87	87	BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
88	88	SECTION 1. NEW LAW A new section of law to be codified
89	89	in the Oklahoma Statutes as Section 3260 of Title 70, unless there
90	90	is created a duplication in numbering, reads as follows:
91	91	A. This act shall be known and may be cited as the “Stop DEI
92	92	Act”.
93	93	B. For the purposes of this section:

145	145	1. “Constrain” means failure during any semester of an academic
146	146	year to provide sufficient open seats i n alternative courses for a
147	147	student to complete or progress toward completion of a degree or
148	148	program requirements;
149	149	2. “DEI-CRT” means diversity, equity, inclusion, and critical
150	150	race theory;
151	151	3. “DEI-CRT related course” means any course with a
152	152	description, course overview, course objectives, proposed student
153	153	learning outcomes, written examinations, or written or oral
154	154	assignments for which the student will receive a grade that includes
155	155	DEI-CRT related content;
156	156	4. “DEI-CRT related content” means content that does one or
157	157	more of the following:
158	158	a. relates any of the following topics to contemporary
159	159	American society: critical theory, whiteness,
160	160	systemic racism, institutional racism, anti -racism,
161	161	microaggressions, systemic bias, implicit bias,
162	162	unconscious bias, intersectionality, gender identity,
163	163	social justice, cultural competence, allyship, race -
164	164	based reparations, or race -based privilege, race - or
165	165	gender-based diversity, race - or gender-based equity,
166	166	or race- or gender-based inclusion,
167	167	b. promotes the idea that racially neutral or color -blind
168	168	laws, policies, or institutions perpetuate op pression,

224	224	c. promotes the differential treatment of any individual
225	225	or groups of individuals based on race or ethnicity in
226	226	contemporary American society,
227	227	d. promotes the idea that a student is biased on account
228	228	of his or her race or sex, or
229	229	e. does not include identifyi ng and discussing historical
230	230	movements, ideologies, or instances of racial hat red
231	231	or discrimination including, but not limited to,
232	232	slavery, Indian tribe removal, the Holocaust, or
233	233	Japanese-American internment;
234	234	5. “DEI-CRT practices” means:
235	235	a. any requirement or guidance that a course instructor
236	236	include or curate materials on the basis of the race,
237	237	sex, or gender identity of an author or authors, or
238	238	b. participating in any workshop, training, seminar, or
239	239	professional development on any DEI -CRT related
240	240	content.
241	241	DEI-CRT practices does not mean any programming explicitly required
242	242	by and limited to an institution of higher education ’s obligations
243	243	to comply with: Title IX of the Education Amendments of 1972, as

296	296	Discrimination in Employment Act, as amended; Title VI of the Civil
297	297	Rights Act of 1964; or an applicable court order; and
298	298	6. “Institution of higher education ” means an institution of
299	299	higher education within The Oklahoma State System of High er
300	300	Education.
301	301	C. The governing board of each institution of higher education
302	302	shall establish curricula and designate courses at the institution
303	303	in a manner that does not constrain or require students to enroll in
304	304	a DEI-CRT related education, major, minor, or certificate
305	305	requirement, except as provided for in subsection E of this section.
306	306	D. An institution of higher education or any employee,
307	307	appointee, or committee acting on behalf thereof may not require,
308	308	solicit, or incentivize faculty to apply or parti cipate in DEI-CRT
309	309	practices or include DEI -CRT related content in any course a s a
310	310	condition of approval, designation, or listing as part of any
311	311	academic degree program including general education, major, minor,
312	312	or certificate requirements or as a condition of consideration in
313	313	any faculty member’s performance assessment, promotion, tenure,
314	314	salary adjustment, or any other incentive, except as provided for in
315	315	subsection E of this section.
316	316	E. Academic degree program requirements of any major, minor,
317	317	certificate, or department with a title that clearly establishes its
318	318	course of study as primarily focused on racial, ethnic, or gender

370	370	studies may be exempted in writing by the governing board of the
371	371	institution of higher education from the prohibitions of subsectio ns
372	372	C and D of this section, subject to the following:
373	373	1. A student may not be constrained or required to enroll in
374	374	any such program, department, or course to satisfy the requirements
375	375	of any other academic degree program including general education
376	376	requirements or any other major, minor, or certificate requirements;
377	377	2. Courses offered or listed under such programs shall satisfy
378	378	the academic degree program requirements of the respective
379	379	departments, majors, minors, or certificates only and shall not be
380	380	used to satisfy degree requirements for general education or other
381	381	major, minor, or certificate requirements beyond satisfying
382	382	university credit-hour graduation requirements; and
383	383	3. The title of any currently established department, major,
384	384	minor, or certificate program shall not be altered or replaced to
385	385	establish an emphasis on racial , ethnic, or gender studies.
386	386	F. 1. An alleged violation of the provisions of this section
387	387	shall be submitted to the Oklahoma State Regents for Higher
388	388	Education on a form prescr ibed by the State Regents.
389	389	2. The State Regents shall adopt a policy providing for the
390	390	investigation of alleged violations submitted pursuant to paragraph
391	391	1 of this subsection. The policy shall include due process
392	392	procedures. An institution of higher ed ucation found to be in
393	393	violation of the provisions of this section shall be in eligible to

445	445	receive funding allocations from the Oklahoma State Regents for
446	446	Higher Education for the following fiscal years.
447	447	3. The State Regents shall submit a report by Decemb er 31,
448	448	2026, and each December 31 thereafter to the Governor, the President
449	449	Pro Tempore of the Senate, the Speaker of the House of
450	450	Representatives, and the chairs of the committees with
451	451	responsibility over appropriations in both houses of the Legislature
452	452	detailing the alleged violations submitted pursuant to paragraph 1
453	453	of this subsection and the findings of investigations conducted
454	454	pursuant to paragraph 2 of this subsection.
455	455	G. Nothing in this section shall be construed to limit the
456	456	academic freedom of an y individual institution of higher education ’s
457	457	faculty to direct the instruction within his or her own class, nor
458	458	limit the free discussion of ideas in a classroom setting.
459	459	SECTION 2. This act shall become effective July 1, 2025.
460	460	SECTION 3. It being immediately necessary for the preservation
461	461	of the public peace, health, or safety, an emergency is hereby
462	462	declared to exist, by reason whereof this act shall take effect and
463	463	be in full force from and after its passage and approv al.
