153+BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
101154 SECTION 1. NEW LAW A new section of law to be codified
102155 in the Oklahoma Statutes as Section 561 -1 of Title 43, unless there
103156 is created a duplication in numbering, reads as follows:
104157 This act shall be known and may be cited as the “Uniform Child
105158 Abduction Prevention Act ”.
106159 SECTION 2. NEW LAW A new section of law to be codified
107160 in the Oklahoma Statutes as Sect ion 561-2 of Title 43, unless there
108161 is created a duplication in numbering, re ads as follows:
109162 As used in this act:
110163 1. “Abduction” means the wrongful removal or wrongful retention
111164 of a child;
112165 2. “Child” means an unemancipated individual who is less than
113166 eighteen (18) years of age;
114167 3. “Child custody determination ” means a judgment, decree, or
115168 other court order providing for the legal custody, physical custody,
116169 or visitation with respect to a child. The term includes a
117170 permanent, temporary, initial, and mod ification order;
118171 4. “Child custody proceeding ” means a proceeding in which l egal
119172 custody, physical custody, or visitation with respect to a child is
120173 at issue. The term includes a proceeding for divorce, dissolution
121174 of marriage, separation, neglect, abuse , dependency, guardianship,
122-paternity, termination of parental rights, or protection from
123-domestic violence;

151228 5. “Court” means an entity authorized under the law of a state
152229 to establish, enforce, or modify a child custody determination;
153230 6. “Petition” includes a motion or its equivalent;
154231 7. “Record” means information that is inscr ibed on a tangible
155232 medium or that is stored in an electronic or other medium and is
156233 retrievable in perceivable form;
157234 8. “State” means a state of the United States, the District o f
158235 Columbia, Puerto Rico, the United States Virgin Islands, or any
159236 territory or insular possession subject to the jurisdiction of the
160237 United States. The term includes a federally recognized Indian
161238 tribe or nation;
162239 9. “Travel document” means records relati ng to a travel
163240 itinerary, including travel tickets, passes, reservations for
164241 transportation, or accommodations. The term does not include a
165242 passport or visa;
166243 10. “Wrongful removal” means the taking of a child that
167244 breaches rights of custody or visitation given or recognized under
168245 the laws of this state; and
169246 11. “Wrongful retention” means the keeping or concealing of a
170247 child that breaches rights of custody or visitation given or
171248 recognized under the laws of this state.

202303 The provisions of the Uniform Child Custody Jurisdiction and
203304 Enforcement Act as provided in Sections 551-110, 551-111, and 551-
204305 112 of Title 43 of the Oklahoma Statutes shall apply to cooperation
205306 and communications among courts in proceedings under this act.
206307 SECTION 4. NEW LAW A new section of law to be codified
207308 in the Oklahoma Statutes as Section 561 -4 of Title 43, unless there
208309 is created a duplication in numbering, reads as follows:
209310 A. A court on its own motion may order abduction prevention
210311 measures in a child custody proceeding if the court finds that the
211312 evidence establishes a credible risk of abduction of the child.
212313 B. A party to a child custody determination or another
213314 individual or entity having a right under the laws of this state or
214315 any other state to seek a child custody determination for the child
215316 may file a petition seeking abduction prevention measures to protect
216317 the child under this act.
217318 C. As authorized by Section 551 -315 of Title 43 of the Oklahoma
218319 Statutes, a district attorney may seek a warrant to take physical
219320 custody of a child pursuant to Section 9 of this act, or to take
220321 other appropriate prevention measures.

253378 to the child at issue under Article 2 of the Uniform Child Custody
254379 Jurisdiction and Enforcement Act, Section 551 -201 et seq. of Title
255380 43 of the Oklahoma Statutes.
256381 B. A court of this state has temporary emergency jurisdiction
257382 under Section 551-204 of Title 43 of the Oklahoma Statutes if the
258383 court finds a credible risk of abduction.
259384 SECTION 6. NEW LAW A new section of law to be codified
260385 in the Oklahoma Statutes as Sect ion 561-6 of Title 43, unless there
261386 is created a duplication in numbering, reads as follows:
262387 A petition under this act shall be verified and include a copy
263388 of any existing child c ustody determination, if available. The
264389 petition shall specify the risk factors for abduction, including the
265390 relevant factors described in Section 7 of this act. Subject to the
266391 subsection E of Section 551 -209 of Title 43 of the Oklahoma
267392 Statutes, if reasonably ascertainable, the petition shall contain:
268393 1. The name, date of birth , and gender of the child;
269394 2. The customary address and current physical location of the
270395 child;
271-3. The identity, customary address, and current physical
272-location of the respondent;
273-4. A statement of whether a prior action to prev ent abduction
274-or domestic violence has been filed by a party or other individual
275-or entity having custody of the child, and the date, location, and
276-disposition of the action;

