investigation issues between
444444 states. The Attorneys ’ Committee shall prepare a summary of legal
445445 issues directly dealing with the Compacts at the annual meeting as
446446 well as a legal update for issues affecti ng member state licensing
447447 agencies;
448448 12. “Compact license privilege ” means the expedited dental or
449449 dental hygiene license to practice in a member state that differs
450450 from the licensee’s home state;
451451 13. “Conviction” means an adjudication or formal judgment by a
452452 court that an individual is guilty through a plea of guilty or no
453453 contest, or a finding of guilt by the court. Evidence of a
454454 conviction of a criminal offense by the court shall be considered
455455 final for the purposes of disciplinary action by a licensin g agency;
456456 14. “Criminal background check ” means a dentist or dental
457457 hygienist seeking Compact license privileges shall complete and
458458 provide a criminal background check, including the use of the
459459 results of fingerprint or other biometric data checks complia nt with
460460 the requirements of the Federal Bureau of Investigation, with the
461461 exception of federal employees who have suitability determination in
462462 accordance with 5 C.F.R., Section 731.202;
463463 15. “Dental hygienist” means any person who:
464464 a. has successfully grad uated from a CODA approved dental
465465 hygiene school,

518518 Examiners (ADEX) licensure exam, or has been in
519519 practice five (5) years or more and has successfully
520520 passed a regional or equivalent state -administered
521521 psychomotor licensure examination prior to January 1,
522522 2024,
523523 c. has successfully passed the written national dental
524524 hygiene board examination administered by the Joint
525525 Commission on National Dental Examinations,
526526 d. possesses a full and unrestricted dental hygiene
527527 license issued by a member state of the Compact,
528528 e. has never been convicted, received adjudication,
529529 deferred adjudication, community supervision, or
530530 deferred disposition for any offense by a court of
531531 appropriate jurisdiction,
532532 f. has never been a subject of discipline by a licensing
533533 agency through any adverse action, order, or other
534534 restriction of the licensee by the licensing agency
535535 with the exception of failure to pay fees or failure
536536 to complete continuing education,
537537 g. is not currently under act ive investigation by a
538538 licensing agency or law enforcement authority in any
539539 state, federal, or foreign jurisdiction, and

591591 h. meets any jurisprudence requirement established by a
592592 member state licensing agency in which a licensee is
593593 seeking a Compact privileg e expedited license;
594594 16. “Dental Practice Act” means the laws and regulations
595595 governing the practice of dentistry within a member state;
596596 17. “Dentist” means any person who:
597597 a. has successfully graduated from a CODA approved dental
598598 school,
599599 b. has successfully passed the American Board of Dental
600600 Examiners (ADEX) licensure exam, or h as been in
601601 practice five (5) years or more and has successfully
602602 passed a regional or equivalent state -administered
603603 psychomotor licensure examination prior to January 1,
604604 2024,
605605 c. has successfully passed the written National Denta l
606606 Board Examination administered by the Joint Commission
607607 on National Dental Examinations,
608608 d. possesses a full and unrestricted dental license
609609 issued by a member state licensing agency,
610610 e. has never been convicted, received adjudication,
611611 deferred adjudication, community supervision, o r
612612 deferred disposition for any offense by a court of
613613 appropriate jurisdiction,

665665 f. has never been a subject of discipline by a licensing
666666 agency as determined by the Compact bylaws and rules,
667667 through any adverse action, order, or other
668668 restriction of the licensee by the licensing agency
669669 with the exception of failure to pay fees or failure
670670 to complete continuing education,
671671 g. has never had a state or federal drug registration,
672672 permit, or license restricted, suspended, or revoked
673673 by the United States Drug Enfor cement Administration
674674 or any state agency that oversees controlled substance
675675 registrations,
676676 h. is not currently under active investigation by a
677677 licensing agency or law enforcemen t authority in any
678678 state, federal, or foreign jurisdiction, and
679679 i. meets any jurisprudence requirement established by a
680680 member state licensing agency in which a licensee is
681681 seeking a Compact privilege expedited license;
682682 18. “Home state” means the state of primary licensure. It is
683683 the location of the practicing dentist or dental hy gienist license
684684 where Compact privileges originate and the licensee practices at
685685 least twenty-five percent (25%) of the time within a calendar year.
686686 The home state may take an a ction against a licensee regardless of
687687 where an action against a licensee occurred;

