85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. NEW LAW A new section of law to be codified
87	87	in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
88	88	is created a duplication in numbering, reads as follows:
89	89	A. This act shall be known and may be cited as the “Students’
90	90	Bill of Rights”.

142	142	B. A student enrolled in and attending a public school district
143	143	or public charter school in this state shall be afforded the
144	144	following rights:
145	145	1. The right to a safe learning environment including the right
146	146	to be free from bullying and threatening behavior as defined in
147	147	Section 24-100.3 of Title 70 of the Oklahoma Stat utes;
148	148	2. The right to an unbiased education that does not endorse,
149	149	favor, or promote socialism, communism, or Marxism and that is free
150	150	from anti-American bias;
151	151	3. The right to an unbiased learning environment that includes ,
152	152	but is not limited to:
153	153	a. the right to a classroom environment that is free from
154	154	the display of flags or propaganda of any organization
155	155	or symbol of socialism, communism, Marxism, or anti -
156	156	American sentiment, and
157	157	b. the right to attend or participate in school -sponsored
158	158	or school-sanctioned events or activities that are
159	159	free from the display of flags or propagand a that is
160	160	paid for with public funds and that represent s any
161	161	organization or symbol of socialism, communism,
162	162	Marxism, or anti-American sentiment;
163	163	4. The right of self -defense if attacked on school property or
164	164	during a school event;

216	216	5. The right to public and free expression of religion, speech,
217	217	and peaceable assembly including , but not limited to:
218	218	a. the right to participate or lead in voluntary prayer
219	219	pursuant to the provisions of Section 11-101.1 of
220	220	Title 70 of the Oklahoma Statutes,
221	221	b. the right to observe one minute of silence each day
222	222	pursuant to the provisions of Section 11 -101.2 of
223	223	Title 70 of the Oklahoma Statutes,
224	224	c. the right to read religious texts of his or her
225	225	choosing during free time, and
226	226	d. the right to an unbiased education that does not
227	227	endorse, favor, promote, demean, show hostility
228	228	toward, or intentionally undermine any particular
229	229	religion or nonreligious faith or religious
230	230	perspective;
231	231	6. The right to an appr opriate relationship with teachers and
232	232	school employees that is free from acti ons that constitute a crime
233	233	or an attempted crime under state statute;
234	234	7. The right to be free from the use of vulgar language
235	235	directed toward other individuals by other student s, teachers,
236	236	athletic coaches, and school district employees;
237	237	8. The right to have a parent, legal guardian, or legal counsel
238	238	present if he or she is being questioned concerning potentially
239	239	illegal conduct; and

291	291	9. The right to be free from punishment or penalty at school or
292	292	during school-related activities for lawfully exercising his or her
293	293	rights or engaging in lawful conduct outside of school hours and
294	294	outside of school property or school events.
295	295	C. 1. A student or the parent or legal guardian of a st udent
296	296	who believes the student ’s rights provided for in subsection B of
297	297	this section have been violated may submit in writing a demand for
298	298	enforcement of his or her rights. Within seven (7) business days of
299	299	receipt of the demand, the school shall submit a response in writing
300	300	admitting to or denying the allegation.
301	301	2. The student or the parent or legal guardian of the student
302	302	may file an action to enforce the rights outlined in subsection B of
303	303	this section. If the student or the parent or legal guardian o f the
304	304	student is the prevailing party, the court shall award reasonable
305	305	attorney fees.
306	306	3. An action may not be brought for a violation of the
307	307	provisions of paragraph 1 of subsection B of this section unless a
308	308	student or the parent or legal guardian of the student has notified
309	309	the school of ongoing bullying or threatening behavior, the school
310	310	has failed to address the bullying or threatening behavior by
311	311	allowing the alleged bully to remain in contact with an alleged
312	312	victim, and the continued bullying or thr eatening behavior rises to
313	313	the level of continual harassment. An action may not be brought

367	367	SECTION 2. This act shall become effective July 1, 2025.
368	368	SECTION 3. It being immediately necessary for the preservation
369	369	of the public peace, health, or safety, an emergency is hereby
370	370	declared to exist, by reason whereof this act shall take effect and
371	371	be in full force from and after its passage and approval.
