7575 BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new section of law not to be
7777 codified in the Oklahoma Statutes reads as follows:
7878 A. This act shall be known and may be cited as the “Parental
7979 Rights Protection Act ”.
8080 B. The purpose of this act is to ensure that the rights of
8181 parents, as outlined in the Parents ’ Bill of Rights, are fully
8282 protected and to establish clear consequences for any violation of
8383 those rights by state agencies, officials, or individuals acting in
8484 an official capacity.
8585 SECTION 2. NEW LAW A new section of law to be codified
8686 in the Oklahoma Statutes as Section 2010 of Title 25, unless there
8787 is created a duplication in numberin g, reads as follows:

139139 The Parents’ Bill of Rights is hereby amended to include the
140140 following provisions:
141141 1. Right to Due Process: Parents have the right to be notified
142142 in writing of any allegations or concerns regarding their parental
143143 rights or the welfar e of their child, with clear details of the
144144 allegations, evidence, and specifi c actions required of the parent
145145 to resolve the issues;
146146 2. Right to Family Reunification: Parents shall have the right
147147 to a fair and unbiased process for reunification with the ir child,
148148 including a clearly defined and transparent timeline for
149149 reunification, unless there is clear and convincing evidence of
150150 immediate harm to the child. The Department of Human Services or
151151 any state agency shall make all reasonable efforts to place children
152152 with relatives or family members before placing them in foster care;
153153 3. Right to Appeal: Parents have the right to appeal any
154154 decisions related to the removal of their child or any actions that
155155 limit their parental rights. Appeals shall be han dled in a timely
156156 manner and in accordance with due process;
157157 4. Right to Access to Evidence: Parents have the right to
158158 access all evidence, records, and reports used to make decisions
159159 affecting their parental rights, including access to child welfare
160160 records, medical reports, and other relevant documentation. The
161161 Department of Human Services or any state agency shall not withhold
162162 or redact evidence unless specifically authorized by law; and

214214 5. Right to Fair Investigation: Investigations regarding
215215 allegations of child abuse or neglect shall be conducted fairly,
216216 transparently, and in the best interest of the child, with all
217217 parties (including both parents, guardians, and relevant
218218 professionals) having the opportunity to present evidence,
219219 testimonies, and challenge accusations.
220220 SECTION 3. NEW LAW A new section of law to be codified
221221 in the Oklahoma Statutes as Section 2011 of Title 25, unless there
222222 is created a duplication in numbering, reads as follows:
223223 A. Any state agency or officia l including, but not limited to,
224224 employees of the Department of Human Services, law enforcement, or
225225 judicial officers found to have willfully violated the rights of
226226 parents as enumerated in the Parents ’ Bill of Rights, shall be
227227 subject to the following con sequences:
228228 1. Monetary penalties: The violating agency or official shall
229229 be subject to fines, with amounts determined based on the severity
230230 of the violation, to be paid into a fund for the support and
231231 reintegration of affected families;
232232 2. Civil liability: The agency or official may be held liable
233233 for damages caused to the affected parent or family, including
234234 emotional distress, financial losses, and attorney ’s fees. Parents
235235 may file a civil lawsuit to seek redress for violations;
236236 3. Suspension or rem oval from office: State officials who are
237237 found to have knowingly violated th e rights of parents or engaged in

289289 misconduct, including fraudulent reporting, failure to provide due
290290 process, or retaliatory actions, may be subject to suspension or
291291 removal from office, in accordance with applicable state laws and
292292 procedures; or
293293 4. Mandatory training and re -education: Any state employee
294294 found to have violated the Parents ’ Bill of Rights shall be required
295295 to complete mandatory training on parental rights, due pr ocess, and
296296 ethical conduct, before returning to their duties.
297297 B. Judges or court officials who violate the rights of parents
298298 by failing to follow due process or by making rulings without
299299 sufficient evidence shall be subject to disciplinary action by the
300300 Council on Judicial Complaints . This may include suspension,
301301 removal, or other penalties as determined by the Council.
302302 C. Any employee or official within a state agency who reports
303303 violations of the Parents ’ Bill of Rights, in good faith, shall be
304304 protected from retaliation. Retaliatory actions, including
305305 demotion, dismissal, or h arassment, shall be subject to disciplinary
306306 action.
307307 SECTION 4. NEW LAW A new section of law to be codified
308308 in the Oklahoma Statutes as Section 2012 of Tit le 25, unless there
309309 is created a duplication in numbering, reads as follows:
310310 A Parental Rights Review Board shall be established to monitor
311311 compliance with the Parents ’ Bill of Rights. The Board shall
312312 consist of members appointed by the Governor to include legal

364364 experts, social workers, family advocates, and other relevant
365365 stakeholders, and shall:
366366 1. Review complaints submitted by parents and families
367367 regarding violations of their rights;
368368 2. Investigate claims of violations by state agencies or
369369 officials;
370370 3. Recommend actions, including disciplinary measures,
371371 penalties, and reforms to improve the protection of parental rights;
372372 and
373373 4. Electronically submit an annual report to the Governor,
374374 Legislature, and the public on the status of parental rights
375375 protections in Oklahoma.
376376 SECTION 5. This act shall become effecti ve July 1, 2025.
377377 SECTION 6. It being immediately necessary for the preservation
378378 of the public peace, health or safety, an emergency is hereby
379379 declared to exist, by reason whereof this act shall take effect and
380380 be in full force from and after its passage and approval.