739739 19. “Licensing agency” means the agency, board, or other entity
740740 of a state that is responsible for the licensing of dentists and
741741 dental hygienists;
742742 20. “Member state” means a state or United States territory
743743 that has enacted the Compact;
744744 21. “Regional board examination ” means the Western Regional
745745 Dental Board Examination (WREB), the North East Regional Board of
746746 Dental Examiners (NERB), the Commission on Dental Competency
747747 Assessments (CDCA), Council of AADB Compact Testing Agencies (CITA),
748748 Southern Regional Testing Agency (SRTA), Central Regional Dental
749749 Testing Services (CRDTS);
750750 22. “Repository” means the AADB repository, or its successor
751751 entity, of original documents of a licensee that may include
752752 original transcripts, certification documents, test scores, military
753753 training records, previous or current licensing documents, and other
754754 sources of materials needed for applications and verification. The
755755 repository shall receiv e documents from primary or originating
756756 sources and verify their authenticity;
757757 23. “Scope of practice” means the dental-related procedures
758758 that require a license, permit, or training to undertake the
759759 treatment and procedure to be completed on a patient wi thin the
760760 practice state’s requirements;
761761 24. “State” means a state within the United States or a United
762762 States Territory; and

814814 25. “State jurisprudence” means the knowledge of the state laws
815815 and rules of dentistry and dental hygiene in which a Compact lice nse
816816 privilege is extended.
817817 SECTION 4. NEW LAW A new section of law to be codified
818818 in the Oklahoma Statutes as Section 329.4 of Title 59, unless there
819819 is created a duplication in numbering, reads as follows:
820820 A. The member states her eby establish the Interstate Dental and
821821 Dental Hygiene Compact. Each state sh all enact the Compact in a
822822 form that is not materially different from the model Compact as
823823 determined by the Compact Commission.
824824 B. Each member state shall have two voting membe rs on the
825825 Interstate Dental and Dental Hygiene Compact Commission, to be
826826 appointed by the state licensing agency. Such members shall serve
827827 as commissioners and have one vote each, cumulatively making up the
828828 Compact Commission. Member states with separate licensing agencies
829829 for dentists and dental hygienists shall appoint one commi ssioner
830830 from each licensing agency. Commissioners may not delegate votes or
831831 proxies; however, if a commissioner is unable to attend, the member
832832 state may substitute a delegate t hat meets the same requirements.
833833 C. Upon five states joining the Compact, the Compact shall
834834 become active. The Compact Commission shall have the authority to
835835 enact bylaws and rules on behalf of the Compact that shall have the
836836 force of law in each partici pating state to carry out the provisions
837837 of the Compact.

889889 D. The Interstate De ntal and Dental Hygiene Compact shall be a
890890 distinct, standalone entity; separate and apart from the American
891891 Association of Dental Boards.
892892 E. The Compact Commission shall meet a t least once per calendar
893893 year and additional times as necessary pursuant to the bylaws and
894894 rules.
895895 F. The Compact Commission shall elect officers from the
896896 membership that shall serve as an Executive Committee. Elections
897897 shall occur during the annual meet ing. The quorum of commissioners
898898 shall select an Executive Committee consisti ng of a chair, vice
899899 chair, secretary, treasurer, and a representative from the north,
900900 south, east, and west districts as divided pursuant to the Compact
901901 rules. All officers shal l serve one-year terms.
902902 G. Quorum for purposes of conducting business shall be a
903903 majority of Commission members attending in person or virtually.
904904 H. The Commission shall provide notice of all meetings on its
905905 website and in other communications to members .
906906 I. A vote of two-thirds (2/3) of the membership shall be
907907 required for an executive session to discuss:
908908 1. Items specifically related to participation in a lawsuit or
909909 in anticipation of a legal proceeding;
910910 2. Matters specifically exempted from disclosu re by federal
911911 statute;

963963 3. Discussions of investigative records of an active Compact
964964 member investigation or investigative records for law enforcement or
965965 discussions involving specifically accusing a person of a crime or a
966966 public censure;
967967 4. Discussions that would include information of a personal
968968 nature that would constitute an un warranted invasion of personal
969969 privacy;
970970 5. Anything considered internal practices and procedures or a
971971 trade secret;
972972 6. Other items in the Commission bylaws allowing for executi ve
973973 sessions to be called; or
974974 7. Advice of legal counsel.
975975 J. The Commission shall keep minutes and make them available to
976976 all member states.
977977 K. The Commission may establish other committees as needed.
978978 L. The Commission shall prepare an annual report tha t shall be
979979 made available electronically to the legislatures and governors of
980980 the member states concerning the activities of the Compact
981981 Commission during the preceding calendar year. Such reports shall
982982 also include reports of financial audits and any rec ommendations
983983 that may have been adopted by the Compact Commission.

