114 | 167 | | 3. “Child custody determination ” means a judgment, decree, or |

115 | 168 | | other court order providing for the legal custody, physical custody, |
---|
116 | 169 | | or visitation with respect to a child. The term includes a |
---|
117 | 170 | | permanent, temporary, initial, and mod ification order; |
---|
118 | 171 | | 4. “Child custody proceeding ” means a proceeding in which l egal |
---|
119 | 172 | | custody, physical custody, or visitation with respect to a child is |
---|
120 | 173 | | at issue. The term includes a proceeding for divorce, dissolution |
---|
121 | 174 | | of marriage, separation, neglect, abuse , dependency, guardianship, |
---|
151 | 228 | | 5. “Court” means an entity authorized under the law of a state |

152 | 229 | | to establish, enforce, or modify a child custody determination; |

158 | 235 | | Columbia, Puerto Rico, the United States Virgin Islands, or any |
---|
159 | 236 | | territory or insular possession subject to the jurisdiction of the |
---|
160 | 237 | | United States. The term includes a federally recognized Indian |
---|
161 | 238 | | tribe or nation; |
---|
162 | 239 | | 9. “Travel document” means records relati ng to a travel |
---|
163 | 240 | | itinerary, including travel tickets, passes, reservations for |
---|
164 | 241 | | transportation, or accommodations. The term does not include a |
---|
165 | 242 | | passport or visa; |
---|
166 | 243 | | 10. “Wrongful removal” means the taking of a child that |
---|
167 | 244 | | breaches rights of custody or visitation given or recognized under |
---|
168 | 245 | | the laws of this state; and |
---|
169 | 246 | | 11. “Wrongful retention” means the keeping or concealing of a |
---|
170 | 247 | | child that breaches rights of custody or visitation given or |
---|
171 | 248 | | recognized under the laws of this state. |
---|
202 | 303 | | The provisions of the Uniform Child Custody Jurisdiction and |

203 | 304 | | Enforcement Act as provided in Sections 551-110, 551-111, and 551- |

206 | 307 | | SECTION 4. NEW LAW A new section of law to be codified |

209 | 310 | | A. A court on its own motion may order abduction prevention |
---|
210 | 311 | | measures in a child custody proceeding if the court finds that the |
---|
211 | 312 | | evidence establishes a credible risk of abduction of the child. |
---|
212 | 313 | | B. A party to a child custody determination or another |
---|
213 | 314 | | individual or entity having a right under the laws of this state or |
---|
214 | 315 | | any other state to seek a child custody determination for the child |
---|
215 | 316 | | may file a petition seeking abduction prevention measures to protect |
---|
216 | 317 | | the child under this act. |
---|
217 | 318 | | C. As authorized by Section 551 -315 of Title 43 of the Oklahoma |
---|
218 | 319 | | Statutes, a district attorney may seek a warrant to take physical |
---|
219 | 320 | | custody of a child pursuant to Section 9 of this act, or to take |
---|
220 | 321 | | other appropriate prevention measures. |