448+location of the responde nt;
449+4. A statement of whether a prior action to prevent abduction
450+or domestic violence has been filed by a party or other individual
451+or entity having custody of the child, and the date, location, and
452+disposition of the action;
304453 5. A statement of whether a party to the proceeding has been
305454 arrested for a crime related to domestic vi olence, stalking, or
306455 child abuse or neglect, and the date, location, and disposition of
307456 the case; and
308457 6. Any other information required to be submitted to the court
309458 for a child custody determination pursuant to Section 551 -209 of
310459 Title 43 of the Oklahoma Statutes.
311460 SECTION 7. NEW LAW A new section of law to be codified
312461 in the Oklahoma Statutes as Section 561 -7 of Title 43, unless there
313462 is created a duplicati on in numbering, reads as follows:
314463 A. In determining whether there is a cred ible risk of abduction
315464 of a child, the court shall consider any evidence that the
316465 petitioner or respondent:
317466 1. Has previously abducted or attempted to abduct the child;
318467 2. Has threatened to abduct the child;
319468 3. Has recently engaged in activities that may indicate a
320469 planned abduction including , but not limited to:
321470 a. abandoning employment,
322-b. selling a primary residence,
323-c. terminating a lease,
324-d. closing bank or other financial management accounts,
325-liquidating assets, hiding or destroying financial
326-documents, or conducting any unusual financial
327-activities,

360533 4. Has engaged in domestic violence, stalking, or child abuse
361534 or neglect;
362535 5. Has refused to follow a child custody determination;
363536 6. Lacks strong familial, financial, emotional, or cultural
364537 ties to the state or the United States;
365538 7. Has strong familial, financial, emotional, or cultural ties
366539 to another state or country;
367540 8. Is likely to take the child to a country that:
368541 a. is not a party to the Hague Convention on the Civil
369542 Aspects of International Child Abduction and does not
370543 provide for the extradition of an abducting parent or
371544 for the return of an abducted child,
372-b. is a party to the Hague Convention on the Civil
373-Aspects of International Child Abduction but:
374-(1) the Hague Convention on the Civil Aspects of
375-International Child Abduction is not in force
376-between the United States and that country,

597+Aspects of International Child Abduction but:
598+(1) the Hague Convention on the Civil Aspects of
599+International Child Abduction is not in force
600+between the United States and that country,
404601 (2) is noncompliant according to the most recent
405602 compliance report issued by the United States
406603 Department of State, or
407604 (3) lacks legal mechanisms for immediately and
408605 effectively enforcing a return order under the
409606 Hague Convention on the Civil Aspects of
410607 International Child Abduction,
411608 c. poses a risk that the child ’s physical or emotional
412609 health or safety would be endangered in the country
413610 because of specific circumstances relating to the
414611 child or because of human r ights violations committed
415612 against children,
416613 d. has laws or practices that would:
417614 (1) enable the respondent, without due cause, to
418615 prevent the petitioner from contacting the child ,
419616 (2) restrict the petitioner from freely traveling to
420617 or exiting from the country because of the
421618 petitioner’s gender, nationality, marital status,
422619 or religion, or
423-(3) restrict the child’s ability to legally leave the
424-country after the child reaches the age of
425-majority because of a child ’s gender,
426-nationality, or religion,