10381038 A. Member states agree to submit member state licensing agency
10391039 actions and other documents and data as determined by the Compact
10401040 Commission through bylaws and rules.
10411041 B. Member states shall notify the Compact Commission pursuant
10421042 to the rules regarding any adverse action taken by the licensing
10431043 agency, any active investigation by the licensing agency, and any
10441044 active investigation involving pending criminal charges or other
10451045 circumstances as determined by the Compact Commission rules and
10461046 bylaws.
10471047 C. Any adverse action, order, restriction, or denial of a
10481048 license or permit on a licensee or permit holder shall be reported
10491049 to the Compact Commission clearinghouse by the member state
10501050 licensing agency.
10511051 D. Member state licensing agencies may submit nonp ublic
10521052 complaints, disciplinary or investigatory information not required
10531053 by subsection C of this section to the clearinghouse. All
10541054 investigatory material shall be considered confidential and not part
10551055 of a public record unless otherwise specifically requir ed by state
10561056 statute.
10571057 E. Member state licensing agencies shall accept continui ng
10581058 education credits as required by each state including, but not
10591059 limited to, classes authorized by AADB Accredited Continuing
10601060 Education (ACE) program.

11211121 shall be enforced by a court of competent jurisdiction where the
11221122 witnesses or evidence is located.
11231123 SECTION 6. NEW LAW A new section of law to be codified

11261126 A. The Compact Commis sion shall have the power and duty to:
11271127 1. Oversee and maintain the administration of the Compact

11291129 hiring of personnel, and the ongoing activities or needs of the

11911191 6. Hold an annual meeting for the Compact Commission where the
11921192 elections of an Executive Committee and other issues may be
11931193 discussed and voted on;
11941194 7. Establish personnel policies and programs relating to
11951195 conflicts of interest, rates of compensation, and qualifications of

11971197 8. Accept donations and grants of money, equipment, supplies,
11981198 materials, and services, and to receive, utilize, and dispose of
11991199 them in a manner consistent with the conflict -of-interest policies
12001200 established by the Compact Commission;
12011201 9. As required by Section 4(L) of this Compact, report annually
12021202 to the legislatures and governors of the member state licensing
12031203 agencies concerning the activities of the Compact Commission during
12041204 the preceding calendar year. Such reports shall also include
12051205 reports of financial audi ts and any recommendations that may have
12061206 been adopted by the Compact Commission; and
12071207 10. Coordinate education, training, and public awareness
12081208 regarding the Compact, its implemen tation, and its operation.
12091209 B. The Executive Committee shall have the power to act on

12661266 C. The officers and employees of the Compact Commission shall
12671267 be immune from suit and liability, either personally or in t heir
12681268 official capacity, for a claim for damage to or loss of property or
12691269 personal injury or other civil liability caused or arising out of,
12701270 or relating to, an actual or alleged act, error, or omission that
12711271 occurred, or that such person had a reasonable bas is for believing
12721272 occurred, within the scope of Compact Commission employment, duties,
12731273 or responsibilities; provided, such person shall not be protected
12741274 from suit or liability for damage, loss, injury, or liability caused
12751275 by the intentional or willful and w anton misconduct of such person.
12761276 D. The liability of the executive director and employees of the
12771277 Compact Commission or representatives of the Compact Commission,
12781278 acting within the scope of such person ’s employment or duties for
12791279 acts, errors, or omissions occurring within such person ’s state may
12801280 not exceed the limits of liability se t forth under the constitution
12811281 and laws of that state for state officials, employees, and agents.
12821282 The Compact Commission is considered to be an instrumentality of the
12831283 states for the purposes of any such action. Nothing in this
12841284 subsection shall be construed to protect such person from suit or

13421342 Commission representative in any civil action seeking to impose
13431343 liability arising out of an actual or alleged act, error, or
13441344 omission that occurred within the scope of Compact Commission
13451345 employment, duties, or responsibilities, or that the defendant had a
13461346 reasonable basis for believing occurred within the scope of Compact
13471347 Commission employment, duties, or responsibilities, provided that
13481348 the actual or alleged act, error, or omission did not result from
13491349 intentional or willful and wanton misconduct on the part of su ch
13501350 person.
13511351 F. To the extent not covered by the laws of any state involved,
13521352 a member state, the Compact Commission, or the representatives or
13531353 employees of the Compact Commission shall be held harmless in the
13541354 amount of a settlement or judgment, including at torney fees and
13551355 costs, obtained against such persons arising out of an actual or
13561356 alleged act, error, or omission that occurred within the scope of
13571357 Compact Commission employment, duties, or responsibilities, or that
13581358 such persons had a reasonable basis for b elieving occurred within

