142 | 142 | | 1. “Consumer” means an individual who resides in Oklahoma ; |

143 | 143 | | 2. “Consumer-directed wage access service ” means delivering to |

144 | 144 | | a consumer access to earned but unpaid income that is based on the |

145 | 145 | | consumer’s representations and the provider ’s reasonable |
---|
146 | 146 | | determination of the consumer ’s earned but unpaid income; |
---|
147 | 147 | | 3. “Earned but unpaid income ” means salary, wages, |
---|
148 | 148 | | compensation, or other income that a consumer or an employer has |
---|
149 | 149 | | represented and that a provider has reasonably determined has been |
---|
150 | 150 | | earned or accrued to the benefit of the consumer in exch ange for the |
---|
151 | 151 | | consumer’s provision of services to the employer or on behalf of the |
---|
152 | 152 | | employer including on an hourly, project -based, piecework, or other |
---|
153 | 153 | | basis. Earned but unpaid income shall include income earned under |
---|
154 | 154 | | circumstances in which the consumer is acting as an independent |
---|
155 | 155 | | contractor of the employer but has not , at the time of the payment |
---|
156 | 156 | | of proceeds, been paid by the employer; |
---|
157 | 157 | | 4. “Earned wage access services ” means services providing |
---|
158 | 158 | | consumer-directed wage access services or employer -integrated wage |
---|
159 | 159 | | access services; |
---|
160 | 160 | | 5. “Earned wage access services provider ” or “provider”: |
---|
161 | 161 | | a. means a person that is in the business of providing |
---|
162 | 162 | | earned wage access services to consumers, and |
---|
163 | 163 | | b. does not mean a service provider, such as a payroll |
---|
164 | 164 | | service provider, whose role may include verifying the |
---|
165 | 165 | | available earnings but is not contractually ob ligated |

---|

---|

---|
235 | 235 | | consumer for or on behalf of the person ; |

236 | 236 | | 7. “Employer-based integrated wage access services” means |
---|
237 | 237 | | delivering to a consumer access to earned but unpaid in come that is |
---|
238 | 238 | | based on employment, income, or attendance data obtained directly or |
---|
239 | 239 | | indirectly from an employer ’s payroll service provider ; |

299 | 299 | | 9. “Proceeds” means a payment to a consumer by a provider tha t |
---|
300 | 300 | | is based on earned but unpaid income ; and |
---|
301 | 301 | | 10. “Outstanding proceeds ” means proceeds remitted to a |
---|
302 | 302 | | consumer by a provider that have not yet been repaid to the |
---|
303 | 303 | | provider. |
---|
304 | 304 | | SECTION 3. NEW LAW A new section of law to be codified |
---|
305 | 305 | | in the Oklahoma Statutes as Section 6 50.2 of Title 40, unless there |
---|
306 | 306 | | is created a duplication in numbering, reads as follows: |
---|
307 | 307 | | A. An earned wage access services provider shall: |
---|
308 | 308 | | 1. Develop and implement policies and procedures to respond to |
---|
309 | 309 | | questions raised by co nsumers and address complaints from consumers |
---|
310 | 310 | | in an expedient manner; |
---|
311 | 311 | | 2. When a consumer is offered the option to receive proceeds |
---|
312 | 312 | | for a fee or solicits an optional tip, gratuit y, or other donation, |
---|
313 | 313 | | offer the consumer at least one reasonable option to obtain proceeds |
---|
314 | 314 | | at no cost to the consumer and clearly explain how to elect the no - |
---|
315 | 315 | | cost option; |

368 | 368 | | provision of earned wag e access services, adhere to the following: |
---|
369 | 369 | | a. inform the consumer of his or her rights under the |
---|
370 | 370 | | agreement, and |
---|
371 | 371 | | b. fully and clearly disclose all fees associated with |
---|
372 | 372 | | the earned wage access service s; |
---|
373 | 373 | | 4. Inform the consumer of any material changes to the terms and |
---|
374 | 374 | | conditions of the earned wage access services before implementing |
---|
375 | 375 | | those changes for that consumer; |
---|
376 | 376 | | 5. Allow the consumer to cancel use of the provider ’s earned |
---|
377 | 377 | | wage access services at any time, without incurring a cancellation |
---|
378 | 378 | | fee imposed by the provider; |
---|
379 | 379 | | 6. Comply with all applicable local, state, and federal privacy |
---|
380 | 380 | | and information security laws; |
---|
381 | 381 | | 7. If a provider solicits charges or receives a tip, gratuity, |
---|
382 | 382 | | or other donation from a consumer, disclose clearly and |
---|
383 | 383 | | conspicuously to the consumer : |
---|
384 | 384 | | a. immediately prior to each transaction that a tip, |
---|
385 | 385 | | gratuity, or other donation amount may be zero and is |
---|
386 | 386 | | voluntary, and |
---|
387 | 387 | | b. in the provider service contract with the consumer and |
---|
388 | 388 | | elsewhere that tips, gratuities, or other donation s |
---|
389 | 389 | | are voluntary and that the offering of earned wage |
---|
390 | 390 | | access services, including the amount of proceeds a |
---|

446 | 446 | | 8. Provide proceeds to a consumer by any means mutually agreed |

447 | 447 | | upon by the consumer and the provider . |
---|
448 | 448 | | B. If the provider seek s repayment of outstanding proceeds or |
---|
449 | 449 | | payment of fees or other amounts owed, including volunt ary tips, |
---|
450 | 450 | | gratuities, or other donations, in connection with the activities |
---|
451 | 451 | | covered by this act, from a consumer’s account at a depository |
---|
452 | 452 | | institution, including by means of electronic fund s transfer, the |
---|
453 | 453 | | provider shall: |
---|
454 | 454 | | 1. Comply with applicable provisio ns of the federal Electronic |
---|
455 | 455 | | Fund Transfer Act and regulations adopted thereunder; and |
---|
456 | 456 | | 2. Reimburse the consumer fo r the full amount of any overdraft |
---|
457 | 457 | | or insufficient funds or fees imposed on a consumer by the |
---|
458 | 458 | | consumer’s depository institution that were ca used by the provider |
---|
459 | 459 | | attempting to seek payment of any outstanding proceeds, fees, or |
---|
460 | 460 | | other payments, in connection with the activities covered by this |
---|
461 | 461 | | chapter, including voluntary tips, gratuities, or other donations, |
---|
462 | 462 | | on a date before, or in an incorrect amount from, the date or amount |
---|
463 | 463 | | disclosed to the consumer. |

603 | 603 | | B. The limitations set forth in this section do not preclude |
---|
604 | 604 | | the use by a provider of any of the methods specified in paragraph 6 |

606 | 606 | | proceeds or fees incurred by a consumer through fraudulent or |

671 | 671 | | B. Notwithstanding any other provision of law, earned wage |

672 | 672 | | access services offered and provided by an earned wage access |
---|
673 | 673 | | services provider in accordance with this act shall not be |
---|
674 | 674 | | considered: |

675 | 675 | | 1. In violation of or noncompliance with any law gov erning |
---|
676 | 676 | | deductions from payroll, salary, wages, compensation, or other |
---|
677 | 677 | | income or the purchase, sale , or assignment of, or an order for , |
---|
678 | 678 | | earned but unpaid income; |
---|
679 | 679 | | 2. A loan or other form of credit or debt ; nor shall the |
---|
680 | 680 | | provider be considered a creditor, debt collector, or lender with |
---|
681 | 681 | | respect thereto; or |

682 | 682 | | 3. A money transmission; nor shall the provider be considered a |
---|
683 | 683 | | money transmitter with respect thereto. |