314 | 463 | | A. In determining whether there is a cred ible risk of abduction |
---|
315 | 464 | | of a child, the court shall consider any evidence that the |
---|
316 | 465 | | petitioner or respondent: |
---|
317 | 466 | | 1. Has previously abducted or attempted to abduct the child; |
---|
318 | 467 | | 2. Has threatened to abduct the child; |
---|
319 | 468 | | 3. Has recently engaged in activities that may indicate a |
---|
320 | 469 | | planned abduction including , but not limited to: |
---|
321 | 470 | | a. abandoning employment, |
---|
355 | 528 | | e. applying for a passport or visa or obtaining travel |
---|
356 | 529 | | documents for the respondent, a family member, or the |
---|
357 | 530 | | child, or |
---|
358 | 531 | | f. seeking to obtain the child ’s birth certificate or |
---|
359 | 532 | | school or medical records; |
---|
360 | 533 | | 4. Has engaged in domestic violence, stalking, or child abuse |
---|
361 | 534 | | or neglect; |
---|
362 | 535 | | 5. Has refused to follow a child custody determination; |
---|
363 | 536 | | 6. Lacks strong familial, financial, emotional, or cultural |
---|
364 | 537 | | ties to the state or the United States; |
---|
365 | 538 | | 7. Has strong familial, financial, emotional, or cultural ties |
---|
366 | 539 | | to another state or country; |
---|
367 | 540 | | 8. Is likely to take the child to a country that: |
---|
368 | 541 | | a. is not a party to the Hague Convention on the Civil |
---|
369 | 542 | | Aspects of International Child Abduction and does not |
---|
370 | 543 | | provide for the extradition of an abducting parent or |
---|
371 | 544 | | for the return of an abducted child, |
---|
404 | 601 | | (2) is noncompliant according to the most recent |
---|
405 | 602 | | compliance report issued by the United States |
---|
406 | 603 | | Department of State, or |
---|
407 | 604 | | (3) lacks legal mechanisms for immediately and |
---|
408 | 605 | | effectively enforcing a return order under the |
---|
409 | 606 | | Hague Convention on the Civil Aspects of |
---|
410 | 607 | | International Child Abduction, |
---|
411 | 608 | | c. poses a risk that the child ’s physical or emotional |
---|
412 | 609 | | health or safety would be endangered in the country |
---|
413 | 610 | | because of specific circumstances relating to the |
---|
414 | 611 | | child or because of human r ights violations committed |
---|
415 | 612 | | against children, |
---|
416 | 613 | | d. has laws or practices that would: |
---|
417 | 614 | | (1) enable the respondent, without due cause, to |
---|
418 | 615 | | prevent the petitioner from contacting the child , |
---|
419 | 616 | | (2) restrict the petitioner from freely traveling to |
---|
420 | 617 | | or exiting from the country because of the |
---|
421 | 618 | | petitioner’s gender, nationality, marital status, |
---|
422 | 619 | | or religion, or |
---|
454 | 675 | | e. is included by the United States Department of State |
---|
455 | 676 | | on a current list of state sponsors of terrorism, |
---|
456 | 677 | | f. does not have an official United States diplomatic |
---|
457 | 678 | | presence in the country, or |
---|
458 | 679 | | g. is engaged in active military action or war, including |
---|
459 | 680 | | a civil war, to which the child may be exposed; |
---|
460 | 681 | | 9. Is undergoing a change in immigration or citizenship status |
---|
461 | 682 | | that would adversely affect the respondent ’s ability to remain in |
---|
462 | 683 | | the United States legally; |
---|
463 | 684 | | 10. Has had an application for United States citizenship |
---|
464 | 685 | | denied; |
---|
465 | 686 | | 11. Has forged or presented misleading or false evidence on |
---|
466 | 687 | | government forms or supporting documents to obtain or attempt to |
---|
467 | 688 | | obtain a passport, a visa, travel documents, a Social Se curity card, |
---|
468 | 689 | | a driver license, or other government -issued identification card or |
---|
469 | 690 | | has made a misrepresentation to the United States government; |
---|
470 | 691 | | 12. Has used multiple names to attempt to mislead or defraud; |
---|
471 | 692 | | or |
---|
472 | 693 | | 13. Has engaged in any other conduct the court considers |
---|
473 | 694 | | relevant to the risk of abduction. |
---|
505 | 750 | | relevant to whether the respondent may be permitted to remove or |
---|
506 | 751 | | retain the child. |
---|
507 | 752 | | SECTION 8. NEW LAW A new section of law to be codified |
---|
508 | 753 | | in the Oklahoma Statutes as Section 561 -8 of Title 43, unless there |
---|
509 | 754 | | is created a duplication in numbering, reads as follow s: |
---|
510 | 755 | | A. If a petition is filed under this act, the court may enter |
---|
511 | 756 | | an order that shall include: |
---|
512 | 757 | | 1. The basis for the court ’s exercise of jurisdiction; |
---|