14171417 A. A dentist or dental hygienist applying for Compact l icense
14181418 privileges shall meet the requirements established in applicable
14191419 definitions listed Section 3 of this Compact and hold a current
14201420 valid license in a member state under this Compact.
14211421 B. Notwithstanding any provision of this Compact or state law
14221422 to the contrary, each member state agrees to issue an expedited
14231423 state license within ten (10) days of a completed application
14241424 pursuant to 50 U.S.C., Section 4025(a) to an active duty military
14251425 member or spouse.
14261426 C. Each dentist or dental hygienist shall designat e a home
14271427 state of licensure. The home state shall be determined by:
14281428 1. The state of primary residence for the dentist or dental
14291429 hygienist where twenty -five percent (25%) of his or her practice
14301430 within one (1) year occurs. An active -duty military member o r his
14311431 or her spouse may choose a home state as designated with the
14321432 military but are not required to meet the twenty -five percent (25%)
14331433 practice within the home state requirement; or

14911491 E. A dentist or dental hygien ist seeking a Compact license
14921492 privilege shall apply to his or her home state f or a letter stating
14931493 that he or she is eligible for Compact license privileges.
14941494 F. The home state shall determine the eligibility of the
14951495 applicant and shall issue a letter of app roval or denial for the
14961496 Compact license privilege.
14971497 G. The letter shall be submitted to the proposed Compact
14981498 license state along with:
14991499 1. The completed Compact application packet;
15001500 2. Authorization to seek access to the licensee ’s repository
15011501 documents;
15021502 3. Any additional information as may be required by the
15031503 proposed Compact licens e state; and
15041504 4. Any required fees.
15051505 H. Upon approval from the home state, the Compact license state
15061506 shall issue a state Compact license privilege from the proposed
15071507 application state to the applicant.

15661566 K. A Compact license privilege may be revoked, suspended, or
15671567 limited by the issuing state li censing agency if at any time the
15681568 licensee’s home state license is revoked, suspended, or limited.
15691569 L. The Compact Commission is authorized to develop rules
15701570 regarding the application and renewal process including payment of
15711571 any application fees, and the is suance of a Compact license
15721572 privilege.
15731573 M. Eligibility or ineligibility to rec eive a state Compact
15741574 license privilege shall not impact or prohibit an individual from
15751575 the ability to seek a state license through the regular process
15761576 outside of the Compact.

16421642 privilege may have an adverse action taken against him or her by

16441644 1. Member state licensing agency in a state in which the
16451645 dentist or dental hygienist :
16461646 a. is practicing with a Compact license privilege, or
16471647 b. has requested or received a Compact license privilege
16481648 to practice; or
16491649 2. Compact licensee ’s home state.
16501650 D. Any state in which the Compact licensee holds a Compact
16511651 license privilege may investigat e an allegation of a violation of
16521652 the statutes and rules of dentistry or denta l hygiene in any other
16531653 state where the Compact licensee holds a Compact license privilege.

17881788 licensing agencies shall be enforceable in other member states a s

17901790 E. If a licensee has a disciplinary action taken by any member
17911791 state licensing agency against a licensee under the Compact, he or
17921792 she shall automatically be su bject to discipline by other member
17931793 state licensing agencies.
17941794 F. If a licensee has an action taken against his or her home
17951795 state license including being revoked, surrendered, or relinquished
17961796 in lieu of discipline or suspension, then automatically all othe r
17971797 Compact license privileges shall be placed in the same status. The
17981798 home state shall notify the Compact Commission and the Compact
17991799 Commission shall issue a notice to all member state licensing
18001800 agencies that the licensee holding a Compact license privileg e shall
18011801 suspend the Compact license privilege.
18021802 G. If discipline is taken against a licensee in an Compact
18031803 member state, the member state licensing agency shall notify the
18041804 Compact Commission and the home state of the licensee. The home
18051805 state may deem the action conclusive as a matter of law and fact

18691869 B. A dentist or dental hygienist, as defined by the bylaws and
18701870 rules, may submit a request to the Compact Commission to allow any
18711871 hiring employer, entity, or insurance company to access documents
18721872 from the repository for the purposes of credentialing, licensing, or
18731873 other privileges.
18741874 C. The Commission shall set a fee schedule for these services
18751875 in the bylaws and rules.