672+country after the child reaches the ag e of
673+majority because of a child ’s gender,
674+nationality, or religion,
454675 e. is included by the United States Department of State
455676 on a current list of state sponsors of terrorism,
456677 f. does not have an official United States diplomatic
457678 presence in the country, or
458679 g. is engaged in active military action or war, including
459680 a civil war, to which the child may be exposed;
460681 9. Is undergoing a change in immigration or citizenship status
461682 that would adversely affect the respondent ’s ability to remain in
462683 the United States legally;
463684 10. Has had an application for United States citizenship
464685 denied;
465686 11. Has forged or presented misleading or false evidence on
466687 government forms or supporting documents to obtain or attempt to
467688 obtain a passport, a visa, travel documents, a Social Se curity card,
468689 a driver license, or other government -issued identification card or
469690 has made a misrepresentation to the United States government;
470691 12. Has used multiple names to attempt to mislead or defraud;
471692 or
472693 13. Has engaged in any other conduct the court considers
473694 relevant to the risk of abduction.
474-B. In the hearing on a petition under this act, the court shall
475-consider any evidence that the respondent believed in good faith
476-that the respondent’s conduct was necessary to avoid imminent harm
477-to the child or respondent and any other evidence that may be

507752 SECTION 8. NEW LAW A new section of law to be codified
508753 in the Oklahoma Statutes as Section 561 -8 of Title 43, unless there
509754 is created a duplication in numbering, reads as follow s:
510755 A. If a petition is filed under this act, the court may enter
511756 an order that shall include:
512757 1. The basis for the court ’s exercise of jurisdiction;
513758 2. The manner in which noti ce and opportunity to be heard were
514759 given to the persons entitled to notice of the proceeding;
515760 3. A detailed description of each party ’s custody and
516761 visitation rights and residential arrangements for the child;
517762 4. A provision stating that a violation of the order may
518763 subject the party in violation to civil and criminal penalties; and
519764 5. Identification of the child ’s country of habitual residence
520765 at the time of the issuance of the order.
521766 B. If, at a hearing on a petition under this act or on the
522767 court’s own motion, the court after reviewing the evidence finds a
523768 credible risk of abduction of the child, the court shall enter an
524769 abduction prevention order. The order shall include the provisions
525-required by subsection A of this section and measures and
526-conditions, including provisions in subsections C, D, and E of this
527-section, that are reasonably calculated to prevent abduction of the
528-child, giving due consideration to the custody and visitation rights

822+conditions, including provisions in subsections C, D, and E of this
823+section, that are reasonably calculated to prevent abduction of the
824+child, giving due consideration to the custody and visitation rights
556825 of the parties. The court shall consider the age of the child, the
557826 potential harm to the child from an abduction, the legal and
558827 practical difficulties of returning the child to the jurisdiction if
559828 abducted, and the reasons for the potential abduction, including
560829 evidence of domestic violence, stalking, or child abuse or neglect.
561830 C. An abduction prevention order may include one or more of the
562831 following:
563832 1. An imposition of travel restrictions that require that a
564833 party traveling with the child outside a designated geographical
565834 area provide the other party with t he following:
566835 a. the travel itinerary of the child,
567836 b. a list of physical addresses and telephone numbers at
568837 which the child can be reached at specified times, and
569838 c. copies of all travel documents;
570839 2. A prohibition of the respondent directly or indirectl y:
571840 a. removing the child from this state, the United States,
572841 or another geographic area without permission of the
573842 court or the petitioner ’s written consent,
574843 b. removing or retaining the child in violation of a
575844 child custody determination,
576-c. removing the child from school or a child care or
577-similar facility, or
578-d. approaching the child at any location other than a
579-site designated for supervised visitation;

899+site designated for supervised visitation;
607900 3. A requirement that a party register the order in another
608901 state as a prerequisite to allowing the c hild to travel to that
609902 state;
610903 4. With regard to the child ’s passport:
611904 a. a direction that the petitioner place the child ’s name
612905 in the United States Department of State ’s Child
613906 Passport Issuance Alert Program,
614907 b. a requirement that the respondent surrende r to the
615908 court or the petitioner ’s attorney any United States
616909 or foreign passport issued in the child ’s name,
617910 including a passport issued in the name of both the
618911 parent and the child, and
619912 c. a prohibition upon the respondent from applying on
620913 behalf of the child for a new or replacement passport
621914 or visa;
622915 5. As a prerequisite to exe rcising custody or visitation, a
623916 requirement that the respondent provide:
624917 a. to the United States Department of State Office of
625918 Children’s Issues and the relevant foreign consulat e
626919 or embassy, an authenticated copy of the order
627-detailing passport and travel restrictions for the
628-child,
629-b. to the court:

1045+6. Upon the petitioner’s request, a requirement that the
1046+respondent obtain an order from the relevant foreign country
1047+containing terms identical to the child custody determination issued
1048+in the United States.
7081049 D. In an abduction prevention order, the court may impo se
7091050 conditions on the exercise of custody or visitation that:
7101051 1. Limit visitation or require that visitation with the child
7111052 by the respondent be supervised until the court finds that
7121053 supervision is no longer necessary and order the respondent to pay
7131054 the costs of supervision;
7141055 2. Require the respondent to post a bond or provide other
7151056 security in an amount sufficient to serve as a financial deterrent
7161057 to abduction, the proceeds of which may be used to pay for the
7171058 reasonable expenses of recovery of the child, i ncluding reasonable
7181059 attorney fees and costs if there is an abduction; and
7191060 3. Require the respondent to obtain education on the
7201061 potentially harmful effects to the child from abduction.
7211062 E. To prevent imminent abduction of a child, a court may:
7221063 1. Issue a warrant to take physical custody of the child under
7231064 Section 9 or the laws of this state other than this act;
7241065 2. Direct the use of law enforcement to take any action
7251066 reasonably necessary to locate the child, obtain return of the
7261067 child, or enforce a custody determination under this act or the laws
7271068 of this state other than this act; or
728-3. Grant any other relief allowed under the laws of this state
729-other than this act.
730-F. The remedies provided in this act are cumulative and do not
731-affect the availability of other remedies to prevent abduction.

7591124 SECTION 9. NEW LAW A new section of law to be codified
7601125 in the Oklahoma Statutes as Section 561 -9 of Title 43, unless there

7621127 A. If a petition under this act contains allegations, and the
7631128 court finds that there is a c redible risk that the child is
7641129 imminently likely to be wrongfully removed, the court may issue an
7651130 ex parte warrant to take physical custody of the child.
7661131 B. The respondent on a p etition under subsection A of this
7671132 section shall be afforded an opportunity to be heard at the earliest
7681133 possible time after the ex parte warrant is executed, but not later
7691134 than the next judicial day unless a hearing on that date is
7701135 impossible. In such eve nt, the court shall hold the hearing on the
7711136 first judicial day possible.
7721137 C. An ex parte warrant under subsection A of this section to
7731138 take physical custody of a child shall:
7741139 1. Recite the facts upon which a determination of a credible
7751140 risk of imminent wrongful removal of the child is based;
7761141 2. Direct law enforcement officers to take physical custody of
7771142 the child immediately;
7781143 3. State the date and time for the hearing on the petition; and
779-4. Provide for the safe interim placement of the child pending
780-further order of the court.
781-D. If feasible, befor e issuing a warrant and before determining

1197+D. If feasible, before issuing a warrant and befor e determining
1198+the placement of the child after the warrant is executed, the court
8101199 may order a search of the relevant databases of the National Crime
8111200 Information Center system and similar state databases to determine
8121201 if either the petitioner or respondent has a history of domestic
8131202 violence, stalking, or child abuse or neglect.
8141203 E. The petition and warrant shall be served on the respondent
8151204 when or immediately after the child is taken into physical custody.
8161205 F. A warrant to take physical custody of a child, is sued by
8171206 this state or another state, is enforceable throughout this state.
8181207 If the court finds that a less intrusive remedy will not be
8191208 effective, it may authorize law enforcement officers to enter
8201209 private property to take physical custody of the child. If required
8211210 by exigent circumstances, the court may authorize law enforcement
8221211 officers to make a forcible entry at any hour.
8231212 G. If the court finds, after a hearing, that a petitio ner
8241213 sought an ex parte warrant under subsection A of this section for
8251214 the purpose of harassment or in bad faith, the court may award the
8261215 respondent reasonable attorney fees, costs, and expenses.
8271216 H. This act does not affect the availability of relief allow ed
8281217 under the laws of this state other than this act.