513 | 758 | | 2. The manner in which noti ce and opportunity to be heard were |
---|
514 | 759 | | given to the persons entitled to notice of the proceeding; |
---|
515 | 760 | | 3. A detailed description of each party ’s custody and |
---|
516 | 761 | | visitation rights and residential arrangements for the child; |
---|
517 | 762 | | 4. A provision stating that a violation of the order may |
---|
518 | 763 | | subject the party in violation to civil and criminal penalties; and |
---|
519 | 764 | | 5. Identification of the child ’s country of habitual residence |
---|
520 | 765 | | at the time of the issuance of the order. |
---|
521 | 766 | | B. If, at a hearing on a petition under this act or on the |
---|
522 | 767 | | court’s own motion, the court after reviewing the evidence finds a |
---|
523 | 768 | | credible risk of abduction of the child, the court shall enter an |
---|
524 | 769 | | abduction prevention order. The order shall include the provisions |
---|
556 | 825 | | of the parties. The court shall consider the age of the child, the |
---|
557 | 826 | | potential harm to the child from an abduction, the legal and |
---|
558 | 827 | | practical difficulties of returning the child to the jurisdiction if |
---|
559 | 828 | | abducted, and the reasons for the potential abduction, including |
---|
560 | 829 | | evidence of domestic violence, stalking, or child abuse or neglect. |
---|
561 | 830 | | C. An abduction prevention order may include one or more of the |
---|
562 | 831 | | following: |
---|
563 | 832 | | 1. An imposition of travel restrictions that require that a |
---|
564 | 833 | | party traveling with the child outside a designated geographical |
---|
565 | 834 | | area provide the other party with t he following: |
---|
566 | 835 | | a. the travel itinerary of the child, |
---|
567 | 836 | | b. a list of physical addresses and telephone numbers at |
---|
568 | 837 | | which the child can be reached at specified times, and |
---|
569 | 838 | | c. copies of all travel documents; |
---|
570 | 839 | | 2. A prohibition of the respondent directly or indirectl y: |
---|
571 | 840 | | a. removing the child from this state, the United States, |
---|
572 | 841 | | or another geographic area without permission of the |
---|
573 | 842 | | court or the petitioner ’s written consent, |
---|
574 | 843 | | b. removing or retaining the child in violation of a |
---|
575 | 844 | | child custody determination, |
---|
607 | 900 | | 3. A requirement that a party register the order in another |
---|
608 | 901 | | state as a prerequisite to allowing the c hild to travel to that |
---|
609 | 902 | | state; |
---|
610 | 903 | | 4. With regard to the child ’s passport: |
---|
611 | 904 | | a. a direction that the petitioner place the child ’s name |
---|
612 | 905 | | in the United States Department of State ’s Child |
---|
613 | 906 | | Passport Issuance Alert Program, |
---|
614 | 907 | | b. a requirement that the respondent surrende r to the |
---|
615 | 908 | | court or the petitioner ’s attorney any United States |
---|
616 | 909 | | or foreign passport issued in the child ’s name, |
---|
617 | 910 | | including a passport issued in the name of both the |
---|
618 | 911 | | parent and the child, and |
---|
619 | 912 | | c. a prohibition upon the respondent from applying on |
---|
620 | 913 | | behalf of the child for a new or replacement passport |
---|
621 | 914 | | or visa; |
---|
622 | 915 | | 5. As a prerequisite to exe rcising custody or visitation, a |
---|
623 | 916 | | requirement that the respondent provide: |
---|
624 | 917 | | a. to the United States Department of State Office of |
---|
625 | 918 | | Children’s Issues and the relevant foreign consulat e |
---|
626 | 919 | | or embassy, an authenticated copy of the order |
---|
657 | 974 | | (1) proof that the respondent has provided the |
---|
658 | 975 | | information in subparagraph a of this paragraph, |
---|
659 | 976 | | and |
---|
660 | 977 | | (2) an acknowledgment in a recor d from the relevant |
---|
661 | 978 | | foreign consulate or embassy that no passport |
---|
662 | 979 | | application has been made, or passport issued, on |
---|
663 | 980 | | behalf of the child, |
---|
664 | 981 | | c. to the petitioner, proof of registration with the |
---|
665 | 982 | | United States Embassy or other United States |
---|
666 | 983 | | diplomatic presence i n the destination country and |
---|
667 | 984 | | with the Central Authority for the Hague Convention on |
---|
668 | 985 | | the Civil Aspects of International Child Abduction, if |
---|
669 | 986 | | that Convention is in effect between the United States |
---|
670 | 987 | | and the destination country, unless one of the parties |
---|
671 | 988 | | objects, and |
---|
672 | 989 | | d. a written waiver under the Privacy Act of 1974, 5 |
---|
673 | 990 | | U.S.C., Section 552a, as amended, with respect to any |
---|
674 | 991 | | document, application, or other information pertaining |