19411941 SECTION 13. NEW LAW A new section of law to be codif ied

19441944 A. The executive, legislative, and judicial branches of state
19451945 government in each member state licensing agencies shall enforc e the
19461946 Compact and shall take all actions necessary and appropriate to
19471947 effectuate the Compact ’s purposes and intent to allow for expedited
19481948 licensure for the purpose of mobility. The provisions of the
19491949 Compact and the rules promulgated hereunder shall have s tanding as
19501950 statutory law, but shall not override existing state authority to
19511951 regulate the practice of dentistry and dental hygiene.
19521952 B. All courts may take judicial notice of the Compact and the
19531953 rules in any judicial or administrative proceeding in a membe r state
19541954 pertaining to the subject matter of the Compact which may affect the
19551955 powers, responsibilities, or actions of the Compact Commission.

20072007 C. The Compact Commission shall be entitled to receive all
20082008 service of process in any such proceeding and shall hav e standing to
20092009 intervene in the proceeding for all purposes. Failure to provid e
20102010 service of process to the Compact Commission shall render a judgment
20112011 or order void as to the Compact Commission, the Compact, or
20122012 promulgated rules.
20132013 SECTION 14. NEW LAW A new section of law to be codified
20142014 in the Oklahoma Statutes as Section 329.14 of Title 59, unless there
20152015 is created a duplication in numbering, reads as follows:
20162016 A. The Compact Commission, in the reasonable exercise of its
20172017 discretion, shall enforce the provisions and rules of the Compact.
20182018 B. The grounds for default include, but are not limited to,
20192019 failure of a member state to perform such obligations or
20202020 responsibilities imposed upon it by the Compact, or the rules and
20212021 bylaws of the Compact Commission promulgated under the Compact.
20222022 C. If the Compact Commission determines that a member state has
20232023 defaulted in the performance of its obligations or responsibilities
20242024 under the Compact, or the bylaws or promulgated rules, the Compact
20252025 Commission shall:
20262026 1. Provide written notice to the defaulting state and other
20272027 member states of the nature of the default, the means of curing the
20282028 default, and any action taken by the Compact Commission. The
20292029 Compact Commission shall specify the conditions by which the
20302030 defaulting state must cure its default; and

20822082 2. Provide remedial training and specific technical assistance
20832083 regarding the default.
20842084 D. If the defaulting state fails to cure the default, the
20852085 defaulting state shall be terminated from the Compact upon an
20862086 affirmative vote of a majority of the commissioners and all rights,
20872087 privileges, and benefits conferred by the Compact shall terminate on
20882088 the effective date of termination. A cure of the default does not
20892089 relieve the offending state of obligations or liabilitie s incurred
20902090 during the period of the default.
20912091 E. Termination of membership in the Compact shall be imposed
20922092 only after all other means of securing compliance have been
20932093 exhausted. Notice of intent to terminate shall be given by the
20942094 Compact Commission to the governor, the majority and minority
20952095 leaders of the defaulting state ’s legislature, and each of the
20962096 member states.
20972097 F. The Compact Commission shall establish rules and procedures
20982098 to address licenses and Compact license privilege holders that are
20992099 materially impacted by the termination of a member state or the
21002100 withdrawal of a member state.
21012101 G. The Compact Commission shall not bear any costs relating to
21022102 any state that has been found to be in default or which has been
21032103 terminated from the Compact, unless otherwi se mutually agreed upon
21042104 in writing between the Compact Commission and the defa ulting state.

21562156 H. The defaulting state may appeal the action of the Compact
21572157 Commission by petitioning the federal district where the Compact
21582158 Commission has its principal offices. The prevailing party shall be
21592159 awarded all costs of such litigation, including reasonable attorney
21602160 fees.
21612161 I. The Compact Commission shall not bear any costs relating to
21622162 any state that has been found to be in default or which has been
21632163 terminated from the C ompact, unless otherwise mutually agreed upon
21642164 in writing between the Compact C ommission and the defaulting state.
21652165 J. The remedies herein shall not be the exclusive remedies of
21662166 the Compact Commission. The Compact Commission may avail itself of
21672167 any other remedies available under state law or the regulation of a
21682168 profession.
21692169 SECTION 15. NEW LAW A new section of law to be codified
21702170 in the Oklahoma Statutes as Section 329.15 of Title 59, unless there
21712171 is created a duplication in numbering, reads as follows:
21722172 A. The Compact Commission shall attempt, upon the request o f a
21732173 member state licensing agency, to resolve disputes which are subject
21742174 to the Compact and which may arise among member state licensing
21752175 agencies.
21762176 B. The Compact Commission shal l promulgate rules providing for
21772177 both mediation and binding dispute resolution, as appropriate.

22322232 A. Any state is eligible to beco me a member state of the
22332233 Compact.
22342234 B. The Compact shall become effective and binding upon
22352235 legislative enactment of the Compact into law by no less than five
22362236 states. Thereafter, it shall become effective and binding on a
22372237 state upon enactment of the Compact into law by that state.
22382238 C. The governors of nonmember states, or their designees, shall
22392239 be invited to participate in the activities of the Compact
22402240 Commission on a nonvoting bas is prior to adoption of the Compact by
22412241 all states.
22422242 D. The Compact Commission may propose amendments to the Compact
22432243 for enactment by the member states. No amendment shall become
22442244 effective and binding upon the Compact Commission and the member
22452245 states unless and until it is enacted into law by unanimous consent
22462246 of the member states.
22472247 SECTION 17. NEW LAW A new section of law to be codified
22482248 in the Oklahoma Statutes as Section 329.17 of Title 59, unless there

22502250 A. Once effective, the Compact shall continue in f orce and
22512251 remain binding upon each and every member state; provided, that a

23062306 B. Withdrawal from the Compact shall be by the enactment of a
23072307 statute repealing the same. The individual ’s Compact license
23082308 privilege shall remain in effect for six (6) months from the date of
23092309 the member state licensing agency’s withdrawal.
23102310 C. The withdrawing state shall immediately no tify the chair of
23112311 the Compact Commission in writing upon the introduction of
23122312 legislation repealing the Compact in the withdrawing state.
23132313 D. The Compact Commission shall notify t he other member states
23142314 of the withdrawing state ’s intent to withdraw within sixty (60) days
23152315 of its receipt of notice provided under subsection C of this
23162316 section.
23172317 E. Reinstatement following withdrawal of a member state shall
23182318 occur upon the withdrawing stat e reenacting the Compact or upon such
23192319 later date as determined by the Compact Commission.
23202320 F. The Compact Commission is authorized to develop rules to
23212321 address the impact of the withdrawal of a member state on licenses
23222322 granted in other member states to dent ists and dental hygienists who
23232323 designated the withdrawing member state as the state of principal
23242324 license.
23252325 SECTION 18. NEW LAW A new section of law to be codified

23792379 A. The Compact shall d issolve effective upon the date of the
23802380 withdrawal or default of the member state which reduces the
23812381 membership in the Compact to one member state.
23822382 B. Upon the dissolution of the Compact, the Compact becomes
23832383 null and void and shall be of no further force or effect, and the
23842384 business and affairs of the Compact Commission shall be concluded
23852385 and surplus funds shall be distributed in accordance with the
23862386 bylaws.
23872387 SECTION 19. NEW LAW A new section of law to be codified
23882388 in the Oklahoma Statutes as Section 329.19 of Title 59, unless there
23892389 is created a duplication in numbering, reads as follows:
23902390 A. The provisions of the Compact shall be severable, and if any
23912391 phrase, clause, sentence, or provision is deemed unenforceable, the
23922392 remaining provisions of the Compact shall be enforceable.
23932393 B. The provisions of the Compact shall be liberally construed
23942394 to effectuate its purposes.
23952395 SECTION 20. NEW LAW A new s ection of law to be codified
23962396 in the Oklahoma Statutes as Section 329.20 of Tit le 59, unless there
23972397 is created a duplication in numbering, reads as follows:
23982398 A. Nothing herein prevents the enforcement of any other law of
23992399 a member state that is not inconsiste nt with the Compact.
24002400 B. All lawful actions of the Compact Commission, including all
24012401 rules and bylaws promulgated by the Commission, are binding upon the

24622462 in the Oklahoma Statutes as Section 329.21 of Title 59, unless there
24632463 is created a duplication in numbering, reads as follows:
24642464 The most current edition of the American Institute of
24652465 Parliamentarians Standard Code of Parlia mentary Procedure governs
24662466 all meetings of the Compact Commission, including its committees, in
24672467 those situations not otherwise covered in the bylaws.
24682468 SECTION 22. This act shall become effective November 1, 2025.