---|
675 | 992 | | to the child authorizing its disclosure to the court |
---|
676 | 993 | | and the petitioner; and |
---|
708 | 1049 | | D. In an abduction prevention order, the court may impo se |
---|
709 | 1050 | | conditions on the exercise of custody or visitation that: |
---|
710 | 1051 | | 1. Limit visitation or require that visitation with the child |
---|
711 | 1052 | | by the respondent be supervised until the court finds that |
---|
712 | 1053 | | supervision is no longer necessary and order the respondent to pay |
---|
713 | 1054 | | the costs of supervision; |
---|
714 | 1055 | | 2. Require the respondent to post a bond or provide other |
---|
715 | 1056 | | security in an amount sufficient to serve as a financial deterrent |
---|
716 | 1057 | | to abduction, the proceeds of which may be used to pay for the |
---|
717 | 1058 | | reasonable expenses of recovery of the child, i ncluding reasonable |
---|
718 | 1059 | | attorney fees and costs if there is an abduction; and |
---|
719 | 1060 | | 3. Require the respondent to obtain education on the |
---|
720 | 1061 | | potentially harmful effects to the child from abduction. |
---|
721 | 1062 | | E. To prevent imminent abduction of a child, a court may: |
---|
722 | 1063 | | 1. Issue a warrant to take physical custody of the child under |
---|
723 | 1064 | | Section 9 or the laws of this state other than this act; |
---|
724 | 1065 | | 2. Direct the use of law enforcement to take any action |
---|
725 | 1066 | | reasonably necessary to locate the child, obtain return of the |
---|
726 | 1067 | | child, or enforce a custody determination under this act or the laws |
---|
727 | 1068 | | of this state other than this act; or |
---|
759 | 1124 | | SECTION 9. NEW LAW A new section of law to be codified |
---|
760 | 1125 | | in the Oklahoma Statutes as Section 561 -9 of Title 43, unless there |
---|
761 | 1126 | | is created a duplication in numbering, reads as follows: |
---|
762 | 1127 | | A. If a petition under this act contains allegations, and the |
---|
763 | 1128 | | court finds that there is a c redible risk that the child is |
---|
764 | 1129 | | imminently likely to be wrongfully removed, the court may issue an |
---|
765 | 1130 | | ex parte warrant to take physical custody of the child. |
---|
766 | 1131 | | B. The respondent on a p etition under subsection A of this |
---|
767 | 1132 | | section shall be afforded an opportunity to be heard at the earliest |
---|
768 | 1133 | | possible time after the ex parte warrant is executed, but not later |
---|
769 | 1134 | | than the next judicial day unless a hearing on that date is |
---|
770 | 1135 | | impossible. In such eve nt, the court shall hold the hearing on the |
---|
771 | 1136 | | first judicial day possible. |
---|
772 | 1137 | | C. An ex parte warrant under subsection A of this section to |
---|
773 | 1138 | | take physical custody of a child shall: |
---|
774 | 1139 | | 1. Recite the facts upon which a determination of a credible |
---|
775 | 1140 | | risk of imminent wrongful removal of the child is based; |
---|
776 | 1141 | | 2. Direct law enforcement officers to take physical custody of |
---|
777 | 1142 | | the child immediately; |
---|
778 | 1143 | | 3. State the date and time for the hearing on the petition; and |
---|
810 | 1199 | | may order a search of the relevant databases of the National Crime |
---|
811 | 1200 | | Information Center system and similar state databases to determine |
---|
812 | 1201 | | if either the petitioner or respondent has a history of domestic |
---|
813 | 1202 | | violence, stalking, or child abuse or neglect. |
---|
814 | 1203 | | E. The petition and warrant shall be served on the respondent |
---|
815 | 1204 | | when or immediately after the child is taken into physical custody. |
---|
816 | 1205 | | F. A warrant to take physical custody of a child, is sued by |
---|
817 | 1206 | | this state or another state, is enforceable throughout this state. |
---|
818 | 1207 | | If the court finds that a less intrusive remedy will not be |
---|
819 | 1208 | | effective, it may authorize law enforcement officers to enter |
---|
820 | 1209 | | private property to take physical custody of the child. If required |
---|
821 | 1210 | | by exigent circumstances, the court may authorize law enforcement |
---|
822 | 1211 | | officers to make a forcible entry at any hour. |
---|
823 | 1212 | | G. If the court finds, after a hearing, that a petitio ner |
---|
824 | 1213 | | sought an ex parte warrant under subsection A of this section for |
---|
825 | 1214 | | the purpose of harassment or in bad faith, the court may award the |
---|
826 | 1215 | | respondent reasonable attorney fees, costs, and expenses. |
---|
827 | 1216 | | H. This act does not affect the availability of relief allow ed |
---|
828 | 1217 | | under the laws of this state other than this act. |
---|
